A regular meeting of the Southold Town Planning Board was
held at 7:30 P.M., Tuesday, October 5, 1971,~at the Town Office,
Main Street, Southold, New York.
There were present: Messrs: John Wickham, Chairman; Henry
Moisa, Vice-Chairman; Henry Raynor; Frank Coyle; Alfred Grebe.
Also present: Howard Terry, Building Inspector
Mr. & Mrs. E. J. Elle~berger presented the Planning Board
with revised maps for the proposed minor subdivision of property
of S. Santini, located at N/E corner of~Westphalia Avenue and
Howard Avenue, Mat~ituck, N.Y. The revised map showed exact
dimensions and areas of all lots as required by the Planning
Board at their last meeting. The map showed five (5) lots;
lot no. lcontained 17,555 sq. ft. of area; lot no. 2 contained
20,119 sq. ft. of area; lot no. 3 contained 20,000 sq. ft. of
area; lot no. 4 contained 20,000 sq. ft. of area; lot no. 5
contained 20,000 sq. ft. of area. Discussion ~as held on the
size of lot no. 1. This lot has 130.73 f~. of road frontage
on Howard Avenue. Decision was tabled on this proposed minor
subdivision for further deliberation of the Board later in the
evening.

On motion by Mr. Moisa, seconded by Mr. Grebe, it was

determination on the above proposed minor subdivision for

James Reeve and Mrs. Robert Tooker appeared before the
Planning Board in reference to their proposed subdivision
Located at E/S of Wells Road, Peconic, N.Y. The revised map
showed six (6) lots: lot no. 1 contained 40,000 sq. ft. of
area; lot no. 2 contained 40,000 sq. ft. of area; lot no. 3
contained 40,000 sq. ft. of area; lot no. 4 contained 40,000
sq. ft. of area; lot no. 5 contained 52,500 sq. ft. of area;
lot no. 6 contained 84,000 sq. ft. of area. The excessive
area of lot no. 6 is due to a large portion of the southeast-
erly section-of the lot being un-usuable wetlands. This lot
has 100 ft. of road frontage on Wells Road. The Board dis-
cussed this proposed subdivision with Mr. Reeve. Mr. Reeve
requested that the Planning Board grant preliminary approval
to this subdivision. D~cision was tabled for further delib-
eration of the Board later in the evening. Mr. Reeve was
advised that if preliminary approval is granted, he_must
submit six (6) copies of preliminary map with at least two
of them showing topography of the property.
On motion by Mr. Raynor, seeonded by Mr. Moisa, it was
RESOLVED that the Southold Town Planning BOard table
decision on the above proposed subdivision for further
deliberation of the Board later in the evening.

Mr. David Gillispie appeared before the Planning Board in
reference to his proposed minor subdivision located off north

side of Main Road, East Marion, N.Y. Action was tabled on this
matter at the last Planning Board meeting for conference with
the Town Attorney by the Chairman. The Chairman was not yet
present at tonight's meeting. Action was tabled for discussion
with the Chairman later in the evening. Mr. Gillispie was ad-
vised to contact the office tomorrow morning.
The Chairman was present at 8:00 P.M.
Mr. Ralph Asselta presented the Planning Board with
preliminary map for the proposed minor subdivisiOn of his
property located at north side of Main ROad, Cutchogue, N.Y.
The preliminary map showed five (5) lots and proposed 20 ft.
right-of-way running from the Main Road northerly to lot no.
4 and then easterly along the southerly boundar~ of lots 4
& 5 and northerly boundary of lots 2 & 3. Lot~no. 1 con-
tained 21,500 sq. ft. of area; lot no. 2 contained 22,000
sq. ft. of area; lot no. 3 contained 26,000 sq. ft. of area;
lot no. 4 contained 25,000 sq. ft. of area; lot no.5 con-
tained 25,000 sq. ft. of area. All lot areas were exclusive
of right-of-way. This right-of-way must be increased to
25 ft. Discussion was held with Mr. Van Tuyl on this pro-
posed minor subdivision. Decision w~s tabled for further
deliberation of the Board later in the evening.
On motion by Mr. Moisa, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning-Board table
decision on the above proposed minor subdivision for further
deliberation of the Board later in the evening.

