Mr. Olsen presented the Board with a copy of the minutes of the Planning Board meeting of May 12~ 1969. Fir. Weglicki and Mr. Jack Driscoll-~he real estate broker) appeared at this meeting and requested permission to sell Lot ~ 28. The Board granted permission to sell this lot (which is on an existing highway) subject to the subdivider filing an application for Sec. I of this subdivision and paying the required fee for the filing of said subdivision. This subdivision has been granted preliminary approval by the Planning Board~ but no approval has been received from the Board of Health. Mr. Olsen stated that the Board of Health may disapprove of the present-lay-out and a new map will have to be drawn up.~ so he suggested that this lot could just be left the map. The filing fee for a subdivision consists of'S% of the bond estimate~ since this subdivision has not been approved by the Board of Health~ a bond estimate cannot be done. Therefore the Chairman suggested tha~the condition previously set on the approvals, which was that the filing fee be paida be waivered. On motion byMr. Raynor~ seconded by Mr. Moisa~ it was RESOLVED Martin Weglicki be granted permission to remove LOt ~ 28 from his proposed subdivision map of property located at north side of Peconic Bay Blvd.. Laurel~ New York. The condition previously set~ being that the applicant pay 'the subdivision filing fee~ is here- by waivered due to the fact that the Board of-Health has not yet approved the subdivision and no bond estimate can be calculated. Coyleo Mr. William iSchriever of Orient and Mr. George Penn~ Jr. of Penny'Lumber Co. ~appeared before the Board in re!ference tO Greenport Homes~ Inc. This property is scheduled for auction sometime late in May. Fir. Wm. Schriever~ a prospective biddera appe~redbefore the Board to inquire what possible plans the BoardWouldconsider for the removal Of the present buildings and c0~strUction of new home sites. Mr. Schriever ieltthat he must have some idea of what the Boar~ ~ould approve of~ inorder to sub. it asuitable bid. The present construction consists of 28 buildings W~th 50 living units on a tract'of 7 acres. Mr, Schriever informed us that if he is ableto purchase Greenport Homes~~ Inc, he wQUid alsO purchase part of the Cassidy property~ adjoining it on th~west~ making a total area of about 11 acres. He estimat~dhis cost of purchase at about $10~000. per acre~ and stated that in'order to make the plan work~ he would, have to divide it into 50 ~ acre lots~ to be sold at $~a000. eac~ on which Penny Lumber Co. proposed to construct homes at a cost of about $15~000. Mr. Penny stated that in order for the prospective home builders to receive a low '" Southold Town Plann~' ~ Board -$- April 21~ 1970 interest rate from the Federal Farm & Home Program~ the to~l price of the lot and house must be under $21~000. ~ir Schrieve~ presented the Board with a proposed plan for the lay-out of~the proposed sub- division. The total area of land would be 480~000sq. ft.~ 100~000 sq. ft. wouid be used for~ roads, and 15a000sq. 'ft. for park area, the remaining 380~000sq. ft. would be the total tot area. Theplan showed 50ftj roads., With a total of 380i000s~'. ft. of lot area, each of the fifty (50) lots would contain 7~-3G0sq, ft, of ar~, The Board was of the opinion that 50 lots with 7,300sq, ft. of area each would be too great a density, The Chairman suggested .that 40 lots with 12~000sq. ft. of area each might possibly be acceptable to the Planning Board. Mr* schriever informed the BOard that he had confered with Mr. Koppelman on this plan and he agreed with it., he also spoke withMr. Villa of the Health Dept~ whose position was that as long as there is public water and sewerage availablea they will go alOng with any lot size that the Town will approve of. Mr. SChriever stated that he is trying to offer an ~ternative to rental. There are several other prospective bidders proposing rental. The buildings as are, now pay under $5,000~ in taxes. He estimated that theltaxes would double 5 or 6 timesl~ if his proposition is carried out. The Board agreed that this would be a much better land use than the existing~ but again stated that the density'which he proposed was too great. The Chairman informed Mr. Schriever that the Planning Board will have to confer with the Town Attorney. s' the Board of Health~ the Planning Commission~ and the state Dept. of Transportation. The Chairman asked Mr. schriever to appear at the next meeting® by which -time they will try to have an answer for him. Mr. Jack Driscoll and Mr. Rene Gend~on presented the Planning Board with a preliminary sketch for proposed "Senior Citizens Rental Apart~nts"~ property located on Factory Avenue~ about 200~ from Sound Avenue~ Mattituc~ New York. Total area is about 7 ~cr~s~ on which the developer wants to put 100 apartments. He intends ~o' have his own sewerage disposal plant and water system. The property is pres~ zoned "A"~ and it is proposed to be re-zoned for industrial use in the p~oposed'Master Plan. The Chairman informed himthat the Planning Board would not'recommend any such density as 100 units on 7 acres of land. The Chairman stated that this will ~require a change of zone, which will have to be submitted to the Town Board. ~o Dris~oll asked what objection the Town would have to such a project as this. The Chairman stated that there is a water problem ~ight in the village of Mattituck and he is proposing to put one hundred living units right in where ~the water pr.oblem is, The Chairma~~ stated there wouldbe no guarantee to the Town Board that he would make a senior citizens development out of it. If a change of zone were granted permitting him to have an apartment 'complex.~ no condition could be set that would restrict the occupancy to seniOr 'citizens. '' 'Southold Town Plannings. Board -4- ~'~pril 21~ 1970 The Town could not bond him for anything that he may say that he will do. The Chairman informed him~that as soon ashe submits the change of zone to the Town Board~. it will be forwarded tO the Planning Board for their recommendation, The Chairman once again said that 14 units per acre was too great a ..density, Mr, Driscoll stated~that he could drop~it tO 12 units~ but n© less~ he statedhis opinion that this density would be better~ in regard to water~ ~than having 100 families on 1 acre lotS, The Chairman said that this was not true because on 1 acre lots one family would only be using ½ of the water~ the rest of it is available for flus~in~ action~ which means that the water supply would be safe for at least 100 years, The Chairman informed them that their first step is to petition the Town Board for a change of zone. Mr, Driscoll inquired what zoning would be in~' their favor to petition the Town Board for a proposition such as this. The Chairman stated that at the present time B-2 would be the most favorablea but said that there is no assurance that the Town Board will not change the density in this zone in the near future. Mr. John J, Jones presented the Planning Board with a preliminary site plan for proposed Cutchogue Shopping Cen~er to be located on north side of Eain Ro~d! (immediately east of Sterling Nurslery)~ Cu~ ~ew York, The t~tal land area is 236~288sq, ft, (5o2acres)~ building area is 44~364sq. ft, The plan showed 3-61 parking stalls (Town requirement, being 202), The Board questioned ,the loading area on the east. Side of the building as to its efficiency, Mr, Joseph Martirano~ Real!~State Manager for Hills Supermarkets~ explained the dock method of ~oa~in9 to be used~ which 'the Board felt was efficient, The property is ~resently zoned "B" Business~ so no change of zone will be required, Fir. Jones sta~ed that they own half of the of-way (SterlingS'S) adjoining the property on ~the west and ~orth, and would be willing to pave the entire surface if this ~ould be satisfactory with the Sterlings, The architecture of the buildings w~ll ,be colonial, The proposed plan showed plantings~and landscape. The principal't~nant Eill be Hills Supermarket, there will be several smaller sateli~e stores~ and a movie 'theatre' 'The Chairman .suggested that there may be~a problem in regard to drainage~ Mr~ Jones ,stated that this will be ino problem as the drainage W~ll be ail built in, Artie Melusino stated that the entire area will be sel~f drained according to the Town of Southold specifications~ and that their engineer will'work in conjunction with the Town engineer, Mr, Jones requested-the Planning Board to grant preliminary approval of the site plan as submitted. The Chairman informed ~r. Jones that a decision will possibly be reached later in the evening by the Board, '~ ' ' Southold Town Plan~-~g Board '-5-- -- April 21~ 1970 Eugene Francolini~. Attorney and Kurt Hambach~: Vice President of the South Fork Development Corp. appeared before the Planning Board in reference to Corey Creek Estates~ subdivision located at south side of Bayview Road,. Southotd~.. New york,' F~. Francolini informed the Board that the canal was dredged subsequent to the filing of the subdivision map. The Chairman told them .that they have officially filed a subdivision map and then altered it.~ a correction will have to be made with the County Clerk. The Chairman voiced his opinion that the development of 'the waterfront in the Town of Southold is solely as important as the develppment of the road frontage. Mr. Francolini Stated that eight i(8) of the~ 10ts in the subdivision have already been conveyed, Previously there was some discretion with the Supt. of Highways in reference to the turn in Corey' Creek Lane on Lot ~ 25.