There were present: Messrs. JohnWickham,. Chairman, Henry Moisa, Alfred Grebe and Archibald Young. Absent: Mr. William Unkelbach Also present: Messrs. Otto W. Van Tuyl, Consultant and Howard M, Terry, Building Inspector. The-Planning Board received from the Town Board the original petition of:Edward'L. Donahue, ClementB...Donahue,.EdWard ~Meyer, Raymond W. Donahue, and Reginald S. Donahue for change of zone from "Al" Residential and Agricultural District to "B" Business District on certain real property situated at-Southold, and more particularly bounded and describedas follows: Beginning ata point marked by a granite monument set at the point of in~rsection o~ the northwesterly line or. Middle Roadwith the northeasterly line of Kenney~S Road; and running thence along said line of~Kenney's Road, North 41 degrees $Outh01d Town Planning Board -2- September 13, 1961 57 minutes 50 seconds West a distance of 220.62 feet to an iron pipe; thence on a line at right angles to said line of~Kenney's Road, North 48 degrees 02 minutes 10 seconds East a distance of 131.30 feet to an iron pipe; thence along land of the party of the first part and along land of Edward Donahue, South 42 degrees 05 minutes 50 seconds East a distance of 200.0 feet-to an iron pipe seton said northwesterly line of Middle Road; thence along said line of Middle Road, South 39 degrees 08 minutes 40 secondsWest a distance of 133.38 feet to the point of beginning. Map of land surveyed for the Donah~e Estate at Southold by-Otto W. Van Tuyl &~Son dated August 17, 1961~ The Donahue~Brothers, Edward, Clement, Raymond andReginald and Edward D. Meyer appeared before the Board to answer questions. Mr. Meyer stated that'he intends to build a blockand brick building 100 ft. by 35 ft. facing on Route 27A. The setback-on Route 27A will be 50 feet-and on Kenney's Road it will be 35 ft. ~r. Meyer intends to produce and assemble electronic instruments and will eventually hire 10 to 15 employees. On the opposite'corner is the property of Conway which is zoned "B" Business and is used for the repair of farm machinery, trucks, tractors, etc. Diagonally across Route 27A is the property of Ka~]~e~in which is zoned "B" Business and is used for the sale and service of Farm machinery. On motion of Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the Plan~ing Board recommend to the Town Board the change of zone fr0m'"A"~Residential and Agricultural District to "B" Business District on the property of Edward L. Donahue, Raymond W.. Donahue, Reginald S. Donahue, ClementB. Donahue and Edward D. Meyer, Southold, New York. Diagonally a~ross from the property in question., on the south side of R0Ute 2'7~ is of Ka~n Farm ~achinery Which is zoned "B" Bus~ne~ this proPerty~on the west side of the corner of Kenney's ROad and Route 2'7A is the property of Conway which is zoned "B" Business and used for a similar purpose. The Planning Board feels this property is particularly suitable for "B" Business and wOuld be advantageous to the economy of~Southold Town. Southotd Town Planning Board -3- September 13, 1961 Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe and Mr. Young. Mr. Walter U hi appeared before the Planning Board with Mr. Frank Mc/~ann to discuss"Orient-By~e-Sea, Section Two. The Chairman stated that Mr. Price, Su~rintendent of Highways, was not in agreement with the Board's suggestion of t0 ft. by 200 ft. flush drainage area along the highway in the vicinity of lot 48, but~he will go along with double catch basins, there must be 100% verticatdrainage in the heretofore approved leaching area locations. Mr. Uhl~s in agreement with this. He said he would do every- thing possible to put the property in order for final approval and approval of the highways. ~r. Uhl statedthat he has received approval of the Health Department. The Chairman stated that a letter-would be forwarded to Super- intendent-Pr'ice requesting that he send to either b~r. Uhl or the Planning Board the specifications or name of the manufacturer with relation to the double catch basins. He would also request that Mr. Price go along with Mr. Van Tuyl to locate the position of these catch basins. The Board also requested that-some sort of formula or reasonable practice be set up of so many feet.of area per lot or 100 feet of road frontage or at least some basis that the Planning Board could use in future cases. The Board finding that everything seemed to be order agreed to sera date for the public hearing on approval of Orient-By-The-Sea, Section Two. On motion of Mr. Grebe, seconded by M_r. Mr. Terryadvised the Board that the~ Suffolk.County-Planning Commission 'would be holding a public'hearing on SePtemb~er/2~th on %he