Mr. Rudolph Bruer, Attorney presented the Planning Board
with preliminary maps for the proposed minor subdivision of

Henry L. Fleet, property located at east side of Fleet's Neck
Road, Cutchogue, N.Y. The map showed six lots: lot no. 1
contained 43,700 sq. ft. of area; lot no. 2 contained 42,800
sq. ft. of area; Lot no. 3 contained 44,000 sq. ft. of area;
lot no. 4 contained 45,600 sq. ft. of area; Lot no. 5 con-
tained 45,600 sq. ft. of area; lot no. 6 contained 45,600
sq. ft. of area. All lots front on existing Town Highways.
The B,D~rd advised Mr. Bruer that a minor subdivision is con-
sidered as five (5) lots or less. The Planning Board inf0mmed
Mr. Bruer that it is their opinion that this should be a major
subdivision.
~ On motion by Mr. Wickham, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning Board table
decision on the above proposed minor subdivision for further
deliberation of the Board later in the evening.

Mr. Rudolph Bruer, Attorney presented the Planning Board
with preliminary maps for the proposed subdivision of the
property of Clarence C. Fleet, located at E/S Fleet's Neck
Road & W/S Stitlwater Avenue, Cutchogue, N.Y. The map showed
ten (10) lots all containing over 40~000 sq. ft. of area and
fronting on existing Town highways. The Chairman suggested
that it would be good business to put a road through between
Old Pasture Road and Stillwater Avenue, in view of the fact
that these roads are opposite one another. MrJ van Tuyl said
that the State and County do not like direct crossings. The
Chairman suggested cutting a road through between lots 1 & 10
and 2 & 9. The Board suggested that this map be referred to
the Supt. of Highways for his recommendations and comments.
The Board advised Mr. Bruer to get in kouch with the Supt. of
Highways before proceeding any further in this matter.
On motion by Mr. Moisa, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board table
decision on the above matter pending recommendations and
comments from the Supt. of Highways.

Dominic Aurichio, Attorney appeared before the Planning
Board in reference to the County Planning Commission recommenda-
tions on the subdivision "Petty's Bight", located off N/S Main
(State) Road, Orient, N.Y. Mr. Aurichio said that the County
has made a recommendation to change the drainage at the entrance
from the Main Road. Mr. Aurichio said that the State has ~ready
issued a work permit for this entrance. The Chairman said that
if the State has approved it, we will go back to the County and
advise them of this. The Chairman said that the question is:
"Are the drainage structures adequate?" Discussion was held on
the drainage and the grade at the entrance on the Main Road.
The Chairman says that the Planning Board will confer with the
County Planning Commission~to see if some of their recommenda-
tions can be scaled down. The Chairman informed Mr. Aurichio
that if we want to over-ride the recommendations of the County,
it must be by unanimous Vote of the Planning Board. This matter
was tabled for further discussion by the Board later in the
evening.
Mr. David Horton, Vice-President of Peconic Homes, Inc.
appeared before the Planning Board to request a favorable
recommendation to the Town Board for the release of the bond
for the subdivision "Eastward Manor." Mr. Horton said that
he spoke with the Supt. of Highways who informed him that he
will send his favorable recommendation to the Planning Board
for the release of the bond on this subdivision. To date, the
recommendation of the ~upt. of Highways has not yet been
received by the Planning Board.
On motion by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board empower
the Chairman to take the Proper action for recommending release
of bond on the subdivision "EastWard Manor"~upon receipt of
favorable recommendation of release of bond from the Supt. of
Highways.