~ Fir. Francolini advised the. Board .that an arc will be made on the turn and deeded to the Town. Howard Terry informed them that the bond will expire on June 22~ 1970 and must be zenewedl Mr. Francolini requested a one year extension of 'the bond to complete the roads and other improvements. This extension shall be granted subject to the developer presenting the Planning Board with a copy of the renewed bond coverage. The Chairman once again informed Mr. Francolini ~ and Mr. Hambach that a corrected map will have to be filed with the County Clerk. On motion byMr. Moisa~ seconded byMr. Raynor~. it was RESOLVED that the Southold Town Planning Board grant a one year extension of time.to complete the roads and other improvements in the subdivision "Corey Creek Estates~" located at south Side of Bayview Road~ Southold, New York~ subjectt0 the developer presenting the Board with a copy of the ~enewed bond coverage from the insuranc~ company. Vote of the Board: Ayes:- Messrs: Wickham~, Moisa~ Raynor~ Coyle. WilliamEssex~ Attorney appeared~before the Planning Board on behalf of Fishers Island Development Corp.~. he presented the Board with a map of the Fort H~-Gj Wright property located on the north- westerly end of ~ishers ISland. The approximate acreage of the property is from 8-10 acres. There are now 6 deterioated buildings on the property at present~ The Corporation wishes to sell the property off in sections 'to persons interested in restoring the area. ~tr. Essex'requested the Board to grant the Fishers Island Development Corp. an open area development on the property as shown within the red lines on the map as submitted. The Chairman reviewed the fact that the Town has not granted any open area developments in the lpast 9 years~ he suggested that they file for a minor subdivision of five (5)lots. Essex upon his request. The Chairman informed him that once this is approved as a minor sup division, it cannot be divided again. Mr. Essex to confer with the Fishers Island Development Corp. in regard to filing minorsubdivision application. Richard Lark, Esq. presented the Board with a copy of the conveyance between Leonard Emma and Emma Enterprises, Inc.~ as requested ~ for Laurel Country Estates. This subdivision was granted final approval at the last meeting subjectto receipt of copy of the conveyance. Fir, Lark stated that the description of the property given in the deed is the exact same as Schedule "A" of the application. Copy of covenants and'restrictions to be placed on lots yet to be received. Richard Larka Esq, presented the Board ~ith a copy of the deed in which Birch Properties~ Inc~ conveyed~ to the Birch Hills Property~wners AssoCiation= I~c., the roads and park and play- ground area in'the subdivision "Birch Hill Estates". The roads will be'private and will not.be dedicated~to the Town. Letter of approval was received~from the Supt, of HighWays's~ating that he has inspected.the roads and reComme~S that they ~be t~rned .over to the Birch Hills Property Owners Association~ Inc. Mr. Lark.requeSted the Planning Board to send a recommendation to the Town Board recommending that the bond be released in his care. On motion by Mr. Coyle~ seconded by blt. MOisa~ it was RESOLVED thatthe Southold ToWn Planning Board recommend to the SoutholdTOwn Board'the release of the bond for-the, roads in the subdivision "Birch Hill Estates." Richard Lark~ Esq. presented the Planning Board with a revised preliminary map for proposed minor subdivision of Richard Babcock, property lo=ated at west side of Calves Neck ~ '~outhold Town Planning~oard -7- ~'- April 21~ 1970 Road~ Southold~ N%-~Y~ There is public water in the entire propoMed~ minor-sut)division°~'The map showed4 Tots. all containing consider- ably o~er the minimum square footage requirement. The map shOwed a parcel of land of 5~2.00sq. ft. of area on the-~east.side of Calves Neck Road~ opposite Lot $. la which was .labeled 1A~ The Board did not favor 'this,.they questioned whether or not there was a property owners association. F~r. Lark said that there was no property owners asso¢iationa and the chances of dedicating it to the Town.were slight. The Board agreed to tea=lng 1 A as part of L~tl$ 1 subject to the conditions that itmay never be built upon~, and it must be legally conveyed, as part of Lot $ 1. Mr~ Lark~to prepare formal application for minor subdivision to be presented at next meeting. In reference to Mattituck Hills and Mattituck Ridge~ Fir. Lark informed the Board that everything has been submitted to'the Board of Health~. but no answer has been received yet. Correspondence was received from the New York State Department of Transportation in answer to our inquiry if theyhave any plans to- widen the North Road ~(Route 25) easterly of the Greenport Traffic Circ~, The state informed us .that they have no plans,to widen the road in this area. However~ in regard to the proposed subdivision of Gus Shada the developer Will have to aPPlY for a State Highway' Permit for any work performed within the State Highway boundary. The Board informedMr. Lark that the first step forthis proposed development wii1 be to file application for a change of zone from "A# to "M' & "B-2"~ then file application for a subdivision. The Southold Town Planning Board received from the Southold Town Board the original'amended petition of Case Bros.