TOWN ~ PLANNING BOARD December 14, 1970 A regular meeting of the Southold Town Planning Board was held at 7:30 P~M., Monday, December 14, 1970, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Alfred Grebe; Frank Coyle present at 8:40 P.M. Also present: Howard Terry, Building Inspector Mr. Herbert Wells, Sr. presented the Planning Board with preliminary map for proposed minor subdivision of the George H. Wells Estate, property located at south side of Wells Road, Peconic, New York. The preliminary map showed 5 lots, all containing at least 40,000 sq. ft. of area and over. On'motion by Mr. Moisa, seconded by Mr. Grebe, RESOLVED that decision on the above matter be ta~e~-until later in the eyening. Mr. Gottlieb Nickles presented the Planning Board with revised map for proposed minor subdivision of Ollie Overton, property located at N/S Soundview Avenue~ E/S Horton Lane~ and S/S Major's Path, Southold, New York. On motion by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that decision on the above matter be tabled until later in the evening. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Grebe. The Planning Board discussed the proposed mino~ subdivision of the George H. Wells Estate, property located at south side of Wells Road, Peconic, New York. The map showe~ 5 lots, all containing at least 40,000 sq. ft. of area, and all fronting on an existing Town Highway. On motion by Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision map of the George H. Wells Estate, property located at south side of Wells Road, Peconic, New York, subject to applicant presenting the Planning Board with the ~ollowing: 1. Formal application. 2. Fee of $10. per lot. 3. Three (3) copies of final map. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Grebe. This motion shall include authorization for the Chairman to sign final map upon receipt of the above listed requirements.. The Planning Board discussed the proposed minor subdivision map of Ollie Overton, property located at N/S Soundview Avenue, E/S Horton Lane~ and S/S Major's Path, Southold, New York. The map showed ~ lots all containing at least 20,000sq. ft. of area with the exception of lot ~ 1 which contains 18,750 sq. ft. of area. At the last meeting of the Board, it was required that the map be revised so that all lots contain at least 20,000sq. ft. of area, since that time, it was learn- ed that lot ~ 1 had been previously deeded out with the existing area Southold Town Planr~9 Board -3- December 14, 1970 of 18,750 sq. ft. and that a building permit had been issued on it. In view of the preceding information, the Board feels that the area of lot $ 1 is beyond their control and should remain as shown on map as presented. The owner does have additional property in the vicinity but the boundary lines are in litigation, therefore the property will not be ab~b~to be developed for quite some time. The forma~ application has been received, but the fee of $10. per lot has not yet been received. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to t~ proposed minor subdivision map of Ollie Overton, property located at N/S Soundview Avenue, E/S Horton Lane, and S/S Major's Path, Southold, New York, subject to applicant present- ing the Board with three (3) copies of final map, and fee of $10o per lot. Vote of the Board: Ayes:- Messrs: Wickha~, Moisa, Raynor, Grebe. This motion shall include authorization for the Chairman to sign final map upon receipt of the above listed requirements. Lefferts P. Edson, Esq. and Matthew Mullen appeared before the Planning Board in reference to proposed change of zone application of Matthew & Marion Mullen, property located at north side of Route 25, Cutchogue, New York. The Chairman informed them that the Planning Board has not yet received the official transmittal instructing them to forward a recommendation. Mr. Edson staked that he had attended the Town Board meeting on December 8th and that a resolution was passed by the Town Board on that date to transmit this application to the Planning Board for their recommendation. Howard Terry, who was present at the Town Board meeting on December 8th, verified this point. On the s~mgth of the above, the Plahning Board proceeded to make a recommendation on the application of Matthew Mullen, Cutchogue, New York, relative to change of zone from "A" Residential and Agricult- ural District to "B" Business District on certain property situated in Cutchogue, New York, bounded and described as follows: BEGINNING at a point on the northerly line of Main Road at the southerly corner of ~ nd now or formerly of Z. Rysko which point is also the easterly corner of the parcel herein described: running thence along the said northerly line of Main Road South 43° 44' 40" West 250.00 feet to land of Dickson; running thence along said last mentioned land NOrth 42° 24' 00" West 273.07 feet to land of Traube; running thence along said last mentioned land North 43° 15' 10" East 246. 85 feet to the said land of Z. Rysko; Southold Town Plann~_~ Board -4- December 14, 1970 running thence along said last mentioned land South 43° 05' 20? East 275.00 feet to the said northerly line of Main Road at the point of BEGINNING. On motion by Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board favorably recommend to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "B-2" Business District on the above described property. The Planning Board makes this recommendation on the basis of the following: 1. This property is only ~-~from an existing business zone. 2. There is business zoning on all four corners of the nearby intersection. The Planning Board feels that if we are not allowing business zoning on County Road 27, we should have business areas available on Route 25. This resolution also includes authorization for this application to be transmitted to the County Planning Commission for their study and report. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Grebe. Eugene Horton and John Miesner appeared before the Planning Board in reference to the drainage plans for "Peconic Homes, Inc. at Mattituck." The Board informed them that they must meet the following requirements for drainage: Two (2) leaching pools with individual catch basins must be installed at the south end of the turn around (catch basins to be tied together), overflow to go down the drain on the blacktop. In reference to the time extension on the preliminary approval gf "Mattituck Hills" and "Mattituck Ridge", the Chairman reported on his c~nversation with the Town Attorney. At first the Town Attorney said that everything must comply with the new amendments, since that time the Town Attorney sent a letter to the Chairman clarifying his determination. The Town Attorney states that wheb and if the proposed new amendments to the Zoning Ordinance go into effect, the Planning Board will have to recommend that specific subdivisions be accepted, these two subdivisions would have to be Southold Town Plan~g Board -5- -- December 14, 1970 included in order to go under present specifications. William Essex, Esq. and Donald H. Dennis presented the Planning Board with a preliminary sketch for proposed subdivision of their property located at south side of Harbor View ~venue and west side of Reeves Avenue, on the east side of Mattituck Inlet, Mattituck, N.Y. The area of the property is approximately 16.11~ A. The map showed 15 lots all containing a minimum of 40,000 sq. ft. of area. Lot ~ 15 contained considerably more than 40,000 sq. ft. of area, the Board suggested re-drawing the lot lines of all the lots on the west side of the proposed highway. Mr. Essex explained that the reason for this was to keep as many lots in ~rees as possible, 'if the size of lot ~ 15 was decreased there would be no trees on it. There was no provision for park and playground area shown on the sketch. Mr. Essex advised the Board that he is going to speak to Mr. Tasker in reference to the Town accepting money in lieu of park and play-ground area. Alden iYoung appeared before the Planning Board in regard to "Mattituck Hills" and "Mattituck Ridge". At the last meeting of the Planning Board held on November 23rd, these 2 subdivisions were granted a one year time extension of the preliminary approval subjec~ to confirmation with the Town Attorney. The Town Attorney has informed us that in order for this time extension to remain effective after the enactment of the proposed new amendments to the Zoning Ordinance the Planning Board will have to put these 2 subdivisions on the approved list in the back of the ordinance. Mr. Young said that he has spoken with Mr. Hell of the Bureau of Water Supply, Mr. Heil thought that the Village of Greenport might be interested in supplying this area with water. In reference to "Leeward Acres", Mr. Young asked if the walk-way which the Board is requiring could be an easement over the lots. The Board in- forme~ that this would be acceptable to them. Supervisor Martocchia advised the Planning Board that he has received a request from Attorney Richard Lark asking the Town Board to set a hearing date on the change of zone application of Anna C. Hansen, Mattituck, New York. There was some question as to whether or not they would have to re-apply or submit an amended application. Southold Town Plan %g Board -6- December 14, 1970 Mr. Martocchia was of the opinion that they should withdraw the present application and submit a new one. Supervisor Ma~tocchia asked the Planning Board to look into the matter and handle it under the Town Board's direction. The Planning Board was advised of the special meeting to be held at the Supervisor's Office. 16 South Street, Greenport, N.Y., at 4:00 P.M., Wednesday, December 16, 1970, for the presentation of the ~ast~r Plan in its final form. Renewal of agreement between the Village of Greenport and Valentine Ruch to supply water to his subdivision "Shorecrest" was received and read by the Chairman. Letter was received from William Wickham in reference to water collecting on Richard Babcock's property due to drainage in sub- division "Calves Neck", Southold, N.Y., owned by George Ahlers &Ano. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board authorize Chairman Wickham to contact the Town Attorney for advice on this matter and to write a letter to George Ahlers advising him that this situation must be resolved. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Copy of letter was received which EUgene Francolini, Attorney a/c South Fork Development Corp., sent to the bonding company requesting them to send the Planning Board a copy of the renewal for the bond coverage for the subdivision "Corey Creek Estates." Bond coverage is extended until June 22, 1971, subject to receipt of renewal of bond coverage. Southold Town Plan~ .g Board -7- December 14, 1970 Discussion was had by the Planning Board in reference to drainage in "Sunset Knolls, Section II", Alden Young advised the Board that a solution is being worked out, between him and Larry Tuthill. The minutes of the Village of Greenport Planning Board, dated December 8, 1970 were read and placed on file. In reference to "Deep Hole Creek Estates", Howard Terry read resolution of the Town Board dated June 24, 1969, releasing the bond subject to certain conditions, copy of this was sent to Robert Tasker, Town Attorney. The Planning Board was presented with three (3) copies of final map for minor subdivision of George R. Clary, property located at Sterling Road, W/S Horton Road, and S/S Lilac Lane, Cutchogue, N.Y. The maps did not show the adjoining property owners. The Planning Board will not accept a minor subdivision map which does not show all adjoining property owners. Maps to be sent back informing them that the maps are unacceptable without showing all adjoining property owners. Bulletin was received from the New York State Office of Planning Coordination on the subject to "L.I. Sand and Gravel Mining." Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The meeting was adjourned at 10:00 P.M.
