Y. llg?l PLANNING BOARD MEMBERS John Wickham, Chairman Henry M o.lsa Alfred Grebe Henry Raynor Frank Coyle MINUTES SOUTHOLD TOWN PLANNING BOARD May 13, 1971 A regular meeting of the Southotd Town Planning Board was held at 7:30 P.M., Thursday, May 13, 1971, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor,; Frank Coyle. Absent: Mr. Alfred Grebe (due to unfavorable weather conditions) Mr. Robert W. Gillispie III presented the Planning Board with preliminary maps for the proposed minor subdivision of Joseph Gioscai, Peter D. Pizzarell~,, and Reuben Wecker, property located at south side of Main Road~EastMarion, New York. The map showed three lots: lot no. 1 contained 20,000~ sq. ft. of area; lot no. 2 contained 24,000~ sq..ft, of area; lot no. 3 contained 20,9006 sq. ft. of area. The map showed a 15 ft. right-of,way on east side of lot no. 1 '~nning south the entire length of the lot, 136 ft., from that point on the right-of-way continued to the south end of the property at a width of 10 ft. Southold Town P1 ning Board -2- ~y 13, 1971 The Chairman informed the applicants that this right-of-way is not acceptable. He advised them that 25 feet must be reserved for the right-of-way, and the right-of-way must be improved to a width of 15 feet. After some deliberation, the Board told them that the right-of-way must be 25 feet in width the entire length of lot no. 1 and for a distance of 100 ft. on lot no. 3. The remaining southerly part of the right-of-way beyond 100ft. of lot no. 3 can be 10 ft. in width. The Board advised Mr. Gillispie that determination will be made on this matter later in the evening. M_rs. Ann Rudin appeared before the Planning BQard in reference to her proposed minor subdivision located at corner of Carrington Road & Vanston Road, Cutchogue, New York. The Board inspected the revised map contained in file, dated May 4, 1971, This map showe~ a total of 7 lots, which the Board informed her is unacceptable. The Board in formed her that they would approve of lots 1, 2, & 3, but they would not accept the map showing the division of the remainder of the property as lo~s 4, 5, 6, & 7. Mrs. Rudin was advised that she would be notified tomorrow of the Board's final determi- nation after further deliberation of the Board later in the evening. Dominic Auridhio, Attorney presented the Planning Board with preliminary maps for proposed minor subdivision of Tendler & others, property located at east side of Ninth Street and south side of Brown Street, Greenport, N.Y. (property formerly owned by the Oak Grove Corporation) Mr. Aurichio stated that the property was purchased by four parties (Pipes Cove Corp.) and they wish to divide it into four parcels and each build a dwell- ing. The map showed five (5) lots. Lot no! 1 contained 129,730 sq. ft. of area; lot no. 2 contained 45,710sq. ft. of area; lot no. 3 contained 42,500sq. ft. of area; lot no. 4 contained 42~500 sq. ft. of area; lot no. 5 contained 47,430sq. ft. of ares. ~ot no. 1 included the filed subdivision map of Greenport Driving Park, Suffolk County Map No. 369, lot no.'s 1, 11, 13, 15, 17, 19, 21, 23, 25, 27, 29, & 31. Mr. Aurichio stated that they will file an abandonment on this filed map, none of these lots wall be sold. Mr. Aurichio stated that he will present the Planning Board with a letter to the foregoing effect. The Board stated that they will not accept a division of lot no. 1 in the future with lots containing less than 40,000sq. ft. of area. The Southold Town P1 ~ing Board -3- May 13, 1971 Board advised Mr. Aurichio that this matter will be discussed later in the evening and he will be notified tomorrow of the Board's determination. Dominic Aurichio, Attorney presented the Planning Board with final maps for the proposed subdivision "Petty's Bight", property located at north side of Main Road, Orient, N.Y., owned and developed by George & Irving Newman. Mr. Aurichio stated that they have secured Health Dept. approval and they have filed with the state for connection to the Main Road. The Chairman told Mr. Aurichio that the Supt. of Highways has notified the Planning Board that he disapproves of the road lay-out. Mr. Aurichio stated that he has since had the map revised. The Chairman informed him that the Planning Board must have a letter from the Supt. of