There were present: Messrs: John Wickham, Chairman; Henry Moisa~ Vice-Chairman; Henry Raynor; Frank Coyle; Alfred Grebe. Also present: Howard Terry, BUilding Inspector Joseph Snellenburg,. Esq, appearedbefore the Planning Board in reference to proposed subdivision of Andrew Dzenkowski~ property located at east side of Rocky Point Road,i and north and south side of.SouthernBlvdo to Cedar Drive, East Marion. was pre~i~usly requesteda but not grante~becau that he negoiate with Edna Brown topurchase her' right-of-way adjoining ~he property on the north end. Mr* Snellenburg advised the Board that negoiations have been completed~ Mrs. Brown has agreed to sell the right-Of-way, but title has not been cleared yet. The Board inspected ' ' $outhold Town Plann~g Board -2- September 1,~ 1970 the map again. All lots on the north side of Southern'Blvd. contain 40,000 sq. ft. of area or over~ but the lots on the south side of Southern Blvd,. contain only 33,000 to 36,000 sq. ft. of area, and the 2 lots on the east side of Cedar Road contain only 33~000 sq. ft. of area each. The Vice Chairman suggested that we take no action on this subdivision until such time as an approval is received from the HealthDept. for these undersized lots~ M3c. Snellenburg stated that hehad spoke with the Health Dept. informally'andthat they told him that they would more or less have to allow these lots because of the shape of the property which makes it impossible to divide it differently. The Chairman suggested that the' Planning Boardcould send a letter of transmittal to 'the Health Dept. recommending approval on the basis of Southern Blvd~ being an existing Town Highway which makes it impossible to change the location of the road~ and on the basis of the fact that the application was submitted before January 1, 1970o The Chairman also suggested that the large lot on the northeast corner of Southern Blvd. and Rocky-Point Road, which contains Dzenkowski~S residence, be given a number to prevent him from subdividing it any further in 'the future. Decision reserved at this time, to be made later in the evening. Mrs. Constance Moore appeared before the Planning Board in referen'ce to the Samuel E. Darby Estate~ Nassau Point~ CUtch0gue. The property contains approximately 1.9 acres of land. The ~ily wishes to divide the estate into 3 parcels so that~ each can have a part of the estate. On the westerly'half of the property which fronts on the Bay, is a large 3 story house which Mrs. Moore ~ishes to acquire for herself, on the northeast end is a garage~With apart- ments above which one of the brothers will receive, the, southeast section will go to the other brother. The right-Of-way at,me entrance to the property is 25 feet lin width, butwidens O~t'~to 75 feet in the center of the property due to'a fairly of land contained in the center of the right-of-way. suggested eliminating this right-of-way at its present iDcati0n and replacing it with a 25fro right-of-way 'to be located furth r 'to 'the west so as to balance the area of 'the 3 lots more'cloSely. Mrs. Moore to have map revised by Van Tuyl as shown on this preliminary map dated Feb. t3~ 1970, revisedAugust 6, 1970 by Van Tuyl. Mr. & Mrs. Russell Broache appeared before the Planning Board in reference to Cove Beach Estates, property 1Oea~ted at East Marion. Mr. Otto Uhl had previously appeared at the Planning Board meeting held on July 13th~ at which time he requested approval of a major subdivision of 15 lotsK 5lots fronting on Li'I~ Sound and 10 .interior lots immediately to the south. The Board advised him that the lots fronting on the Sound must-have at least 135ft. frontage, and that the right-o:f-way should be at least 50 ft. wide andlabeled as "reserved for possible future dedication to the Town." At that time Mr. Uhl was to have map revised accordingly. Fir. Broache presented the Boardwith revised map showing only the 5 lots fronting on the Sound, the frontage has been increased to 135 ft. and the right-of-waywidened to 50 ft. and labeled as "reserved for possible future dedication