Y. ll9?l PLANNING BOARD MEMBERS John Wlckham, Chairman Henry Molsa Alfred Grebe - Henry Raynol' Frank Coyle M I N U T E S SOUTHOLD TOWN PLAATNING BOARD September 7, 1971 A regular meeting of the Southold Town Planning Board was .held at 7:30 P.M., Tuesday, September 7, 1971, at the Town Office, Main Street, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; ~enry Raynor; Frank Coyle. Absent: Mr. Alfred Grebe (due to unfavorable ~eather conditions) Rudolph Bruer, Attorney presented the Planning Board with three (3) copies of revised final maps for the proposed minor subdivision of Jack Stukas, property located at north side of Sound Avenue, Mattituck, N.Y. The revised map showed five (5) lots: lot no. 1 contained 32,261 sq. ft. of area; lot no. 2 contained 34,877 sq. ft. of area& lot no. 3 contained 34,602 sq. ft. of area; lot no. 4 contained 36,197 sq. ft. of area; Southold Town Planning Board -2- September 7, 1971 lot no. 5 contained 35,498 sq. ft. of area. Ail adjacent and surrounding prop.erty owners were p~inted on the map. A question was raised on the location of the right-of-way to the Gilles property (located to the north of this property). There was no right-of-way shown over the Stukas property on this map. Mr. Bruer checked the title search which did not cite any provision for a right-of-way over this property. These maps were in accordance with all requirements as stated by the Planning Board at their last meeting. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board table decision on the above proposed minor subdivision for further deliberation of the Board later in the evening. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Rudolph Bruer, Attorney presented the Planning Board with map of properties of Clarence Fleet and Henry Fleet, located at east side of Fleet's ~Neck Road, Cutchogue, N.Y. The property of Clarence Fleet is on'the north end and contains approximately 10.6 acres, immed&ately adjacent to the south is a parcel of land of 5.399 acres, formerly M. S. Hand (now residential plots); to the south of this property is the property of Henry Fleet con~ining approximately 6 acres of area. Mr. Bruer stated that he is aware that he must a major subdivision on the property of Clarence but he asked the Planning Board iX they would Subdivision of 6 lots on the property of Henry Fleet on the South end. The Chairman stated that they might possibly accept a minor subdivision of 6 lots on this property. The Board informed Mr. Bruer that they would like to make a physical inspection of the properties before making any decisions on them. Mr. Bruer to present the Planning Board with preliminary maps for these properties at the next meeting of the Board. Ralph Tuthill presented the Planning Board with a pre- liminary sketch for the proposed minor subdivision of his property located at the north side of Wickham Avenue, Mattituck, Southold Town Planning Board -3- September 7, 1971 N.Y. The sketch showed a large parcel of land of approximately 5 acres to be divided into a minor subdiv~ ion of five (5) lots with 30 ft. right-of-way immediately east. The property on the east side of this right-of-way was previously divided bY the Board of Appeals. Each of the five lots on the west side of the right-of-way contained 40,000+ sq. ft. of area. Lots 5, 3, & 2 on the east side of the right-of-way are all built upon'and are in different ownership. Only lots 1 & 4 remain in the same ownership and are not built upon. The Board informed Mr. Tuthill that they would like to take a look at the property. The Chairman stated that if the Planning Board is generally willing to accept the five (5) lots on the westerly side as a minor subdivision, they should be in the process of conveying lots 1 & 4 on the easterly side. The minor subdivision must not show the same ownership as any of the lots on the easterly side. The Board advised Mr. Tuthill to take the preliminary steps for conveying the lots on the easterly side and to have Van Tuyl make up a minor subdivision map of the westerly five (5) lots showing all adjacent and surrounding property owners. Mr. David Gillispie presented the Planning Board with preliminary map for the proposed minor subdivision of his property located off north side of Main (State) Road, East Marion, N.Y. The map showed a total of five (5) lots, each containing 40,000 sq. ft. of area with 30 ft. right-of-way. This property is situated on the south side of Dam Pond. On the north side of Dam Pond there is a parcel Of land with 400 ft. of frontage on L.I. Sound and 150 ft. deep. This parcel was divided up into five lots: lA, 2A, 3A, 4A, & SA, each of these lots to be part of the corresponding lot number on the south side of Dam Pond. Mr. Gillispie stated tha~ he will restrict the property to prevent any structures from being built upon it. The Board informed him that they will require him to submit a covenant to the following effect: "Under no circumstances will any structures be allowed to be erected on the sub-lots front- ing on L.I. Sound." The Planning Board stated that they will have to confer with the Town Attorney in reference to the legality of granting a minor subdivision under such conditions. Southold Town Planning Board -4- September 7, 1971 Dominic Aurichio, Attorney appeared before the Planning Board in reference to the proposed subdivision "Petty's Bight" located off north side