SOUTHOLD TOWN PLANNING BOARD
February 23, 1971
A regular meeting of the Southold Town Planning Board
was held at 7:30 P.M., Tuesday, February 23, 1971, at the Town
Office, Main Road, Southold, New York.
There were present: Messrs: John Wickham, Chairman; Henry
MoiSa~ Vice-Chairman; Henry Raynor; Frank Coyle present at 7:40 P.M.
Absent: Mr. Alfred Grebe, due to unfavorable weather conditions.
Also present: Howard Terry, Building Inspector
Mr. J. Abott Muir appeared before the Planning Board in
reference to the Master Plan Map. He questioned why the in-
dustrial zoning on his property and the property of Ike Edwards,
located at east side of Rocky Point Road, East Marion, had been
deleted from the Master Plan Map. Mr. Muir was'under the im-
pression that his property had been reverted back to "A" Resi-
dential and Agricultural. The Chairman explained that the
Master Plan Map is only a guide line for the future, not a

zoning map. The Chairman stated that the Planning Board doesn't
think that the present zoning, in the Town in general, is neces-
sarily the best that can be done, however, they have no intention
of lifting his zone. As far as the Planning Board is concerned
there is no problem. The Chairman stated that for the present
time, the Planning Board, the Town Board, and the County all have
the same feeling, but in the future, possibly 10 to 20 years from
now, it may be questionable whether or not this property should
be zoned industrial. Mr. Muir asked if the property would now be
considered as a non-conforming use. The Chairman told him that
the property is one,he zoning map as industrial, it is not a non-
conforming use, and as long as he continues to use if for industri-
al property~ it shall remain as such.
THE CHAIRMAN: I will now call the me~ting to order and open
the hearing by reading the legal notice ofhearing for the plat of
property under question for approval:
NOTICE IS HEREBY GIVEN that pursuant to Section 276 of
the Town Law, a public hearing will be held by the Southold
Town Planning Board at the Town Office, Main Road, Southold,
New York, in said Town on the 2~3rd day of February, 1971, at
7:30 bJ~lQck in the evening of said day on the question of
approval of the following plat:
1. Plat of property owned by Pec~ni~ Homes, Inc. at
Mattituck, entitled Eastward Manor, consisting of a parcel
of land of 8.33 ~cres, situated at Mattituck, in tbs Town
of Southold, Suffolk County, New York, and bounded and des-
cribed as follows:
BEGINNING at a monument at the intersection of-the
southerly line of Main Road and the easterly line of
land of J. & S. Saland, said monument being the follow-
ing three (3) courses and distances as measured along
the southerly line of Main Road from the intersection
of the easterly end of a curve connecting the easterly
line of Cardinal Drive with the said southerly line
of Main Road:
(1) ~. 88° 08' 20" E. for a distance of 398.67'
(2) N. 89° 03'E. for a distance of 571.32'
(3) S. 87° 39' 20" E. for a distance of 161.30'
to said point of beginning.

The Chairman read the affidavits attesting to its publication
in the Long Island Traveler-Mattituck Watchman and the Suffolk
Weekly Times.
The Chairman inspected the file on this subdivision and read
the following correspondence contained therein:
Letter received from the Superintendent of Highways, dated
October 13, 1970, approving the road lay-out.
Bond Estimate prepared by Lawrence Tuthill, in the amount
of $9,000. , dated November 23, 1971.
Notice received from the Suffolk County Planning Commission
advising us that this subdivision does not come within their
jurisdiction at this time, dated December 30, 1970.

