AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trastees adopted at the meeting held on June
20~ 2012, and in consideration of application fee in the sum of $250.00 paid by Helen & Robert Keith and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct approximately 95 linear feet of low-sill bulkhead
between existing low-sill bulkheads on subject parcel and adjoining parcel to west; and
place approximately 20 cubic yards sand fill (to be trucked in from an upland source)
between proposed bulkhead and existing inter-tidal marsh to be planted with Spartina
alterniflora (12" on center) to create approximately 190 square feet of additional inter-
tidal marsh; and extend existing stone rip-rap approximately 25 linear feet to the
westerly property line using ±100 pound stone; and as depicted on the site plan
prepared by En-Consuitants, last dated June 12, 2012, and stamped approved on July
6, 2012.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Helen & Robert Keith, residing at 995 Willis Creek Drive, Southold, New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work heroin authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 20, 2012 regarding the above matter:
WHEREAS, En-Consultants on behalf of HELEN & ROBERT KEITH applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated May 17, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 20, 2012, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of HELEN & ROBERT
KEITH to construct approximately 95 linear feet of Iow-sill bulkhead between existing
Iow-sill bulkheads on subject parcel and adjoining parcel to west; and place
approximately 20 cubic yards sand fill (to be trucked in from an upland source) between
proposed bulkhead and existing inter-tidal marsh to be planted with Spartina altemiflora
(12" on center) to create approximately 190 square feet of additional inter-tidal marsh;

Permit to construct and complete project will expire two years from the date the permit

In our recently submitted application, I failed to depict the proposed approximately 25 linear foot
extension of the existing stone rip-rap located along the landward embankment to the westerly property
line, where it would meet the recently approved and constructed upland retaining wall return located
on the westerly adjacent property line. Therefore, please fred enclosed four (4) copies of a project plan
prepared by En-Consultants, last dated June 12, 2012, which has been revised to include this
additionally proposed work.
The project description should be amended accordingly to add: "Extend existing stone rip-rap
approximately 25 linear feet to the westerly property line using _+ 100 pound stone."

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

For a four-year period from 2001 to 2005, the owners of the subject parcel watched the rapid and
accelerated loss of a once wide and healthy intertidal marsh fronting their property, a marsh that
historically served as a natural protective feature against erosion and flooding. During that period, the
owners conferred with various coastal experts from both the private and public sector with the hope of
finding a way to stem the erosion of the marsh and corresponding loss of the adjacent upland before all of
the marsh was lost. Ultimately, staff from the New York State Department of Environmental
Conservation suggested installation of a low-sill bulkhead and associated placement of fill to create and
restore intertidal marsh that had been lost and to stabilize and preserve the existing marsh. The project
was implemented in late 2005 pursuant to Town Wetlands Permit 5700 as amended on October 20, 2004,
and now 7 years later, a healthy and functional intertidal marsh is once again thriving where it had
previously been lost and otherwise lost permanently. Not only has the Spartina alterniflora been
stabilized and preserved but natural beds of ribbed mussels, which naturally stabilize the marsh through
their abyssal threads, have become established both along the edge of the low-sill bulkhead and even
inside the corrugated vinyl sheathing.
Because erosion of the westerly portion of the property was then not as prevalent, however, and because
a low-sill project of that scope had at that time not yet been implemented in the Town of Southold, the
permits did not allow the low-sill bulkhead to extend to the westerly property line. But later in 2010,
both the NYSDEC and Southold Trustees permitted construction of a low-sill bulkhead and plantings on
the adjacent westerly parcel pursuant to Town Wetlands Permit No. 7408, leaving approximately 95
linear feet of unprotected marsh between the two bulkheads. As that remaining unprotected marsh has
continued to gradually erode, the owners now wish to connect the gap between the two structures through
construction of a low-sill bulkhead and creation of approximately 190 square feet of additional intertidal
marsh between the existing marsh and proposed bulkhead. Based on the demonstrative success of the
previous bulkhead on the subject parcel, it is clear that the project will have a positive impact on the
quality and quantity of wetlands and adjacent marsh ecosystem through the stabilization, preservation,
and enhancement of the existing marsh. Specifically, preserving and enhancing the marsh will allow it to
continue providing the wetland functions and values associated with vegetated intertidal marsh, such as
marine food production, wildlife habitat, cleansing ecosystems, absorption of silt and organic material,
and enhancement of visual quality and scenic resources, all consistent with the purpose, intent, and goals
both of Chapter 275 and the Local Waterfront Revitalization Program.
