A regular meeting of the Southold Town Planning Board
was held 7:30 P.M., Wednesday, November 1, 1961 at the Town
Clerk Office, Main Road, Southold, New York.
There were present: Messrs. John Wickham, Chairman,
Henry Moisa, Alfred Grebe, Archibald Young and William
Unkelbach.
Also present: Messrs. Otto W. Van Tuyl, Consultant,
RobertW..Tasker, Esq., Town Attorney, and Howard M. Terry,
Building Inspector.
Mr. LeRoy Reeve, an Executor of the George H. Fleet Estate,
appeared before the Planning Board to tentatively discuss the
layout of lots on property of George H. FleetEstate, ~e:%~een
Midwood'~Road and Southern Cross Road, CUtchogue, New. York. Mr~
Reeve wished to know the Board's opinion as to the necessity of
filing a subdivision map. There are 10 inside lots and the
proposed road is to be 50 ft. in width.

-RESOLVED that the layout of preliminary plan of George H.
Fleet-Estate, Cutcho~ue, by-Otto W. Van Tuyl & So~, dated Sept-
ember 27, 1961 is satisfactory to the Planning Board as far as
layout of lots and roads is concerned~ as long as a subdivision
map is filed since there will be more than five lots in this
proposed layout.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, bIr.
Grebe, Mr. Young, and Mr. Unkelbach.
Irving L. Price, Jr., Esq. representing 'Charles Cornibert
and Cleaves point-Section II again appeared before the Planning
Board to discuss this proposed subdivision and to determine why
the Planning Board will not give approval to the subdivision map.
The-Planning Board stated that they feel they have good reason for
requiring the.developer to comply with the highway specifications
of the Town of Southold. Town. Attorney Tasker also appeared to
answer any legal questions posed by Mr. Price. The specific
objection to Cleaves Point-Section II is the fact~there is no
access to water. In practically all cases the Town has required
a 100 ft. by 100 ft. turnaround at water. The Chairman stated
that in the approval of~Section I it was ztated that thePlanning
Board would require access to water when Section II Was~prSsented
for approval. Town'Attorney Tasker advised that in the approval
of maps the Planning Board must pass on the layout of roads there-
fore they.must follow what is setforth. The specific reasons for
requiring termination at water were diEcussed; such as.rescue
equipment andfire protection. Mr. Price stated that the roads
are to be private and whoever enters would be trespassers therefore
the road to water would not be neeessary for the residents of
Section II as there is a private beach already.provided. The
Planning Board stated that that-cOuld notbe considered since it
is quite possible the roads woul~ become public in the future.
Mr. Tasker~s opinion was that the Planning Board should present
this situation to the Town Board and see what their feeling would
be.
The Secretary was instructed to make arrangements for Mr.
Wickham, accompanied by Mr. Young, to be present at the next
Town Board meeting to discuss the general topic of dedication
of highways and rOads terminating at water.
Robert Preston appeared before the~Planning Board relative
to the dedication of Gull Pond Lane in Fordham Acres at Route 25,
Greenport. The Planning Board advised that they are satisfied

with the layout of-Ford/~amAcres provided there is some provision
made for a road termination at water. Mr. Preston stated that he
would be willing to do that but he would not want to cut~a road
to water if it is not necessary.
On motion of Mr. Grebe, seconded by Mr. Young, it was

approval of the layout of Gull~Pond Lane as a Town Highway byRuth

The above described proposed highway being comprised of a
strip of land of a uniform width of 50 feet from North Road
southerly to the point 125 feet southerly from land now or
formerly of U~bens, thence widening to about 100 feet in width.

The Planning Board has requested ~r. Robert Muir, Ruth
Preston and Ida Belle Latham to reserve an area 100 ft. by 100
ft. on the southeast corner of the property-adjoining the 100 ft.

dedication ifTrequired by the Town Board.

The Pianning. Board received a copy of a 'letter fbrwarded
to Supervisor'AtbertSon from William Wickham stating that in
June 1959 he presented to the Town Board a petition to rezone
from "A" to "C" certain acreage he owns both north and south of
Middle Road~ Cutchogue. This was re~erred to the Planning Board
'from which he received a reply dated July.9~ 1959 stating that the
application was being held pending the outcome of' negotiations on
the part of the Town, County and State on the location and relocation
of Middle Road. Also he is in no hurry for a determination but he
thinks the TOwn Board should seriously consider changing to "C" a
vastly greater area in that section. With the.economy of' Southold
Town at a low ebb due to: several bad farming years and culminating
in this disastrous season he believes the Town should initiate
action to encourage This is one section
which 'could well be utilizedl and oth~er sections so set-
up we ~ould then be in a promote a C~mpaign to 'ate-tact
industrial firms and'in this way giVe our economy a much needed
boost.
The PIanning Board discussed this letter and in line with t~e
discussion felt':a letter should be forwarded to theHunt~ngton
Town Planning Board requesting a copy of;their ToWn~ Zon~ Ordin-
ance and any information they may have alvailable relative to the
establishment of industrial parks.

