A regular meeting of the Southold Town Planning Board was
held 7:30 P.F~ TueSclay~ December 20, 1960 at the Town Clerk
Office~ Main Road~ So. uthold~ ~ew York.
There were present: Messrs. John Wickham, Chairman, Henr:y
~oisa, Archibal~ Young~ and William ~nkelbach.
Absent: ~Lr. Alfred Grebe 's abme~ce was ea~ed by
~ir. Otto W. Van Tuyl, Consultant
The Planning BOard received notification from the Town Board
that the petitio~ ~f FZ~nk Pumillo for a change of zone from "A"
Residential and Agri~ultural District to "B" Business District
was granted effective as of Dec~ber 17 ~ 1960,
Notif~ ation was also receive~ that the petition of Willia~
Davis for a change of zone from "A" ReSidential and Agricultural
DiStrict to "~4" ~ultiple Residence District was granted effective
December~ 17, 1960.

J. Baxter and Procan, Inc. from William Wickham. Mr. Wick~am
stated th% t his office is in the process of making another appli-
cation on behalf of ~Xartin Filla for premises adjoining the Procan~
Inc.--Baxter parcel on the north and west and since it is not ready
for presentation to the Town Board he asked that the Town BOard and
Planning Board withhold final consideration until the new appli-
cation is. received.
The Planning Board received a letter from the Town Board
enclosing a resolution relative to the proposed rezoning from
"A" Residential and Agricultural ~)istrict to "B" B~iness
District the property in the vicinity of the intersection of
Sound Avenu-e~ ~iddle Road.~ and Cox N~k Road at ~4attituck and
requesting an official report from the Planning Board relative
to this change of zone.
On mot~n of Fir. M~a, seconded by Mr. YoUng, and carried,

RESOLVED that the Planning Board recommend to the ToWn Board
the change of zone from "A" Residential and Agricultural District
to "B" Business District on dertain property situated at Mattituck

It st~ould also be noted that the Lea g Island Lighting Company
substation constitutes a non--conforming use and it should bs
included in this "B" Business District as outlined in the map
dated December 6~ 1960 by'Otto W. Wan Tuyl. The pylko property
approximately opposte the substation on the south side of the road
is also a non-conforming use to the extent that three families
occupy the house and the barn haS been used as a carpenter shop
for a considerable period-

.The Planning Board received a letter from Wood~ollow
erti~s, Inc~, ~orge Eo Busctunann, regarding Section Two of
orie~t-By~The~sea. In the letter it is Stated that while they
intend filing the remaining property as Section Two they contemplate
re/xti~g the greate~ ~tion for farming. They will ~tinue the
paving of Sound view Road from where it en~s at ~ection ONe to
Ryder ~arm Lane~ along I~yder Farm Lane to Kings Farm~ Road, along
Kings Farm ~oad to Three waters Lane connecting up w~h Section ONe~
They are now negotiatin~ for the installation of this section of
road~ in accordance with Town specifications, includ~g six dry-
wells at a cost of $7~ 100.00 and the work will be completed before
plat Of Section TWo is file~L This will take care of giving access
to the public be~ch as previously discusS~' with the Board. It
is stated in the letter that the cost to install the re~aining
roads .and twelve dr~wells as shown on plat based on an estimate
will'be appr~ximately $19~800.00. They would like to have the-
approval of the Town Board to perz~t them to defer the installation
until a la%er date and 'they c~ furnish a Performance. Bond for
one year with any renewals of same~ They will install all the
necessary ~oad monuments an~ protect same so they are not abused
by the farming operations-
The Board wished a letter forwarded to WoOdt~ollow acknowledging
their lectern and stating that the BOard is taking the matter of
Performance Bond UP with the Town Board,- Superintendent of Highways
and Town counsel.
A letter was forwarded to th~ Town Counsel requesting a sample
of a Performance ~ond, knowing if it is usual procedure to add a

certain percentage for possible rise in price of future con--
struction, if it is customary to have performance bonnie for a
si~ngte year renewable annually thereafter fmr s longer period~
and any other suggestions on this matter ~ may have.
A letter was forwarded to ~e Southol~ T~wn B~rd calitng~
attention to Woodhollow~s plans because the performance bond
must be handled by the Town of Southold,, and stating t_hat the
Planning Board is looking into the matter of footage olf highly
to be constructed, the coSt per foot, and the adequagry of the
amount.
A letter was forwarded to the ToWn of Huntington~ Depart--
m tnt o.f Planning requesting that the Southold Town Planning
Board be supplied with information pertaining to their genezal

he forwarded a letter to the Southold Town Board amending his
p~tition by changing paragzaph t~wo (2) thereof to read ~s follows:
"that by changing from quote A unquote ~esidential and agricultural
district, the premises described in paragraph one (1) hereof".
The Board thoroughly discussed this petition~ It was the
~eeting that mentors of the Board should visit the site in the-
near future, but since they are all familiar with it. motion was
offered by Fir. UD~e!bach. seconded by ~LT. Young, and carried
RESOLVING that the Planning Board forward a r~commendation
to the Town Board stating that the Planning BOard would respect-
fully suggest that instead of changing the zone on this pEoperty
alone, that the Town Board on its own motion chanqe to "C" Industrial
District all of this immediate area and~ in addition~ it would seem
logical to the planning Board that the warehouse area west of the
Ferry District might well be changed to "B" BuSiness ~istrict~

Mr. Howard Terry was requested to contact ~handler ~ Pa,lmer~
Norwich, Connecticut, to dete~e if they have engineers status
in Ndw York State~ and also if they have any ~maps of the Fort area
which Would be useful to the Planning Board in determining areas to
be zone~.
Mr. Van Tuyl was requested to prepare a ~escription of the
areas in question recommended Dy the Planning Board.
The minutes of the meeting of De. cember 6, 1960, on motion of
~Lr~ Unkelbach, secon~e~ by Mr. Young, and carried~ were approved
as read.
Vote of the Board: Ayes:- Mr. Wickha$, Mr- Mois.a, Mr.
y~u.g~ and Mr. Unkelbach.
The Board received the report of the Building Inspector on
~the AnnUal ~oning ~c~vention held in HUntington on December 10,
1860.
The secretary was instzucted to prepar~ the Annual Report
of the Planning Board for submission to the Town Board-
