SOUTHOLD TOWN PLANNING BOARD
November 23, 1970
A regular meeting of the Southold Town Planning Board was
held at 7:30 P.M., Monday, November 23, 1970, at the Town-Office,
Main Road, Southold, New York.
THERE WERE PRESENT: Messrs: John Wickham, Chairman; Henry Moisa,
Vice-Chairman; Henry Raynor; Frank Coyle; Alfred Grebe.
Also present: Lawrence Tuthill, Construction Engineer, Howard
Terry, Building Inspector.
Richard Cron, Esq. presented the Planning Board with final
maps for "Leeward Acres", proposed subdivision to be located ~t
Bayview, Southold, New York. The Chairman stated that all they
have is prelim'inary approval, and he informed him that after a
subsequent review by the Planning Board several problems have
been disclosed. The park and playground area is large enough,
but part of it is under water, the Board doesn't accept park

and playground area which is under water. The Chairman stated the
Board's opinion that some of the lots are too long and too narrow,
and that this is not good planning. Also, the block along North
Bayview Road is too long. The Chairman informed the developer, Mr.
Torn, that he simply does not meet the requirements. Mr. Cron
stated that when they submitted this map for preliminary approval
it was unanimously granted, and he questioned why preliminary
approval was granted if the map does not meet the requirements.
The Chairman informed him that preliminary approval is primarily
an approval of the road lay-out only. The Chairman told him that
the map does not meet the requirements of the Planning Board and
that the engineer knows our requirements and should have known
better. Mr. Cron questioned again what the next step should have
been after preliminary approval if not to prepare the final maps.
The Chairman stated that the surveyor was in error by preparing
these final maps because they do not meet the requirements. Mr.
Born said that he felt that the park and playground area could be
enlarged without creating too much of a problem. The Chairman
agreed and also stated that a cross walk could be located on the
North Bayview Rgad block with relatively few problems. The Chairman
stated that they have met the Board of Health requirements and
obtained their approval and with some minor adjustments they can
meet the r~quirements of the Planning Board. The Chairman informed
them that it will be discussed later in the evening and they can
inquire at the office tomorrow of the exact requirements which must
be met by them. Mr. Born questioned whether or not he could keep
the same road lay-out because the roads have already been cut through.
The Chairman told him that the roads could be kept basically the same.
Mr. Cron questioned again the next step to be taken after preliminary
approval is granted. The Chairman informed him again that preliminary
approval is only an approval of the road lay-out and the park and
playground area, The Chairman recalled that the Planning Board had
gone out of their way to support their prior map which they sub-
mitted by transmitting it to the Health Dept. with a letter of
kecommendation stating that they should accept thismap. They in-
formed them that the Planning Board engineer had mad~ extenuating
studies of the drainage, 'etc. The Chairman stated t~at~he was per-
sonally ~ery upset~when ~they ~ not accept their map. The~Cha~rman
requested the de~eloper to give the Board another w~sk~ to go over the
map and ~ry to make a ~t~%%~i~'n~on~ as to what the Board feels should
be done. There W~ll be some requirement on North
Bayview Road. Mr~ Cron .stated that in his opil Planning Board
is at fault and that a burden should not be placed on the applicant to
change the map too intensively. Henry Raynor asked Mr. Born's
opinion of the lay-out of the map. Mr. Born stated that he felt
that it was an extremely poor lay-out, but it was the only one that
was economically feasible after the new Board of Health ruling f~r
one acre lot.