to the Town." The Chairman advised themthat~theBoardwill not accept this map as presented because of the large parcels of land %o the south and east which are in the same ownership and not shown on the map as part of the subdivision. Mr. Ernest Wilsberg~.presented the Planning Board with preliminary map for proposed Lon to be located at south side of Orchard S~r~et~ Entire paree~contains 12.4acres of land. The preliminary map showed 8 lots~ all containing over ~0~000 sq. ft. of area. The southwesterly section of p=operty,~ about 4 acres~ was not contained within the subdivision. The Board advised hLm that since this is a major subdivision it could be divided f~to section one and two,~ the southeasterly parcel could be Section I, and the southwesterly parcel could be section II. On motion by Mr. Wickham, seconded by Mr. Grebe,. it was RESOLVED that the Southold Town Planning Board grant preliminary approval to Section I of the proposedsubdivision of Ernest & Har01d Wilsberg, property located at south side of. Southold Town Plann~g Board -4- ~ lSeptember 1~ 1970 Mr. Andrew Cyprus, President of Nick & Nicki Hair~ Stylists,~ appeared before the Planning Board to request final approval of his minor subdivision, property located at south side of Sound Beach Drive and north side of Summit Drive~ Lot $ 10 of Cap~t. Kidd Estates~ Mattituck. .The map showed 2 lots each containing at least 20,000 sq. -ft. of area. The map showed a 15 ft. right- of-way on the west side of Lot fronting on~ Summit' Drive. This right-of-way is to be used as access for the lot fronting on Sound Beach Drive. The Board was agreeable to accepting this minor subdivision on the basis of the fact that the p~operty has city water supplied by the Capt.' Kidd ~ater Co. which allows him to have the minimum of 20~000 sq. ft. of area per lot, and on the basis that~ the applicant owns no adjoining land~ or ~her land in the area. On motion by Mr. Coyle~ seconded by Mr. Grebe, it was RESOLVEDthat the Southold Town Planning Board grant final approval to the minor subdivision of Nick &-Nicki~Hair Stylists~ Inc. property located at south side of Sound Beach Drive~ and north side of Summit Drive~ Mattituck, New York. The Planning Board received from the Town Board the original petition of Dri-Gen Realty~ Corp.~ Inc.~ North Oakwood Drive.,~ Laurel,. The Board discussed this proposed change of zone at some length. Decision was reserved on the above proposed change of zone until later in the evening. The Planning Board received from the Town Board the original petition of Andrew Cassidy~ Albertson Lane, Greenport,. New York, relative to a change of zone from'"A" Residential and Agricultural District to!'M-l"iMultiple Residence Distric~ on certain real property, together with the instructions to prepare an official report defining 'the conditions contained therein. This property is situated at Greenport~ in the Town of Southold~ County of Suffolk and State of New York~ and more particularly bounded and described as follows: Bounded northerly by the Main Road running between Greenport and Southold; easterly' by land and buildings of Dri-~en Realty 'Corporation~ southerly by land of Long Island Railroad Company; westerly by'land and buildings of Fl~e~ Lumber Company; cOntai~in~ four and twenty-six hundreths acres (4.26A) and being~the same premises owned Dy Andrew Cassidy. After much discussion it was agreed that it woutdbe better to have a'"B-2" Business classification~ similar to the application on the adjoining premises of Driscoll ~Gendron on ~he easterly side. Letter to be sent to Mr. Cassidy suggesting ~that he amend his application to read "B-2" Business District. On motion by Mr. Raynor, seconded by Fir. Moisa, it was ~' Southold Town Planr~g Board -6,. ~y September 1, 1970 RESOLVED that the $outhold Town Planning Board table recommendation on the application of Dri~Gen Realty Corp., North Oakwood Road, Laurel~ New York, for proposed change of zone from "A" Residential and Agricultural District to "B-2" Business District on property located at south side