There were present: Messrs. John~ickham~ Chairmam~ Henry Moisa~ Alfred Grebe~ Archibald Young~ and William Unkelbach. Also present: Messrs. Howard M. Terry~ Building Inspector, Robert W. Tasker~ Town Attorney~ Otto W. Sacks and possibly ]¢ro ?appish joining in a~d also some of the other property owners Ln the area. However,~ he does not w~zut to do-it unless there is some i~dication from the Planning Board that it would be feasible. The Chairman advised Mr. Wickham that there had been some discussion at the last meetirg about this Southold To~Planning Board ~2- February I~ 1960 situation and the Board had been aware of the fact for some time that there had been~ople in that n~ighborhood ~o are interested in having the area zoned commercial~ amd the Planning Board thought they might correspond with the other interested people to see if they would like to join~lth Papish and the Town Board on its own motion. ~. Wick_ham stated that he was bringing the matter upat this' time as a move to get the situation under way. The Chairma~u stated that the Plsan~ug Board is definitely of the opinion this area should be zoned '~B" Business and the only thing left to resolve is how it may be done most satisfactorily~ WilliamWickham als~spoke to the Planning Board with reference to the application of Willia~ M. Beebo ~ud Harry E~ ~son for tentative approval of a subdivision to be known as Moose Cove at Little Neck~ East Cutchogue, ~ew York~ Tentative approval had been granted by the ~lanning Board on December l~, 19~9. He asked the Board just where the dividing line is for developers that do not have to file maps~ and what about the new Health Department requirements? The ~nairman advised that the Planning Board is primarily interested ~u highways ~nd that is the basic reason for insisting on a filed map. The primary reason for revising the Rules and Regulations for the Subdivision of Land was that the ~anning Board ~fouud they are getting no where~there is a problem with the developments° As far as the Zoniug Ordinance of the Town of ~outhold is concerned~ the minimum lot must be 12~00 sq~ fto and the thine that confuses everyone is that the Board of Health will not o.k. a filed map ~less the lots are 20~000 sq. ft. However~ if someone were to present for dedication a highway to the Town of ~outhold and it were approved by the Town~t~en the Planning Board would not insist on a map being filed if there werea reasonable number of lots. Possibly 6 to l0 lots. Mr. Harold Price~ ~ighway ~uperintendea% stated that they are adding a paragraph ~o the highway specifications that "~ere a~rOad has Been C~mpleted according to the'specifications to the satisfaction of the Town Board and himself~ then they will give tentative approval, but the road will not be accepted as a Tov~highwsy ~uatil one year from that date." ~ Price fUrther stated that he thought another sentence should be added to that stating that a third coat of oil sho~ld be applied before the To~ takes over at the end of the year. Mr. William Wickham stated th~tas far as he is concerned the question in his mind is who sh~ll file a map~ who shall have 20~000 sq. ft. and will you allow 12~00 sq.ft~ on a public road. Is the Planod~g Board going to penalize man With the subdivision? The Chairman advised that the Pl~u- nine Board carrot say someone is o.k. with less than 20~000 sq. ft. because the Health Department will say you arenoto Seuthold Town Planning Board FeBruary 1~ 1960 If everyone files a map here and it requires the Board of Health approval than the applicant must go to the Board of Health. ~hat is in the best interests of the To~n of Southold is the planning Board's main concern. The Chairman advised he feels it will not be long before~erything is 20~000 ft. Bight now the V.A. and F.H.A. ~_ll not give mortgages on less ths_u 20~000 sq. ft. Mr. Willi~ Wickham stated that he feels that whereas Suffolk County is so long that many problems applying to islip and Bab~n do not apply out here in our farming communities. Mro Unkelbach suggested the possibility of the Planning Board petitioning the Board of Health to ease up on the regulations since there is no comparison between ~outhold and villages f~ther west. On motion of ~. Young~ seconded by ~, Moisa~ ~ud carried~ It was RESOLVED, that 1~. Wit~am~ Chairman of the Planning Board~ accompanied by ~o Van Tuyl~ visit with Dr. Da~idl 0verton~ Commissioner of Health of Suffolk Co~.ty relative to the possibility of easing up on lot si~e regmlations~ water supply mud other regulations with relation to the ToE of Southold. Vote of the Board: Ayes:- bM. Wickham, Mr. Moisa, bM. Grebe~ M~. Young~ and Mr. U~melbach. TheBoard