Mr. Born stated that he felt that the map which he had prepared for
cluster development greatly excelled the present one. The Chairman
asked Mr. Born to present the Board with a copy of the map which was
prepared for cluster development. Mr. Born said that he would see
that the Board received a copy. The Chairman asked Mr. Born if he
would allow the Board to transmit this plan for cluster development
to the Health Dept. for him, providing that it meets with the Planning
Board's approval. Mr. Born said that he would. This matter to be
discussed later in the evening.
~ary Olsen, Esq. presented the Planning Board with revised
final maps for the subdivision of Martin Weglicki located at N/S
Peconic Bay Blvd., Laurel, New York. The Chairman informed Mr.
Olsen that the map meets all of the requirements as stated by the
Planning Board at the public hearing, but that he has since spoken
with the Town Board who suggested that the reserved sections in
the ends of the c~ssroad be deeded to the lot owners. If the
adjoining properties are ever developed the circle will have to
be taken out of the road to facilitate road maintenance. The
Board advised him to have the required amount of revised maps
ready to present at the next meeting.
Mr. Gottlieb Nickles appeared before the Planning Board in
reference to minor subdivision of Ollie Overton (J.T. Overton Estate)
located at N/S Soundview Avenue, E/S Horton Lane, and north and south
side of Major's Path, Southold, New York. The Chairman advised Mr.
Nickles that the Board has looked the map over and finds that lots
1 & 3 are too small. The Board suggested that he revise the lot
lines of Lot %'s 2 & 4 to give the undersize lots more area. The
map shows 5 lots~ The Chairman penciled in new lot lines by reducing
the area of lot ~ 4 to add to the other lots. Mr. Nickles advised
the Board that t0t $~'1 is under contract to be sold, so the lot lines
of this lot will not be able to be changed. Henry Raynor suggested
that the revised map show the names of all the surrounding property
owners. The Board questiOned Mr. Nicktes as to whether or not the
developer owns any other property in the area. Mr~ Nickles said
that he does but it will not be developed for quite some time because
of a boundary dispute with an adjoining property owner. The Chairman
advised him that any future subdivision of land will require more than
20,000 sq. ft. of area in each lot. This matter to be taken up later
in the evening, and Mr. Nickles will be notified tomorrow of their
decision.

David Horton & others appeared before the Planning Board in
reference to their proposed subdivision to be known as "Peconic
Homes, inc. at Mattituck." Larry Tuthill presented .the Planning
Board with estimate for performance bond in the amount of $9,000.
The developers stated that most of the rough~work has been completed
(bond estimate was prepared accordingly.) David Horton presented
the Board with maps showing drainage plans, stc. Discussion was
had about drainage for the turn around at the south end of the
road. Mr. Horton advised the Board that the Mattituck Fire Dept.
has approached him to request a possible well site on the right-
of-way at the south end of the property. The Chairman stated that
the Planning Board would have no opposition tc this but they must
know the e~act location of'where they propose to put it. If it is
not located at the north end of the right-of-way then the right-of-
way will have to be paved up to the well site. Recommendations for
the drainage on the turn around at the south end of the road will
be discussed by the Board later this evening.
The Planning Board was presented with final maps for the proposed
minor subdivision of Alfred E. Dart, property located at east side of
Main Bayview Road, Southold, N.Y. Formal application, Fee, and letter
of intent have been submitted by the applicant.
On motion by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board table decision
on the above matter until later in the evening.

Request Mas received from Joseph P. Snellenb~r9, Esq. for
authorization to prepare final maps for the subdivision of Andrew
Dzenkowski. The Chairman read letter of apprOval from the Health
Dept. dated October 24 1970, received by Mr. Snellenburg.
On motion by Mr. Coyle, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board table decision
on the above matter until later in the evening.

Lawrence Tuthill P.E. presented the Planning Board with re~sed
estimate for performance bond in the amount of $3,600. for the
completion of roads and other improvements in the subd&vision "Calves
Neck", located at Southold, N.Y., owned by George Ahlers & another.
On motion by Fir. Moisa seconded by Mr. Wickham 'it

on the above matter until later in the evening.

The Chairman read recommendation submitted by Larry Tuthill
an reference to the drainage in "Sunset Knolls, Sec. II". This
matter to be discussed later an the evening.
In reference to "Bennett's Pond", subdivision located at
Mattituck, Richard Lark, Esq. informed the Board that he had no
knowledge of the variance obtained by the developer from the Board
of Appeals for a reduction in setback on lot ~ 5. The developer
Mr. John T. Reeves made the ~pplication and represented himself at
the variance hearing.
Richard Lark, Esq., ~uis F. Simeone, & Joseph T. Macari appeared
before the Planning Board to request an ext~nBion of time on the
preliminary maps ~f the subdivisions "Mattituck ~idge" and ~"Mattituck
Hills."I Dick Lark informed the Board that he has spoken with the
New York State Water Resources Commission and the Health Dept. who
advised him that it will take several months to go through all the
necessary hearings to obtain their approval. He advised the Board
that the Health Dept. is requiring public water Only, not sewerage.
At the last meeting the Planning Board suggestedthat the developers
appear before them to discuss their plans for the water system/ The
Chairman explained to them that the installation of the equipment
for the water system will be cheap, it is the year after year main-
tenence that will he,so costly. Mr. Macari stated that he realizes
the cost of maintenence and operation and that it will present no
problems. The Chairman stated that the Boar~r~ust be sure that they
know what they are getting into before they grant an extension. Mr.

