MINUTES
SOUTHOLD TOWN PLANNING 'BOARD
June 22, 1970
A regular meeting of the Southold Town Planning Board was
held at 7:30 P2M~,. Mondays june 22, 1970~ at the Town Office,
Main Road~ Southold~ New York.
There were present: Messrs: John Wic~ham,. Chairman; Henry
Moisa~ Vice Chairman; Henry Rayn.r~ Frank coyle~ Alfred Grebe,
Also present: Howard Terry, BUilding Inspector
Mr. Alfred E. Dart appeared before 'the Planning ~Board to
request a minor subdivision of 2 lOts on his property located at
sout/~sideof ~ayview Road, S6uthold, New york. The Board
recalled that'he~had come before themseveral years ago
asked for residence pl~ts f~r his d_aughter .and 2 other ehildreno
The 2 proposed lots contained over 40,000 sq. ft, of area each
and are located at the southeasterly e~d of his property
fronting on Willow Pond Lane~ the proposed 50 ft. right-of-way
will be extended for access to the interiOr lot. The entire

tract contains 32,1~ acres. The Chairman statedthat the Planning
Board is reluctant to approve a minor subdivision onthis because
it is such a large parcel-of land which might someday be developed
into a subdivision. The Chairman said that there will be two
obstacles involved in this: First approval ofacceSs must be
secured from the Board of Appeals, secondly~ the Planning Board
must decide on the location of the roads to plan rom the future
development of this as a major subdivision. The Chairman quest-
ioned the authority of the Planning Board to approve a minor
subdivision where the person owns the adjacent property, can an
exception be ~ade under circumstances ~here the lots in 'the minor
subdivision Will be deeded to the members of his immediate family?
The Board wants to hold this up until such time as they can get a
legal opinion on it, this must be cleared with the Town Attorney~
to make sure that it would be legal. ~
Mr, John D. Stern appeared before the Planning Board to
request a minor subdivision of 3 lots on his property located
at north side of Main Road, Orient~ New York? The map shOWed
3 proposed lots and~a large parcel of land,i'~ total of'about
9+ acres. Lot $ 1 contained 35,500 sq. ft. of area,
2 & 3 contained about an acre each~ leaving a parcel 'of about
6 acres unmarked. The Chairman stated~that when ever there
are 2 pieces of-property close to one another it should be
filed as a major subdivision. Mr. Stern explained ~that the
remaining unmarked property contained his residence and
grounds which would never be divided. The Chairman suggested
that he make a minor subdivision of 5 lots because he cannot
leave such a large area unmarked when filing for a minor
~subdivision. Mr. Stern was given minor subdivision applications.
Map to be revised to contain 5 lots.
'Representatives from the League, of Women Voters and other
speCtators~inc~uired-about the proposed change'of zone ,applications

25~ Greenpor~ 'The Board informed them that they have no juris-
diction over a change of zone, they only make a recommendation
to the T~Wn Board. The Chairman briefly viewed 'the Board's
opinion on these proposed change of zones,

Lawrence Tuthill~ P.E~presented the Planning Board with a
revised estimated performance bond in the amount of $9~000. for
the completion of the roads and other improvements in 'the sub-
division "Downsview", located at south side of New Suffolk
Avenue, Cutchogue,~ New York.
On motion bY Mr. Grebe, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board recommend
to ~the Southold Town Board a revised performance bond in the
amount of $9~000. for the completion of the roads and other
improvements 'in ~the subdivision to be known as "Downsvie~"~
located at the southside of New Suffolk avenue~ Cutchogue,
New York.
It appears that the owner will have to terminate his
agreement with the original contractor and hire a new
contractor to complete the work and now wishes to file a
bond to cover the u~completed~work.
Vote of the Board: Ayes:- Messrs: Wickham~ Moisa~ Raynor,
Grebe~ Coyle.
After the regular meeting of the Planning Board~ a joint
meeting of the Planning Board and Board of Appeals~was held to
discuss the proposed amendments to the Zoning Ordinance. Several
changes were made and blanks filled in. A copy of the proposed
amendments with the Planning Board and Board of Appeals recommend-
ations to be sent to the ToWn.Board meeting on June 30th.
On motion by Mr. Moisa~ seconded by Mr, Raynor~ it was
RESOLVED that the minutes of the Southold Town Planning
Board~ datedlMay 27.~ 1970~ be approved as submitted.
