VIMiiIESSETH,that the party of'he first part,by virtue of the power and authority given in and by said last
will and testament, and in consiecration of one hundred and twenty seven thousand and f ive
hundred ($127,500). dollars,
paid by the party of 'he second pan,does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second pan
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected. aituate,
lying and being MAUX at Bayview, near Southold, in the Town of Southold, County of
Suffolk and State of New York, known and designated as Lot number fifty one (51)
on a certain map entitled "Bay Haven at Southold, Town of Southold, Suffolk County,
New York" surveyed December 10, 1958, by Ottow W. Van Tuyl 6 Son, licensed Land
Surveyors, Creeport, N.Y., and filed in the Office of the Clerk of Suffolk County
on the 2'_nd day of January 1959 as map No. 2910.
V- Together with a righr of way over "Bay Haven Lane," "Watersedge Way", and "Cin Lane",
as shown on said Map, and the right, in common with other owners of the lots shown
on said Map to the use of the "Community Beach" as designated on said map.
RESERVING nevertheless unto the grantor, his heirs, administrators, executors and
c,pC assigns, the fee to the said "Bay Haven Lane", "Watersedge Way," and "Cin Lane", and
to the "Community Beach", and all franchise rights therein and the right of
c� dedication of said streets to the proper governmental agency for street purposes
and the right of dedication of said community beach to the proper governmental
agency for use thereby as a public beach.
Being and intended to be the same premises described in the deed to the party
of the first part herein and Rosemary Bettinardi, his wife, now deceased, by deed
from William Wells dated 7 February 1959 and recorded 12 March 1959 dated

TOGETHER with all right,title and interest, if any,of the party of the first part of,in and to any streets and
roads abutting the above-described premises to the center lines thereof;TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedents death in saidpnemmes.and also
the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ.
wally,or by virtue of said will or otherwise;TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first pan covenants that the party of the first pan has not done or suffered anything
whereby the said premises have been incumbeced in any way whatever,except as aforesaid.
AND the party of the first pan, in compliance with Salina 13 of the Lien Law,covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will ay
the same first to the payment of the cost of the improvement before using any part of the total o[the same or
any other purpc ,
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
