July 27, 1970
A regular meeting of the Southold Town Planning Board was
held at 7:30 Po'M.,. Monday, July 27, 1R70, at the Town Office,
Main Road, Southold~ New York.
There were present: Messrs: John Wickham~ Chairman; Henry
Raynor, Frank Coyle.
Absent: Alfred Grebe Cdue to unfavorable weather conditions)

Also present: Howard 'Terry, Building Inspector
Fir. CarEolt Schutz a/c Doris Moeller presented the Planning
Board with revised plan for proposed minor subdivision of her
property!0cated at .east side of Little Neck ROad, Cutchogue.
The map sho~ed 3 lots, Lot $ 1 contained 95,000sq" ft. of area,
lot ~ 2 contained 85~000sq" ft. of area, and lot ~ 3 Contained
8% acres and is designated onthe map as~ "not to be subdivided".
Almost half of the area in each of these lots is marsh, the
Chairman sketched in the hig~ water mark on each or'the lots.
On motion by Fzr. Wickham, seconded by Mr. Raynor~ it was

RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision of Doris Moeller~ property
located at east side of Little Neck Road, Cutchogue~ New York,
subject to ~the following cOnditiDns:
Applicant must file formal application.
2. Applicant must pay fee of $10.00 per lot.
3. Applicant must present the Planning Board with three (3)
copies of final map.
Vote of the Board: Ayes:- Messrs: Wickham~ Raynor~ Coyle.
Mr. Joseph A. Shipule presented the Planning Board with final
maps for his subdivision "Bayview Woods Estates", located at east
side of North Road to Bayview~ Southold, N.'Y. Mr. Shipule informed
the Board that the roads are just about completed. There is a minor
dispute with Chas. Abrahams~ Construction Inspec'tor~ in:reference
to water coming into this subdivision from another area. Fir. ghipule
is going to install 2 additional basins on the park and playground
area to clear this up. The drainage has been completed on North
Road to Bayview. This is one of the subdivisions which has been
held up by the County Board of Health since January lst~ their
approval was recently received~ so it is now ready for a f~nal
hearing.
On motion by Mr. Raynor, seconded by Mr. Coyle~ it was
RESOLVED that the Southold Town Planning Board set 7:30
Monday, August 10~ 1970, at the Town Office~ Main Road, Southold~
New York, as the time and place of hearing upon the approval of the
following plat:
1. Plat of property owned by Joseph A. Shipule & others~
entitled Bayview Woods EStates~ consisting of a parcel of land
of 13.612 acres~ situated at Southold~ In the Town of Southold,
Suffolk County, New Yorka and bounded and described as follo%.s:
PARCEL I -.BEGINNING at a point on the easterly line on the
North Road to Bayviewa 122.09 feet northerly along said
easterly line from Nortk Bayvliew Road; from said point of

Mr. Otto Van Tuyl amd Mr. Reese,$secretary presented the
Planning Board with preliminary plan for Harbor Eights,~ Section
V. The map showed 70 lots, numbered 109-178, conta:ining 20~.000
sq. ft. of area each. The Board informed them that.they could not
grant preliminar~ approval to any subdivision contain!ing lots of-
20,000 sq. ft.a which did not have provisions for Public water
and sewerage. The map was dated December 31~ 1969.by Van Tuyl
& Sons~ but wasnot presented to the Planningl Board until this
evening. Mr. ,van Tuyl explained that the map-was set up With
lots of ~0,000 sq. ft. of area~ but was done so that they could
easilybe changed to 40~000 sq. ft, o~ are~ if'necessarya with-
out altering the road l~y-out. Mr. Reese's secretary informed
us that Mr. Reese would like permission to cut the roads through.
The Board questioned the 2 access roads on North B~yview Road.
Sections 3 & 4 have one access road each on North Bayview Road.

The Board is of the. OpinionI that Section V should have only one
access road on North Bak-~iew Road. The map showed no .~provision
for park and playground area. The park area ~previouSly sat aside
is adequate for sections I~II~iII, & IV~ but will not cover section
V. The Chairman informed them that the Board would grant permission
to cut the roads ~through~ but would not grant preliminary approval
to the map because of the size of the lots, The Chairman labeled
the lots numbered 177~ & 178 as park and playground area. The Board
granted permission to cut Clipper Drive through from Lot $ 109
southerly to Lot $ 21~ and Schooner Drive from Lot $ 52 southerly
to Lot $ 30. The Board would not allow these roads to be cut
through to North Bayview Road because they do n6t approve of the
2 access roa~s on North Bayview Road. The road ~lay-out on the
southerly end may have to be changed to provide, for one access
road, centrally~ located, on North Bayview Road. This subdivision
map will have to be sent 'to the County Board of Health for their
approval or disapproval. Harbor Lights~ Section tV was granted
preliminary approval prior to January lst~ it is no~. pending
approval or disapproval by the County' Board of Health.
Alfred Dart presented the Planning Board with a revised
preliminary map for minor subdivision of his property located
at east side of Main Bayview Road, $outhold~ ~Y.~ Mr. Dart
originally requested to set off 2 lots for his~:children on the
north en~ of his property~ immediately west of Willow Pond
Lane. The Planning Board consulted the Town ~ttorney on the
legality of doing this. The Town .Attorney has?informed the
Board that this cannot be done, however for a
minor Subdivision may be submitted, us that
he would also like to set off 'the parCel which.~contains his
residence and buildings. The Board suggested that he apply
for minor subdivision of four (4) lots. Lot $~s 1 & 2 being
the 2 lots t0~ be' set off for his children~ loti$ 3 containing
his residence and accessory buildings, lot9 4~ the remainder
on which a stipulation must be ~placed stating
parcel may not be divided any further in the future,
for the purpose'of creating another minor subdivision.
On m~otion by Mr, Raynor,1 seconded by Mr. Wickham, it was
RESOLVED that t~e Southold Town Planning Board grant
final approval to the mi~or subdiVision of Alfred E. Dart,
located at east side of Main Bayview Road, $outhold~ N2'¥.~,
subject to ~the following conditions:
1. Applicant must file formal application.

