I., N. y. 119'71 PLANNING BOARD MEMBERS John Wickham, Chairman Henry Molsa Alfred Grebe William Unkelbach Frank Coyle MINUTES SOUTHOLD TOWN PLANNING BOARD October 27, 1971 A regular meeting of the Southotd Town Planning Board was held at 7:30 P.M., Wednesday, October 27, 1971, at the Town Office, Main Street, Southold, New York. There were present: Messrs:- John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank Coyle. Absent: Mr. ALfred Grebe (due to unfavorable weather conditions.) Also present: Howard Terry, Building Inspector Mr. Russell Case appeared before the Planning Board on behalf of the minor subdivision of Philip L. Babcock, located at private right-of-way off south side of Main Roadr Cutchogue, New York. The Chairman read letter of October 13, 1971 received by the Planning Board from Mr. Babcock explaining his intentions for the property. The Chairman also read letter of October 4~ 1971 received from Charles Lind, Director of the Suffolk County Planning Commission, letter containing the County Planning recommendations in regard to this minor subdivision. Mr. Case presented the Planning Board with three copies of revised map. Southold Town Planning Board -2- October 27, 1971 The revised map showed the owner of the property as Case Estate. Mr. Case explained that this was an error on the part of Van Tuyl, owner should be prin~ed as Margaret E. Babcock. The Board informed Mr. Case that the map will have to be revised with the correct name of the owner of the property printed on it. The revised map showed a division of the property into five lots: lot no. 1 contained 43,363sq. ft. of area; lot no. 2 contained 43,560sq. ft. of area; lot no. 3 contained 50,225sq. ft. of area; lot no. 4 contained 43,560sq. ft. of area; lot no. 5 contained 50,166sq. ft~ of area. The lot lines have been revised to eliminate the sharp turns in the right-of~way. Discussion was held in reference to the development of this property in the future. In regard to the County Planning Board recommendation, the Planning Board will require that provision be made for connecting the right-of-way with Case's Lane in future develop- ment. The Planning Board informed Mr. Case that they will require two (2) statements in writing from him: [1] "When and if the remainder of this property is developed, there will be a connection to this right-of-way on the Babcock minor sub- division from Case's Lane.~' [2] "It is not the intention of Mr. Case to ask for another minor subdivision on this piece of property,a' Decision was tabled at this time for further deliberation of the Board later in the evening. Asselta appeared before the Planning Board in reference to their proposed minor subdivision located at north side of Main Road, Cutchogue, N.Y~ The Planning Board was presented with three copies of revised map dated October 18, t~7t. The map showed a division of the property into five ~5) lots: lot no. 1 contained 21,642sq. ft. of area; lot no. 2 contained 28,275sq. ft~ of area; lot no. 3 contained 25,557sq. ft. of area; lot no. 4 contained 24,896sq. ft. of area; lot no. 5 cOntained 25,211sq. ft. of area. The right-of-way has been increased to 25 feet in width. The Chairman read the Planning Board's letter of October 6, 1971 to Mr. & Mrs. Asselta, said letter granted final approval to this minor subdivision subject to receipt of three (3) copies of revised maps, two (2) copies of of formal application and fee of $40. Th~ three (3) copies of revised maps presented were in accordance with revisions as stated at Planning Board meeting of October 5, 1971, formal application, and fee of $40. were also presented. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Ralph M. & Theresa ¥. Asselta, property located at north side of Main R~d, CutChogue, New York. The Chairman signed the final m~ps. Rudolph Bruer, Attorney appeared before the Planning Board in reference to the proposed subdivision of Clarence C. Fleet to be known as '"North Pequash Estates at Cutchogue", located at E/S Fleet's Neck Road and W/S Stillwater Avenue, Cutchogue, N.Y. Decision was tabled on this matter at the last Planning Board meeting pending recommendations and comments from the Supt. of Highways. Mr. Bruer informed the Planning Board that he has spoken with the Supt. of Highways, who stated that he doesn't think it is necessary to put