SOUTHOLD TOWN PLANNING BOARD
January 10, 1962
A regular meeting of the Southold Town Planning Board was
held 7:30 P..M., Wednesdayi January 10, 1962 at the Town Clerk
Office, Main Roadt $outhold, New York.
There were present: Messrs. John'Wickham, Chairman,
Henry-Moisa~ Alfred Grebet Archibald Young, and William
Unkelbach.
Also present: Mr. Otto W. Van Tuyl, Consultant.
The Planning Board discussed the Annual Associations of
Towns meeting to'be held in Buffalo, New York on February 14, 15,
and 16. Mr. Grebe indicated that he planned to attend represent-
ing the'Planning Board and Fire DiStrict.
The Planning Board received a petition signed by 18 heirs
or rightful owners of'a cemetery plot known as "Latham~Cemetery"
at Orient, who protest and Object to the creating of roads
surrounding said cemetery byEdwin H. King or hi~ successors.
T~e letter accompanying the petition stated ~hat many of the old
families would like'space to be Duried with theirfamilies and
they believe in no instance should a family burial ground be denied

the right for reasonable expansl~m. They feel the Planning
Board should abolish the East Road which is not necessary and
is not in keeping with the cemetery appearance.
After a thorough discussion, on motion of Mr. Young, seconded
by Mr. Unkelbach, it was
RESOLVED that a letter be forwarded to Irving Latham, who
represented the petitioners objecting to the road around the'~atham
Cemetery", advising that the Planning Board does not have the
authority to prohibit the construction of this road as it is
private property and Mr, King has not presented an application
for dedication of this highway, or a plan for a subdivision. It
was suggested that the petitioners contact Mr. King regarding a
mutual solution to this problem.

Mr.~H~rotd.-~ilsberg appeared before the Planning Board
relative to a proposed subdivision to be started on the east side
of Main Bayview Road, Southold. This subdivision would contain
approximately 48 lots, each containing at least 20,000 sq. ft. of
area. Mr. Wilsberg wished to have the Board's opinion of the layout
before making arrangements to have the map redrawn for tentative
approval. The Planning Board found the map to be satisfactory,
but made a few suggestions relative to a tie-in with proposed
roads in the Dart property and Fairview Park.
Mr. Van ~uyl had prepared a layout of the Bayview Area showing
Oakwood Park, SouthwoOd, Gagen development, Fairview. Park, Dart
property, Wilsb~rg propertyand Goose Neck Estates.
Mr. Chartes~Cornibert accompanied by his attorney, Irving L.
Price, Jr. appeared before the Planning Board fora discussion
of proposed ~Subdivision Cleaves Point, SectionII. At the last
planning Board meeting on'December 5th tentative approval had been
given to this proposed subdivision under the condition Cleaves Point
Corporation reserve a 100 ft. by 100 ft. area on the water off of
Snug Harbor Road and Osprey Nest Road for possible future dedication
to the Town of Southold.
Mr. Cornibert now stated that he disputes this matter of the
property being encumbered with the restriction of 100 ft. by 100 ft.

for possible future dedication to the Town. He stated that he
has dedicated a 150 ft. parcel to the Town for a future Town marina
in Cleaves Point, Section I and he does not think it is'neCessary
to reserve additional land for dedication to the Town in Seetion II.
Mr. Price had prepared a statement relative to the I00 ft.~ by 100 fro
area being reserved but Mr. Cornibert refused to sign it.
After a brief discussion with the Board and consultation :with
his attorney Mr. Cornibert asked the Planning Board if he could
reserve this area for a specific number of years. The Planning
Board stated they felt that would be agreeable and set 12 years as
the deadl±ne.
On motion of Mr. Grebe, seconded by Mr. Young, it was
RESOLVED that the Planning Board grant Cleaves Point,CDrpa~ation
tentative approval of its subdivision to be known as"Cleaves'Point
Section Ii~ at East Marion, New York.
This tentative approval is granted under the condition that
Cleaves Point-Corporation reserve an area 100 ft. by 100 ft. on the
water off of Snug Harbor Road and Osprey Nest Road for a period Of
12 years for possible dedication to the Town of Southold for highway
purposes. It was further
RESOLVED that a letter be forwarded to Mr. Price conf~rming
the above action of the board and stating that the Planning Board
must be in receipt of a letter~a~knowledging this condition by one
of the officers of Cleaves Point Corporation before a pubIic hearing
can be held. It~was further felt that this requirement should be
incorporated in the declaration of covenants an~ restrictions to be
filed with the County Clerk.

Mr. Young, and Mr. Unkelbach.