Certification of approval received from the Health Dept.,
dated February 1, 1971.
Notice to developer of amount of subdivision fee.
Planning Board recommendation to the Town Board for accept-
ance of bond in the amount of $9,000., dated November 24, 1970.
THE CHAIRMAN: Upon inspecting this file, I find it complete
in all respects.
Is there anyone present who wishes to speak in opposition
to this subdivision?
(There was no response.)
THE CHAIRMAN: Is there anyone present who wishes to speak
in favor of this subdivision?
DAVID HORTON & JOHN MIESNER: Yes, we are the developers~
and we request that you approve this subdivision.
THE CHAIRMAN: Are you prepared to post bond or make some
arrangements.
DAVID HORTON: Yes, we are. We also have a contract from
Paul Corrazini, by which we would like to reduce the amount of
the bond.
THE CHAIRMAN: This is acceptable to us, we will send a
recommendation to the Town Board for a reduction in the amount
of the bond. However0 you understand that if we approve this
subdivision tonight, it will be approved subject to the post-
ing of the bond?
DAVID HORTON: Yes, we understand that. Is it necessary
that we present the restrictions for the deeds tonight?
THE CHAIRMAN: No it is not. What are you going to do
with the wager from the turn-around?
DAVID HORTON: The last we heard, the Mattituck Fire Dept.
is not going to go down there.
THE CHAIRMAN: So what are your plans now?
DAVID HORTON: We have 2 catch basins on the turn-around now,
if it is acceptable to you, we will make a natural drainage area
immediately south of it.

THE CHAIRMAN: Yes, this would be acceptable to us, however,
we will require that you send us a letter stating that you will
grade it and seed it, and guarantee to establish the seeding.
DAVID HORTON: 'Yes, we will present you with such a letter.
THE CHAIRMAN: Is there anyone else present who wishes to
be heard on this subdivision?
(There was no response.)
THE CHAIRMAN: Hearing none, I will declare this hearing
closed at this time, decision will be made by-the Board later
in the evening.
Mrs. Ann R~din presented the Planning Board with a preliminary
plan for the division of her property located at S/E corner of Vanston
Road and Carrington Road, Nassau Point8 Cutchogue~ New York. This
property was formerly owned by Mrs. Posner and it is a non-conforming
"M" Multiple Residence District use. The Board was also presented
with a plan for the division of the property, left at the office by
H.E. Bishop, P.E. Mrs. Rudin disavowed any knowledge of this plan
and upon inspecting it, said that she did not wish to divide the
property in that manner. The plan which Mrs~ Rudin brought in was
done by Van Tuyl, it showed 8 lots. The Chairman informed her that
the plan was unacceptable to the Board as 5 lots is the maximum
number of lots that they will accept in a minor subdivision. The
Board advised her to have the map revised~ and informe~ ~:tha~:~a~.lT~i
lots must have at least 100 ft. on the road and the map must show
all adjacent property owners. Mrs. Rudin is to have map revised
and present it at the next meeting of the Planning Board°
Mr. Joseph Zevits presented the Planning Board with a
preliminary sketch for the division of his property located
at east end of Sunset Lane (Pvt. Road off W/S of Main Bayview
Road), Southold, New York. Mr. Zevits explained that he has
2 parcels of land, both in separate deeds, he wishes to divide
both of them in half so that he will have four (4) lots. The
two lots fronting on the Bay will h~ve 20~000 sq. ft. of area,
the two northerly lots will h~ve 15~000 sq. ft. of area. All
of the lots in this area are of similar size. The Chairman
advised him to fill out minor subdivision applications and
have map revised showing accurate dimensions to scale, and

all adjacent property owners and roads.
Dominic Aurichio, Attomney a/c Irving & George Newman,
presented the Planning Board with a revised plan for the
proposed subdivision "Petty's Bight Estates," located at
north side of Route 25, Orient, N.Y. The map showed 18 lots,
each containing at least 40,000 sq. ft. of area, to~al area
of land is a little over 18 acres. Mr. Aurichio stated that
the water and sewer tests have been taken and the results are
excellent. The roads in this subdivison are to be privately
owned and maintained and turned over to a property owners
association. The Chairman informed him that the Town Board
requires a 50 ft. turn-around at the end of all connecting
roads, This area must be marked as "reserved for possible
future dedication to the Town of Southold." The Chairman
stated that as soon as the road is continued, the area within
the turn-around will immediately revert back to the property
owner. The Chairman penciled in turn-arounds at the end of each
connecting road and advised Mr. Aurichio to have map revised as
such. Mr. Aurichio also to present Board with a copy of the
Might-of-way provision. The Board informed him that the road
lay-out must be approved by the Superintendent of Highways.
This particular subdivision must also be sent to the County
Planning Commission for their approval, and a permit must be
obtained from the State for connection to the State Highway.
The Planning Board was presented with a letterof intent
received from the SOuthOld Park District. The Southold Park
District advised us that they plan to purchase about 200~i--feet
of the Ollie Overton property. The Chairman advised Mr. Nickles
once again, that the Planning Board will not accept a minor
subdivision map showing over 5 lots, and suggested that it may
be better if they convey the property to the Park District first, f
then apply for' a minor subdivision on the remaining property.
Richard Lark, Attorney, presented the Plannzng Board with
preliminary plans for three (3) prop~osed minor subdivisions on
property of Elsie M~&~ra~h~Q~ ~nd the Estate of George F. Grathwohl,
New Suffolk, New York. The first plan showed two lo~s on the south