Highways stating that he approves of the road lay-out. Mr. Aurichio requested that this subdivision be set up for a public hearing as soon as possible. Mr. Aur~hio stated that the highways in this sub- division are to be private roads. The Chairman stated that all highways in this subdivision must meet the Town Highway Specifications, and also informed him that the filing of a subdivision is conditional on the Town Board's approval and acceptance of a performance bond for the completion of the roads, drainage, and other improvements. Mr. Aurichio ques- tioned why the roads must meet the Town Specifications. The Chairman stated again that all highways in a proposed subdi- vision must meet the Town Specifications and suggested that he contact the Supt. of Highways about the road lay-out. Richard Cron, Attorney presented the Planning Board with preliminary maps for the proposed minor subdivision of property which he is under contract to purchase (present owner - Robert C. Milliken), property located at north side of Indian Neck Lane, Peconic, N.Y. The map showed five (5) lots: lot no. 1 contained 42,000sq. ft. of area; lot no. 2 contained 44,500sq. ft. of area; lot no.3 contained 46,000 sq. ft. of area; lot no. 4 contained 50,000sq. ft. of area; lot no. 5 contained 36,000sq. ft. of area. The ~map showed 30 ft. right-of-way running along the front of lots 1, 2, & 3, then westerly along the front of lots 4 & 5. All lots have over 100ft. frontage. The map showed a ditch beginning on Richmond Creek (on lot no. 4), running southerly through lots 4, 3, 2, and into lot no. 1. The Board required that Southold Town Planing Board -4- May 13, 1971 the line between the meadow and the upland be shown on the map. A lengthly discussion was held in reference to alleged dredging on or near this property by the present owner. The Board ad- vised Mr. Cron that determination would be made by the Board later in the evening. William Clark, Attorney presented the Planning Board with revised maps for the proposed minor subdivision of Edward R., Jr. & Ruth F. Fornuff, property located at south side of Naugles Drive, Mattituck, N.Y. The revised map showed division of property into four lots: lot no. 1 contained 28,779sq. ft. of area; lot no. 2 contained 31,324sq. ft. of area; lot no. 3 contained 32,880sq. ft. of area; lot no. 4 contained 33,103sq. ft. of area. The map showed 25ft. right-of-way in center of property running from Naugles Drive to the south end of the property. Lot no. 1 & 2 have l10.63ft, of frontage on Naugles ~rive (25ft. right-of-way included) Determination on this matter was tabled for further deliberation of the Board later in the evening. William Clark, Attorney presented the Planning Board with revised maps for the proposed minor subdivision of Peter and Mary Meskouris, property located at N/W corner of Cox Neck Road, and Luthers Road (Breakwater Road), Mattituck, N.Y. The revised map showed three (3) lots: lot no. 1 contained .947A; lot no.2 contained .948A; lot no. 3 contained .951 A. Existing dwelling and detached garage were shown on lot no. 2. The map showed all adjacent property owners. .There. was some discretion about the westerly boundary line goi~t~pond. The Board stated that they want to know just how much property he owns. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RES!OLVE~ that the Southold Town Pl~anning Board table ~e%ermination on the above proposed minor subdivision for further investigation and deliberation of the Board. Vote of the Board: Ayes; Messrs: Wickham, Moisa, Raynor, Coyle. Southold Town P1 ~ing Board -5- May 13, 1971 Mr. Steve Mitacchione appeared before the Planning Board in reference to his property located at west side of Eugene's Road, Cutchogue, New York, pursuant to the following letter which was sent to him on May 11, 1971: Steve Mitacchione North Side Road Wading River, New York Dear Mr. Mitacchione: It has come to the attention of the Planning Board that your contractor has been digging a canal in your property at Eugene's Road, Cutchogue, N.Y. This unauthorized canal is in direct and open violation of the "Rules and Regulations for the Subdivision of Land" currently in force in this Town. By this action you have seriously compromised the future use of this land. In addition, it may compromise future