A regular meeting oft he Southold Town Board of planning
was held 7:30 P-M- , Tuesday, July 18~ 1961 at the Town Clerk
Office, Main Road, Southold, New York.
There were present: Messrs. JohnWickham, Chairman, Henry
Moisa, and Archibald Young.

Also present: Messrs. Otto W. Van Tuyl, Consultant, Howard
Terry, Building Inspector, ~dHarold Price, Highway,Superintendent.
Mr. Costas Stars appeared before the Planning Board fo~ a
discussion. Mr. Stars has a map of a proposedsubdivision on the
north side Route 25, East~Marion, containing approximately 30 lots.
Mr..Stars is providing a 50 ft. road through the entire subdivision
which he intends to dedicate to the Town, butatthe northerly end
there~is a jog and one of the property owners at-that point, Mr.
Frumenti, will not sell Mr. Stars enough land to make the~road 50
ft. Mr. Price stated that he does not'feel the TOwn.will be able
to take over the road unless the entire length is 50 ft. The State
Law requires 50 ft. for:a Town Road.

It was the feeling of the'Planning Board that a third party
should speak to the property owner~ Mr. Frumenti, to see if some
solution could be reached between Mr. Stars andMr. Frumenti. It
was felt that Mr. Young would be the best person for this job and
Mr. Young stated he would attempt to reach some mutual agreement.
Mr. Van Tuyl stated he would prepare a sketch showing the~exact
amount of land needed and accompanyMr. Young.
Mr. JohnMarshut and a delegation from LaughingWaters, Southold,
appeared before thePlanning Board to discuss the development of
CoreyCreek for a Town operated marina. They feel this creek would
be a very good harbor for a boat marina and possibly an area for
bird conservation.
After a thorough discussion the ~lanning Board advised Mr.
Marshut and the delegation that thePlanning Board is in favor of
such a project but they do not feel it~will materialize for'some
time.
Mr. William~Smith.appeared before the Planning Board with the
cloth prints and road profiles for the proposed subdivision Fairview
Park, south side Pine Neck Road, Southold.
On motion of Mr. Moisa, seconded by Mr. Young, it-was
RESOLVED that the Planning Board set 7:30 P.M., Tueday,~August,
1, 1961, Town Clerk Office, Main Road, Southold, New York, as time

The Planning Board again discuSsed the petition ofG. W. Smith
&Sons, Inc. and Southold Devslopmnt Corp. ~or~a change of zone
from "A" Residential and AgriculturalDistrict to "M" Multiple
residence District. Mr.~-WilliamSmith stated that the prospect~ive
purchaser , who does contract-work-for'G- W- Smith &'.Sons, wishes
to build either a duplex or-mOtel on the property, He does n6t
wish to go to the expense of preparing plans until he receives
some indication on the status of the change of zone.
On motion of Mr. Moisa, seconded by Mr. Young~ it was
RESOLVED that the Planning Board recommend to the Town
Board this change of 3zone from"A, Residential and Agricultural
~District to "M" Multiple Residence District on certain real
property~situated at-Southold and more particularly bounded and

The Planning Board has investigated this property and feel
that a multiple residence use would be in conformity with the area.
The Planning Board has requestedadditi~nal informationon the
proposal and in return has found that the prospective purchaser, who
has been doing contract work for G. W. Smith &Sons, insists he is

going to build a duplex or motel, it is felt-this would be a good use
of the property. It is obvious, however, that such a building will
have to.be placed on higher land.

The Planning Board received from the Town Board the original
petition of Guido Ciacia requesting a change~of zone from "A"
Residential and Agricultural District to "B" Business~District on
certain real property situated at'Arshomomaque and bounded and
described as follows: Beginning at a point formed bythe inter-
section of the northerly line of'Kerwin Boulevard and the easterly
line of the Main (State) Road, and running thence N. 30°24'20"E.
along said.easterly line of Main Road 50 feet~to land now or formerly
of Mann, thence easterly along said land now or formerly of Mann
S. 59735'40"E. 125 feet to a point; thence northerly along said land

On motion of Mr. Young, seconded by Mr. Moisa, it was
RESOLVED that'the Planning Board recommend to the Town Board
this change ofz~ne from "A" Residential and Agricultural District
to "B" Business District.
The~Plannin~ Board finds that this property is presen~tly non-
conforming bus~ness. Mr. Ciacia has conducted:a boat building,
repair business and carpenter shop on the premises for many years.
There presently exists a "B" Business'~District~to the.south of
Mr. Ciacia on the corner of-Kerwin Boulevard and~Main (State)Road.
On the opposite side ofMain (S~ate) Road, from the railroad over-
passeasterly to Greenport, the land is zoned "B" Business.

The minutes of the meeting of June 20, 1961, on motion of
Mr. Moisa, seconded by Mr. Wick~m, were approvedas submitted.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, and
Mr. Young.
Mr. George McMann appeared before the Planning Board to discuss
the road situation at Orient-By-The-Sea, Section II. Mr.~ Lawrence
Tuthill also appeared and submitted his report on the total cost
of construction ofhighwaYs and the amount'of performance bond
which ~zhould be required.
In his report-~o the Planning Board Mr. Tuthill states that
for the construction of~roads, leaching pools, catch basins, leach-
ing areas, drainage pipe is $32,000.00 with an increase of 30%,
20% for increase in construction costs for~a period of 3 years,
and 10~ for administration cost if there should be a default, which
would bring the total cost to $41,600.00. Mr. Uhl has informed Mr.
Tuthill that the roads Sound View Drive and North Sea'Drive are to
be completed and if accepted by the Town of~Southold prior to
issuance of. this performancebond, the estimate for the total remain-
ing work-would be $23,~00.00. - The Board advised Mr. McMann that
the final figure would'be increased by 10%.
Mr. McMann stated that he would convey this information to
Mr. Uhl and try to have him finish Sound View Drive and North Sea
Drive so that there would only be one problem to deal with.
There was a question brought up about the drainage of'a small
area into the'~sound at-approximately lot~no. 48. The Planning Board
and the. TownlBoard.does not approva of that-method. They feel the
water should drain back into the soil. There was a discussion about
another'tot being set aside for a leaching area, but nothing firm was
agreed a upon.
The matter of the dedication or'Calves Neck Road at;.Southold,
o~ned by.L. Barton Hill & Adelaide H. Hill was~discussed. The
Planning Board had returned the file to the'Town'Board because the
applicationwas incomplete and faulty. The Board hasnew received
three prints of the proposed layout showing courses, distances and
monuments, and a map giving road profiles and drainage.

On motion of Mr. Young, seconded by Mr. Moisa, it was
RESOLVED that the Planning Board recommend to the Town Board
the dedication of~Calves Neck Road to the Town of Southold, in
view of the fact this road has an excellent base, and the area has
a veryhigh assessment value, however, there are several problems:
1. The pavement is not the acceptable width.
2. There is no access to the water.
3. There is a question regarding the drainage.
Finally, the Planning Boardwould like to recommend to the Town
Board the withdrawal of approval of the Open'Development~Area on
roads not now constructed in this development.
Calves Neck Road is bounded and described as follows:
