There were present: Messrs. JohnWickham, Chairman, Henry Moisa, Alfred~Grebe, i%rchibald Young, andWilliam Unkelbach. Also present: Messrs.~0t~ W. Van Tuyl,.Consultant, and Howard M. Terry, Building Inspector. PUBLIC B~ARING: On the question of approval of the following plat: 1. Plat of property owned bySouthold Builders, Inc., entitled~Oakridge~Hills at-Southold, consistingof'a parcel of land ofapproximatety 6.073'acres, situated~at-Southold, in the Town of:Southold, Suffolk County, New York, and bounded and described as follows: Beginning ara point-on the southwesterly side of Horton Lane where the same is intersected by'the southeasterly-side of land now or'formerly of Clement~W. Booth former~ly'Ba~nabus H. The~Chairman ope'ned the hearing by reading legal notice of hearing and affidavit attesting to its publication in the official newspaper. LEFFERT$ EDSON, ESQ., Southold, New York: I present the map of Os_kridge Hills which has been'approved by the-Suffolk-County Department of Health. I request that it be considered and approved byyour Board subject to the decision of ~th~e Highway3'Superintendent. (ThE in'dicated sat could not reported that ~the Highway-Super'i~ntende~t had ~!-inspected the roads and fou~d~them only They dedication at this ~ime,) THE CHAIRMAN: The Town Highway Specifications will probably be amended and Stiffened within a relatively short time and the Superintendent'of Highways is concerned that so many'of the roads in new developments have been breaking up this spring~ I think this has been a more severe winter'than ususaIon highways. In the past in cases like this the Planning Board has waived the Southold Town Planning Board -3- April tt, 1962 provisians that highways must be dedicated within 90 days or performance bond must~be posted just because of the uncertainty I mentioned before. Until the situation is clarified we do not think it is fair to hold the developer up. THE CHAIRMAN: Is there anything else? (There was no response.) THE CHAIRMAN: Since there is no one else presentwho wishes to say anything in regard to this application for a subdivision by ~Oakridge Hills I will declare the hearing closed. On motion of Mr. Moisa, seconded byMr. Young, it was moved: WHEREAS Southold Builders, Inc. has petitioned the Southold Town .Planning BOard for 'final approval of their plat known as "Oakridge Hills" at Southold, New York, and WHEREAS the Southold Town Superintendent of Highways has inspected the highways and found them to be satisfactory for private access and ~mergency vehicles, and hisreport is hereby approvedby the Planning Board, and WHEREAS the Southold Town Planning Bo'ard, pursuant to due notice-thereof, h~lda public_hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be'heard, and WHERE~S theSouthold TownPlanning Board waives the provision in theRules and Regulations for the~ubdivision of Land requiring park and playground area.or cash equivalent~ and WHEREAS th'e-$outhold TownPtanning Board waives the 90 day requirement for the dedication of highways to the Town of Southold and posting of~a bond for same ~nereas the HighwayTSuperintendent will only approve~these highways for private and emergency access; NOW THEREFORE BE 'IT .RESOLVED that the subdivision to be known as '~)akridge Hills" at Southold, New York, consisting of 6.0'73 acres Southold Town Pla~ing Board -4- April 1t, 196'2 and owned by $outhold Builders, Inc., be approved. this plat is bounded and described as follows: Beginning at a point on the southweSterly side of Hort~n~Lane where the same is intersected by the southeasterly sidelof land now or formerly of~Clement'W. The Board w~shed Mr. Van Tuyl to supply the proposedhighway dedicati°n map and profiles of~Oakridge Hills for the fileo The he had discussedwith~Super~ntendent of Highways~ics ighways in Green Acres at Orient an'd Mr. Price fe~t that~the buffer strip between Greenway~Ea~t and~Orvilte Terry'~s prope~ty~even~though it is landscaped and made into a park~ still iS directly contrary to the requirements' for dedication. It was suggested that ~his buffer strip might be dedicated to the TownI along with the highways. Mr. William J. Baxter, Jr. appeared before the.~ Planning Board with a plan for a proposed subdivision on the~$tewart property adjoining the ~Mattituck School on the east. After examining the map it was decided the Board me~f0ers should invsstigate this proposal. Further, since ~this adjoins the'~Matti~uck-~School District property ate tter was to be forwarded to the Trustee's of the Mattituck -South.old Town Planning Board -5- April 11, 1962 School District advising them of this proposal and stating that it entails a highway running north from the'Main-~Road, turning east and for the immediate future terminating in a~turn-around. ThebPlanning Board feels eventually this road will continue out to Mill Lane a short distance below the railroad. The bPlanning Board felt the school