Y. 11971 PLANNING BOARD MEN BERS John Wickham, Chairman Henry Molsa Alfred Grebe Henry Rayno~' Frank Coyle MINUTES SOUTHOLD TOWN PLANNING BOARD Special Meeting June 18, 1971 A special meeting of the Southold Town Planninq Board was held at 7:30 P.M., Friday, June 18, 1971, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickha~'~ Chairman; Henry Moisa, Vice-Chairman. Absent: Messrs: Henry Raynor, Frank Coyle, & Alfred Grebe. Also present: Raymond Dean, Supt. of Highways; and Howard Terry, Building Inspector The subdivision fee due on '~alves Neck" will be $670. This amount is computed on the basis of a flat fee of $50., plus $5. per acre (3.516 A.. n 4 A.) - $20., plus 4% of a $15,000. bond - $600. The $600. figure was computed in view Southold Town P]~ ning Board -~ June 18, 1971 of the fact that the Town Board would not approve of a reduction in the amount of the bond as recommended by the Planning Board. The Town Board will require George ~[hlers to post a performance bond of $15,000. The drainage in this subdivision was discussed by the Planning Board and Mr. Dean, Supt. of Highways. Mr. Dean recommended that the drainage be revised as follows: All basins to be connected together and an overflow pipe be installed on the 15 ft. right-of-way, so that the excess water will run to the creek. Mr. Dean stated that he will send this recommendation to the Planning Board in writing. In regard to "Laurel Country Estates", Mr. Dean stated that he recommends that beam type guard rails be placed at all spur roads or cross roads in all subdivisions. Mr. Dean to send the Planning Board this recommendation in writing together with speci- fications for the guard rails. The ~lanning Board advised Mr. Dean that his letter approving the lay-out of the roads in the proposed subdivision "Petty's Bight" must contain the date of the map to which the approval applies. The subdivision fee due on the proposed subdivision "Aquaview Park", owned by Andrew Dzenkowski, will be $120. This fee is computed on the basis of a flat fee of $50. plus $5. per acre (14 A. - $70. ) A performance bond will not be required as all roads in this subdivision are existing town ~oads~ This sub- division is scheduled for a final hearing on July 19, 1971. Mr. Dean informed the Planning Board that there is a drain- age problem at Sunset Knolls, Section II. Mr. Dean stated that he spo~e with Dick Lark recently in reference to the dddication of the roads in Section I and Section IIof Sunset Knolls. Mr. Lark told him that Section I is ready to be dedicated and Section II will be ready very shortly. Mr. La~ plans on waiting for the Southold Town Pi' ning Board -3- _~_.June 18, 1971 completion of Section II and dedicating them both at the same time. Mr. Dean advised him to go ahead and dedicate Section I when it is ready, not to wait for Section II, dedicate them separately. Mr. Dean stated that he will have Larry Tuthill make an inspection of Section I and write a letter of recom- mendation when it is ready to be dedicated. Mr. Dean advised the Planning Board that Reeve Bros. are trying to get the roads ready to be dedicated in "Bennett's Pond", subdivision located off south side of Westphalia Road, Mattituck, N.Y. Mr. Dean stated that he will require the following items to be completed before recommending dedication: 1. The circle in the road has to be straightened out. 2. Barri- cades have to be put up at the cross road. 3. Several road signs have to be erected. 4. The road has to be pa~ched in several places, and 5. Stone has to be applied to it. Mr. Dean also advised the Planning Board that Peconic Homes, Inc., owners and developers of "Eastward Manor Estates", subdivision located at S/S Main Road, Mattituck, N.Y., want to dedicate their roads before fall of this year. Mr. Dean stated that he has so many subdivisions that want to dedicate their roads this year that it will upset his budget greatly. The Planning Board discussed the proposed minor subdivision of Peter & Irma Vignes located at S/S Naugles Drive, Mattituck, N.Y. The Chairman recommended that determination be tabled on this matter until they complete the sale on their house on the adjoining lot, which was shown on the map but was left unnumbered. Also the Planning Board will require that the proposed right-of- way be 25 ft. in width, not 15 ft. as shown on the map. On motion by Mr. Moisa, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board send the following two letters: Southold Town P3"-'~'~ning Board -4- nne 18, 1971 Steve Mitacchione Northside Road Wading River, New York Dear Mr. Mitacchione: In regard to your appearance at the meeting of the Planning Board on June 14, 1971, please be advised that the Planning Board has taken the following action: From evidence presented it appears that you have not dredged any upland, and therefore are not in violation of the Pules and Regulations for the Subdivision of Land. As was further explained to you, you will probably present an application for a minor subdivision at some time in the future and at that time the Planning Board will forward the application to the Soil & Water Conservation District for suggestions as to sloping and seeding the waterfront. Rasmussen Beebe Drive Cutchogue, New York Dear Mr. RasmussenA It would appear that you are very substantially