William Esseks, Attorney presented the Planning Board
with a preliminary plan for the proposed subdivision of the
property of Donald A. Dennis, located at S/S Harborview Ave.
& W/S Reeve Avenue, Mattituck, N.Y. The preliminary plan
showed 16 lots and proposed 50 ft. road (Inletview Lane East)
off S/S Harborview Avenue. All lots contained 40,000+ sq. ft.
of area. There was.no provision for park and playground area
shown on this map~ Mr. Esseks requested that the requirement
for park and playground area be waivered due to the fact that
BaileyaBeach Recreation Area is such a short distance northerly
on Harborview Avenue. The Board suggested that if they have
~35 ft. of road frontage on each lot, they might probably
waiver the requirement for park and playground area. Mr. Esseks
questioned how many lots can be sold before they post a bond
for the road and other improvements. The Chairman informed him
that one lot can be sold before posting a bond for the roads.
This matter will be discussed by the Board later in the evening.
The Planning Board dsicussed the proposed mino~ subdivision
of Philip L. Babcock, property located off S/S Main Road, Cutchogue,
N.Y. The Vice-Chairman read the letter received from Mr. Babcock,
dated September 13, 1971, stating his intentions for the~propet~y~
The Vice-Chairman also read letter received from Russell Case, dated
September 27, 1971, explaining his grounds for selling this particular
piece of property to Mr. Babcock. Also contained in file was letter
of September 10, 1971 sent to Mr. Babcock by the Planning Board. This
map has been sent to Charles Lind of The Suffolk County Planning
Commission for their comments and recommendations. The Chairman said
that he sp~ke with Mr. Lind who said that the usual procedure is for
the Planning Board to approve it and then send it to the County for
their suggestions. The County has sent a letter to the Planning
Board on this minor subdivision, but it has not yet been received.
Mr. Lind suggested that this parcel be separate from the rest of
the property and also that when the rest of the _property is deveToped,
a road should be connected to the right-of-way~ The Chairman said
that we should receive these recommendations within the next few
days. Mr. Raynor objected to the six (6) lots in this minor sub-
division. The State Law and the Rules and Regulations for the
Subdivision of Land in the Town of Southold define a minor subdivision
as five (5) lots or less. A lengthly discussion was held on this
matter. The Chairman stated.that there is a gravel packed well
point on lot number 6, perhaps Mr. Case would like to k~ep lot no,
6, thereby creating a minor subdivision of 5 lots. However, since
Mr. Babcock has already purchased the property, this will be a
matter for discussion between Mr. Babcock and Mr. Case. Also, the

lots could be made larger so that the minor subdivision contains
five (5) lots.
On motion by Mr. Wickham, seconded by Mr. Moisa, it was
RESOLVED that the Southold Town Planning Board send a letter
to Mr. Philip Babcock advising him of the above.

Coyle, Grebe.
The Planning Board was presented, with the covenants and
restrictions for the proposed m~nor subdivision of Elaine
Axien, property located at private right-of-way off N/S Middle
Road (CR 27), Peconic, N.Y. Final approval has been pending
re~9~pt of covenants and restrictions.
On motion by Mr. Raynor, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board referethe
covenants and restrictions for the proposed minor subdiv~ision
of Elaine Axien to the Town Attorney for his approval.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The Planning Board was presented with preliminary maps
for the proposed minor subdivision of Valentine Ruch, property
located off S/S M~dd~e Road (CR 27), Southold, N~Y. The map
showed a minor subdivision of ~the property into four (4) lots.
Lots 1 - 3 were numbered accordingly, but the remaining parcel
on the easterly e~d was labeled as "to keep". The Board stated
that this lot must either be taken out of the subdivision and
labeled with the name of title, or be labeled as lot no. 4.
Also, all adjoining and adjacent property owners must be shown
on the map. The Board stated that they would like to make a
physical inspection of the property before making any decision
on it.

The Planning Board was presented with favorable recommendation
from the Supt. of Highways for release of bond on the subdivision
"Sunset Knolls, Section 2", together with report of inspection from
the engineer.
On motion by Mr. Wickhhm, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning Board recommend
favorably to the Southold Town Board the release of the bond
for the subdivision "Sunset Knolls, Section 2". This recommend-
ation is made with regard to the favorable recommendation of the
Supt. of Highways.

The Planning Board'was presented with favorable recommendation
from the Supt. of Highways for i~lease of bond on the subdivision
"Yennecott Park", located off S/S~CR 27, Southold, N.Y.
On motion by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED that the $outhold Town Planning Board recommend
favorably to the Southold Town Board the release of the bond
for the subdivision "Yennecott Park". This recommendation is
made with regard to the favorable recommendation of the Supt.
of Highways.

The Planning Board was presented with favorable recommendation
from the Supt. of Highways for release of bond on the subdivision
"Bennett's Pond", together with report of inspection from the
engineer.
On motion by Mr. Wickham, sedonded by Mr, ~ebe, it was
RESOLVED that the Southold Town Planning Board recommend
favorably to the Southold Town Board the release of the bond
for the subdivision "Bennett's Pond", ~ocated Off Westphalia
Road, Mattituck, N.Y. This recommendation is made ~ith regard
to the favorable recommendation of the Sup~. 'of Highways.

