SOUTHOLD TOWN PLANNING BOARD
March 16, 1971
A regular meeting of the Southold Town Planning Board
was held at 7:30 P.M., Tuesday, March 16, 1971, at the Town
Office, Main Road, Southold, New York.
There were present: Messrs: ~n Wickham, Chmi~man; Henry
Moisa, Vice-Chairman; Henry Raynor; F~ank Coyle;;Al'fred Grebe
Mr. Gerry Horton a/c Peconic Homes, Inc., presented the
Planning Board with a check in the amount of $5,500. endorsed
over to the Town of Southold, in lieu of performance bond for
the completion of the improvements in the subdivision "Eastward
Manor", located at south side of Main Road, Mattituck, New York.
Mr. Horton requested the Planning Board to forward this check
to the Southold Town Board.
On motion by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED that.the So~thold Town Planning Board recommend
to the Southold Town Board, a performance bond in the amount'

of $5,500. for the completion of the remaining work on roads,
drainage, and other improvements in the subdivision "Eastward
Manor", located at south side of Main Road, Mattituck, New York.
This motion shall include authorization for check in the
amount of $5,500 endorsed over to the Town of Southold, received
from Peconic Homes, Inc., to be forwarded to the Town Board to-
gether with the above recommendation.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
Mr. Charles DiGregorio presented the Planning Board with
three (3) copies of revised map for his proposed minor sub-
division located at north side of Leslie Road, Peconic, New
York. The revised map showed five (5) lots: Lot No. 1 con-
tained 175,000~ sq. ft. of area; Lot No. 2 contained 80,000±
sq. ft. of area; Lot No. 3 contained 80,000~ sq. ft. of area;
Lot No. 4 contained 40,000~ sq. ft. of area; and Lot No. 5
contained 80,000± sq. ft. of area. The map also Showed pro-
posed fifty (50) ft. road with turn-around ak northerly end.
All adjacent property owners were shown on the map. The
Chairman advised Mr. DiGregorio that if this minor subdivision
is approved, the Planning Board will require a written state-
ment from him saying that no lot in this minor subdivision
will be re-subdivided. Mr. DiGregorio presented the formal
application, fee of $50. yet to be received. The Board ad-
vised Mr. DiGregorio to present letter of intent and fee at
the next meeting.
Mr. Joseph E~ Zevitts presented the Planning Board with
three (3) copies of revised final maps for the proposed minor
subdivision of his property located at p~ivate~right-of-way
off south side of Bayview Road, Southold, N~ York. The' re-
vised map showed four (4) lots: Lot No. 1 contained 14,636~
sq. ft. of area; Lot No. 2 contained 14,636~ sq. ft. of area;
Lot No. 3 contained 19,400± sq. ft. of area; Lot No. 4 con-
tained 19,4005 sq. ft. of area. Mr. Henry Moisa stated that
he felt that the size of these lots conform with the sur-
rounding parcels of land in the area. Mr. Zevitts present-
ed formal application and fee of $40.
On motion by Mr. Moisa, seconded by Mr. Grebe~ it was

RESOLVED that the Southold Town Planning Board grant
final approval to the proposed minor subdivision of Joseph
E. Zevitts, property located at right-of-way off south side
of Bayview Road, Southold, New York.
The ~Chairman signed the final maps.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
Mrs. Ann Rudin presented the Planning Board with revised
maps for the proposed minor subdivision and lay-out of rental
plots for expansion of existing use (non-conforming multiple
residence) on her property located at northeast corner of
Carrington Road and Vanston Road, Nassau Point, Cutchogue,
New York. The map showed ~ lots fronting on Carrington Road:
Lot No. 1 contained 18,000~ sq, ft. of area; Lot No. 2 con-
tained 15,000~ sq. ft. of area; Lot No. 3 contained 15,000~
sq. ft. of area. The lot containing Mrs. Rudin's residence
was not numbered. The Board advised her that this lot must
be labeled as Lot No. 4. On the south end of the property,
the map showed 4 proposed rental plots for expansion of
existing use (non-conforming multiple residence) with 25ft.
right-of-way for access. All of these lots have 100 ft. of
road fronta~q. The Board informed Mrs. Rudin that they will
have to confer with the Town Attorney in reference to the
legality of granting the rental plots for the expansion of
the existing use.
On motion by Mr. Raynor, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board table
determination on the above described proposed minor sub-
division for conference with the Town Attorney.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The Chairman read letter received from Bernard H. Sachar
Attorney a/c Mr. & Mrs. Francais J. Christie, owners of Lot No.
11 on the subdivision map of Capt. Kidd Estates, Mattituck,
New York. Mr. Sachar stated that his clients, Mr. & Mrs.