use of any other properties you may own in the Town. We would respectfully suggest that you immediately stop your contractor and that either you or your attorney attend the next meeting of the Planning Board to discuss steps to be taken to rectify this condition~-~or to present reasons why this prohibition may not be applicable. Very truly yours, cc- Town Attorney Town Trustees John Wickham, Chairman SQuthold Town Planning Board Mr. Mitacchione stated that some time ago, before he started any work, he came to see Mr. Terry, the Building Inspector. Mr. Terry told him that this was not under the Planning Board's jurisdiction, and suggested that he contact the Mosquito Control Commission and the Highway Dept. He then went to see Mr. Dean, Supt. of Highways, who referred him to the Mosquito Control Commission. After corresponding with the Mosquito ContEol Commission, they sent a letter of approval to Mr. Dean approving the proposed dredging. Mr. Dean then told him to go ahead and get a permit from the Town Trustees. Mr. Mitacchione said that he then secured his permit to dredge from the Town Trustees. Mr. Ramussen, an adjacent property owner, also secured a permit from the Town Trustees for permission for Mr. Mitacchione to dredge in front of his property. Several Town departments have received complaints that Mr. Mitacchione has gone beyond the permission granted to him by the Board of Trustees. Mr. Mitacchione said that he only dredged the areas as specified on the permit. He said that he did clean the gutter out at $~outhold Town P1 ning Board -6- ~ May 13, 19~1 the north end of the creek, at the request of Mr. Rasmussen, but he did not dredge it. The Chairman asked Mr. Mitacchione to send the Planning Board a copy of the letter of approval from the Mosquito Control Commission, a map showing exactly where the dredging has been done, and & letter from him stating his reasons for the dredging and stating that it is~not up into the meadow land. The Board advised Mr. Mita- cchione that they will make a physical inspection of the property, and if he has done no dredging up into the meadow land, they will write a letter stating that he has>~not vio- lated the Subdivision Regulations, and therefore it is not under the Planning Board jurisdiction. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board authorize Chairman John Wickham to inspect the above described property, and if he finds that there has been no dr~dging into the meadow land, w~ite a letter to Mr. Mitacchione stating that he has not dredged into the meadow land and therefore, this matter is not within the 3urisdiction of the Planning Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board authorize Chairman John Wi~ham to send the following letter to Russell Case: Russell Case Case's Lane Cutchogue, New York Dear Mr. ~ase: It has come to the attention of this Board that your contractor has gone beyond the permission granted by this Board to deepen the gutter to a depth of 3 ft. in order to obtain material to raise the level of the meadow in order to be useful in con$~ne- tion with the Cedars Golf Course. Such deepening, of course, being within the authority of the Town Trustees and dovered-by your permit from them. However, the reported dredging of a canal through the meadow across the front of your property is an entirely different matter and could well fall within the authority of this Board. Southold Town Pl"~ning Board -7 ~ May 13; 1971 "The Rules and Regulations for the Subdivision of Land" prohibit such canals without a specific permit from this Board. Since you have expressly stated that this improvement was to be made not only to keep the high tides from coming over the farm~ land under cultivation but also done in such a manner that it would not come within the scope of these regulations. This letter, then, is in effect serving n~tice that you will be expected to maintain this land in the use you have requested, namely a golf course. Obviously, to maintain it in its existing use, agriculture, or uses similar to these Would provide no problem. cc- Town Attorney Town Trustees Very sincerely, John Wickham, Chairman Southold Town Planning Board Mr. Almet Latson presented the Planning Board with revised maps for the proposed minor subdivision of property of Helen