PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William U nk¢lbach SOUTHOLD TOWNPI~NNING BOARD December 6, 1960 A regular meeting of the Southold Town Planning Board was held'7:30 P.M., Tuesday, December 6, 1960 at the Town Clerk Office, Main Road, $outhold, New York. There were present: Messrs~ lohn~Wickham, Chairman, Alfred Grebe, Henry Moisa, Archibald Young, and William Unkelbach. Also present: Mr. OTto W. Van Tuy~,Consultant. The minutes of the meeting of'November 1, 1960, on motion of Mr. Moisa, seconded by Mr. Young, and carried, were approved as corrected. The Board wished it to be noted in the minutes that some of the members had visited the Victoria property at Bayview. vote of the Board: Ayes:- Mr. Wickham, Mr. Grebe, Mr. Moisa, Mr. Young, and Mr. unkelbach. The Planning Board received application for Tentative approval of Subdivision plat to be known as Hickory'Acres Southold Town Planning Board -2- December 6, 1960 (Section One), East Cutchogue, New York, containing 5.76 acres. The applicant who is Flora S. Luce, and George L. Penny, III~ state that tbs cost of grading and required public improvements will be $990.00 and that they request a Performance Bond be waived for the reason that all of said improvements have been .completed and paid for'by applicant. The description of the entire land under application is as follows: Premises at East-Cutch0guel Town of Southold, County of~Suffolk and State of New York, bounded and described as follows: BEGINNING ata monument on the.easterly line of Bay Avenue at the northwesterly corner of land of~Alden and the southwesterly corner of land of the applicant; running thence along the easterly line of Bay-Avenue north 12 degrees 35' 50" east 300 feet~to a monument; thence along land of~Stoutenburgh north $0 degrees 12' 50" east 566.38 feet to a monument; thence along other land of the applicant three courses, as follows: (1) south 17 degrees 58' 40" east 151.55 feet; thence (2) north 80 degrees 12' 50" east 52.61 feet; thence (3) south 26 degrees 46' 10" east 318.77 feet to the northerly line of~Pine Tree Road; thence along the northerly line of Pine Tree Road south 63 degrees 13' 50" west.50 feet; thence along other land of the applic~ three courses, as follows: (1) north 26 degrees 46' 10" west 150 feet; thence (2) south 63 degrees 13' 50" west 110 feet; thence (3) south 77 degrees 16' 10" west 309.23 feet to a monument at the northeasterly corner of land of Bourguignon; thence along land of'Bourguignon and land or'Alden north 84 degrees 01' 10" west 355.65 feet to the point of beginning. Containing 5.76 ~cres, more or less. Three Preliminary Maps of Hickory Acres (Section One)~ at~East~Cutchogue, by Otto W. Van Tuyl ~ Son, dated November 4, 1960, were received. Hickory Acres ( Section One) contains nine lots, all having over 20,000 sq. ft. The road~, Lupen,Drive and Billard Road, run> from Bay.,Avenue to Pine Tree Road and have already been constructed according to the specifications of the Highway Depart, ment. On motion of Mr. unkelbach, seconded by Mr. Moisa~ and carried, it was RESOLVED that the Planning Board grant FloralS. Luce End George L. Southold Town Planning Board -3- December 6, 1960 Itwas FURTHER RESOLVED that the Planning Board cenfirm this action by letter to Flora Luce and ano. and advise that she may now instruct her engineer or ~urveyor to proceed with computing the map, preparing the finished map, submit her cloth prints to the Health Department for approval, and proceed with other matters necessary prior to submitting them to the Planning Board for final approval. These prints must be submitted at least 15 days prior to a regular meeting of the Board. vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr, Young, and Mr, unkelbach. The Plan~ing Board discussed the denial by the Town Board of the petition for a change of zone of Alec in Cutchogue, and the granting of the change of zone of Pumillo in Mattituck. The Planning Board, on motion of Mr. Moisa, seconded by Mr. Young, and carried, RESOLVED that a letter should be forwarded to the Town Board stating that in view of these facts that the two cases had been decided in oppositi~ to what are very clearly in the best interest of the Town of'Southold, the Planning Board feels there must be some extenuating circumstances and it would seem to the Planning Board that it is rather important that they be made aware of what the circumstances are so that in the future they m ay enter into the Planning Board's considerations. Further, the Board would like to have the opportunity of meeting with the Town Board and discussing these and other matters at their convenience after the first of the year. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. unkelbach. The Board received notification from the Town Board that the petition of~William Vic toria for a change of zone from "A" Resident~l and Agricultural District to "M" MultipteResidence District was denied. The Board received notification from the Town Board that the petition of the Jut. Order United American Mechanic, Mattituck, Council~34 for a change of zone from "A" Residential and Agri- cultural. District t0 "B" Business District was granted ~ffective as of November 26, 1960. Southotd Town.Planning Board -4- December 6, 1960 The Planning Board members received a copy of the booklet entitled "Suffolk County, a growing county,~ in a growing market, a good place to work and play~" published by the Suffolk County Planning Commission. Mr. Van Tuyl presented to the Planning Board, for discussion, the final map of Hilton Heights at North Parrish, Bayview, Southold, New York. All of the lots in this subdivision are over 12,500 sq. ft. Since the roads have not been constructed Mr. Van Tuyl was advised that Mr. Epp would have to present to the Town Board a Performance Bond sufficient to cover the full cost of improvements estimated by the Planning Board and approved by the Town Superintendent of Highways. Mr. Van Tuyl stated that t~ would take this matter up further with Mr. Epp prior to filing for final approval. Mr. Van Tuyl brought up the matter of Section 2, Orient-By- The-Sea. Mr. Uhl would like to construct that.section of Soundview Avenue in Section 2 which runs to the Sound and dedicate that part to the Town. However, according to the Real Property.Law and the Subdivision~Law, when a map is filed all streets should be monumented with two monuments at-each corner. The Planning Board felt that that would not be practical on undeveloped land thatMr. Uhl intends to rent as fan, land, until such time as he is ready to develop. They suggested that he divide Section two if he wants to develop the Shore front parcel and separate it from the intended farm land and then proceed to install and monument his roads to specifications in that area and to file for the balance as Section 3, if and when he is readstar to develop it. They suggested that possibly the Town Board would adjust the fee~ for this subdivision if he wished to do it that way. It is also the Planning Board's thought that the road nearest the water front should~ontinue under its present ra~e and Serve only that portion of the subdivision as shown on the water front section of the map and the second road shouldbe the road which connects with the proposed Soundview or Sound Road running along parallel to the Sound bluff from Youngs Avenue to orient Point as suggested in proposal dated June 1, 1960. On Monday~'December 5th the Planning Board metwith the Town Board at'the intersection or,cox Neck Road, Sound Avenue and Middle Road~ Mattituck, to discuss zoning the intersection area "B" Business. Van Tuylo After considerable discussion relative to the area to be zoned, on motion of Mr. Grebe. seconded by Mr. Unkelbach and carried, it was RESOLVED that the Planning Board recommend to the Town Board that on the Town Board's own motion, the following area be zoned "B" Business District at the intersection of Sound Avenue, Cox Neck Road, and Middle Road: On the Bullock property~ north side Middle Road~ from~Cox Neck Road east to the easterly line of the Long Island Lighting Company Easement, 300 ft. in depth. On the property of Norris, north side Sound Avenue and west side Cox Neck Road~ the line will run north approximately 500 ft. on Cox Neck Road and approximately 400 ft. west on Sound Avenue, projected to an intersection at right angles to each street. On the south side of Sound Avenue the district will run along the southerly and east- erly line of the Long Island Lighting Company Eas~ement to the westerly line of the Sacks property. The triangle bounded on the north by Middle Road and south bySound Avenue shall extend east to the easterly side of the Long Island Lighting Company Easement and substation. All of the aforementioned' are shown on map prepared by Mr. Otto W. Van Tuyl and set forth in a legal description of same. Engineers~ stating that the Planning Board has maps in their files pre~ared by Chandler & Palmer~ and requesting that they advise if one or more member of staff has ~ew York State Professional Engineer licenses or is their company licensed to do professional engineering the State of New York. The Board d/scussed meeting with the Board of Assessors in.the near future to discuss problems of mutual ~oncern. It was decided that they wo~l,d forward a letter of invitation to the Board of Aseessors after the first of the new year. The Boar~ discussed the advisa~ility ~f notifying real estate agents~ ~ro~edure set up by the Planninc. a filed map when s~bdi~id- in~ .five or more l~ts~, and if there are four or less approval of access shoul~ be se=t~red from the Board of Appeals. Mr. Wickham stated that he had spoken with the T~wn Attorney and was advised that if an occasi~nal lot is sold from a going farm concern that this is r. ot with the intent to subdivide a~d the approval of a filed map should ~ot be required, h©wever if it is obvious that a n individual is breaking up a farm a map should be filed. THe Board members were to consider this matter of issuing information sheets and will discuss it again at the next meeting.
