A regular meeting of the Southold Town Planning Board was

PUBLIC HEARING: Upon the question of approval of the fol!~,?ing
plat: Plat of pro~er~y ov~ed by James Dean~ Entitled Downsview~
located at Cutchogue= in the Town ~of Southold, Suffolk Co~uty~ New
York.
The Chairman opened the hearing ~y reading the legal notice
of hearing and the affidavits of publication f~m the Long Island
TraveterLMattituck Watchm~u ~ and the Suffolk Weekly Times.
· T~ CHAIR2~L~N: 'As far as I kn~N evez~ything is in order. This
subdivision ~as presented to the planning board some sixm0~ths ago.
HG,~ARD T~qY: The arno,rout of the performance bond has been
approved bM the Town Board.

in opposition to this subdivision?
(There was no response.)

this.
GARY OLSEN, ESQ.: I am the attorney for the applicant herein.
The subdivision has met~a!l the rules and reguiati~ns of the Board°
~Je move that approval be granted to the subdivision° l~Je will obtain
the bond when approavl for the subdivision has been granted°

subdivision~ I have two letters that I would like to present
to the Board. The first one deals with my o%%~ property.

"I would like, to consider the foll~,ing at the subject
hearing.
~,Provision shall be madr for the prevention of flooding on
property adjoining and south of Downsview caused by any change
in the natural grade of the l~nd .when making ~he proposed road
along the southern border of Do~sviewo
"The property south of D0va~sview presently has natural
drainage northwestward over Do%~nsview property to marshland west
of the existing Beachwood Colony right of way to New Suffolk
Avenue~"
(~4r= Taylor pointed out the low spot on the map)
MR,. TA~w~OR: I am concerned that this wouls stop the natural
drainage of my property. The other letter from six homeowners
along ~he Beachwood Colony and having a permanent easement for
well points on l~ud of James Ed Dean.
"I would like you ~o consider the following at the subject
hearing.
"Restrict the use of land adjancent to an existing well point
permanea~ent easement (recorded at the Suffolk Count~ Clerk's
Office, Riverhead, N~Y~, July 8~1965~ Liber 5776~ pages ti-14} on
l~nd of James Desn, (now kno%~a as Downsview) to prevent installation
of any cesspools, septic tanks, seepage fields or other s~age
disposal facilities within i00 feet of said easement or a distance
more or less than t00 feet as recommmended by the
department of health or sanitsu~ codes~

The easement
(A ler~hty discussion was held on the easement in question,
The Chairm~ointed out that the Superintendent of Highways should
be notified that the easement concerns the road in ~he subdivision.
Another letter of approval from the Superintendent of HighWays
is required and the easement must be shown on the map)~

that ~% T~9? does not object to the overall layout of the su~-
division, b~t tO bring to the attention of the Board that what
he presented to the Board°

T~ CP~IPd~AN: Hearing none, I will declare the hearing closed
and we-will discuss~ this latter and co~ to a decision. I c~
assure you ~ight n~ ~ will require the easement to be sho~ on
the ~p~ ~ud we will bring it to. the attention of the highway
su~rintendRnt.
Leffe~ s P. Edson, Bsq.~ appeared before the Board with
a pre!ini~ary layout of property of Schroeder~ Section Io Howard
Terry pointed out the park and playground area is in Section II.
A !enghty discussion was held on the park and p!aygro~und area.and
dedication of highways. The Board requested a letter of intent
for the Park and playground in Section II. R~so it was pointed
out that roads teri~inating at waterfront must have a 100 foot
turn-around~nd the Town requires 100 foot of shoreafront for
dedication.
On motion by -~r. Coyle~ seconded by Mr. Unkelbach~ it was

apprOUa%~S~ject to a letter of intent being receive~ fez the
part ~nd p/ayground area in either SeCtion I or Section II of this
property. ~

of the preliminary approval for the~ subdivision to be known as
Highwood.
On moT~n by ~ Coyle~ seconded by ~r. Moisa~ it was
RESOLVED that the pre!iminar~aapproval on the subdivision
to be knovrn as Highwood be extended for a period of one year°

Walter Kapp~ Esq., appeared before the Board to request an
extension cf~pproval c~n the subdivision to b~ known as Harvest
Homes in order to complete final maps.
On motion by I~. Moisa, seconded by ~ Unkelbach, it was

RESOLVED approval of/~k~ be extended ~r a period of
six mo~khs ~0 complete final maps.

RESODVED that final approval be 9iven ~o the. subdivision
known as Jackson~s La-riding, Mattituck, New York~ and that ~he
Chairman of the Planning Board be authorized to sign the final
map after the Town Board has accepted a bond ~or the completion
of the roads and other improvements~

On motion by Mr. Coyle, seconded by Mr. Unkelbach, it was
RESOLVED that the Southold Tow~ Planning Board does not
recommend the above cha~ge of zone to the Southold Tov~u~ Board without
getting ~n touch ~th the St~ Agnes Cemetery Association~and
the Sterling Cemetery Association and asking their opinion of
the proposed change of zone. In addition, the Planning Board
~ould recom~mend a buffer strip on each side for each cemetery.