M. Latson, located at right-of-way off east side of Young's Avenue, Southold, N.Y. The Board inspected these maps and informed Mr. Latson that all revisions were in accordance with the require- ments set by the Planning Board at their last meeting. The Board questioned Mr. Latson as to whether or not the right-of-way goes all the way to Young's Avenue. Mr. Latson says that it does not, they come in through the park property and have been doing so since 1896. The Board advised Mr. Latson that determination will be made later in the evening and he will be notified of their decision tomorrow. Richard Lark, Attorney presented the Planning Board with preliminary maps for the proposed minor subdivision of property of Elaine Axien, property located at right-of-way off north side of Middle Road, Peconic, N.Y. The map showed five lots: lot no. 1 contained 61,380sq. ft. of area; lot no. 2 contained 62,635sq. ft. of area; lot no. 3 contained 68,932s~. ft. of area; lot no. 4 contained 74,678sq. ft. of area; i~t no. 5 contained 95,601sq. ft. of area. Mr. Lark explained that the large lots are due to unusua~'topographical donditions on the property. Discussion was held in reference to the 20ft. right-of-way on lot no. 5. T~e Chairman stated that since these lots are so large, the Southold Town P1 ning Board -8- May 13, 1971 Board will require a covenant stating that these lots will not be further subdivided in the future. Mr. Axien stated that these lots were very carefully laid out in this manner so as to take advantage of the terrain. Mr. R~.~rnor questioned if Mr. Axien was a stockholder in the C.P.F. Land Corp. (the adjacent property owner to the south) Mr. ~xien stated that he is not. On motion by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board table determination on the above described proposed minor subdivision so that the Board may make a physical inspection of the property. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Richard Lark, Attorney presented the Planning Board with maps for the proposed minor subdivision of Istepan Minakyan and Semun Bedikogtu, property located at north side of Sound- view Avenue, Mattituck, N.Y. The map showed three (3) lots: lot no. 1 contained 1.182 A; lot no. 2 contained 1.149 A; lot no.3 contained 1.128 A. Lot no. 1 has 106.62ft. of road frontage on Soundview Avenue, lot no.'s 2 & 3 have 105 ft. of road frontage on Soundview Avenue. Formal application and fee of $30 have been received. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED~that the Southold Town Planning Board grant final approval to the minor subdivision of Istepan Minakyan and Semun Bedikoglu, property located at north side of Soundview Avenue, Mattituck, N.Y. This motion shall include authorization for the Chairman to sign the final maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Richard Lark, Attorney presented the Planning Board with revised maps for the proposed minor subdivision of the Estate of George F. Grathwohl, property located at S/S Tuthill Road Southold Town Pi~ i~ing Board -9- ~ May 13, 1971 and E/S of New Suffolk Road, New Suffolk, N.Y. The map showed two (2) lots: lot no. 1 contained 36,164sq. ft. of area; lot no. 2 contained 29,882 sq. ft. of area. lot no. 1 has 200 ft. of frontage on Tuthill Road and lot no. 2 has 237.85 ft. on Tuthill Road and 61.67ft. on New Suffolk Road. Formal'appli- cation and fee of $20 have been received. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the minor subdivision of the Estate of George F. Grathwohl, property located at S/S TU~iil Road and E/S New Suffolk Road, New Suffolk, N.Y. This motion shall include authorization for the Chairman to sign the final maps. Richard Lark, Attorney presented the Planning Board with revised maps for the proposed minor subdivision of Elsie Grathwohl, property located at N/E corner of George's Road and New Suffolk Road, New Suffolk, N.Y. The map showed four (4) lots: lot no. 1 contained 45,756sq. ft. of area; lot no. 2 contained 52,507sq. ft. of area; lot no. 3 contained 42,628 sq. ft. of area; lot no. 4 contained 47,176sq. ft. of area. Lot no. 1 has 156.94ft. of frontage on ~ew Suffolk Road; lot no. 2 haslS0 ft. on New Suffolk Road & 280ft. on George's Road; lot no. 3 has 230.17ft. on The map showed 25ft. strip of land (part ) beginn£~g