in violation of the Rules and Regulations for the Subdivision of Land which have been in effect in this Town for some years. I refer in particular to the dredging of meadow land on your property at Eugene's Road, Cutchogue, New York. I should like to point out that although I believe you have a permit from the Town Trustees for this dredging, you have no~ filed for a permit with this Board. Southold Town P]f'~lning Board -5- June 18, 1971 I would like to point out further that under existing regulations you are well within your rights to engage in dredging and filling on your own property where there is no anticipation of selling or further subdividing. However, it is the contention of this Board that most filling and dredging of wetlands is done in anticipation of sale or subdivision. This letter, then, is serving notice that by your actions you have seriously compromised any subdivision or any sale toward the purpose of subdivision. We would be happy to discuss this further with you or your attorne~ and feel that this is a very important matter. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board send the following letter to the Southold Town Board: Southold Town Board 16 South Street Greenport, New York Gentlemen: Ptease be advised that the Southold Town Planning Board reviewed the revised proposed "Wetlands Ordinance" at a special meeting held on June 18, 1971. A public hearing is scheduled to be held on June 29, 1971 in reference to this matter. The Southold Town Planning Board hereby objects to the adoption of the revised proposed Wetlands Ordinance on the following grounds: Southold Town Pl~.ning Board -6- June 18, 1971 1. There is no provision for the Planning Board to review the applications. 2. There are not enough copies of applications, maps, or other information required to make a complete file for the' Building Inspector, Town Clerk, Town Trustees, Planning Board, Board of Appeals, or Town Board to sonsider the work or issue permits on. 3. There is too much latitude in case of a violation. 4. There are no elevations to work from, above or below highwater mark. 5. More help will be needed to enforce it. 6. There is no provision for preserving any of the fresh water areas. 7. There is no provision to preserve the wetlands by size of lot - small lots, large parcels. 8. There is no permit required to repair anything (docks, bulk- heading, dikes, sloughing of canals, etc.) The Planning Board's main objection is that this ordinance makes no attempt to actually preserve the wetlands. On motion by Mr. Moisa, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board send the following letter to the Southold Town Board: Southold Town Board 16 South Street Greenport, New York Gentlemen: Southold Town P1 ~%ing Board -7- ~ June 18, 1971 Please be advised that the Southold Town Planning Board reviewed the proposed "Amendments to the Zoning Ordinance" at a special meeting held on Friday, June 18, 1971, and the Southold Town Board of Appeals reviewed the proposed "Amendments to the Zoning Ordinance" at their regular meet- ing held on Thursday, June 17, 1971. The Planning Board and the Board of Appeals recommends to the Town Board the following additions and changes: Page 4 -(Definitions)- HOME OCCUPATIONS, add - home bakinq, etc. - HOTEL - add - room or apartment. Page 5 - " - MARINA OR BOAT BASIN - add- with or without compensation. Page 7 -(Definitions)- TOURIST COTTAGE - add temporary seasonal occupancy. Page 7 -(Definitions)- YARD, FRONT - add - and a buildin9 line drawn parallel thereto. Page 7 -(Definitions)- pARD, REAR - add -and a buildinq line drawn parallel thereto. Page 7 -(Definitions)- YARD, SIDE - add - and a buildinq line drawn parallel thereto between the front and rear yards. Page 11 ~ Article III, Section 300 A - add Subsection 4, - Privately owned horses (riding horses or pets) on lots of one-half (½) acre or larger, or by special exception by the Board of Appeals. Page 14 - Article III, Section B-add Subsection 14, - Yard sales, attic sales, garage sales, auctions, and all similar sales of personal property of the tenant, or owner, if owner- occupied premises, shall be by special permit from the Board of Appeals, at such hours and such dates and under such condi- tions and terms as the Board of Appeals may prescribeo Such sale shall be limited to one sale per person per year. Page 21 - Article V - add - SECTION 502 - BUILDING LENGTH & SEPARATION - No building shall exceed 125 feet in length. The minimum distance between principal buildings shall ~e equal to 2 times the height of the highest building, and the minimum distance between a principal and an accessory building shall be 20 feet. Upon approval of the Planning Board, each of the foregoing requirements may be varied by 20 percent in case of clustering only. Page 57 - Signs - The fee for all signs, except signs permitted by Section 300 C 7 (a), shall be ~.25 for each square foot of sign area with a minimum fee of ~2Q00. Gillispie, Jr., Chairman Southold Town Board of Appeals The Planning Board inspected the proposed New Zoning Map. Several recommendations were made. This matter to be discussed further at another special meeting to be held some time next week. Recommendations and comments will be made at that time to be sent to the Town Board.