Simeone stated that they realize that it would be impossible for an
average businessman to operate such a project at a p~ofit, their
intentions are to declare it as a tax loss. The Chairman informed
them that the Board would like them to present figures on the
projected cost of maintenance and operation. A question was raised
on the size of the pipe to be used. Mr. Simeone stated that 6" pipe
will be used on which fire hydrants can be hooked into. The Board
advised Mr. Lark that if an extension was granted, the estimate for
the performance bond will have to'be revised.
On motion by Mr. Coyle, seconded by Mr. Wickham, it was
RESOLVED that the Southold Town Planning Board table decision
on the above matter until later in the evening.

In reference to the proposed subdivision "Wheatfield Park"
located at Griffing Street, Cutchogue, N.Y., Mr. Lark informed
the Board th~ the owners Nicholas & Frank Mandaro have withdrawm
their application because they were unable to secure a bond for
the completion of the roads and other improvements. Dick Lark
informed the Board that he has a client interested in developing
the property for a senior citizens development with modular homes.
This use would require a change of zone. The Chairman stated that
the shape of the property will present problems and suggested that
he look into the possible purchase of the adjoining property in
order to widen the parcel.
Howard Terry informed the Board that they are now receiving
copies of reports of inspection on the construction of subdivision
roads ~rom Chas. Abrahams, Construction Inspector.
The Planning Board was informed that Robert Tanker, Town Attorney
received a letter from the Glen Falls Insurance Comuany stating that
they have in their possession a letter authorizing them to release
Frank Zaleski of his obligation on the roads in "Deep Hole Creek Estates"
It was suggested that the Town Attorney request them to send him a copy
of this letter of authorization which they say they received.

On motion by Mr. Grebe, seconded by Mr. Moisa, it was
RESOLVED that the ~ext regular meeting of the Southold Town
Planning Board be held at 7:30 P.M., Monday, December 14, 1970,
at the Town Office, Main Road, Southold, New York.

Grebe.
The Board ~iscussed again the revised estimate for performance
bond, as presented by Lawrence Tuthill, in the amount of $3,600, for
the completion of roads and other improvements in the subdivision
"Calves Neck", located at Southold, N.Y. owned by George Ahlers &
another. The Board was advised that the bulkheading has commenced
but has not yet been completed.
On motion by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board table recommendation
on the above matter until such time as the bulkheading is completed.

On motion by Mr. Moisa, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board authorize
Andrew Dzenkowski to have final maps made up and signed by the
Health Dept. for his proposed subdivision located at E/S Rocky
Point Road, East Marion, New York, as shown on revised preliminary
map dated July 14, 1970, by Otto Van Tuyl.

The preceding motion shall include authorization for a letter
to be sent to ~oseph P. Snellenburg, Attorney a/c Andrew Dzenkowski,
advising him as such.
On motion by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision of Alfred E. Dart0 property
located at east side of Main Bayview Road, Southold, New York.
The Chairman signed maps.

The Board discussed again the proposed subdivision of David
Horton & others, "'Peconic Homes, Inc. at Mattituck". It was decided
that they be allowed to put in 2 leaching basins at the south end of
the road on the turn-around at the s/W corner on the low spot and
all°w them to run the surplus down the slope into the drainage ease-
ment. Estimate for performance bond in the amount bf $90000. was
discussed by the Board again°
On motion by Mr. Grebe, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning Board recommend to the
Southold Town Board~ a performance bond in the amount of $9~000., as
prepared by Lawrence Tuthill, Construction Engineer, for the completion
of roads and other improvements in the subdivision to be known as
"Peconic Homes, Inc. at Mattituck"~ located at south side of Main Road,
Mattituck~ New York, owned and developedby David Horton & others.