side of Tuthill Road, containing 35,000~ sq. ft. of area, and
29,000~ sq. ft. of area, property in the name of George F.
Grathwohl Estate. The second plan showed four lots on north
side of George Road and west side of New Suffolk Avenue,
property in the name of Elsie M. G~athwohl. The third plan
showed 4 lots on the south side of George Road and east side
of Fred Street, property in the name of Elsie M. Grathwohl.
The Board discussed several revisions of lot lines of these
plans and advised Mr. Lark to have maps drawn up as such.
Richard Lark, Attorney, presented the Planning Board with
the approved minor subdivision map of George F. Clary, property
located at N/S Sterling Road, W/S Horton Road, and S/S Lilac
Lane, Nassau Point, Cutchogue, N.Y. Mr. Lark informed the
Board that the land owner immediately to the west, on the S/S
of Lilac Lane, Robert Reib, wishes to divide his property in
half. The area of his property is .906 acres and he has
216.80 feet on Lilac Lane. The Chairman stated that the
Planning Board would not approve of the division of this
property, but if Mr. Reib is willing to acquire additional
land from his adjacent property owner to the west, D.D. Kruse,
the Planning Board might consider it.
Richard Lark, Attorney, and Alden Young, P.E. presented the
Planning Board with a revised plan for the proposed subdivision
of Louis F. Simeone and Joseph T. Macari, property located at
north side of Bergen Avenue, Mattituck, N.Y. The developers
have purchased an additional 36 acres of land to the north, from
A.W. Renander, Jr. This plan is to be filed in Sections I & II.
The revised plan showed 116 lots, each containing a minimum of
40,000 sq. ft. of area and having 130 feet of road frontage. Mr.
Lark asked the Board's opinion of varying the road frontage on
the lots, no ~ot to have less than 115 ft., the Board agreed to
this. Mr. Young stated that the topographical levels are geo-
graphical only, they are not accurate. The re-charge basin is
located between lots 16 & 17. The Board informed them that all
connecting roads must have 50ft. turn-arounds at the end. Mr.
Lark stated that the drainage area located b~tween lots 83, 84,
& 85 will be covented against building upon. The Chairman in-
formed Mr. Lark that the road leading into the park and play
ground area must be 50ft. in width. Mr. Lark stated that they
do not wish to turn that road over to the Town, they want to

keep it private. The Chairman explained that it still must be a
50 ft. road. Larry Tuthill suggested creating a 50ft. road on
the north-west corner of the subdivision for ingress and egress
to the park and play ground area. He also suggested that the
property lines on lot ~'s 32, 33, & 34 be extended to the foot
of the cliff, in case they ever have to bulkhead. In regard to
the Town Board requirement for a 50ft. road leading into the
park and play ground area, the Board suggested that Mr. Lark
speak to the highway committee of the Town Board and request
them to waiver the requirement for a 50ft. road to be reserved
for possible future dedication to the Town. The Board cautioned
Mr. Lark that Section II of this subdivision must be filed with-
in three years, and also that the Health Dept. may change their
regulations by that time. The Board suggested that they take
this map to the Superintendent of Highways for his approval and
recommendations.
Edward Latham appeared before the Planning Board in regard
to the Master Plan Map. Mr. Latham said.that he thought there
were too many wetlands on the Master Plan Map for Orient, and
that there are too many restrictions on wetlands. The Chairman
informed him that there are no restrictions on wetlands, what
so ever. The Chairman explained the benefits of the scenic
easement contracts to him and informed him that they are not
mandatory~ they are strictly the option of the land owner. The
Chairman advised him that if.the Town did not show the wetlands
on the Master Plan Map, thereby expressing an interest in them,
the County or the State would come in and confiscate them by
condemnation. Mr. Latham thanked the Chairman and the Board
for explaining the purpose of the wetlands on the Master Plan
Map and stated that the Board has given him a better under-
standing of the Master Plan Map in general.
Howard Terry advised the Planning Board that letters, on
date of February 12th, were sent to the L.I. Traveler-Mattituck
Watchman, the Suffolk Weekly Times, and the News-Review, request-
ing that they give some publicity to the "Information Meeting~
which is to be held on March 4th, in their papers in the next
two weeks.