The Planning Board received notification fro~ the Town Board
stating that the petition ofWoodhollow Properties~ Inc. for a
change ofzone~from~"A" Residential and Agricultural District to
"B" Business District was granted effective as or'october 16, 1961.
Notification was also received from the Town Board stating
that the ~etition of'Edward L. Donahue,.Raymond'W. D0nahue,
Reginald S.-Donahue, Clement B~ Donahue and Edward D. Meyer for
a chang9 of zone from "A" Residential and AgriculturalDistric t
to "B" Business'District was granted effective as of Octobe~ 20,
t96~.
The~ Planning Board received from the Town Board the Original
petition of Kenneth G. Brown, President of K. G. Brown Mfg.,
Inc. requesting a change of zone from "A" Residential and Agricu-
ltural District to "B" Business DiStrict on certain real property
situated atWickhamAvenue~ Mattituck, and more particularly bounded
and described as follows: Beginning at a point on the easterly side
of~Wickham Avenue, 190.01 feet southerly from the southerly side of
Hamilton Avenue~ which point Of beginning is and intendedto, be
the point of intersection of the division line between the land
now or formerly'of Bond and the land of the Long Island Railroad,
with the easterly side of:Wickham'Avenue; running thence North 47
degrees ~2' 50" east along the southerly line of the land now or
formerly of Bond, a distance of 280.90 feet to the land now or
formerly of Wells; thence South 13 degrees 22' 00"~East along the
land now or formerly of'Wells a distance of 69.59 feet to the other
land of the Long Island Railroad Company; thence South 46degrees
18' 10" west along land of Long Island Railroad, a distance of

This change of zone is requested for the reason-that'they
wish to use the property described for parking in connection
with the manufacturing plan~ on ~the other side of the street.
On.motion of Mr. Moisa, seconded by Mr. Grebe, it was

this change of zone from "A" Residential and Agricultural District

to "B" Business District on property of Kenneth G. Brown, President

The Planning Board feels this change of zone is in the best
interests of the Town of Southold to provide additional business
facilities for existing business. In view of the fact this was
a non-conforming "B" Business property of the L~ island Railroad
Company this actually will not change the nature of the~r~ighborh0od.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Grebe~ Mr. Young, and Mr. Unkelbach.
The Planning Board received a letter from Town Attorney
Tasker relative to the form of a resolution on the approval of
subdivision plats. Mr. Tasker stated that the resolution should
state that the plats be approved on the basis that-if the highways
be completed within 90 days rather than dedicated within 90 days.
The Board wished a letter forwarded to Mr. TaSker stating
that it is the Planning Board's opinion that there are some
developers'who state that they are planning to dedicate their
highways to the Town of~Southold but in reality make no realistic
attempt to do so. The Planning Board is interested not in having
highways completed and having to check on them them~selves, but
in having them turned ~over to the Town of. Southold as soon as
possible. It seems to the Planning Board that dedication was the
only~-criterion and although the~Planning Board has no right to
require dedication presumably, nevertheless, they do not pass
out of the~planning Board~s jurisdiction until dedicatimn. It
was suggested to Mr. Tasker that possibly the resolution might
be reworded to state that per formance bond will be required
unless ~de~cationis completed within 90 days'.

Applicant states that he is the owner of~"C" Industrial
property which runs from Naugles Drive to Mattituck Inlet, having
sold the level and usable "C" Industrial land to Tree Plateau Co.,
Inc. and keeping the described property on the hill for use as
residential purposes. Residences are not allowed in "C" Industrial
District and he wishes to change the property and annex it to the
adjoining "B" Business'District. There is a residence on the
premises which he wishes to move to the rear of the property and
build a new year-around home on the front of the lot facing Naugles
Drive.

RESOLVED that the Planning Board recommend to the TOwn'Board
this change of zone from "C" Industrial District to "B" Business
District on the property oflThomas H. DeWulf. Map of land of

October 18, 1961.
It is the feeling cf the Southold ~wn Planning, Board that
this change of zone would in no way change the character of the
area. It is adjoining "B" Business propekty and wout~ tie in
with it. Mr. DeWulf is being denied the. proper use of his property
which is suitable for residential purposes by having it in the
"C" industrial District.

The'Planning Board next discussed the petition of BroWn's
Hill's Estates, Inc. and Douglas Robertson for. Open Development
Areas on property in Orient. This petition was recommended
favorably by the Planning Board in October 1959 but the .Town Board
wished a morerecent recommendation aS nothing had been~done about
the application in i959~ since the Town Boar.d~was not Satisfied
with the Robinson (westerly) access to the property.

The. Planning Board has since then studied an application for
development of the Ruth L. Young property as a separateentity
and there will be no connection of the two.properties, or road
to the two properties~ from the Main Road (State Rcute 25). The
Plan~ing Board feels that inasmuch as this property has been slowly
developed since the original recommendation of 1959 by'the installa-
tion of water mains, widening of right-of-ways to 50 feet as requested
and installation of the major part of the roads as per the attached
plan;
On motion of Mr. Moisa~ seconded by Mr. Young, it was
RESOLVED that the P~lanning Board recommend to the Town Board
that the Open'Development-Areas be granted over the aforementioned

It is a stipulation of the Planning Board that the roads as
shown be completed and particularlySouthview Drive Extension and
NorthviewDrive Extension. These roads are not yet completed and
thePlanning Board does not believe this Open Development'Area
should be granted until that time.

and ir'has focused a great deal of attention on the migrant~robtem.
Mr.- Wickham'feels that the Planning Board should 1study tkis'specific
problem and communicate in a constructive manner' with the-Board of
Directors ofthe Cutchogue Camp. This matter will be ~rought up
again at the next meeting.