Christie are presently in litigation with Mr. Nick Cyprus over
the cutting through of a road over Mr. & Mrs. Christie's prop-
erty. Mr. Sachar stated that if his clients were permitted to
subdivide their property, as Mr. Cyprus was, the differences
between the two parties might be able to be resolved without
a trial. The Board surmised this letter as a proposal to ~ub-
divide Mr. & Mrs. Christie's lot. The Chairman instructed a
letter to be sent to Mr. Sachar stating that a law suit bet-
ween his clients and Mr. Cyprus is not the concern of the
Planning Board. If they wish to present an application for
a minor subdivision of their property, it will be considered
by the Planning Board on its merits. However, it would appear
that the lot in question is a little small to be further sub-
divided.
The Southold Town Planning Board received from the
Southold Town Board the original petition of Martin Filla,
Mattituck, New York, relative to change of zone from "B"
Business District to "B-2" Business District on one p~rtion
and from "A" Residential and Agricultural District to "B-2"
Business District on the other portion, on certain real
property situated in East Cutchogue, New York, together
with the ~nstructions to prepare an official report de-
fining the conditions contained therein.
This property is situated at East Cutchogue, in the
Town of Southold, County of Suffolk, ~and more particularly
bounded and described as follows:
BEGINNING at a point on the easterly line of Eugene's
Road at the southerly corner of land now or formerly
of Glover and running thence along said land now or
formerly of Glover and land of Abatelli, the follow-
ing six (6) courses and distances:
1. North 42° 12' 00" East 185.47 feet;
2. North 50° 34' 00" West 121.00 feet;
3. North 43° 44' 40" East 131.22 feet;
4. South 68° 15' 00" East 220~48 feet;
5. South 26° 11' 50" West 331.63 feet;
6. North 68° 42' 40" West 193.44 feet.
Upon inspecting the file~,the Chairman read a letter from
the applicant's attorney contained therein. Richard Cron,
Attorney a/c Martin Filla, requested notification of the date
on which this application is to be brought before the Planning

Board so that he may be present at such time.
On motion by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board table
recommendation on the proposed change of zone application
of Martin Filla, on property located at East Cutchogue, N.Y.,
until the next regular meeting of the Planning Board, so that
the attorney may be notified to appear.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The Southold Town Planning Board received from the
Southold Town Board the original petition of W. Gordon
and Lucy J. Ahman, Fishers Island, New York, relative
to change of zone from "A" Residential and Agricultural
District to a minimum or light business distric~ "B-2"
on certain real property situated at Madeline and Central
Aves., Fishers Island, New York, together ~ith the instruc-
tions to prepare an official report defining the conditions
contained therein.
This property is situated at Fishers Island, in the
Town of Southold, County of Suffolk, and more particularly
bounded and described as follows:
N - Madeline Avenue
E - Central Avenue
S - Prop. of Henry Zabohonski
W - Prop. of Estate of Lily C. Boyd
The Board discussed this proposed change of zone at
some length.
On motion by ~r. Grebe, seconded.by Mr. Coyle, it was
RESOLVED that the Southold Town P~anning Board favorabl~
recommend to the Southold Town Board the change of zone from
"A" Residential and Agricultural District to "B-2" Business
District on the premises of W. Gordon and Lucy J. Ahman,
situated at Madeline and Central Avenues, Fishers Island,
New York.
It is the opinion of the Planning Board that this
proposed change of zone will be in harmony with the pro-

posed heavy industrial district, which is immediately adjacent
to this property on the south.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The SouthOld Town Planning Board received from the Southold
Town Board the original petition of ~hilip W. Abatelli, Cutchogue,
New York, relative to change of zone from "A" Residential and
Agricultural District to "B" Business District on certain real
property situated at Main Road, East Cutchogue, New York, to-
gether with the instructions to prepare an official report de-
fining the conditions contained therein.
This property is ~ituated at East Cutchogue, in the Town
of Southold, County of Suffolk, and more particularly bounded
and described as follows:
BEGINNING at a monument on the southerly side of Main Road
distant 136.14 feet easterly from Eugene's Road
Continuing thence to a monument 90 feet along Main Road on
a bearing N. 42 degrees 12 minutes East
Thence on a bearing South 50 degrees 34 minutes East a distance
of 121 feet to a monument.
Thence on a- bearing South 42 degrees 12 minutes West a distance
of 90 feet to a monument.
Thence on a bearing North 50 degrees 34 ~inutes West a distance
of 121 feet to a monument at the point of BEGINNING.
The Board. discussed this proposed change of zone at some
length.
On motion by Mr. Coyle, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board table
recommendation on the above proposed change of zone for
further deliberation of the Board.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.