On motion by Mr. Coyle, seconded by Mr. Moisa, it was
RESOLVED that the Southold Town Planning Board grant final
approval to the minor Subdivision of O~lie Overton (J.T. Overton Estate)
property located at N/S Soundview Avenue~ E/S Horton Lanes and north
and south side of Major's Path, Southold~ New York~ subject to present-
ation of 3 copies of final map to be revised as penciled in by the

Chairman, and fee of $50.00.

On motion by Mr. Coyle, seconded by Mr. Grebe, it was
RESOLVED that the Southotd Town Planning Board grant a one year
extension of time on the preliminary maps of proposed subdivisions
"Mattituck Ridge"~ located at N/S Bergen Avenue, Mattituck, .N.Y.,owned
by Louis F. Simeone~ and "Mattituck Hills", located at N/S Bergen
Avenue, Mattituck, N.Y.~ owned by Joseph T. Macari, subject to discussion
with the Town Attorney as to whether or not such an extension would
remain effective after the proposed amendments to the Zoning Ordinance
are adopted, and if the Planning Board has thc right to grant such an
extension.
Vote of the Board: Ayes:-Messrs: Moisa, Coyle, Grebe.
Opposed: Mr. Henry Raynor
Chairman John Wickham abstained from voting.
On motion by Mr. Grebes seconded by Mr.. Moisa~ it was
RESOLVED that the Southold Town Planning Board set the following
requirements for the subdivision to be known as "Leeward Acres", located
at S/S North Road to Bayview, & E/S Jacob's Lane, Southold~ New York:
1. The 100ft. turn-around at east end of "Leeward Drive" must be
labeled as "reserved for possible future dedication to the Town of
Southold, for a distance of 25ft. on each side, or full 100ft. by. 100ft.
as shown on map.
2. Park & playground area must be enlarged to contain 3 acres of
up land.
3. A walk-way must be established on the block along North Bayview
Road between lots 10 & 11, and 35 & 36, to be 10ft. in width, paved 5 ft.
4. A drainage pond not be established at this time~ and the entire
park and playground area be left in its natural state.
5. A 10ft. strip along the east side of Jacob's Lane to be
reserved for possible future dedication to the Town of Southold.

Mr. Henry Raynor abstained from voting.
On motion by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board authorize
Howard Terrya Building Inspector to s~_~ a letter to the Suffolk
County Sewer Agency inquiring whether or not they transmitted
authority to the Health Dept. to pass on sewerage requirements
for subdivisions in the Town ~f Southold.

Grebe.
The Planning Board discussed the proposed amendments to the
Zoning Ordinance as revised and corrected by the Town Attorney.
On motion by Mr. Wickham, seconded by Mr. Moisa, it was
RESOLVED that the Southold Town Planning Boardrecommend to
the Southold Town Board the adoption of the proposed amendments
to the Zoning Ordinance (including control of yard sales) as
revised and corrected by the Town Attorney.

The Planning Board was presented with the proposed new zoning
map for their inspection and comments.
On motion by'Mr. Coyle~ seconded by Mr. Grebe~ it was
RESOLVED that the Southold Town-Planning Board recommend to
the Southold Town Board the adoption of the proposed new zoning
map as prepared on the 800ft. to the inch scale map.

The Planning Board was presented with the revised Master Plan
Map for their inspection and comments.
On motion by Mr. Moisa, seconded by Mro Raynor, it was
RESOLVED that the Southold Town Planning Board recommend to
the Southold Town Board the adoption of the revised~aster Plan
Map as prepared on the 800ft. to the inch scale map. ~
Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Coyle~
Grebe.
Howard Terry reported that the maps have been delivered to the
Nassau-Suffolk Blueprint Company and will be available for the engineer
to work on in about a week, and they should be ready for presentation
to the Town Board in 2 or 3 weeks.
The meeting was adjourned at 12:15P. M.