property might benefit by highway access to the northeast corner of the school property at some time in the future and the-Planning Board could require that the developer make provision for a future highway connection to the school property if it is their wish. This would have to be done before the lots are sold which means provision would have to be made soon if the school is interested. The Planning Board received a reply to their letter of March 9, 1962 to the ~Suffolk CountyDepartment of Public'Works relative to Charli~-.'s Lane and New Suffolk Road, ~CR 26. In the letter the Chief Engineer stated that the da~a submitted by the ~Planning Board did not reveal the man'er 'in which~ the deve~iop~r~plans t~ dilspose of water falling on ~Charlie's 'Lane and the adjoining-property. They could not permit'water to bs idischarged on ~.to a Co~nty~Road. They'would require 4 copies of'a plan showing the proposed~g~ade of ~Charlie's'Lane and a drainage plan for the disposal of all w~er draining ~or 'falling on Charlie~s ~Lane. They would also want to know the effect the development of tn s property Will have on the box culvert under New Suffolk Road. On motion of l~r. Moisa, seconded by Mr.i Unkelbach, it was RESOLVED that Mr. Van Tuyl be authorized to draw up tentative specifications for drainage on CharineSs Road in New Suffolk° Vote of the Board: Ayes:- Mr. Wickham, Mr~ Moisa, Mr.. Grebe, Mr. Young, and Mr.. Unk~lbach. Mr.. Van Tuyl briefly discussed George (or 'El~ie~is) Mr. George Grathwohl~s d~velopment at New"Suffolk. This road is now 3'3 ft. wide and to be a Town road it should be 5'0 fro Van' Tuyl stated that Highway Superintendent"Price indicated that the 33 ft. width might be satisfactory. The " Planning Board received from the Town BOard the 'original petition of George K. Mr. Vloutely states in his application ~that the premises have been used for 'a multi~.te residence use since he'fore, zoning. He now wishes'to exp~nd h~s 'facilities and since.a~'nonrconforming use cannot he'expanded the application.form ~chang~-of~zone is made. ' TheChairman re~d letter.s from J. Billman, Bloomington, Indiana andEast'Marion; James.:O.~Orr, Main Road, East Marion; AlbertaEdwards Parker,-Main Road, EastMarion and Charles Ro Mosback,~Oceanside andEast Marion, all in opposition to this proposed change of zone. Members of thePtanning Board have all investigated this property. On motion of Mr. Grebe, seconded by Mr.-Unke!bach, it was IAEEOLVED that ~the Planning Board does'n:ot recommend to the Town Boardthis change of zone fr-om "A" Residential and'Agricultural Distric~to.-"M" Multiple ~esidence-DiSt~ic%on the property of George K. Vloutely. The~Planning Board feels .this proposal would be spot zoning in a striCtly residential area. Further, when zon!nglwas first contemplated the residential character of the Village of Eas~ Marion was preserved and we feel it 'is important that'~his beautiful village remain residential. The next meeting of the ~Southold Town Planning Board will be held 7:30 P.~M., Wednesday, May 9, 1962 at the-Townfierk Office, Main Road, Sou~hold, New York. It was the suggestion of theBuitding Inspector that the Planning Boardmight tike to have someone from TheAs~halt Institute, College Pa~, Marylan~ come to the next'~Planning Boardmeeting aha discuss the building and maintenance~of secondary 'or ~"town" roads, the latestmethodsand materials, quantities ~and qualities, etc. This would be very helpful in connection with the impr-ovement of the Town highway'specifica- tions-and conStruction. The~P~anning ~oard instructed the secretary to write such a letter inv~ing someone from this Institute'to appear at the May 9th~Planning Board meeting. A letter'~as received from the~Cutchogue ~Fire District relativeto ~he installation of a fire well and approach r~mp on proposed extension of.Grilling Str~eet north of thePost ~ffice in-Cutchogue. ~ne Board instructed th~t ~he letter be -placed in ~the 'file pertaining to the 'extension of Griffing Str~eet for futurereference~ Southold Town Planning Board -8- April 11, 1962 The Planning Board received for their 1files the legal description and map of the proposed change of zone on Town Board*s ownmo~ion from "A" Residential andAgzicultural District to "B" Business /)istrict on certain property inArshamomaque. The propertyis bounded and described as follows: Beginn~ing at the intersection of the southerly line of Main Road~wlth the westerly line of Silvermere Road about 575 feet to land of Long Island Railroad~Company; thence in a general southwesterly ~irection along land of Long Island Railroad Company about 520~0 feet to Kerwin Boulevard; thence northwesterly along Kerwin Boulevard to the south- easterly line of said Ma~n ROad; ~hence inca general northeasterly direction along said Main Road about 5900 feet to ~he point Of beginning. Excepting two existing "B" zone areas within the above described Doundaries.
