There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank Coyle. Absent: Mr. Alfred Grebe (Due to unfavorable weather conditions,~)~ Also present: Howard Terry, Building Inspector The chairman called the meeting to order at 7:30 P~M. Mr. Raynor also read the affidavits ~ftesting to its publication in the Suffolk Weekly Times and the Long Island Traveler. Southold Town Planning Board -3- July 19, 1971 The Board inspected the final maps which contained the Health Dept. signature of Herbert W. Davids, Director of the Division of Environmental Health Services, on date of June 14, 1971. THE CHAIRMAN: We have a whole series of correspondence with the Health Dept. on the size of the lots. This is also in order and signed by H.W. Davids, Director of the Division of Environmental Health Services. The Chairman read the letter of October 21, 1970 from the Health Dept. advising the developer that this subdivision has been approved as a result of the action of the Board of Review. The Chairman also read the Planning Board's letter of January 13, 1971 advising the developer to purchase the 3acent right-of-way owned by Edna Brown, which the developer did purchase. THE CHAIRMAN: This matter has been before the Board for some time. It has met the approval of the Board on numerous occasions. THE CHAIRMAN: ts there anyone present who wishes to speak against this subdivision? JEAN TIEDKE (Representative of L.W.V.) : Is this one acre lots? THE CHAIRMAN: No, these lots~are not all one acre. The nine lots on the north side of Southern Blvd. are one acre lots, but the remaining six lots in this subdivision are 3/4 acre+. All of these lots have been approved by the County Health Dept. THE CHAPMAN: Is there anyone present who wishes to be heard in favor of this subdivision? JOSEPH J. SNELLENBURG: I am the attorney for the developer. Ail of the lots in this subdivision are in conformity With the Board of Healthl In view of the existence of town roads running east, west, north, and south, no road construction will be necessary. The lots on the north side of Southern Blvd. average well over 40,000sq. ft. of area. The other parcels were varied by the County Health Dept. THE CHAIRMAN: Is there anyone else present who wishes to be heard in favor of this subdivision? Mr. & Mrs. Andrew Dzenkowski acknowledged their presence. Southold Town Planning Board -4- July 19, 1971 THE CHAIRMAN: All of the lots in this subdivision front on existing public highways, therefore no road construction or bonds will be required. We have discussed the parcel of land on the N/E corner of Southern Blvd. and Rocky Point Road which Mr. Dzenkowski is reserving for his own use. Therefore, if there is no one else wishing to be heard on this subdivision? (There was no response. ) THE CHAIRMAn,: I will close the hearing at this time. Planning Board will take action on this matter later in the evening. The Mrs. Ann Rudin appeared before the Planning Board in reference tO her proposed minor subdivision located at S/E corner of Carrington Road and Vanston Road, Cutchogue, N.Y. Mrs. Rudin presented the Board with revised maps showing five lo~s. However, Mrs. Rudin inquired if she could revise the number of lots in this minor subdivision to four instead of five. The Board agreed to this revision and advised Mrs. Rudin to have maps revised to show four lots, the three lots fronting on Carrington Road and the remainder of the property to be lot no. 4 Mrs. Rudin presented the Board with two (2) copies of formal application and fee of $40. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Ann Rudin, property located at S/E corner of Carrington Road & Vanston Road, Cutchogue, N.Y., subject to receipt of three (3) copies of revised final map showing four (4) lots. William Wickh~m, Attorney appeared before the Planning Board in reference%'to the proposed minor subdivision of Elaine Axien. Mr. Wic~]~h~_m presented the Board with formal application and fee of $50. The revised map showed five lots. Lot no. 5 now has 100 ft. of frontage on the right- of-way as ~required by the Board at their last meeting. The B~ard informed Mr. Wickham that a restriction must be placed on these lots, so that they cannot be further subdivided in the future. Mr. Wickham stated that they are restricted by Southold Town Plaiting Board -5- July 19, 1971 the contour of the land itself, each lot is set off so that there can be only one house on each lot. Mr. Wickham stated that he will submit a recordable covenant to the Planning Board stating that these lots will ~ot be further subdivided in the future. Mr. Edward Abitz appeared before the Planning Board to request permission to re-grade lot no.'s 17 & 18 of "Mattituck Estates" in order to make them suitable for building. The restrictions in this subdivision call for a 50 ft. setback. If these lots were built upon in their present conditions the water would run into the back of the houses. Howard Terry, Building Inspector stated that lot no. 17 would have to be re-graded in order to meet the Housing Code require- ments. Mr. Henry Raynor made a physical inspection of these lots prior to this meeting. Mr. Raynor stated that these lots will have to be re-graded in order to build on them and he sees no objections at all as long as the fill is not used to fill meadow lands. Mr. Abitz stated that the fill will not be used to fill wetlands, but it will be used within Mattituck Estates subdivision. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board grant Edward Abitz permission to re-grade lot no.'s 17 & 18 of "Mattituck Estates" in order to make them suitable for building. This permission is granted subject to receipt of the following: (1) Letter from Mattituck Estates, Inc. stating that lot no.'s 17 & 18 belong to two private owners. (2) A letter from each of these two private owners stating that they will limit the re-grading to the approximate areas as shown on the map, and not re-grade below 7 ft. cuntour. (3) Statement that the surplus fill will not be...used to fill ~tlands and will be used within Mattituck Estates subdivision. (4) Copy of map as presented to the Planning Board at their meeting on July 19, 1971 showing proposed re-grading." Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, ~oyle. Mr. & Mrs. Peter Vignes appeared before the Planning Board to request final approval of their proposed minor subdivision located at south side of Naugles Drive, Mattituck, Southold Town Planning Board -6- July 19, 1971 New York. The Planning Board advised Mr. & Mrs. Vignes that this matter will be discussed later in the evening at which time the decision will be made by the Board. Mr. Ralph Assel~a appeared before the Planning Board to informally discuss the proposed division of his property located at north side of Main Road, Cutchogue, New York. The total area of the parcel is 2.883 acres. The Board informed Mr. Asselia that the maximum number of lots that they will allow in this parcel will be three (3). Mr. Assel~a to make up preliminary sketch of how he would like to divide the property and present it to the Board at the next meeting. Mr. Peter Blank presented the Planning Board with preliminary plan for the proposed minor subdivision of property of M. L. Blank, located on right-of-way off east side of King. Street, Orient, N.Y. This property fronts on Pete Neck Creek and Orient Bay. The proposed division of this property did not include the meadow land within the minor subdivision. The Chairman recommended that they run the lines right out to Pete Neck Creek and convey the wetlands with the lots. The Board informed him that they can have up to 5 lots if they put the meadow land into the lots and meet the 100ft. frontage requirement. Mr. Blank to revise lay-out of this pro- posed minor subdivision and present it to the Board at the next meeting. Walter Kapp, Attorney presented the Planning Board with final maps of the minor subdivision of George Braun (to Edward Skwara) as approved by the Planning Board on May 6, 1970, subject to receipt of revised and up-dated survey of the property. This property has been under contract to be sold to Edward Skwara since October 1967. The maps which Mr. Kapp presented showed Edward Skwara as the owner of the property, The Planning Board stated that they will require Mr. Kapp to submit copies of the contracts Southold Town Pl.~,~ing Board -7- ~ July 19, 1971 of s~le between George Braun and Edward Skwara for the lots in this minor subdivision, and will also 'require him to submit three (3) copies of revised map showing ~eorge Braun as the owner at the time the map was drawn up and Edward Skwara as the contract vendee. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the minor subdivision of Edward Skwara, property lOcated at west side of Stillwater Avenue, Cutchogue, New York, subject to receipt of the following: (1) Copies of the contracts of sale between George Braun and Edward Skwara for the lots in this minor subdivision. (2) Three (3) cop~es of revised map showing George Braun as the owner at the time the map was drawn up and Edward Skwara as the contract vendee. (3) Application fee of $20. This motion shall include authorization for the Chairman to sign the final maps upon receipt of the above. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. William smirch a/c W.H.D. Realty Corp. presented the Planning Boardiwith preliminary map for proposed subdivision "Northwoods Estates", property located at south side of Sound- view Avenue, Southold, N.Y. Preliminary map showed eleven (11~) lots all containing over 40,000sq. ft. of area with frontage on Soundview Avenue from 120ft. to 250ft. W.H.D. Realty Corp, also,owns a two acre parcel Of land on the north sid~ of Soundview Avenue, directly across the street from thiS proposed Subdivision. Mr. Smith sta~ed that this parcel will not be part of the subdivision. The~ plan to sell this parcel off as a two acre lot or two one acre lots in the near future. Mr. smith stated that they have gone to the Health Dept, and Mr. Villa has marked the test holes and test well. The map showed all adjacent property owners to the east, south, and west, but did not show the property owners on the north side of Soundview Avenue. The Board informed Mr. Smith that they will require that the map show the property owners on the north side of Soundview Avenue. Mr. Smith to have map revised and present it at the next meeting of the Planning Board. Southold Town Pla~ing Board -8- ~ July 19, 1971 Mr. Massimo F. Yezzi presented the Planning Board with revised site plan of the proposed "Mattituck Shopping Center." This plan showed the post office connected to the shopping center complex as originally planned. This plan has all the buildings attached in a contigious manner. The main sidewalk and parking area remain the same as previously approved. The southerly entrance has been ~liminated. On motion by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the revised site plan of the proposed "Mattituck Shopping Center", property located at N/E corner of Main Road and Factory Avenue, Mattituck, New York. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Mr. & Mrs. Francais J. Christie presented the Planning Board with final maps for their proposed minor subdivision located between south side of Sound Beach Drive and north side of Summit Drive, lot no. 11 on map of Capt. Kidd Estates, Mattituck, N,Y. The maps showed a division of this lot into two parcels. One parcel contained an area of 25,619 sq. ft. and the other contained an area of 22,297 sq. ft. Both parcels have over 100 ft. of road frontage. The map showed a 15 ft. right-of-way on the east side of the parcel on the north side of Summit Drive, to be used as access for both lots. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVE~ that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Erancais J. Christie, property located between south side of sound Beach Drive and north side of Summit Drive, lot no. 11 on map of Capt. Kidd Estates, Mattituck, N.Y. The Chairman signed the final maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Southold Town Planning Board -9- July 19, 1971 Mr. & Mrs. Tsontakis appeared before the Planning Board for an informal discussion on the possibility of creating minor subdivisions out of lots 5 & 6 of Capt. Kidd Estates. Mr. & Mrs. Tsontakis plan to purchase one of these logs and Mr. & Mrs. Nackos plan to purchase the other. Each of these lots will be purchased separately from Dawn Estates, Inc. and a separate application will be made for a minor subdivision on each of them. Mr. Tsontakis stated that Dawn Estates, Inc. told them that the 10ft. right-of-way on the west side of lot no. 5 could be removed and 5 ft. added to each of the two lots. The Planning Board informed them that this right-of-way could not be removed because this is a filed approved subdivision map. In order to do this they would have to abandon this map and re-file it. Mr. & Mrs. Tsontakis asked the Board's opinion of how to divide this property most a~Vantageously~~ The Board informed them that each of these lots could be divided into two lots and possibly a right-of-way placed between the lots as access for the northerly lots. The Board informed them that each of these lots must contain at least 20,000sq. ft. of area. Mr. & Mrs. Tsontakis to draw up preliminary sketches for the division of the property and present them at the next Planning Board meeting. The Planning Board was presented with preliminary sketch for proposed minor subdivision of Margaret Guimaraes, property located off north side of Main Road, East Marion, N.Y. (adjacent to Cove Beach Estates minor subdivision of 5 lO~s.) The sketch as presented showed four (4) ½ acre lots and a large parcel of land to the south containing two houses which was left unmarked. Lots 1, 2, & 3 front on L.I. Sound and on the no~h side of the proposed 50ft. road. Lot no. 4 and the remaining parcel contain- ing the two houses are on the south side of this proposed 50 ft. road. This proposed 50ft. road will tie into Schroeders subdivision to the west and Cove Beach Estates on the east. The entire area of the parcel is 10.8 acres. The Board stated that they would consider approval of the three lo.ts on the north side of the proposed road. However, the entire parcel on the south side of the proposed road must be labeled as lot no. 4, and we must receive a statement from Mrs. GUimaraes agreeing not to further subdivide lot no. 4 in the futurei ~n order to further subdivide lot no.4 they will have ~o make a major subdivision of the entire parcel. Letter to be sent to Mrs. Margaret Guimaraes notifying her of the Planning Board's requirements for this minor subdivision. Southold Town Planning Board -10- July 19, 1971 The Planning Board was presented with statement of explaination from Alden Young and copy of revised map for the minor subdivision of ~eter & Mary Meskouris, located at N/W corner of Cox Neck Road and Luther's Road (Brea~- water Road), Mattituck, N.Y. The revised map showed a distance of 240.50 feet owned by Sledjeski from the west- erly boundary line of this minor subdivision to the east line of Pausewang. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Peter & Mary Meskouris, property located at N/W corner of Cox Neck Road and Luther's Road (Breakwater Road), Mattituck, N.Y. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed subdivision of Andrew T. Dzenkowski, entitled "AQUAVIEW PARK", located at E/S of Rocky Point Road, north & south side of Southern Blvd. to Cedar Drive, East Marion, New York. The Chairman signed the final maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board discussed again the proposed minor subdivision of Peter & Irma Vignes. The Board was in agree- ment that final approval should be granted to this minor subdivision since the lot with the house on it has been set off by the Board of Appeals. On motion by Mr. Raynor, seconded by Mr. ~oisa, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Peter & Irma Vignes, property located at south side of Naugles Drive, Mattituck, N.Y. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, ~gyle. Southold Town Pl~¥ning Board -11 .... ~uly 19, 1971 Further discussion was held on the proposed minor sub- division of John Scheel, property located at E/S of Bay Avenue, Nassau Point, Cutchogue, N.Y. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of John Scheel, property located at E/S of Bay Avenue, Cutchogue, New York. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board discussed again the letter from the Supt. of Highways, Raymond Dean, dated June 28, 1971, advising us that he and the highway committee of the Town Board -Louis Demarest and Martin Suter - have made an inspection of the roads in the subdivision "Nunnakoma Waters", Southold, N.Y. The Highway Committee and Mr. Dean have agreed to recommend that these roads be kept private if Mr. Smith could get 100% of the property owners to sign a statement, stating that they wish to keep these roads private. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board that the roads in the subdivision "Nunnakoma Waters" be kept private if Mr. Smith can get 10~ ~f the property owners to sign a statement, stating that they wish to keep these roads private. This recommendation is made with regard to the favorable recommendations of the Supt. of Highways and the Highway Committee of the Town Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Rayngr, Coyle. No reply has been received from the Bethany Cemetery Association in regard to the proposed change of zone appli- cation of Frank & Martin Sidor. The Board ordered anOther letter to be sent to the Bethany Cemetery Association re- questing their recommendations and comments on this proposed change of zone before the next meeting of the Planning Board. Southold Town Planning Board -12- July 19, 1971 The Planning Board was advised that the proposed amend- ments to the Zoning Ordinance and the proposed new zoning map have been transmitted to the Suffolk County Planning Commission for their determination, recommendations, and comments. Rolguin, Edw. - "A" to "C", property located at S/W corner of Middle Road (CR 27) and Cox Lane~ Cutchogue, N.Y. We should receive an answer ~om the County on these proposed change of zones before the next meeting of the Planning Board. A copy of the minutes of the Southold Town Trustees meeting of ~une 7, 1971 was received by the Planning Board and placed on file. The Planning Board was advised that the New York Planning Federation will hold their 33rd Annual Planning & Zoning Institute at the Kutsher's Country Club, Monticello, N.Y., from October 10 to 13. Copy of notice which the Suffolk County Dept. of Health sent to Robert J. Douglas, dated July 1, 1971, notifying him that a review of his subdivision "Willow Terrace, Sec. II'" will be held by the Board of Review at the library of the Suffolk County Dept. of Health on July 14, 1971 at 9:30 A.M. was read and placed on file. Results of this hearing have not yet been received. Southold Town Pl%~ning Board July 19, 1971 Copies of the new Health Dept. regulations on subdivisions, entitled "Planning the Subdivision as part of the total environ- ment'' were received by the Planning Board. Letter received from the Suffolk County Department of Health, Robert Villa, P.E., Chief, General Engineering Services, on date of July 14, 1971, requesting information on a building now under construction on Harbor Lane, Cutchogue, owned by a Mr. Austin, land purchased from Chet Orlowski. The Chairman dictated a reply to be sent to Mr. Villa. Copy of letter sent to William Esseks, Attorney by the Suffolk County Dept. of Environmental Control in reference to the Eishers Island Development Corp. Sewage Collection System was read by the Chairman and placed on file. This letter requested Mr. Esseks to furnish them With a list of homeowners currently connected to the sewage collection system at Fishers Island. Since the proposed Fishers Island School will construct their own sewage disposal facility, the Health Department will require each of the dwellings serviced by this collection system to construct an individual disposal unit. Copy of letter sent to Stephen McCoy by the Planning Board in answer to his request for permission to bulkhead ~.I. Sound shorefront was read and placed on file. Mr. McCoy was advised that he does not need a permit from the Planning Board~ the Town Trustees, or the Army Corp. of Engineers, as this bulkheading will be done above highwater mark according to the sketches which he submitted. He was also advised that the Town of Southold has jurisdiction only over Town waters, which would be creeks and in~nd areas. Long Island Sound is not a town water. However, any bulk- heading, jetties, or similar construction below ordihary high water mark does require the approval of the New York State Office, of General Services, and also permits from theArmy Corp. of Engineers, Federal Plaza, New York, and Mr. McCoy was advised to contact them if he changes his plans to construction below ordinary high water mark. Southold Town Pl~n~ning Board -14 .... ~ July 19, 1971 On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the minutes of the Southold Town Planning Board dated June 14, 1971 be approved with corrections on pages 3 and 13. On motion .by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that the minutes of the Southold Town Planning Board dated June 18, 1971 be approved as submitted and that the actions taken at this meeting be sustained. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the minutes of the Southold Town Planning Board dated June 29, 1971 be approved as submitted. On motion by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the next regular meeting of the Southold Town Planning Board be held at 7:30 P.M., Monday, on August 16, 1971, at the ~own Office, Main Road, Southotd, New York.
