The owners are in the process of acquiring contracts to be presented to ~e Town Boar~ so-that a bond can be approved~ Chairman Wickham suggested that this hearing be recessed until the other members Of the Board are present. CLARK: I am.not sure that I wish to speak against it~ I am just interested as a property owner in the vicinity. Just what subdivision is involved here? THE CHAIRMAN: "Laurel Country Estate's":.~ owned by Emma Enterprises~ Inc.~, located at Peconic Bay Blvd,~ Laurel. RICHARD LARK~,i ESQ-~': This subdivision is located a little ~orth of Peconic Bay Blvd. The owner to date, Leonard C. Emma~ purchased it as one of three parcels from C~%'T~ Young. LeonardC. Emma is under contract to sell to Emma Enterprises~ Inc. They are only taking the parcel befOre you on this subdi~ision~ as shown on this map. The corporation will acquire no beach rightS. The parcel is quite small and narrow and there would be no purpose to add the beach area to the park and playground. Thereforethey will not deed out any beach .rights with the lots. DONAV~H~. Up--dated letter of January 5~ 1970 from the Village of Greenport agreeing to supply water to this subdivision ~original letter dated December ll~ 1968)and letter of August 7~a 1968 from the Supt. off Highways disapproving of Wild Cherry,Lane as a dead en~ which has since been resolved,, were conta~ed in. files The Chairman read the Planning BSar~s letter of February 4a 1970 in whichthey forwarded copies of this subdivision map to the Dept. of .Public Works for their comments. Reply was received from Wm. S. Mr. Van Tuyl read letter of March 16~ 1970 received by him from the Health Deptm~ inwhiCh they indicated 1that they disapprove of th~s subdivision a~dthey are setting up an appeal to ,be heard by Mr. And~eoli~ Southold Town Planning Board -10- March 24~ 1970 HOWARD TERR~, BUILDING INSPECTOR: The bond has been received by the Town Board, but they have taken no action on it yet. On motion by Mr. Moisa, seconded by Mr. Wickham~ it was RESOLVED that the Southotd Town Planning Board recess this hearing for final approval of the subdivision "Shorecrest,'~ owned by Valentine Ruch. located at south side of CR27~ Middle Road~. Greenport~ N~'¥~'~ until such time as it is reviewed by-the County Board of Health and all necessary information is received. An up-dated letter from the Superintendent of Highways .~ approving the road lay-outa must also be received. Vote of the Board: Ayes:-Messrs: Wickham~ Moisa~ Grebe.. Coyle, Fr~. Harold Reese appeared before the Planning Board to inquire the time limit on the preliminary approval which the Board granted to "Harbor Lights~ Sec. IV" on June 17~ 1968. The Board informed him that the preliminary ~pproval was granted for a period of-6 months from date of such approval. Mr. Reese said that he spoke with Mr. Villa of the Health Dept.~ who indicated to him that it would be automatically denied by them at this time. Mr. Villa suggested that he b~ing it before this Board for recommendations~ then the review board will take it from there. The Chairman informed Mr. Reese that the Planning Board will send'their recommendations to the Health Dept, if he will present us with a final map and letter from the Superintendent of Highways~ TPIE CHAIRMAN: I will now rea~ the legal notice of hearing concerning the amendments to the Rules and Regulations of the Subdivision of Land in the Town of Southold: NOTICE IS ~R~B¥ GIVEN that the Planning Board of the Town of Southold will hold a public hearing at the Sou~hold TownClerk~s Office. Main Street~ Southold~ New York~ on the 24th day of Marchm 1970~ at 8:30 o~clock in the evening of said day in the matter of the amendments tot he Rules and Regulations gover~ the Subdivision of Land in the Town of Southold,. said amendments being as follows: 1. By amending ~rticle IIIa Section 4~ Subsection A The subdivider shall~ w~thin one year after the Conditional Approval of the Preliminary Layout~ file with the Town Clerk an application ~in duplicate) for approval of all or Part of the proposed subdivision, using the approved appliccation blank. Thus~ the subdivider may develop the subdivision in Southold Town Planting Board --11 .... March 24.~ 1970 progressive stages instead of in its entirety. Butno subdivision o~ portion thereof shall be considered unless it has frontage on a public street; abuts an existing street on the~ToW~s Official MaP; or an aPProved street for which a bond has been filedunder ParagraPh Es below. A Highway Inspection fee of ~% of bond estimate as pre~ pared by the Town Engineer for street and improvements proposed in the subdivision shall be paid prior to final plat approval. Failure to submit all or a portion of the Subdivision Plat within six months shall automatically cancel the Preliminary Layout Conditional Approval~ unless a request for an extensionof time is granted by the Planning Board. Such extension shall be granted only if the proposed subdivision fully conforms to the zoning regulations in effect at the time such extension ks applied for. The only change I see is STANLEY W~IMEY: I have a question. in the fee and the wording. As I see its it was 2%a now it is being changed to 4%. Why the raise? THE CHAIRMAN:- These fees~ as area actually do not cover costs~, even for the publication ofthe legal notice. S~Y WAIMEY: Will this cover it? THE CHAIRMAN: I hope so. On motion by Mr. Coyle~. seconded by Mr. Grebe~ it was RESOLVED-that the Southold Tow~ Planning Board approve the amending of Article III. Section IV~i Subsection A of the Rules and Regulations governing the SubdiVision of Land in the ToWn of Southold~ as described in the preceding legal notice. Moisa,. it was RESOLVEDthat the Southold Town Planning Board grant final approval to the minor subdivision of Philip Druhl.~ lo~ated at West & Lake Drive, Southold~ N.Yi~ Chairman signed the final maps. Letter of transmittal and copy of performance bond in the amount of $68,000. for SUnset Knolls~ Sec, II~ to be sent'to the Town Board requesting a notification of acceptance of bond~ so that the final maps can be signed. Notice of public hearing was received from theTown of Southampton advising us that a public hearingwill be held 'to amendtheir Zoning Ordinance in reference to. signs.