application for a change of"zone on the property~of'Woodhollow Properties, Inc. at, Orient. TheSouthold Town Board recently approved thislchange of zone from "A" Residential~and~Agricultural to "B" Business. Irving L. Price, Jr., Esq~ appeared before the Planning Board present the application for approval of Section Two or'Cleaves Southold Town Planning Board -5- September 13, 1961 Point at-East Marion, New York. Preliminary-Plan or'section Two, Cleaves'Point at East Marion by Otto W, Van Tuyl &~Son dated September 11, 1961. This proposed subdivision will contain 22 lots, each having over 12,500 sq. ft. -of area and having public water. Cleaves Point, Section Two is ~escribed as follows: Beginning at the intersection of the westerly line of Maple Lane with the northerly line of Osprey'Nest Road as shown on"Map of-Section One Cleaves'~Point" filed in Suffolk~CountyClerk's Office as Map No. 2752; running thence along the northerly line of said Osprey Nest Road, S.56°37'10"W. about 630 feet to Gull Pond: thence northerly along Gull Pond 500 feet, more or less; thence along other land of the applicant, four courses, as follows: (1) N. 56°37'10"E. 170 feet, more or less; thence (2) N. 33°22'50"W. abo~t 35 feet; thence (3) N.19°30"E. 450 feet, more or less;' thence N, 56°37'10"E. 100 feet, more or less to thewesterly line of said Maple Lane; thence southerly along said line of'Maple Lane, about 800 feet to the point of beginning. The Chairman brought up the question of a 100 ft. turnaround at'the water. It was pointed out that in the Planning Board's minutes of March 11, 1957 there was mention made that~Osprey Nest Road should be made a 50 ft. right-of-way and extended to the water with a 100 ft. by 100 ft. turnaround. Mr. Price asked the Planning Board under wh~tregulations or section of the State~ Law the Planning Board is requesting that this be done? He stated :that the Planning Board has no authority other than the regulations approved by the Town of!Southold and the State Law. He stated that his client has instructed him not, to agree to anything other than what is shown on the preliminary plan. These roads are to be kept-private. On motion of Mr..Young, seconded by Mr. Grebe, it was matter be tabled until the. Board has an ~ult with the Town Attorney with regard to the legallposition of the Board. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, and Mr. Young. The Chairman dictated a letter to Town Attorney Tasker requesting his opinion on the above matter. Southold Town Planning Board -6- September 13~ 1961 The Planning Board received from the Town Board the original petition of William Victoria and Regina G. Victoria for~a change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District. Thomas~Stark, Esq. appeared before the Planning Board with Mrs. Victoria to answer questions relative to this application for a change of zone on certain property situated at Ba~view, Southold, and bounded and described as follows: bounded on the west by la~ds now or formerly of Koke Estate 740 feet, more or less, on the north by other lands ofWillia~Victoria and Regina G. Victoria 850 feet, more or less, and on the south and east by the waters of Corey~Creek and the shore line thereof as the same winds and turns and by the meadow land now or formerly.of Howard M. Terry and others; all as shown and outlined on plot-plan prepared by.Alden W. Young, Licensed Land Surveyor of Riverhead, New York, dated July 7, 1961. -- Mr% Stark promised to forward to the Board a complete metes and boun~s~description of this property and same will be recorded in the next minutes of the Planning Board. ~r~hD~rs. Victoria wish their propertyrezoned from "A" To "M" S~ that theymay expand their present non-conforming operation which is used for 'the location of cottages for summer rental. On motion of Mr. Moisa, seconded by Mr. Grebe it was RESOLVED that the Planning Board recommend to the Town Board this change of zone from '~" Residential and Agricultural District to "M" Multiple Residence District. This property has been: nonconforming since ~rior to the enact- ment of~Zoning and ian enlargement of the use will in no way harm the character~of the ~rea. Mr. and M~s. Victoria wish to maintain the front of the property facing on Main Bayview Road in "A" Residential and Agricultural Districtas a buffer. The Planning Board feels a changeto "M" would be'the most reasonable use for ~the property. Vote of the Boar~: Ayes:- Mr. Wickh~m~ Mr. Moisa,.Mr. Grebe, and Mr. Young. The Planning Board received from the Town Board the original petition of'FrederickL. Jackson~ administrator of~Estate of Adeline J. Becktold, Southold, requesting a change of zone from "A" Resi- dential and Agricultural District to "B" Business District on certain property situated at Southold, and more particularly bounded and described as follows: Beginning at a point on the easterly side Southold Town Planning Board -7- September 13~ 1961 of Wells Avenue 200 feet-southerly from its intersection with the southerly line of'Main ROad, said point of b eg~nning being the southwesterly corner of the premises late of Adeline J. This change of zone is requested becauHe it is intended to put this property on the ma-rket.as a single parcel-and it iB,~believed better planning for the village .zi.