Main Road~ Greenport, New York. It is the opinion of the Planning Board that this application should be considered in conjunction with the application on the adjoining premises of Andrew Cassidy. Recommendations will be made on both of these proposed change of zone application upon receiving the amended petition of Andrew Cassidy. Vote of the Board: Ayes:-Messrs: Wickham. Moisa,. Raynor~, Coyle, Grebe. Arnold Larsen appeared before 'the Planning Board in reference to proposed minor subdivision of Theodore Dowd~ property located at south side SoundView Ave. and east side of Lighthouse Road, Southold. The .map showed 8 lots~ 3 fronting on Soundview AVeo~ and5 ~fronting on Ligh~thoUseRoad,~ all containing over 20z000 sq. ft. of area, but less than 40,000 sq. ft. of area. The Board informed him.lthat~they will not accept.lOts containing less than 40~000sq. ft. of area. The Chairman suggested that it be cut down to 5 lots~ 2 on Soundview Ave. and 3 on Lighthouse Road. Mr. Larsen statedthat it would be impractical to cut the 3 lots on Soundview Ave. Down to 2 lots because it would create lots with excessive road frontage. The Chairman stated that the Board might possibly accept 6 lots~ depending on the lay-out~ Map to berevised by surveyor. Mrs. Rose Koroleski appeared before the PlanningBoard Un regard to the status of the improvements in "Rosewood Estates". Riverhead. CementBlock had installed the curbing!and, drainage during the spring ofl.969. Corazzini was to do %he r ads shortly thereafter~ but due toasetback in sChedUle )ads have not yet been Completed. Mr. Corazzini is ready'to proceed~ but wants a letter from the Planning Board stating 'that ~he curbing and drainage meet all of the specifications. Abrahams, to make an inspection of the improve- merits andsend copies of report to Koroleskis~ Riverhead Cement Block~. and Corazzini. · -. Southold Town Plan~=.~g Board -7- .~__3tember 1, 1970 Richard Lark~ Esq. appeared before the Planning Board to request approvalof division of property for George R~ Clary,~ lot located at north side Sterling Road, west side of Horton Road~ and south side of Lilac Lane, Nassau Point, Cutchogue. The lot has 100 ft. frontage on Sterling Road, 362.5~t. frontage o ~ ~ ' n Horton Road, and llS-ft, on L~lac Lane, it contains approxi- mately 37,000 sq~ ft. of area. Mr. Clary-is requesting permission to divide this lot in half. The lot to the west has been sold to R. Reibe~ it is no longer owned by Clary. The Board discussed this proposed division at some length, no action taken at this time, to be discussed again at the next meeting. The Chairman read the report of the Agricultural Study submitted by Dr. Joseph Sullivan. The Chairman informed the Board that the Commoners of the Town of Southold are ready to enter into scenic easement and negative easement contracts. The Chairman has received several contracts which he will present to the ToWn Board at their next meeting on Sept. 8th. Final information meeting on Master Plan to be held sometime at the-end Ofthe month or early October. The Chairman suggested that information be sent to the newspapers to inform the public and brief them on the material. The Chairmanalso suggested that some sort of ~fly folder or information sheet be printed to hand out to the people at the meeting. R 'and Gus Boar~ on located at no~th enport~ ity will be 7 units per acre, there will be 29 ~s, containing a total of 350 u~its. There is still some discretion on how the 150 ft. strip off 'the road should be zoned. The Board suggested that a scenic easement be placed on it.' Mr~ Schad Was a little hesitant about placing a scenic easement on it. Decision~o be made by Mro Schad and applicationto be amended accordingly. ' ~' Southold Town Plann.~g Board -8- . .... New York. Mr. Lark requested suggestions for dividing this property.. Preliminary map to be d~awn up and presented in the future. On motion by Mr~ Wickham, seconded by Mr, Moisa~ it was RESOLVED that the minutes of the $outhold Town Planning BOard dated August 10~ 1970, be approved as submitted.