Letter was received from the Town Trustees in reference
to the application of Bayview Development Corp. (Victoria
Motel & Cottages) for permission to install floating dock
with bulkheaded landfall. The Town Trustees inquired if the
Planning Board's restrictions of May 12, 1966 are still ap-
plicable to this property. The following letter was dictated
by the Chairman to be sent to the Town Trustees:

permission to install a floating dock
with bulkheaded landfall.
Gentlemen:
Your letter of September 24, 1971, in regard t~' the above
captioned matter, was received by the Planning Board at their
regular meeting held on October 5, 197~, please be advised of
the following:
In view of the fact that the Trustees and the Town Board
required Mr. Victoria to b~ing back the shoreline to an
agreed upon position, this would remove any restrictions
we might have on this particular p&ece of property. However,
that parcel of the Victoria property on the easterly side and
northerly end, shown as the boat basin, has not been corrected.
Therefore, in our opinion, it still merits prohibition of
development of any kind until the condition of our letter of
May 12, 1966 is corrected.

The Planning Board inquired of the Chairman if he had
spoken with the Town Attorney in reference to the proposed
minor subdivision of David Gillispie. The Chairman said
that he had not.
On motion by Mr. Moisa, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board grant
final approval to the proposed minor subdivision of David
Gillispie, property located off north side of Main Road,
East Marion, N.Y., subject to the matter of the sub-lots
and the covenants and restrictions being checked out with
the Town Attorney, if the Town Attorney approves of this
subdivision, then the Chairman shall be empowered to sign
the final maps.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The proposed subdivision of James Reeve & Robert Tooker
was discussed by the Planning Board again. Mr. Reeve and Mr.
Tooker are requesting preliminary approval of this subdivision.
On motion by Mr. Wickham,seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board grant
preliminary approval to the proposed subdivision of ~ames
Reeve & Robert Tooker, property located at E/S of Wells
Road, Peconic, N.Y.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The Planning Board~discussed again the proposed minor
subdivision of S. Santini, property located at ~N/E corner of
Westphalia Avenue & Howard Avenue, Mattituck, N,Y. A motion
was made by Henry Raynor for disapproval of this minor sub-
division because of the under-sized area of lot number 1,
17,555 sq. ft. of area. This motion was lost for lack of a

On motion by Mr. Wickham, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board grant
final approval to the proposed minor subdivision of S. Santini,
property located at N/E corner of Westphalia Avenue & Howard
Avenue, Mattituck, New York.

The Planning Board discussed again the proposed minor
subdivision of Henry L. Fleett property located at east side
of Fleet's Neck Road, Cutchogue, N.Y. The Planning Board was
of the opinion that this property should be re-filed as a ma3or
subdivision. Filing for a ma3or subdivision would entail
having a test well and test hole done on the property and
approved by the Health Dept. and paying an acreage fee.
On motion by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board disapprove
the proposed minor subdivision of Henry L. Fleet. The attorney
a/c Henry L. Fleet is to be notified that this property must be
re-filed as a major subdivision.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,

The Planning Board discussed again the proposed minor subdivision
of Ralph M. & Theresa Y. Asselta, property located at N/S Main Road,
Cutchogue, N.Y.
On motion by Mr. Wickham, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board grant final
approval to the proposed minor subdivision of Ralph M. & Theresa
Y. Asselta, property located at N/S Main Road, Cutchogue, N.Y.,

subject to receipt of the following: (1) Three (3) copies of
final map (2) Two =opies of formal application (3) Fee of
$40.
Vote of the Board: Ayes:- Messrs; Wickham, Moisa, Raynor,

The Planning Board discussed again the proposed subdivision
of Donald A. Dennis located at ~/S Harborview Avenue and W/S
Reeve,Avenue, Mattituck, N.Y. Under the Subdivision Regulations
the park and playground requirement is one lot for each 50
people. The Board decided that they would waiver the require-
ment for park and playground area if they increase the frontage
of the lots to 135 ft. and reduce the number of lots on the W/S
of the proposed road (Inletview Lane East) to five lots, to be
lots 11 - 15.
On motion by Mr. Moisa, seconded by Mr. Wickham, it was
RESOLVED that the Southold Town Planning Board waiver
the requirement for park and playground area in the proposed
subdivision of Donald A. Dennis subject to the lots on the
W/S of the proposed road (Inletview Lane East) being reduced
to five lots: lot numbers to be 11 15, and all frontages
on these lots must be a minimum of 135 ft.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The Planning Board discussed again the proposed subdivision
"Petty's Bight", located off N/S Main (State) Road, Orient, N.Y.
The Board decided that this subdivision should be referred to
the Town Engineer, Lawrence Tuthill for conference with Charles
Lind of the Suffolk County Planning Commission.
On motion by Mr. Raynor, seconded by Mr. Coyle, it was

reference to the County recommendations on proposed subdivision
"Petty's Bight", located off N/S Main (State) Road, Orient, N.Y.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,