of Main Road, Orient, N.Y. The Planning Board informed Mr. Aurichio that they are waiting to receive a letter from the Suffolk Connty Planning Com~is~&Qn with their comments and recommendations, and also that an error has been made in the bond estimate which must be corrected, The Chairman advised Mr. Aurichio that the County has verbally informed us that they will recommend several minor changes in the contour of the roads. The Chairman informed Mr. Aurichio that as soon as we hear from the County we will notify him and the maps can be taken down to Van Tuyl's for revision. Mr. Aurichio s~ated that they are ready to start working on the roads. They plan to do everything but the curbing before the public hearing, so as to minimize the performance bond. Mr. Philip L. Babcock appeared before the Planning Board in reference to the proposed minor subdivision of his p~gperty located off south side of Main Road, Cutchogue, New York. Mr. Babcock presented the Board with a sketch showing the proposed lay-out for this minor subdivision. This parcel of proper~y was taken out of the Case Estate. It contains approximately 6 acres of area. Mr. Babcock wishes to divide it into five (5) lots and run a 20 ft. easement to connect to the 20 ft. right-of-way (Case Bros.) and run southerly along lots 1-4 and part of lot 5. ~e Planning Board advised Mr. Babcock that this matter will be discussed later in the evening and he will be notified of the Board's decision tomorrow. Robert Tooker, Attorney, James Reeve, and John Reeve appeared before the Planning Board in reference to "Bennett's Pond" subdivision located off south side of Westphalia Avenue, Mattituck, N.Y. Mr. Tooke~ ~kated that the road is completed and the curbs and drainage system have been installed, and that all of the requirements of the Supt. of Highways and Engineer have been met. Mr. Tooker requested that the Planning Board recommend to the Town Board that the bond be released. The Chairman stated that the Planning Board will not make such a recommendation until they have a favorable re~mmendation from the Supt. of Highways and report of inspection by the Engineer. Southold Town Planning Board -5- September 7, 1971 The Chairman stated that he feels that the Planning Board has already been taken on this subdivision. Lots 5 & 6 are very shallow due to the swamp area in the rear yard area of the lo~s. However, the developers told the Planning Board that they realized this and they would ha~e enough room for a house regardless. After receiving approval from the Planning Board they went to the Board of Appeals and applied for a reduction in setback which was granted. The Chairman said that the Planning Board caught all of the grief in this instance and he wants to make sure that it does not happen again. The Planning Board informed the developers that they will require a favorable recommendation for release of bond from the Supt. of Highways and a copy of the report of inspection of the engineer before recommending to the Town Board that the bond be released. Robert Tooker, Attorney and James Reeve presented the Planning Board with preliminary map for proposed subdivision of property located at east side of Wells Road, Peconic, N.Y. The total area of the parcel is 6.83 acres. The map showed seven (7) lots fronting on the east side of Wells Road, all having over 100 ft. of road frontage with the exception of lot $ 7, which has only a 15 ft. easement. A lengthly dis- cussion was held on the layout of these lots, in regard to the frontage on lot $ 7. The Planning Board advised them that all adjacent and surrounding property owners must be shown on the map. Mr. & Mrs. Ellenberger presented the PI ~evised preliminary maps for the proposed minor of property of S. Santini, located at northeas~ cornez of Westphalia Avenue and Howard Avenue, Mattituck, N.Y. ~he map showed five (5) lots: lot no. 1 contained 17,600+ sq. ft. oE area; lots 2-5 ~ontained 20,000 sq. ft. of area each. Note on map indicated that dimensions of proposed lots are approximate only. The Planning Board informed Mr. & Mrs. Ellenberger that dimensions and areas of all lots on this map must be exact. The Board advised them to take the map back to Van Tuyl and have it re- vised to show exact dimensions and areas. Southold Town Planning Board -6- September 7, 1971 Mr. Andrew Wenchel presented the Planning Board with a survey showing the proposed minor subdivision of his property located at south side of Soundview Avenue, Mattituck, New York. The parcel contains 40,000+ sq. ft. of area, with 407 ft. of road frontage on Soundview Avenue and an average depth of 100 ft. The map showed the approximate location of the existing dwelling on the easterly half of the property. Mr. Wenchel requested approval of the lay-out of the lots in this minor subdivision. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of the property of Andrew Wenchel, property located at south side of Soundview Avenue, Mattituck, New York, subject to applicant presenting the Planning Board with the following: 1. Two (2) copies of formal application. 2. Application fee of $10. 3~ Three (3) copies of final maps showing minor subdivision of two (2) lots as above approved. This motion shall include authorization for the Chairman to sign final maps upon their presentation. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. William Schriever, Excavation Contractor, appeared before the Planning Board in reference to the proposed Subdivision "Petty's Bight", located off N/S Main (State) Road, Orient, New York. Mr, Schriever has been contracted by the Newmans to cut the roads through. Mr. Schriever requested that the turn-around at the westerly end of "Petty's Drive", on lot no. 1 be waivered due to the high elevation which would create hazardous conditions. Discussion was held/on the road lay-out, drainage, etc. The Planning Board advised Mr. Schriever that the County Planning Commission is sending recommendations and comments which will require minor revisions of the road lay~out. On motion by Mr. Moisa, seconded by Mr. Wickham, it was Southold Town Planning Board -7- September 7, 1971 RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board a waiver of the 100 foot turn-around and dead-end on the westerly end of "Petty's Drive", in the sub- division "Petty's Bight", located off the N/S Main (State) Road, Orient, New York, subject to the approval of the Supt. of Highways. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning~ Board discussed again the proposed minor subdivision of Jack Stukas, property located off north side Sound Avenue, Mattituck, New York. On ~o~ion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Jack Stukas, property located at north side of Sound Avenue, Mattituck, N.Y. The Chairman signed the final maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Plannin9 Board discussed~again the proposed minor subdivision of Philip Babcock, property located off S/S Main Road, Cutchogue, New York. On motion by Mr. Wickham, seconded by Mro Raynor, it was RESOLVED that the Southold Town Planning Board authorize Chairman John Wickham to send a letter to Mr. Philip Babcock in regard to his proposed minor subdivision located off south side of Main Road, Cutchogue, N.Y. The Planning Board stated that it is unrealistic for them to come in here with a minor subdivision on such a large parcel of land. The Planning Board wants to know what the next step is. They will not go along with this property being cut up into one minor subdivision after another. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board send a letter to the Suffolk County Dept. of Public Works recommending that a guard rail or fence be placed on the S/S County Road 27 to prevent ingress and egress from County Road 27. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board received letter-=,,from the Supt. of Highways requesting the release of the bond for "Rosewood Estates", subdivision located at Mattituck, N.Y. (Copy of report of inspection of Chas. Abrahams attached) On motion by Mr. Moisa, seconded by Mr. Coyle, it was Southold Town Planning Board -9- ~eptember 7, 1971 RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board, the release of the performance bond for the roads in the subdivision "Rosewood Estates", located at Mattituck, N.Y. This recommendation is made with regard to the favorable recommendation of release of the bond by the Supt. of Highways. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Letter received from the Supt. of Highways forwarding the report of inspection of Chas. Abrahams of the status of the work for consideration of lifting the bond on "Sunset Knolls, Sec. 2, Mattituck, N.Y. This letter did not contain a recom- mendation from the Supt. of Highways for the release of the bond. Subject letter placed on file. Request received from Woodhollow Properties, Inc. for renewal of covenants and restrictions for Section 2, Orient- by- the- Sea. Letter which Mr. Terry sent to him advising him of the proper procedure was read and placed on file. Reply received from Alden Young (in regard to "Laurel Country Estates") informing us that he does not include in his fee or participate in the water supply analysis required by the Suffolk County Dept. of Health as a requisite to approval of a subdivision. He stated that this was true in the layout of "Laurel Country Estates. The Suffolk County Department of Health did approve the method of water supply, so any test wells or samples from existing wells in the neighborhood would be in their records. The Chairman dictated letter to be sent to Alden Young informing him that the Planning Board requires the location of test wells, as well as test holes to be shown on all subdivision maps, and also informing him that in the future, hewill be expected to show the locations of all test wells and test Southold Town Planning Board -10- September 7, 1971 holes done on the subject property, in their appropriate locations, on all subdivision maps which he presents for submission to the Planning Board. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board submit the following budget for the fiscal year beginning January 1, 1972: AN~. On motion by Mr. Wickham, seconded by Mr. Rap-nor, it was RESOLVED that the Southold Town Planning Board strongly recommend to the Southold Town Board, a raise in the salary of the PlanKing Board Secretary, Betty Neville. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The minutes of the Southold Town Trustees meeting of August 9, 1971 were read and placed on file. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the next regular meeting of the Southold Town Planning Board be held at 7:30 P.M., Tuesday, October 5, 1971, at the Town Office, Main Streeth, Southold, New Y~rk.