went on to discuss with Mr. Nilliam Wickham ~ud Mr. Walter Luce~ Cutchogue~ New York~ the ~tter of the affect of detergents on the soil~ storm sewers and water districts, ~.,~W~al~er Luce ~hen spoke to the Board wi~h reference to l~ts he~s on'~'~a~'~venu~'~ ~ine Tree Road, Cut~gue. The Chairman advised that as far as the, rules and regulations for ~ne s~.B~ivlsxon o~ Iana are concerned~ l~ the hm~hway is accepted by the Totem then lots may be sol~. If son. one desired to open other roads he would have to g~ through the preliminary proceedimEs of putting the roads L~to shape,and f~ng a map~if someone wished to build on the roads before the year is up when they are accepted by the Town~ l~. Luce was advised that Bay Avenue ~ud Pine Tree Road are established Town highways and he can sell lots with 12~00 sq. Ft~ ~he question now is lots on unapproved roads off Bay Avenue and Pine Tree Road. N~uce was told that there are only two alternatives~ Either seek approval of the access or file a map of the entire parcel and have it approved and the problem will be solved. On motion of ~. The matte_ of the application of Walter Grabie for ~u Open Develou~nt Area was ordered held in abeyance umtil the Ple~raing Board hears from the Health Department. A letter ~as received from the $outhold Town Board of Appeals stating that they ~derstand that the Board of Health now requires 20,000 sq. ft. minimom lot sizes in subdivisions, It is also their omderstanding that the Pls~n%ing Board and board of Health regard property coming -~nder the subdivision reg~2ations as being any property which ~ divided into five or more lots. Actually if these assomptions are correct the Board of Appeals will continue to fm~ction on property which are divided into four or fewer lots. A reply to their letter ws.s requested. The Ptarming Board replied that it is the feeling of the Platooning Board that the dividing point for lots to be hsndled as a subdivision should be between fo~3m and five. The Planning Board suggested that the Board of Appeals handle cases of access involving four ~ less lots and. the Plar_ning Board hsmdle cases i~volv~ug five or more lots where access is concerned. The aDplication of Ralph Glover and Una Belle Glover for an Open Development Area was received. Location of the property, NorthSea Drive, ~outhold, New ~'ork. After study- ~g the application it was the feeling of the Planning Board that the aforementioned ruling of access involving four or less lots being referred to the Board of Appeals would apply in this case. The Planning Board received the application of George G. Bailey~ Broadwaters Drive, Nassau Point: for a char.~ge of zone from "A'~ Residential and Agricultural District to "B" Business Districton certain real property situated at south side Main Road~ Cutch~gue~ New York~ approximately U. O0 ft. west of Bay Avende .. with a ~rontage ol 66 feet and depth of !65 bounded easterly and s~outherly by l~ud of ~illiam Midgiey~ westerly by Walter Silleck and northerly by Main Road~. but more particularly bounded and described as follows: (Deed description) Begir~m~_ug at a point marking the northwesterly Corner of the tract hereby conveyed~ and mthe northeasterly corner of the lands now or formerly of Oscar Silleck~ on the southerly margin of the Main high%~ay running through Peconic~ thence running Southerly by ~and with said lands now or ~orm fly of Oscar Silleck ten (10) rods to land now or formerly of Daniel Southold To~-Plar,~ihg Board -~- February l~ 1960 V. On motion of ~, Unkelbach, seconded by N~, Moisa and carried it was RES0L~ that the Planning Board recommend to the To%,m Board that the change of zone be made from "A" Residential and Agric~3~t~al District to "B" Business District on the aforementioned described property. The Pta~uiug Board is thoroughly familiar %~th this property~ and wish to point out that this change will fill out a ~B" Business District~ because this property has been a jog in_the existing district. The request seems completely reasonable to the Planning Board. Vote of the Board: Ayes:- Mm. ~ickha~ M~. Moisa~ Mr. Grebe~ M~. Young~ and Y~. Unkelbach. The R!ar~ing Board discussed the matter of amendments to the $outhold To%~Building Zone 0rdina~ce as proposed by the Board of Appeals on I~y l~ 19~9. On motion of Mr.. Young~ seconded by h~, L~kelback and carried~ it was RESOLVED~ that the Planning Board recommend to the 'Town Board the first three amendments proposed in the letter of the Southold Town Board of Appeals on May l~ 19~9: t. Sign sizes: Article iii - subsection,8 to read '~1 foot by 2 feet.'~ subsection 9 to read ~$ feet by 6 feet.~ subsection l0 to read ~3 feet by $ feet.