Request received from Halsey A. Staples, Proprietor of
"Stuart D. Staples Monument Works" for sonsidera%ion of change
of nQn-conforming business to conforming business on this
property. The Chairman instructed ~% a letter be sent to
Mr. Staples informing him that when and if any changes are
made in the Zoning Map his request will be considered, to
date, his property remains as non-conforming.
Received and placed on file, a copy of letter sent to
Donald Alfano, resident of Corey Creek Estates, by Eugene
Francolini, Attorney a/c South Fork Development Corp. ad-
vising Mr. Alfano that the paving.of Co~y Creek Lane will
commence within the next few weeks.

Gentlemen:
The Town Board of the Town of Southold has formulated
some suggestions which we feel will be helpful in the future
for your Board and for the public.
When preliminary plans are approved by your Board, it is
suggested that such approval be in writing, thus eliminating

any later criticism of procedure. It is also suggested the
approval of the Suffolk CoUnty Health Department be obtained
on any lot prior to any other permits being issued for building,
etc.

This w~ll mean that the owners of minor subdivisions must
take their maps to the Health Dept. for their approval before
obtaining ~final~approval from the Planning Board~ The Chairman
suggested that the Health Dept..be invited to our next meeting
to discuss this matter further.
Correspondence and questionnaire received from the Metro-
politan Regional Council, Inc. given to the Chairman for
completion.
The booklet of "Newark Airport Redevelopment Program" was
received from the Port of New York Authority and presented to
the Planning Board for their inspection.
The Planning Board was presented with the Annual Regional
Report of 1971, received from the Tri-State Transportation
Commission.
On motion by Mr. Raynor, seconded by Mr. Moisa, it was
RESOLVED that the Southold Town Planning Board hereby
recommend to the Southold Town Board that an addition be
made to the present Town Clerk's Office, Main Road, Southold,
Southold Town Plannzng Board

New York, as a capital improvement item for this year's budget.
This additional space is desparately needed by all departments
using the building.
We believe an addition to the present building, using full
cellar, properly waterproofed and dehumidified, is needed for
permanent record storage. A large room is needed for the Assessors
where they can have tables to work on their maps, etc. The present
room being used for storage cabinets, tax bill printing and assess-
ment book printing machinery is inadequate. A map room is needed
where current tax maps can be kept exclusively for use by the
Asse~s.~sp.r.s, Building Department, and Planning Board - not for gen-
era~ ~so, a large room connected to the present Building Depart-
ment is needed for Planning Board and Board of Appeals meetings.
We believe that the above recommendations would be the most practical
and economical way to get the needed space.
We propose that the present tax machine used by the Receiver
of Taxes be left in the same room and additional tables or desks
be put in this room for the Receiver of Taxes. The present two
rooms on the easterly side of ~he hall be used as map room for the
general public - a set of tax maps with rack and a table in one
room and the other as a private office for Assessors t~ talk with
applicants about various programs, gripes, etc.
The present "Backroom" to be ~nlarged for general assessor
business, etc.
The present Town Clerk Offices seem adequate for the time
being, however, a "window and counter" should be provided for
the issuing o~ dog licenses, beach stickers, etc. The Trustees
should use the same meeting room, maps, etc. as the Planning
Board and Board of Appeals.
Fire retarded wood construction, shingled as the present
building would be adequate for the next ten to fifteen years.
The property between the present north line and the new
extension of Traveler Street should be purchased as soon as
possible - condemned if necessary and clea~ed so that there
will be adequate parking and access for the property.
The present uses of the building cannot be separated as
they work together. An addition to the building will be the
most practical solution to the immediate problem.

RESOLVED that the minutes of the Southold Town Planning
Board, dated September 7, 1971, be approved as submitted.

RESOLVED that the next regular meeting of the Southold
Town Planning Board be held at 7:30 P.M., Wednesday, October
27, 1971, at the Town Office, Main Street, So~thold, New York.
