PLANNING BOARD MEMBERS John W'ickham, Chairman Henry Alfred Grebe Archibald Young William Unkelbach MINUTES SOUTHOLD TOWN'PLANNING BOARD June 6, 1961 A regu/ar meeting of the Southold Town Planning Board was held 7:30 P.M., Tuesday, June 6~ 1961, at the Town Clerk Office, Main Road, Southold, New York. There wer~ present: Messrs. John Wickham, Chairman, HenryMoisa, Alfred Grebe, Archibald Young, and William Unkelbach. Also present: Mr. Otto W. Van Tuyl, Consultant and Harold Pr~ice,.Superintendent of Highways. Mr..~ichaet Zukas, Southold, appeared before the Board for an informal discussion. Mr. Zukas has several-acres of land on Main Bayview Road and facing West-Creek, Southold, which he wishes to divide into lots. The lots would run the length of the property which is 184,67'ft. by approxi~tely t000ft, in depth, with a 30 ft. road. The Planning Board advised '~%hat.as per the rules that if there are four-or less lo{~ that would be a matter of access, but fiveor more would require the filing of'a~ subdivision. Mr. Zukas advised he would possibly file for:an OpenDevelopment-Area with four lots each containing over 20,000 sq. ft. SoUthold Town Board of R~nning -2- June 6, 1961 Mr. Dan Smith, Southold, appeared before the Planning Board to answer questions relative to the petition of George-W. Smith & Sons, Inc., for a change of zone from "A" Residential and Agricultural District to "M" Multiple Residence~District~on certain real property situated at-Lake Drive and Kenny Road, $outhold. Legal description was previously setforth in the Planning Board minutes of May 10, 1961. Mr. Smith stated that he has a prospective purchaser~r this property who plans to erect a motel after the change of zone is secured. The Planning Board advised that theylook with favor on this appliCation but they wish to see the plans for the proposed motel. Mr. Smith stated he would contact the prospective purchaser and attempt to secure plans for the Planning Board to look at. Mr. Martin Graemlich and Mr. Henry Graemlich of Greenway Realty Corp. appeared before the~Planning Board to discuss their p~oposed subdivision to be known as Green Acres at-Orient. There was a lengthy discussion relative to drainage problems and also a road ending atthe water. After a thorough discussion the follow- ing was arrived at in the matter of Green Acres at Orient, map by. 'Otto W. Van Tuyl dated April 11, 1961 and revised April 14, 1961and May 29, 1961. The Planning Board insisted and the owners agreed that there would be a 100 ft. turn-aroUnd at the-Sound and it will be on the easterly edge of land presently in the area marked'~or residents only" on the map. In addition, the owners suggested a flush leachinq area in conjunction with a landsc~ing project adjacent to Route 25 on the West side of Greenwayl'East. Finally, there was agreement between the-Planning Board, the owners and the Superintendent of Highways Price of~a drainage area of at least 150 ft. on the westerly line, including parts of lots 12 and 13 and the drainage area on'the east side to include at least actual pond area and take in all of lot 31 and all of the lot marked "pa~k". The Planning Board approved the layout of the map subject only to the receipt~of~a new map showing the above- mentioned changes. Mr. Joseph Snellenberg and Mr. Julius zebroski appeared before the Planning Board-to discuss propertyowned byMr. Zebroski at Bayview Road, S~thold. Mr. Snellenberg advised that he had made application to th~ Boardrof~Appeals for~'approval of~access to a lot owned by'Mr. Leslie Gazzola but it was denied because there had been no hardship shown, nom was the requested access to a lot owned entirely by Mr. Gazzola, it.was to a larger area than ~Mr. Gazzola owned. Mr. Sneltenberg stated that at'the present Southold Town Planning Board -3- June 6, 1961 time there is an agreementbetween the owners of the lots purchased from Mr. Zebroski to deed them back to Mr. Zebroski so that he may redivide them with largerarea. After considerable discussion relative to the possibility of an. Open Development Area or whether Mr. Zebroski should file for a subdivision when the land is all deeded back to him, the following was the Planning Board's deter- mination: The Board is willing to accept four lots but are not going out on a limb against the Board of~Appeals, and the Board of'Appeals is apparently insisting that the lots are in the name of Zebroski, or at.least in legal agreement and this appears to the'Planning Board to be reasonable. Following this line of think- ing the Planning Board would like to see a complete realignment of lots with an engineers map and property owners agreement to go with it. It would then seem to the Planning Board that Since the Board of~Appeals have granted access on one side of'the road perpendicular to Bayview Road which parenthically we find was not cut in until long after the effective date o'fZoning, but nevertheless ha~ing been granted access on one side ofthis road to one owner the Board of Appeats cannot well refuse another. When and if they are straightened out and this would leave not more than 'four lots which the Planning Board can and would be willing to handle. Mr. Van Tuyl brought up the matter or'Orient-By-The-Sea, Section 2. .Mr. Uhl is in the process of selling lot No. 52 and the proposed 100 ft. road to the Sound to the adjoining property owner Millis. He would like to change the road to the~Sound to Lot No.~44~which is also 100 ft. wide and adjoining the previous proposed road. On'motion of Mr. Grebet seconded by Mr. Young, it was RESOLVED tha~tthePtanning Board is in agreement-with the pr~posal by Walter Uhl to change the proposed 100 ft. road to the~Sound %~ Lot No. 44 on map of'Orient-By-The-Sea, Section 2, dated May.t0, 1961, by'Otto W. Van Tuyl & Son. Vate of.the Board: Ayes:- Mr. Moisa, Mr. Grebe, Mr. Young, andMr. Unkelbach. (Mr. Wickham did not Vote aS he had left the meeting prior to a discussion on this matter.) The next meeting of the Southold Town Planning Board will be held '7:30 P.M., Tuesday, June 20, 1961, at the Town Clerk Office, Main Road, Southold, New York. The minutes of the meeting of May 10, 1961, on motion of Mr. Grebe, seconded by Mr. Moisa, were approved as read. Vote of the Board: Ayes:-' Mr. Moisa, Mr..G~e~e~ Mr. Young, and Mr. Unkelbach.