~ _~T~ese clarifications~wo-~ld elimimat~ the possibility of odd shaped elongate~ aGver~s~ng s~gn , ~outhold Town Planning Board '6- February l, 1960 2. ~Under Section 360 (2) of Article ili A~ the ~N'~ District allows a ~0 sq. ft~ double face sign without~any restrictions. ~e believe an additional sentence should be added to (2) as follows: ~Height of signs in the ~M" District~ advertising -the business conducted on the premises~ should not exceed 3~ feet ~ud the bottom edge of the sign shall not be less than four feet from the ground level.'~ It is believed that most motel signs are electrical in nature and it has been reco~mmended that a four foot clear- ance be r~.quired~ Any ~uecessary hardship co~2d be corrected byvari~uceo We do not suggest altering the superficial area of the signs~ The purpose is to cohfine the maximum dimensions to the sign area intended ~aen the present amendments were adopted. 3-. It is recommended that the following addition be made to the Ordinance under Article ii! A~ Section 350, to read: ~'l. ao Two family dwellLugs." This oversight was called ~o our attention by the Town Attorney. A further amendment on motion of Mr. Grebe, seconded by Mro Moisa and carried was recommended to the To~m Board by the Planning Boa_~o The Planning Board is m~ recemot ox a l~tter from Frank Ai~an~ Jr.~ Chief Eng~ueer~ ~ong Island Rail Road concurring in the Planning Board's proposal and stating that as the Ordinance now reads such a z~ne would place a restriction on future industrial development in which the railroad would naturally be interested. Artid!e V~ Section ~03 to be altered as follows: ,Section ~03--~C" FEONT YARD--In the "C" Industrial ~District~ the required front yard shall be at least thirty (30) feet, provided further that where property ~ bounded on any side by a private right-of-way: other than a railroad right-of-way, there shall be a setback along the entire length of such private right-of-way ~f at least l~ feet.~' Vote of the Board: Ayes:- M~. Wickham~ ~. Moisa, Mr. Grebe, Mr. You~, and Mr. Unkelbach. ~outhold Town Planning Board ~-7- February l~ 1960 The Planning Board discussed with the To~n Attorney the matter of liability insurance. ~. Tasker advised that certain employees in the To%m_ are covered, however the Plan- ning Board, Board of Appeals, etc.~ are not. He stated that the policies of the To%a~ are being gone over and steps will be taken to include the Pl~nin-g Board and Board of Appeals. The aonual meeting of the Association of Towns to be held in New York City February 8~ 9~ and 10th was brought up for discussion. On motion of Mr. Moisa~ seconded by Unkelbach and carried~ it -was RESOL~ that Mrs. Judith T. Boksabe designated to attend the meetings as a representative of the Southold to~n Planning Board. Mr. Wick_ham advised the Planning Board that on January 26~ 1960 he had appeared before the Southold Town Board to discuss the seriousness of Golden Nematode on Eastern Long Island and requested that some financial assistance by the Town of $outhold toward eradication of Golden Nematode wo-~ld be of great help in this program. He went on to explain to the Planning Board the affect of Golden Nematode upon the crops~ how it spreads~ aud what has beau done at the present tLme toward seeking legislation for its eradication and control. On motion of ~. Young, seconded by Mm. UrZ~elbach and carried~ it was RESOL'~ that a letter be forwarded ~o the Southold Town Board recommending that the Town Board of the Town of $outhold take immediate steps to make available funds for the eradication and control of the Golden Nematode. The Planning Board believes that the positive approach to th~ problem offers more hope~ but also at the present time we appear to have an unique opportunity of cooperating with state and federal agencies in a new plan~ namely ~reatment by fumigation of land not now infested~ but "operationally exposed." It was further RESOLVED upon motion, of Mm. Moisa~ seconded by Mr. Grebe ~ud carried~ that a le~er be forwarded ~to the Southampton Town Planning Board outlLuing the Southold Town Planning Board's recOmmenda~on~to the Town Board ~ud the importance or-prompt action in this matter and suggesting that the SouthamptonBoar~ consider this problem and if they see fit recommen~ to their Town Board cooperative aetion~ Vote of the Board: Ayes:- Mr. %$ickham~ Nr. Grathwohl at New 8uffolk~ New York by Otto W. V~u Tuyl & Son dated Jttly 25, 1957. After considerable discussion and considerat±on~ on motion of Ms. Moisa~ seconded by ~. Youug~ and carried~ it was RESOLVED that the Pl~ning Board gr~ut tentative permission to Mr. George F.