The Chairman read letter received from Vincent J. Cunningham
in reference to his opposition to the "C-i" Light Industrial
Districts projected for New Suffolk. Said Letter was placed on
fileo
The Chairman read letter received from William Wickham,
Attorney in reference to the Development Plan Map which was
published in the Long Island Traveler-Mattituck Watchman.
Mr. Wickham stated that the Moose Cove area in East Cutchogue
is not Pz~Pg~l~3delineated as to roads and requested that a
correction be made. Said letter placed on file.
The Chairman read the minutes of the Village of Greenport
Plan~ing Board dated March 5, 1971. The minutes contained their
objection to the proposed change of zone on the Brecknock Hall
Estates.
The Chairman also read the minutes of the Village of
Greenport Planning Board dated March 11, 1971, containing
their favorable recommendation of the adoption of the pro-
posed "Zoning Regulations for the Village of Greenport" to
the Village Board of Trustees.
The Chairman read letter which Howard Terry sent to
Town Attorney Tasker together with the list of subdivisions
suggested by the Planning Board to be included in the amend-
ments to the Zoning Ordinance.
The Planning. Board received notice from the Town Board
that paragraph 4 of the Highway Specifications, which requires
that highways on water front property have access to the water,
has been waivered with regard to the Proposed subdivision map
of Louis F. Simeone and Joseph T. Maca~, property located at
north sideoof Bergen Avenue, Mattituck, New York.
The Chairman stated his opinion that he doesn't think
that there is enough parking area at the beach for all of the

lots in this subdivision, and that there is no where near as
much park and playground area as there should be. The Chairman
instructed a letter to be sent to the developers attorney ad-
vising him as such.
This matter to be discussed later in the evening when the
developers attorney, Richard Lark, is present.
On motion by Mr. Grebe, seconded by Mr. Raynor, it was
RESOLVED that the minutes of the Southold Town Planning
Board, dated February 23, 1971, be approved as submitted.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
Mr. Grebe presented the Planning Board with various
planning and zoning booklets which he received at the New
York State Association of Towns Meeting. The material in-
cluded a sample Planned Unit Development set-up. The Board
inspected the material giving particular attention to the
P U D material. The Chairman took the P U D folders home
with him for further study.
The Board discussed the adoption of the Development Plan
at some length. It was agreed that a statement be prepared for
publication in the newspapers. The Chairman appointed Henry
Raynor to prepare this statement. The Chairman suggested that
the Planning Board recommend to the Town Board that the "C-l"
Light Industrial District be re-named Commercial.
On motion by Mr. Wickham, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning Board hold a
special meeting at 7:38 P.M., Tuesday, March 23, 1971, for
the purpose of formally adopting the Development Plan for
the Town of Southold.

Richard Lark, Attorney a/c Louis F. Simeone and Joseph
T. Macari presented the Planning Board with a rev~s±on of the
northerly end of their proposed subdivision located at north
side of Bergen Avenue, Mattituck, New York. Mr. Lark stated
that the park and playground area is 2.6 acres and that the
parking area at the beach is adequate and a stairwell will be
installed for access to the water. Mr. Lark requested that
the Planning Board grant tentative approval to the lay-out
of this subdivision map subject to the approval of the Super-
intendent of Highways.
The Chairman told Mr. Lark that he felt that the park
and playground area was inadeqmate. Mr. Lark stated tha~
the engineer prepared this map according to the subdivision
regulations of Southold Town. The subdivision regulations
state that 2 acres of recreation area must be provided for
every 100 families. There will be 100 families in this sub-
division and the developers have 2.6 acres of park and play-
grQund area.
The chairman suggested that lot no.'s 84 & 85 be preserved,
perhaps by cluster development. Discussion was held in reference
to the possibility of clustering a portion of Section II. The
Chairman suggested a plan which would include about 20 lots in
the cluster with a half acre of area and 100 ft. road frontage.
Mr. Lark said that this was all tentative because they did
not plan to develop section II in the immediate future. The
Chairman cautioned him to be sure that he submits section II
for preliminary approval at the same time that he submits
section I. Preliminary approval is good for 3 years, provided
that the Health Department regulations do not change.
Mr. Lark asked the Board's opinion of a Planned Unit
Development ontthis subdivision. The Chairman said that he
thought this would be an excellent idea and that he would
speak to the Health Department about it.
Richard Lark, Attorney advised the Planning Board that
he will present final maps, applications, and fees for the
minor subdivisions of Elsie M. Grathwohl and the George F.
Grathwohl Estate at the next meeting of the Planning Board.
Discussion was held in reference to the variance
application of Peter Swahn for a reduction in the front
yard setback on lot no. 5 on the subdivision map of

On motion by Mr. Raynor, seconded by Mr. Wickham, it was
RESOLVED that the Southold Town Planning Board send a
letter to the Southold Town Board of Appeals advising them
to use their utmost discretion before deciding to grant a
variance on the above described property, as this is a
new subdivision recently approved by the Planning Board.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor~
Coyle, Grebe.
On motion by Mr. Moisa, seconded by Mr. Wickham, it was
RESOLVED that the next regular meeting of the Southold
Town Planning Board be held at 7:30 P.M., Tuesday, April 20,
1971, at the Town Office, Main Street, Southold, New York.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The meeting was ad3ourned at 10:00 P.M.