on George's Road, running northerly; to be used for access for lot no. 4. Grathwohl, Winfield J. Grathwohl, & Calvin F. Grathwohl, property located at S/S George's Road and E/S Fred Street, New Suffolk, N.Y. The map showed four (4) lots: lot no. 1 contained 57,064sq. ft. of area; lot no. 2 contained 61,265sq. ft. of area; lot no. 3 contained 53,983sq. ft. of area; lot no. 4 contained 64,865sq. ft. of area. Lot no. 1 has 225.50 ft. of frontage on George's Road; lot no. 2 has 200 ft. of frontage on George,s Road. Lot no.'s 3 and 4 are in- terior lots. Lot no. 3 begins on George's Road as a 25 ft. strip Of land, to be used as access for lot no. 3. Lot no. 4 begins on Fred Street as a 50ft. strip of land, to be used as access for lot no. 4. Formal application and fee of $40 have been received. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the minor subdivision of Ida M. Grodski, Wilfred H. Grathwohl, Winfield J. Grathwoht, & Calvin F. Grathwohl, property located at S/S George's Road and E/S Fred Street, New Suffolk, N.Y. This motion shall include authorization for the Chairman to sign the final maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Southold Town Planning Board reviewed again the original petition of Philip W. Abatelli, Cutchogue, New York, relative to change of zone from "A" Residential and Agricultural District to "B" Business District on certain real property situated at Main Road, East Cutchogue, New York, together with the instructions to prepare an official report defining the conditions contained therein. This property is situated at East Cutchogue, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: Beginning at a monument on the southerly side of Main Road distant 136.14 feet easterly from Eugene's Road Continuing thence to a monument 90 feet along Main Road on a bearing N 42 degrees 12 minutes east Southold Town P1 3ing Board -11- May 13, 1971 Thence on a bearing south 50 degrees 34 minutes east a dis- tance of 121 feet to a monument. Thence on a bearing south 42 degrees 12 minutes west a dis- tance of 90 feet to a monument. Thence on a bearing north 50 degrees 34 minutes west a~dis- tance of 121 feet to a monument at the point of beginning. The Planning Board discussed th,is proposed change of zone briefly. On motion by Mr. Wickham, seconded by Mr. Raynor~ it was RESOLVED that the Southold Town Planning Board table recommendation on the above proposed changed'Of zone until the next meeting, for further deliberation of the Board. Vote of the Board: Ayes;- Messrs: Wickham, Moisa, Raynor, Coyle. The Southold Town Planning Board reviewed again the original petition of Martin Filla, Mattituck, New York, relative to change of zone from "B" Business District to "B-2" Business District on one portion and from "A" Resi- ~ial~a~d Agricultural District to "B-2" Business District on the other p~rtion, on certain real property situated in East Cutchogue, New York, together with the instructions to prepare an official report defining the conditions con- tained therein. This property is situated at East Cutchogue, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: BEGINNING at a ~oint on the easterly line of Eugene's Road at the southerly ~orner of land now or formerly Of G1over and running thence along said land now or formerly ofl~lover and land of Abatelli, the following six (6) courses a~d dis- tances: 1. North 42° 12' 00" East 185.47 feet; 2. North 50° 34' 00" West 121.00 feet; 3. North 43° 44' 40" East 131.22 feet; 4. South 68° 15' 00" East°220.48 feet; 5. South 26° 11' 50" West 331.63 feet; 6. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board table recommendation on the above proposed change of zone until the next meeting, for further deliberation of the Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Southold T©~n Planning Board received from the Town Board the original petition of Franklyn Born, Treas., Casbor, Inc., Mattituck, New York, relative to change of zone from "A" Residential and Agricultural District to "B-2" Business District on certain real property situated in Mattituck, New York, to- gether with the instructions to prepare an official report defining the conditions contained therein. This property is situated at Mattituck, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: BEGINNING at a concrete monument on the southeasterly side of Westphalia Avenue at the northwesterly corner of the premises herein described; running thence along Westphalia Avenue two courses and distances: (1) South 70° 00' East 116.10 feet to a monument; (2) South 36° 23' 40" East 125.00 feet to a monument and Middle Road CR 27; running thence southwesterly along Middle Road CR 27 on a cur~e to the right having a radius of i799.86 feet to a distance of 306.9A feet to land of Kaiser; running thence along said land of Kaiser, North 67° 39' 30" West 192.35 feet to a monument at the southwesterly corner of the premises herein described; running thence North 29° 05' 10" East 97.51 feet to a monu- ment; and thence running North 36° 47' 30" East 258.96 feet to the monument at the point or place of beginning. The Planning Board discussed this proposed change of zone briefly. On motion by Mr. Coyle, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board table recommendation on the above proposed change of zone for further deliberation of the Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. , , Southold Town ~ nning Board -13- May 13, 1971 William Essex, Attorney appeared before the Planning Board for an informal discussion on property located at east side of Tuckers Lane, Southold, N.Y. Mr. E~ex & Others are contemplat- ing the purchase of this property for condominium a~artments. Mr. Essex stated that they propose four to five ~igi~g units per acre and will install public water and sewerage. Lawrence Tuthill, Engineer presented the Planning Board with revised estimate, in the amount of $1,200, for reduction of performance bond for the roads at Bennett's Pond, Mattituck, New York. On motion by Mr. Moisa, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board a 50% reduction in the performance bond, from $15,000 to $7,500, for the completion of the roads in the subdivision "Bennett's Pond", located at south side of Westphalia Road, Mattituck, New York, owned and developed by H. R. Reeve & Sons. The above recommendation together with copy of revised estimate as submitted by Lawrence Tuthill, Engineer, dated May 13, 1971, to be forwarded to the Southold Town Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Lawrence Tuthill, Engineer presented the Planning Board with revised estimate of $3,800 for the amount of performance bond to be require d for the completion of the roads in the subdivision "Calves Neck", located at Southold, New York, owned and developed by George Ahlers & Ano~ Larry advised the Board that the bulkheading has been completed as per speci fica tions. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold-Town Planning Board recommend to the Southold Town Board a reduction in the amount of the performance bond approved by the Town Board, from $15,000 to $3,800, for the completion of the roads in the subdivision "Calves Neck", located at Southold, New York, owned and developed by George Ahlers & ano. together with copy of revised Southold Town Pinioning Board -14- '~ May 13, 1971 estimate as submitted by Lawrence Tuthill, Engineer to be forwarded to the Southold Town Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board reviewed again the revised maps for the proposed minor subdivision of Ann Rudin, property located at S/E corner of Carrington Road and Vanston Road, Nassau Pt. Cutchogue, N.Y. Upon further inspection, the Board determined that these maps were not in accordance with the revisions as required by the Planning Board at their meeting held on April 20, 1971. The Planning Board reviewed again the proposed minor subdivision of Tendler & others. After some deliberation the Board set the following requirements: (1.) An abandonment must be filed with the Suffolk County Clerk's Office on lot numbers 1, 11, 13, 15, 17, 19, 21, 23, 25, 27, 29, & 31 on map of Greenport Driving Park, County Map No. 369~ (2.) The Planning Board will not, in the future, accept a minor sub- division of lot no. 1 with lots containing less than 40,000 sq. ft. of area. The Board will require that the applicant submit a letter of intent to the foregoing effect. (3'.) The right-of-way on the west end of the property (running along lot no. 2) must be ma~k~d as follows: "right-of-way for use by lots other than tot no.'s 2, 3, 4, & 5.