~ Cutchogue~ NewyOrka relative'to a changa of zone from "A" Residential and Agricult~rai ~istrict to "M-l" Multiple Residence District on certain real property together with the instructions to prepare an offiCial report defining the conditions contained therein.. Coyle informed the Board that he had spoken with several members of the Sterling Cemetery Association in reference to the propo'sed Change of zonea and they are to send anotherlettem~ which we havenot yet received. On motion by Mr. Coyle~ seconded hymn. Moisa, it was RESOLVEDthat the Southold Tow~ Planning Board table recommendation on the above p~oposed change of zone for further deliberation of'the-Boa~ due~to the fact that the Board has not yet received the letter from the Sterling Cemetery Association. In'reference to proposed subdivision ofAndrew Dzenkowski~ located at East Mariona N~Y.~, it was reported that negoiations are being carried on with Edna Brown to purchase her 50 ft. right-of- way adjoining the proposed subdivision on the north. ' ~ Southold Town Plan7 -'ng-Board -10- '~ April 21.~r 1970 Letter was received fr:omthe Riverhead Town Planning Board in reference to the proposed fuel desulph~rization plant. L~pon taking into consideration our views'and c0ncernfor %he future~ they recommended denial of the petition~, and the petition was withdrawn by the applicant. Letter was received from George G. Semerjian expressing his personal thanks for the manner in which he was treated in connection with his recent zoning application. The Chairman reported that he and Henry Raynor met with a committee of the Southold-Peconic Civic Association in reference to the proposed Agriculture Study. They presented the committee with the preliminary questionaire to be used by Dr~ Sullivan of South- ampton College. The Town Board has acted favorably on ~the agriculture study and dY resulution they authorized Dr~ Sullivan%o proceed. The Town Board suggested that Justice Demarest sit in on the final draft of the questionaire. The Chairman.a Dr. Sullivan a and Justice Demarest met and drew up the final draft'of the questionaire. Dr. Sullivan expects to begin work on the study early in.May,' Dr. Sullivan suggested thatwe get in touch with the newspapers and'radio Stations to inform the farmers of the study being done. The Southold~Peconic CivicAssociation advised us that they would like to be inCluded in the conference after, the facts have been collected to assist in the interpretation of the study. The Chairman adVised the Board that no date will be set for another public information meeting on the Master Plan until Dr. Sullivan completes the agriculture study? Noticewas receivedfrom the New York State Planning Federation adVising l~re-regis~tration for the annual meeting to be held on October 11, 12~ 13~ & 14,1 1970, at Spring Glen~ New. York. Request for progress report for the roads inlHarbor Lights~ Section I,~ was~received from the Aetna bonding 'company. The ~ond has expired,~and the roads are not ready to be taken over. The roads are under 1956 specifications. The Chairman is tocontact the Supt. of Highways for a report. ' ~ Southold Town Plan~%g Board -11-- - April 21~ 1970 Request for information on the Master Plan was receivedfrom Southampton'Col~ege. Saidrequest placed in file. Notice was received from PLI News (Practicing Law Institute) in reference to interstate land sales.~ Howard Terry reported on his inquiry to Easthampton and Southampton Towns in reference to steps they have 'taken for "scenic easements". They have not actually entered into any contract agreements. The Chairman reported that he had spoken withFlro Newman of the County Planning Commission~ who thinks that Brookhaven Town may have contracts, Mr~ Newman is going to try to get a copy of the contracts for us. The Town Board isfavorable'towards co~tracts for "scenic easements" and feels that ~e should move ahead on this. The Board discussed again the proposed Cutchogue Shopping C~nter~ On motion by Mr. Coyle~ seconded by Mr. Moisaa it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the site plan for the proposed. Cutchogue~. shopping Center= tobe located at north side ofMain Road~ Cutchogue~- New York.