~ the property would be zoned "B" for its entire length. It is presently "B" for 200 ft. back from Main Road. On motion of Mr. Young, seconded by 9Lt. Grebe, it was RESOLVED that the Planning Board recommend to the Town Board this change of zone from "A" Residential and Agricultural District to "B" Business District. This property is presently zoned "B" Business for 200 ft. in depth. Applicant intends to sell the parcel for commercial use and it is believed good planning and will better serve the ne~ds of the co~mnunity if the entire parcel is zoned "B". On the opposite corner the property is Business, across the street is Business'and. to the east-of this property for the balance of the business section the zone is "B" Business. Vote of the Board: Ayes:- Mr~ Wickham, Mr. Moisa, Mr. Grebe, and Mr. Young. The P~anning Board received notification from the Town Board that the application for change of zone by Guido Ciacia, from Residential and~Agricultural District to "B" Business~District.was approved effective as of-September 23, 1961. Notification was also receivedthat the application for a change of zone from "A" Residential and Agricultural District to Southold Town P~lanning Board -8- September 13, 1961 "M" Multiple Residence District on property of~Southold Develop- mentCorp. & George'W. Smith & Sons, Inc. was denied. The Board reviewed the file of the proposed subdivision of Peconic BayOaks at Indian Neck Lane, Peconic. Everything was found to be order to publication for hearing upon the approval of this plat. On motion of Mr. Young, seconded by ~r. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, and Mr. Young. The Planning Board received a letter from Richard J. Cron, Esq. who, since the retirement from law practice of RobertF. Dart, hasheen handling the matter of dedication of the extension of Ruth Road, Mattituck, by~.Stanley. J. and Helen Sledzieski to the Tow of Southoldl In reviewing ~the file Mr. CRon did not find a written letter of approval of the dedication of the proposed road and would like to know if such a letter was ever forwarded. ~is clients are prepared to put in the new road as soon as approval of the proposal previously:filed with the Planning Board is received. In reviewing the minutes of the' Planning Board it was found that a resolution recommending approval of the continuation of~Ruth Road was made at the meeting of FEbruary 21, 1961. The file was then returned tothe Town Board with the resolution and a notation that it is understood by'Mr, and Mrs. Sledzieski that all lots on the south side of the proposed road which they may hereafter sell or convey will have a minimum area of'20,000 sq. ft. A letter to this effect~was to be forwarded to Mr. Cron. The minutes of the meeting of~August 1, 1961, on motion of Mr. Moisa, seconded by Mr.. Grebe, were approved as read. Vote or'the Board: ~es:- Mr. Wickham, Mr. Moisa, Mr. Grebe, and Mr. Young. ~he Planning Board received from the TownlBoard application to layout'Town Highway ~for~the dedication of Gull~Pond'Lane at Greenport by Ruth'F. Preston, Ida Belle: Latham .and Robert'L. Muir. Southold Town Planning Board -10- September 13, 1961 This road is in a proposed subdivision to be known as Fordham Acres, Section One. This proposed subdivision received preliminary approval in September 1960 and the applicant has paid the filing fee for final approval. The preliminary map shows~a 100 ft.. turnaround at water. On motion of Mr. Young, seconded by Mr. Moisa, it was RESOLVED that the Planning Board finds this applicationto be a departure from town policy in that this proposed road on the map for dedication does not have the required turnaround at the water, and the Planning Board is not willing to approve this highway at this time. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, ~r. Grebe, and Mr. Young. A letter covering this matter was to be forwarded to the Town Board. The Planning Board discussed the budget for the fiscal year beginning January 1, 1962 and the following was agreed upon: - (This constituted a $200.00 increase from the 1961 budget.)