The Planning Board was presented with the "Engineeming Report
of the Village of Greenport, Inc. in reference to the proposed
West Greenport Water Supply District", dated June 1970, by HolzmaCher,
McLendon~ & Murrell, Consulting Engineers, Melville, New:Yorko
The League of Women Voters presented the Board with a copy of
their recommendations concerning the proposed Wetlands Ordinance
rom the Town of Southoldo The Chairman stated that he has studied
these recommendations very closely and he feels that their points
are extremely well taken and well supported, and in almost every
particular, they have almost the same thinking as the Planning
Board in their recommendations. The Chairman informed them ~that
in.view of the fact that they so closely approximate our own
thinking on the subject, they can count on our support.
The New York State Office for Local Government is holding a
regional meeting for local officials~ at the Galaxie:, in Plainview,
NiY~, on August 13, 1970.
Notice was received from the New York Planning Federation
announcing that the annual planning and zoning institute will be
held at Homowack Lodge, Spring Glen, New ¥ork~ October 11-14:, 1970.
Letter was received from Richard J. Cron~ Esq. advising us
that the Village of Greenport has notified him that they wili not
set up a seperate water district in the Bayview area for "Leeward
Acres," Any extension of the water supply will be at the expense
of the subdivider.
Letter received from the New York Crop R~porting Service in
answer to our inquiry regarding the potato acreage in Southold Town.

They'informed us that there are 95 farmers in the Town of Southold
with 7,718 acres of potatoes ~lanted-this year.
At the next meeting of the Southold Town Planning Board to be
held on Mondays August 10, 1970~ at 8:30 P~M,', a preliminary, report
and evaluation of Drl Joseph Suilivan~s Agriculture Study~ill be
given. The following.persons have be~n notified robe present:

Notice received from the Tri-State Transporation 'Commission
announcing that John C. ~ohl has been elscted chairman for the
coming' year.
Received copies of letters sent to Raymond~Dean, Supt. of
Highways in reference to the' condition of the roads in Jackson's
Landing, Mattituck, N~'Y~' ~from' W.~H. Wertenberg and Daniel D. '~rgentierio
Notice received from the Suffolk County Sewer' Agency advising
us that Town~ Aaw 277--5 has been amended, as enacted by~ Chapter '886
of the' Laws of 1970.
Notice ~eceived from Aetna Insurance Company advising us that
the performance Dondfor Harbor Lights'Estates, Section Z has expired.
Letter tolbe sent to Mr. Reese advising him of this condition and
requesting h~m to take action to correct it.
Received copy' of letter sent to Race Point COrporation by
An~reoli~ P.'E. S~f~olk County Health Dept., .advising them
finds them unsatisfactory. They advised them that' the necessary
steps be taken in ~the immediate future to correct the existing
conditions. The Planning Board discussed '-their action of the

last meeting by which they approved the minor subdivision of Fishers
Island Development'. Corp., Subject 'to the condition that no raw sewerage
shaI1 enter into the area. They decided that this condition was adequate
in light of the Health Dept. findings.
The Planning Board was presented with revised map~ formal
application~ and_fee for minor subdivision of Jonathan D. Stern,
property located~at north side Main Road, Orient, New YOrk, The
map showed 5 lots as recommended by the Board at 'the last meeting.
On motion by Mr. Coyle~ seconded by Fir. Raynor~ it was
RESOLVED that the Southold Town planning Board grant final
approval to the minor subdivision ofJonathan D. Stern,. located
at north side Main Road, Orient, New York.

Letter received from the Superintendent of Highways stating
'that he approves of the road lay-out of the proposed subdivision
map 0f* Laurelwood Estates" as shown on map dated July 9, 1970o
Richard Lark, Esq. and Gus Shad appeared before the Planning
Board for an informal discussion on proposed change of zone application
of Gus Shad, property located N/S ~oute 25, Greenport, NoYj A lengthly
discussion was held on the zone district boundaries. The BOard made
several suggestions and recommendations as to the location of the
proposed zones. Further action was with held on the matter until
Mr. Shad finalizes the zone district boundaries.
On motion by Mr. Wickham, seconded by Mr. Raynor,~ it 'was
RESOLVED that the minutes of the Southold Town Planning Board
~ated July 13, 1970,. be approved as submitted.