Letters sent to the Nassau-Suffolk Blueprinting Company, on
date of February 12, 1971, and subsequent letter of February 23,
1971, advising them to make copies of the Master Plan Map, were
read and placed on file.
Copy of letter which Robert,-W. Gillispie, Jr. Sent to
Supervisor Martocchia, on date of February 11, 1971, in re-
ference to wetlands preservation and flood plain zoning, was
read and placed on file.
Letter received from the Greenport Village Planning Board
in reference to their annexation. The Village Planning Board
apoligized to the Town Planning Board for any misstatements
made in their minutes of January 23, 1971 concerning the Town
Planning Board.
Notice received from the Nassau-Suffolk Civil Engineers,
Inc., together with a copy of a recent Suffolk County Supreme
Court decision, prohibiting the Suffolk County Clerk from
accepting subdivision maps which are not signed, sealed, and
certified by a licensed land surveyor. Said notice and decision
were placed on file.
Howard Terry advised the Planning Board that the 90 day
time period on the approval of the final map for "Laurelwood
Estates" will expire shortly and Martin Weglicki has not yet
posted a bond.
The Planning Board was advised-that Harvest Homes, Section
II, had been turned down by the Health Dept.
"Information Meeting on Master Plan" to be held at 7:30 P.M.,
Thursday, March 4,1971, at-the Southold High SchoOl. Application
for use of auditorium has, b.een approved, and notice of meeting
has been sent to the papers.

On motion by Mr. Raynor, seconded by Mr. Wickham, it was
RESOLVED: WPIEREAS: Peconic Homes, Inc. at Mattituck, New
Suffolk Avenue, New Suffolk, New York, has petitioned the
Southold Town Planning Board for final approval of their sub-
division "Eastward Manor," located at south side of Main Road,
Mattituck, New York, and
WHEREAS: The Superintendent of Highways has approved the
lay-out of the roads, and khe Planning Board accepts his report,
and
WHEREAS: The Southold Town Board will accept a bond in the
amount of $9,000. for the roads and other improvements in this
s~bdiv is ion ~
NOW, THEREFORE BE IT RESOLVED: that the Southold Town
Planning Board grant final approval to the subdivision known
as "Eastward Manor," subject to the following conditions:
1. Receipt of notice from the $outhold Town Board that
they have received and accepted a bond for this subdivision.
2. Receipt of letter from the developers, stating that
they will grade, seed, and guarantee to establish the seeding
on the drainage area.
This motion shall include authorization for the Chairman
to sign the final maps upon receipt of the above.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle.
On motion by Mr, Wickham, seconded by Mr. Moisa, it was
RESOLVED that the Southold Town,~Plann. ing Board recommend
to the Southold Town Board, a reduction in the amount of per-
formance bond, from $9~000. to $5,610., to be required for
the proposed subdivision "Eastward Manor", located at south
side of Main Road, Mattituck, New York, owned and developed
by Peconic Homes, Inc., at Mattituck.
Copy of contract, between the developers and Paul Corazzini,
in the amount of $3,390., and recommendation for reduction from
Town Engineer, Lawrence Tuthill, also to be forwarded to the Tow~
Board.

RESOLVED that the minutes of the Southold Town Planning Board,
dated February 1, 1971, be approved with minor corrections.

RESOLVED that the next regular ~meeting of the Southold Town

the Town Office, Main RO~d, Southold, New York.
