Y. 11971 PLANNING BOARD MEMBERS John Wickham, Chairman Henry Molsa Alfred Grebe Henry Raynor Frank Coyle MINUTES SOUTHOLD TOWN PLANNING BOARD June 14, 1971 A regular meeting of the Southold Town Planning Board was held at 7:30 P.M. 0 Monday, June 14, 1971, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairm~n; Henry Raynor; Frank Coyle; ~lfred Grebe. Also present: Howard Terry, Building Inspector Mr. & Mrs. Peter Vignes appeared before the Planning Board in reference to their proposed minor subdivision located at south side of Naugles Drive, Mattituck~ N.Y. The map showed five lots and a 15ft. right-of-way. Lot no. 1 contained 40,000sq. ft. of area; lot no. 2 contained 35,000sq. ft. of area; lOt no. 3 con- tained 28,000sq. ft. of area; lot no. 4 contained 30,000sq. ft~ of area; lot no. 5 contained 29,.000sq. ft. of area. The lot immediately west of lot no. 1, which contained their residence, Southold Town Pi~ lng Board -2- June 14, 1971 was not included ink'the minor subdivision. The Chairman in- formed them that the Planning Board will not accept a minor subdivision on any parcel of land in which the owner with- holds part of the property. Mr. Vignes informed the Board that he was granted a variance by the Board of Appeals to set off this lot with 85 ft. of road frontage. He further explained that the reason for setting this lot off with 85 ft. of frontage was due to unusual topographical conditions on the property. This variance was granted by the Board of Appeals under Appeal No. 1430 at a public hearing held on May 27, 1971. Upon further inspection of this map the Board found that the adjacent property owners ~ere incorrect on the east and west boundaries. The adjacent property owner to the east should be Edward Fornuff. The adjacent property owners to the west (from north to south) should be Virginia Lindsay, Vito Suglia~ and A. Golz. The Board advised them that the map will have to be revised to show the correct adjacent property owners. The Planning Board informed Mr. & Mrs. Vignes that they would like to make a physical in- spection of the property before making a determina$ion. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board table determination on the proposed minor subdivision of Peter & Irma Vignes, property located at south side of Naugles Drive, Mattituck, New York, so that the Board can make a physical inspection of the property. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The Southold Town Planning Board received from the Southold Town Board the original petition of Edward R. Rolquin, Harbor Hill Drive, Lloyd Harbor, Huntington, New York, relative to change of zone from "A" Residential and Agricultural District to "C" Industrial District on certain property situated at Middle Road (CR 27) and Cox's Lane, East Cutchogue, New York, together with the instructions to prepare an official report defining the conditions contained therein. This property is situated at East Cutchogue, in the Town of Southold, County 8f Suffolk, New York, and more particularly bounded and described as follows: Bounded north by Middle Road, east by Cox Lane, south by land of A. Pietrewicz, and west by land of said Pietrewicz; Sguthold Town Plaiting Board -3- ~ June 14, 1971 containing by estimation one-half (½) acre, be the same more or less. Mr. Jack Driscoll appeared before the Planning Board on behalf of this application. The Planning Board discussed this proposed change of zone at some length. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board table recommendation on the above described proposed change of zone for further deliberation of the Board later in the evening. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Coyte, Grebe. Mr. Steve Mitacchione appeared before the Planning Board in reference to his dredging operation on his property located at the west side of Eugene's Road, Cutchogue, New York. Mr. Mitacchione inquired if his dredging operation is in violation of the "Rules and Regulations for the Subdivision of Land in the Town of Southold." The Board informed him that he is not in violation of the rules and regulations. The Chairman ad- vised him that the Board will accept a minor subdivision on this property~ ' ' ' ~ _ -' - - I The Board instructed Mr. Mitacchione to have a survey of the property made showing elevations, etc. so that it can be referred to the Suffolk County Soil and Water Conservation District for their comments. The Board advised Mr. Mitacchione that this matter will be discussed later in the evening and he will be informed of the Board's determination tomorrow. William Clark, Attorney presented the Planning Board with formal application and fee of $30. for the proposed minor subdivision of Peter and Mary Meskouris, property located at northwest corner of Cox Neck Road and LUther's Road (Breakwater Road), Mattituck, N.Y. Mr. Clark request- ed final approval of this proposed minor subdivision. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board table determination on above described proposed minor subdivision Southold Town Pl~?ing Board -4- ~- June 14, 1971 for further deliberation of the Board later in the evening. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Mr. Henry Romanowski appeared before the Planning Board in reference to "Laurel Country Estates", subdivision located at north side of Peconic Bay Blvd., Laurel, New York. Mr. Romanowski inquired if the Planning Board has checked to see how many test wells were placed in this subdivision. The Board said that they had not. There were supposed to be at least two test wells made within this subdivision. Mr. Romanowski contends that there was only one test well made. The Board advised Mr. Romanowski that if this is so then the subdivision will be ¥oid. Mr. Romanowski stated that River- head Cement Block Company has done damage on his property while building the roads. The Board advised him to collect from them for the damage they have done. Mr. Romanowski also stated that cars are entering onto his property from the cross roads in this subdivision and they are racing on his property. The Board said that they would check with Mr. Dean, Supt. of Highways, about putting up barriers at the dead-ends of these cross roads to prevent anyone from enter- ing onto his property. In reference to the number of test wells in this subdivision, the Board informed Mr. Romanowski that he will have to get a statement in writing from Mr. Kreiger stating that they only put in one test well and its' location. Mr. Romanowski stated that there was only one test well put in on the north end of the subdivision, and there was a water test taken on the property of Myron Young, property owner adjacent to S/W corner of subdivision. Mr. Romanowski said that he will get a statement from Kreiger and a statement from Mrs. Myron Young. The Board advised Mr. Romanowski that he will have to establish this fact in a court of law. Joseph Snellenberg, Attorney appeared before the Planning Board in reference to the proposed subdivision of Andrew Dzenkowski, to be known as "Aquaview Park", property located off east side of Rocky Point Road, at north and south sides of Southern Blvd. to Cedar Drive, East Marion, N.Y. Mr. Snellenberg requested that the Planning Board set a date for a public hearing on this subdiwision. The Board inspected Southold Town P1 ~ing Board -5- ~une 14, 1971 the file and found it to be in order. The Chairman read letter of approval from the Health Dept., however, the map was not sign- ed by the Health Dept. Mr. Snellenberg stated that H.W. Davids, Director of the Division of Environmental Health Services assured him over the telephone that he would sign the maps as soon as they were delivered to the Health Dept. A performance bond will not be needed for this subdivision because all of the roads are existing Town highways. On motion by Mr. Coyle, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board set the next regular meeting of the Board, 7:30 P.M., Monday, July 19, 1971, at the Town Office, Main Road, Southold, New York, as the time and place of hearing upon application of approval of the following plat: PLat of property owned by Andrew Dzenkowski, entitled "Aquaview Park", consisting of a parcel of land of 14~0~ acres, situated at East Marion, in the Town of Southold, Suffolk County, New York, bounded and described as follows: PARCEL I - Beginning at a point on the northerly line of Southern Boulevard, 312.51 feet easterly along said northerly line from Rocky Point Road; from said point of beginning run- ning along land of Dzenkowski, N. 3° 10' 40" W. - 407.52 feet; thence along the several lands of Davies, Centkowski and Wolski, N. 89° 57' 40" E. - 964.89 feet to the westerly line of Cedar Drive: thence along said westerly line of Cedar Drive, S. 10° 46' 00" E. - 357.86 ~eet to said northerly line of Southern Boulevard; thence along said northerly line, S. 86° 49' 20"W.- 1010.70 feet to the point of beginning. Christie appeared before the Planning Board in reference to their proposed division of lot number 11 of Captain Kidd Estates subdivision at Mattituck, New York. The Chairman read correspondence contained in file from Bernard H. Sachet, Attorney re- presenting Mr. & Mrs. Christie at that time, now deceasdd. Said letter was to inform the Planning Board that Mr. Nick Cyprus has cut a road through on their property in error and they are presently in litigation with him over the matter. The road was cut through on their easterly bound- ary line about 25 ft. in width for a distance of about 275 feet. This lot contains approximately 1.1 acres of land. Mr. Christie.