This correction was made upon request of Mrs. GlO, Cook~ The Chairman read the affidavits.attesting to its~publication in theLong Isl~n~ Traveler-Mattituck Watchman, an~ the Suffolk Weekly T/mes. The Chairman inspected the file and read letter from the Supt. of Highways approving the road lay-out~i bond estimate in the amount of $23,~0'00. by Lawrence Tuthill P.'E~ recommendation to.reduce bond Southold Town Plan~.~g Board -3- ~ August 10, 1970 to $5~.600 because majority of work was completed before a bond was issued~ and contract from CorraZzi~ri in the amount of $5a600-. to complete roads. A performance bond was never posted on %his sub- division because the owner completed most of the work and presented a passbook to the Supervisor for the remaining work to be completed ~in the amount of $5,600, The Chairman inspected final maps showing approval of the County Health Dept. and signature of Herbert Davids. THE CHAIRMAN: Is there anyone present who Wishes to be heard in opposition to this subdivision? (There was no response. ) THE CHAIRMAN: Hearing none, I will now open this hearing to anyone wishing to speak in favor of this subdivision. MR. JOSEPH A~ SHIPULE: I wish to speak in favor of this subdivision. THE CHAIRMAN: Mr, Shipulehas come before this Board many times and has met all of our requirements. Is there a letter of satisfaction from the Town Board in the file? Upon inspecting the file further~ no such letter from the Town Board was found. THE~CHAIRMAN: I am afraid 'that I will not be able to sign the finalc~aps until such time as we have a letter of satisfaction from 'the TownBoard. THE CHAIR/~%N: Is there anyone else present who wishes to speak in favor of this subdivision? (There was no response. ~HE CHAIR/~m~N: Hearing none, I will declare this hearing closed at this time, decision will be made later in the evening. Mr. Kurt Hambsch~ President of the South Fork Development Corporation appeared before the Planning Board in reference to "Corey Creek Estates"a located at south side of Bayview Road, Southotd~ NewYork~ Mr~ Hambsch presented the Board with recent correspondence which he received from the Suffolk County Clerk's Office stating that a correction or amendment cannot be made to this map. This map must be abandoned and a new map must be filed. Mr. Hambsch told the Board that he would be willing to back fill the canal and dredge it in the proper place to make the subdivision conform with the map as filed,, rather .than to file a new map. THE CHAIRMAN: I will declare this discussion closed at this time, 'the Board~willmake a recommendationlater in the 'evening. R.~G.' Terry, Esq. and Mrs. Valentine Ruch appeazed before the Planning Board in reference to the subdivision "Shorecrest"o Mr. Van Tuylpresented the Board with a copy of letter from the Health Dept. Stating~e Board of Review determination on this subdivision, being that 'the lot sizes be increased so that the subdi~isio~.- contains a .total of 18 lots. Mr. Van Tuyl presented a revised map showing 19lots sad requested that it be approved subject to ~ing accepted by the Health Dept. The Chairman informed them 'that the Board will require a letter of approval from the Health Dept. before granting final approval and signing maps. Southotd Town Plann.~g Board -6- August 10, 1970 Massimo Fo Yezzi,. owner and developer of Mattituck Shopping Center,~ to be located at northeast corner oft Main Road ~.(Route 25) and Factory Avenue,~ Mattituck,~ New York, appeared before the Planning Board to request approval for alteration of site plan. The Chairman was reluctant to grant approval to the alteration of this site plan withOUt the approval of the Building Inspector,. Howard Terry, who was unable ~to attend this meeting. On' motion by F~. Moisa~ seconded by bit. Coyle,~ it was RESOLVED that the Seuthold Town Planning Board grant approval to the site plan of Mattituck Shopping Center as altered by moving the Post Office on Factory Avenue and el/minating the side~road on Factory Avenue, subject to the approval of theBuilding Inspector. This motion includes authorization for the Chairman to sign map at such time when approval is receiVedfrom theBuilding Inspector. Vote ofthe Board: Ayes:- Messrs: Wickham~ Moisa~ Raynor, Coyle~ Grebe. William Esseks, Esq. appeared before the Planning Board to request'final approval of ~the minor subdivision of Fish, ers'Island DevelOPment Corp. ~. Esseks informed the Board-that~the Health Dept. has no .objections of the sale of these lots pr~ided that a time schedule for corrective action is agreedto in~eference to the sewerage disposal. The Health Dept. reported~that there are 35 houses in the area which are pumping 5 of which belong to Fishers Island DeVelo~ment~Corp. Flr~ said that anyone building commercially on the property will be required to have cesspools. The Chairman informed him'~that as stated at the last meeting this minor subdivision could be approved subject to the requirements of 'the Division~of Environmental Health Services, this statementmust be written on the finalmaps. bit, Esseks statedthat he realized that they must~conf~orm with the Health Dept. Standards and agreed~to this 'condition~ On motion by Mr. Grebe, secondedbyMr, Ra~n0r, RESOLVED ~that the Sou~old Town Planning Board grant final approval to'the minor subdivision of Fishers Island Development- Corp.,i subject tot he condition that the applicants conformto all the requirements of the Health Dept.' Vote of the Board: ~Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle~ Grebe. Southold Town Plann~ Board -7- August 10, 1970 Andrew Cyprus, President of Nick & Nicki Hair Stylists~ Inc. presented the planning Board with a preliminary plan for minor subdivision of property located at Summit Drive & Sound Beach Drive, Mattituck. The map showed 2 lots, each containing 20~000 sq. ft. of area. The Chairman in~ormedMr. Cyprus of the Health Dept. requirement of 40,000 sq. ft. of area per lot. The regular meeting was recessed at 'this time for special meeting scheduled at 8:30. Mr. Cyprus was asked to appear at the next regular meeting of the Planning Board. RiG~ Terry, Esq~ presented the Planning Board.with a preliminary map of proposed subdivision of Theodore Dowd~ ProPerty located at S/S Soundview Avenue and E/S Lighthouse Road, Southold~New:York, The map showed 8 lotsa all containing over 20~000 sq. ft. of area, but less .than 40,000 sq. fto The Chairman informed himthat the Board might accept a minor subdivision of 5 lots~ but would not accept 8 lots as presented° This matter also to be taken up at the next meeting. The Bo~d discussed again the proposed change of zone from "A" to "B" on property of Driscoll & Gendron, lo~ated at west side of Factory Avenuez Mattituck. The following recommendation was passed: On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold ToWn Planning Board does not recommend to the Southold Town Board the change of. zone from "~" Residential and Agricultural District ~to "B" Business District on'the above described property. It is the opinion of the Southold Town Planning Board that the proposed density per acre is 'too high. vote of the Board: Ayes:-- Messrs: Wickham~ Moisa~ Raynor, Coyle~ Grebe. On motion by Mr. Wickham, seconded by Mr. Moisa~ it was ~SOLVED that the minutes of the Southold Town Planning Board dated~ 27, 1970, be approved as submitted.