RESOLVRO that the Planning Board set 7:30 P.M., Tuesday,
February 6, 1962, Town Clenk Office, Main Road~ So~thold, New
YOrk as time and place ~or hearing upon the question of approval
of the following plat:
Plat of property owned by Cleaves PointCorporation, entitled
Cleaves Point~ Section II at East Marion, consisting of a parcel of
land of approximately 9.40 acres~ situated at East Marion, in the
Southold Town Planning Board

Town of Southold, SuffolkCounty, New York~ and bounded and
described as follows:
Beginning at the intersection of the westerly line of Maple
Lane with the northerly line of Osprey Nest Road as shown on "~ap
of Section One Cleaves Point" filed in Suffolk-County. Clerk~s
Office as Map No. 2752; running thence along the northerly line
of said Osprey Nest Road S.56°37i~10.W. 450 feet; thence N.33°22~50"Wo
25 feet; thence S.56°37'10"W. 160 feet, more or less, to Gull Pond;
thence northerly along Gull Pond 500 feet, more or less; thence
along other land of the applicant four courses, as follows: ~1)

On motion of Mr. Unkelbach, seconded by Mr. Moisa, it was
RESOLVED that Mr. A. N. Young be congratulated on h~73rd
birthday which occurred January 9, 1962.

Mr. grebe requested that a letter be forwmrded to the
Association of Towns suggesting that a stenographer be present
at each session of the:Annual Meeting to take minutes of the
proceedings to be supplied to the members and a minimum fee be
charged to cover the cost of this service.
Mr. Van Tuyl presented for tentative approval the map of
"~reen:Acres" a't ~rient. He stated that everything is in o~der
for a public hearing.
On motion of:Mr. Moisa, seconded by Mr. Grebe, it was
RESOLV~D that the'Planning Board grant Greenway-Realty
'CorpOration tentative approval of Proposed-subdivision to'be
known as "Green Acres" at Orient, New York, map by'Qtto W. Van
Tuyl& Son.

A letter was to be f~rwarded to Greenway Realty-Corporation
stating that they may now instruct their engineer or surveyor to
~roceed with computing the map~ preparing thee finished map, submit
their cloth prints to the Health Department for-approval, and
proceed with other matters necessary prior to submitting them to
the Planning Board for final approval. These prints must be submitted
at least 15 days prior to a regular ~mee~ing of the Planning Board.
It was further RESOLVED thata public hearing be scheduled
for sometime in March (exact date to be set at FebruaryPlanning
Board meeting) and Greenway be requested to advise thePlanning
Board if they plan to dedicate the highways to the T®wn of;southold
within 90 days from the date of the hearing~ as a performance bond
would be required if they do not.

The Planning Board received notification from the Town ~oard
that change of zone frOm"~C~~lDistrict to "~;~B~i%~e~3~_al
District was made on the property, ofThomas H, DeWulf ~ffective as
of December 21, 1961; and from "A" Residential and Agricultural
District to "B" BuSiness Districtwas made on the property.oflK. G.
Brown effective as of:December 21, 1961.
The following annual report of the Southold Town Planning Board
for 1961 was submitted to the Southold Town Board in December~ 1961:
"The Southold Town P~anning Board wishes to report that they
have held 15 meetings this year, 1961. We ha~e met with the Town
Board and Board of!Appeals on three occasions.
~he Planning Board held five public hearings on th~ question of
approval of subdivision plats and all five were approved.
The Board has held.approximately 50 informal discussiOnsand
action ~as taken in:all cases~
The Planning Board has investigated andmade recommendations
to the Town Board on 16 change ofzone applications.. The Building
Inspector collected and turned over to the. Supervisor $375.00 in
connection with these applications for change of'zone° One change
of zone wa~made on the Town'Board's own motion, therefore no fee W~s
required.

"There have been six ~Qrmal applications for subdivisions~ and
$238.00 in fees have been %U~ried over to the SuperviSor~by 'The build-
ing Inspector.
"On December 16, 1961 Messrs. Young, Grebe, Unkelbach, and
Consdt~ant van Tuyl-attended the annual Zoning Convention in
Lindenhurst."
The minutes of the meeting of~December 5, 1961, on motic~ of
Mr. Grebe, seConded by Mr. Unkelbach, were approvedas submitted.

Mr. Young, and bLr..unkelbach.
The next meeting ofthe SoutholdTown Planning Board will be
held 7:30 P.M., Tuesday, February 6, 1962 at.the TownClezk Office,
Main Road~ Southold, New York.
Mr. Wickham again brought-up the matter of the Fleet property
on the west side Fl~e~sNeck Road, ~.~ of'Midwood Road
Qf-southern Cross~Road~ Cutchogue. He proposed-leaving a portion
in the center of'~this ~area wooded and to he,maintained as a park,
excluding i% from'a subdivision map~ The members of the Planning
Board advised against this proposal and stated it'wou'ld be best to
file a subdivision map on the entire parcel. Mr. Van Tuyl stated
that he would begin working on a map for tentative approval.

the Department of~Pu~lic~orks can give us.
The Chairman asked the Secretary to prepare a resume on the
handling of Industrial Parks by'the-various other townships in
Suff~lk~County that we had received information from for the next
Planning Board meeting.
The Planning Board again discussed the labor camp ~ituation.
Mr. MoiSa stated that~meetings were being held and they are trying
to start on some sort of program relative to new buildings in the
Cutchogue camp.
The meeting adjourned at 11:10 P.M.