~stated that lot numbers 10, 12, & 13 have all been divided. The Board advised Mr. & Mrs. Christie that they would like to make a physical inspection of the prop~ erty. The Chairman suggested that they bring in a sketch of the property showing ~xactly how they would like to divide it. The Board stated that all adjacent property owners and the exact area of the property must be shown on the map. Letter was received from Nelson Axien, dated June 6, 1971, in reference to the proposed minor subdivision of Elaine Axien, property located at private right-of-way off north side of Middle Road (CR 27), Peconic, New York. The Board inspected the preliminary map for this proposed minor subdivision. Lot no. 1 contained 61,380 sq. ft. of area; lot no. 2 contained 62,635 sq. ft.. of area; lot no. 3 contained 68,932 sq. ft. of a~ea; lot no. 4 contained 74,678 sq. ft. of area; iot no. 5 contained 95,601 sq. ft. of area. Lots 1-4 contained from 140 ft. to 244.59 ft. of road frontage, however, lot no. 5 has only 89.34 feet of road frontage. The map must be re- vised so that lot no. 5 has at lea~t 100 ft. of road frontage. Southold Town Pla~ing B~ard -7- ~ June 14, 1971 Also the Planning Board will require a statement from Mrs. Axien stating that she agrees to restrict the land from any further subdivision in the future. Letter to be sent to Nelson Axien advising him of the above required revision and condition. Howard Terry ~dvised the Planning Board that Westbury Equipment Company has sold a parcel of land on the northeast side of Pipe's Neck Road (Arshamomaque), ~reenport, N.Y. to David McCabe. This is an illegal sale because they have left a "finger lot" with less than 100ft. of frontage on an unapproved private road. The Planning Board advised that they have Van Tuyl & Son make a survey of the property and present it for approval. The Planning Board was presented with the revised map for the proposed minor subdivision of John Scheel, property located at north side of Bay Avenue, Cutchogue, New York. Upon inspecting this revised map the Board found that further revision will be necessary. The Planning Board will require a 25 ft. easement to Bay Avenue instead of leaving a 24 ft. corridor. Also the Board willlrequire that lot number 3 have at least 100 ft. of frontage on the Bay. Letter to be sent to William Wickham~ the applicant's attorney, advising him of the foregoing requirements. The Southold Town Planning Board reviewed again the original petition of Martin Filla, Mattituck, New York, relative to change of zone from "B" Business District to "B-2" Business District on one portion and from "A" Resi- dential and Agricultural District to "B-2" Business District on one other portion, on certain real property situated in East Cutchogue, New York, together with the instructions to prepare an official report defining the conditions con- tained therein. This property ~s situated at East Cutchogue, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as~follows: Southold Town P1 ~ing Board -8- June 14, 1971 BEGINNING at a point on the easterly line of Eugene's Road at the southerly corner of land now or formerly of Glover and running thence along said land now or formerly of Glover and land of Abatelli, the following six (6) courses and dis- tances: 1. The Planning Board discussed this proposed change of zone. On mo~ion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board recommend favorably to the Southold Town Board the change of zone from "B" Business District to "B-2" Business District and from "A" Residential and Agricultural District to "B-2" Business District on the above described property. It is the opinion of the Planning Board that it would be advantageous to the area if the remaining residential portion of the property, on the east side of Eugene's Road, were divided into lots containing not less than one acre of area each. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The Southold Town Planning Board reviewed again the original petition of Philip W. Abatelli, Cutchogue, New York, relative to change of zone from "A" Residential and Agricultural District to "B" Business District on certain real property situated at Main Road, East Cutchogue, New York, together with the instructions to prepare an official report defining the conditions contained therein. This property is ~uated at East Cutchogue, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: BEGINNING at a monument on the southerly side of Main Road distant 136.14 feet easterly from Eugene's Road; Continuing thence to a monument 90 feet along Main Road on a bearing N. 42 degrees 12 minutes east; thence on a bearing south Southold Town P1, ~j~ing Board -9- ~,_l June 14, 1971 50 degrees 34 minutes east a distance of 121 feet to a monument; thence on a bearing south 42 degrees 13 minutes west a distance of 90 feet to a monument, thence on a bearing north 50 degrees 34 minutes west a distance of 121 feet to a monument at the point of beginning. The Planning Board discussed this proposed change of zone. On motion by Mr. Grebe, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board recommend favorably to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "B" Business District on the above described property. This proposed change of zone would complete the business zoning within the perimeter of the lot. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The ~outhold Town Planning Board reviewed again the original petition of Franklyn Born, Treas., Casbor, Inc., Mattituck, New York, relative to change of zone from "A" Residential and Agricultural District to "B-2" Business District on certain real property situated at Mat~ituck, New York, together with the instructions to prepare an official report defining the conditions contained therein. This property is situated at Mattituck, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: BEGINNING at a concrete monument on the southeasterly side of Westphalia Avenue at the northwesterly corner of the premises herein described; running thence along West- phalia Road two courses and distances: (1) South 70° 00' East 116.10 feet to a monument; (2) South 36° 23' 40" East 125.00 feet to a monument and Middle Road C.R. 27; running thence southwesterly along Middle Road C.R. 27 on a curve to the right having a radius of 1799.86 feet a distance of 306.91 feet to land of Kaiser; running thence along said land of Kaiser, North 67° 39' 30" West 192.35 feet to a monument at the southwesterly corner of the premises here- in described; running thence North 29° 05' 10" East 97.51 feet to a monument; and thence running North 36° 47' 30" East 258.96 feet to the monument at the point or place of beginn- ing. Moisa, it was RESOLVED that the Southold Town Planning Board recommend unfavorably to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "B-2" Business District on the above described property. The Planning Board approved a minor subdivision on this property on date of February 25, 1970. It is the opinion of the Planning Board that the applicant has not allowed a reasonable length of time in which to sell the lots in this minor subdivision. Containing approximately two (2) acres of land. The Planning Board discussed this proposed change of zone. This property lies just east of the New Bethany Cemetery Association. The Planning Board decided that they should be notified before any recommendation is made. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board table recommendation on the above proposed change of zone for further deliberation of the Board. This motion shall include authorization for a letter to be sent to the New Bethany Cemetery Association notifying them of this proposed change of zone and requesting any recommendations or suggestions they may have. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Received request for information on the Master Plan from the L.I. Commercial Review. Reply to be sent advising them that all studies and material on the Master Plan are available at all town offices and town libraries. Southold Town Pi~ ing Board -12.~ June 14, 1971 Received letter from the Supt. of Highways approving the lay-out of the roads in "Pet~y's Bight", proposed subdivision at orient. This letter did not indicate the date of the map to which this approval applies. Letter to be returned to the Supt. of ~ighways together with request for date of subject map. Letter received from the Suffolk County Health Dept. in reference to Petty's Bight. Robert Villa stated that the Health Dept. approval of this proposed subdivision applies to the map as submitted. If it should be disapproved ~m revised, they will require a re-submission of the revised map for their review and re-approval. Further discussion was held zn reference to "Laurelwood Estates" subdivision, at north side of Peconic Bay Blvd., Laurel, N.Y. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board send a letter to the Supt. of Highways notifying him of the request received for barriers to be placed at the cross roads in the above described subdivision and inquiring how this matter can best be handled. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. On motion by Mr. Grebe, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board authorize Chairman John Wickham to write a letter to Steve Mitacchione informing him that his dredging operation located on the west side of Eugene's Road, Cutchogue, N.Y. is not in violation of the "Rules and Regulations for the Subdivision of Land." Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Southold Town Pla~_ing Board -13- June 14, 1971 The Planning Board was presented with the final maps for the proposed minor subdivision of Peter & Mary Meskouris, prop- erty located at N/W corner of Cox Neck Road & Luther's Road (Breakwater Road), Mattituck, N.Y. Upon inspecting these maps the Board approved of the lay-out of the lots in this m~nor subdivision. However, before granting final approval to these maps the Board will require that the exact number of feet owned by Stanley Sledjeski on Cox Neck Road, between the westerly boundary line of this property and the easterly boundary line of the property of Pausewang, be printed on the final maps. Letter to be sent to Alden Young, Surveyor, advising him of the above. · he Planning Board discussed again the proposed change of zone application of Edward R. Rolquin, relative to change of zone from "A" Residential and Agricultural District to "C" Industrial District on certain property situated at Middle Road (CR 27), and Cox's Lane, Cutchogue, New York. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board recommend unfavorably to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "C" In- dustrial District on the above described property. The Planning Board has received no notification from the County of change of policy to keep business off of C~ 27. The area of this parcel .4 acre is too small a parcel for an industrial site. Upon receipt of nOtification of change of policy from the County, and the purchase of an additional 1,6 acres of land to add to th~s property to make it conform with the Master Plan and the new zoning regulations, the Planning Board would be willing to re-consider this application. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Howard Terry ~ the Planning Board with the revised proposed "Wetlands Ordinance" for the Town of Southold. The public hearing for the adoption of this ordinance is shceduled to be held on June 29, 1971. There is no provision for referral to the Planning Board in this ordinance. After inspecting this ordinance the Board felt that there were many errors contained in it which would cause complications in enforcement. Southold Town Pla~ng Board -14- ~une 14, 1971 This matter to be discussed~'further at the sPecial meeting of the Planning Board to be held at 7:30 P.M., Friday, June 16, 1971, at which time recommendation will be made to be sent to the Town Board. Mr. Terry presented the Planning Board with the corrected insert sheets for the proposed amendments to the Zoning Ordinance, received from Town Attorney Tasker. The Planning Board checked over the list of approved subdivisions contained in the back of the amendments to the Zoning Ordinance on pages 61 and 62. They found this list to be in order except that Willow Point was listed twice. Upon inspecting these corrected insert sheets the Board found that several sections of the amendments have been ommitted. Item number 14 on page 14 of the amendments, pertaining to the control of yard sales by special exception of the Board of Appeals, Article III, has been ommitted from these corrected insemt sheets. Article V, Section 502, on page 2loaf the amendments has also been ommitted. This section pertains to the length of building in the "M" Multiple Residence District. The Board recommended that Section 502 be put back into the amendments and that the following exception be placed on it: "Each of the foregoing requirements may be varied by 20 percent in case of clustering only.~ This matter to be discussed further at the special meeting of the Planning Board to be held at 7:30 P.M., Friday, June 16, 1971, at which time recommendations will be made to be sent to the Town Board. The Planning Board was presented with the proposed new "Zoning Map." The Board inspected the map briefly. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that a special meeting of the Southold T~n Planning Board be held at 7:30 P.M., Friday, June 18, 1971, at the Town Office, Main Road, Southold, New York, for the purpose of inspect- ing the proposed "Wetlands Ordinance", proposed "Zoning Ordinance", and proposed "Zoning~4ap" and making recommendations on them to be'~ sent to the Town Board.