a road in through this subdivision. ~owever, Mr. Dean said that if the Planning Board feelS that there should be a through road, he will go along with it. Mr. Dean to send a letter of recommendation for a thraugh road. The Board stated that they want a through-road placed north of Stillwater Avenue and Old Pasture Road. Mr. H. -W. Davids of the Health Dept. (present at the meeting) inspected this map and said that if ~his is what the Planninq Board wants, the Health Dept. will approve of it. Rudolph Bruer, Attorney appeared~before the Planning Board to request preliminary approval of the proposed subdivision of Henry L. Fleet, to be known as "South Pequash Estates at Cutchogue", located at E/S Fleet's Neck Road and W/S Track Avenue, Cutchogue, N.Y. The map showed six lots, all containing over 40,000sq. ft. of area. All lots fronting on existing Town High~ays. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed subdivision of Henry L. Fleet to be known as "South Peq~sh Estates at Cutchogue" located at E/S of~Fleet's Neck Road and W/S Track Avenue, Cutchogue, N.Y~ Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Copy of above resolution to be sent to applicant's attorney and Southotd Town Board. Southold Town Planning Board October 27, 1971 Robert Gillispie III presented the Planning Board with a preliminary plan for the proposed minor subdivision of Sonja Caron Stein, property located at north side of Main Road (State), East Marion, New York. The map showed five (5) lots: lot no. 1 contained 39,255sq. ft. of area; lot no. 2 contained 39,609sq. ft. of area; lot no. 3 contained 47,040sq. ft. of area; lot no. 4 contained 62,500 sq. ft. of area; lot no. 5 contained 67,600sq. ft. of area; The Board stated that they will require a statement from Mrs. Stein stating that lots 4 & 5 will not be further subdivided in the future, this must be a covenant in the proper form for recording in the Suffolk County Clerk's Office. The map showed 50ft. right-of-way running along the easterly side of lots 1,2, & 3 and then westerly along southerly side of lots 4 & 5. Discussion was held on the possibility of extending the ro~d northerly to Dam Pond, to run along easterly side of lot no. 4, thereby making lot no. 4 smaller and then distributing the areas of lots 4 & 5 evenly. Map to be revised and presented at next meeting of the Planning Board. Dominic Aurichio, Attorney appeared before the Planning Board in reference to the proposed subdivision "Petty's Bight", located off north side of Main Road, Orient, N.Y. The Chairman read letter of October 18, 1971 received from Lawrence Tuthill P. E. as follows: Southold Town Planning Board Main Street Southold, New York Re: "Petty's Bight" Gentlemen: On October 8, I met with Mr. Chas. Lind of the Suffolk County Planning Board to discuss the requirements of their Board for storm water catchment and rentention near state roads as noted in the subdivision "Petty's Bight", Orient. The following data will be neSded to meet the requirements of the Suffolk County Planning Com~Lission: 1. The area to be drained. (Southold Town Planning Board requires contours to extend 200' beyond boundaries of a subdivision. 2. Rainfall (Southold Town Planning Board requires ~esign of 10 year, which i~ approximately 2" in 24 hours. 3. Run-off (Southold Town has no specifications or requirements, but there are numerous methods of design which are acceptable.) Southold Town Planning Board -5- October 27, 1971 4, Catch basins and leaching basins -sketch should show height, diameter and type of rings, type and size of inlet casing, size and type of connecting pipes, location of structures and distances between each, height of ground water table, extent of bank run fill around structures; Design data capacity of system, leaching qualities and quantities of the adjacent soils. This should be suitable to hold the expected run-off. Very truly yours, Lawrence M. Tuthill Mr. Aurichio stated that he will submit all of the above required data. Stephen Mitacchione presented the Planning Board with preliminary maps for the proposed minor subdivision of his property located at south side of Eugene's Road, Cutchogue, N.Y. Preliminary map showed minor subdivision of three lots containing 20,600sq. ft. of area; 20,009 sq. ft. of area; and 21,130 sq. ft. of area, all lots fronting on Eugene's Creek. This matter was tabled until later in the evening for discussion with Mr. Ho W. Davids of the Health Dept. Richard J. Cron, Attorney presented the Planning Board with three (3) copies of final maps, two (2) copies of formal application, and fee of $30. for the proposed minor subdivision of Sophie Krukoski, located at S/S Fanning Road and W/S New Suffolk Lane, New Suffolk, N.Y. Final approval was previously granted to this minor subdivision at Planning Board meeting ~eld on February 25, 1970 subject to presentation of three (3) copies of final maps, two (2) copies of formal application, and fee of $30., which were never presented. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Sophie Krukoski, property located at S/S Fanning Road and W/S New Suffolk Lane, New Suffolk, N.Y. This motion hereby re-approves this minor subdivision as per the Planning Board motion of February 25, 1970. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Southold Town ~nning Board -6- October 27, 1971 Herbert W. Davids, Director of the Suffolk County Health Dept. was present at this meeting as per the Planning Board's request of October 5, 1971, for the purpose of discussing minor subdivisions. Under the Town of Southold Subdivision Regulations, all major subdivisions must go to the Health Dept. prior to receiving final approval from the Planning 'Board. We are getting a lot of minor subdivisions and there has been discussion on sending them up to the Health Dept. before granting final approval on them. Although there is nothing in law which requires the Health Dept. to give an opinion on minor subdivisions, the Planning Board thinks that it would be beneficial to both departments. Mr. Davids said that the Health'Dept. would like-to h~ve a preliminary look at these minor subdivisions before the Planning Board grants final approval. The Planning-Board presented Mr. Davids with the preliminary map for the proposed minor subdivision of S~ephen Mitacchione. Mr. Davids said that they would require ma~s showing soil conditions, adequate depth below finished grade'and test hole and test well dat~, map must also have topography on it. The Chairman said' that they will send up all lots 20,000+sq. ft? of area before granting final ap- proval and all lots 40,000+sq. ft. of area after final ap- proval by the Planning Board. Mr. Davids said that they would like to receive all waterfront properties in Mr. Davids said that they will need basically information as they need for major subdivisions. A fi~ will be made by the Health Dept. on each minor i~ cation. All necessary information to '~e by the Planning Board and then sent to the Health De recommendations. All information as stated on Department Procedure and Requirements for Approval to Construct on Individual Lots." (green sheet) must be s.~mitted. Mr. Davids said that it will take approximately a week for the Health Dept~ to act. on each application after receiving maps with all pertinent data. The Health Dept. will require two (2) copies of maps. The Planning Board discussed again the p~oposed minor subdivision of Margaret E. Babcock, located at private right- of-way off south side of Main Road, Cutchogue, New York. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Margaret E. Babcock, property located at private right-of-way off south side of Main Road, Cutchogue, New York, subject to presentation of the following: 1. Three (3) copies of final map, as per survey dated October 22, 1971 by Otto Van Tuyl & Son, to be revised to Southold Town Planning Board -7- October 27, 1971 show name of owner of property as Margaret E. Babcock (not Case Estate as presented) 2. Fee of $50. 3. The Planning Board will require two (2) statements from Mr. Russell Case to the following effect: 41. "When and if the remainder of this property is developed, there will be a connection to this right-of-way on the Babcock minor subdivision from Case's Lane." ~2. "It is not the intention of Mr. Case to ask for another minor subdivision on this piece of property," This motion shall include authorization for the Chairman to sign the final maps upon fulfillment of the above requirements. Vote of the Board: Ayes:- Messrs: Wickham, Moist, Raynor, Coyle. Discussion was held on the proposed minor subdivision of Elaine Axien, property located at private right-of-way off N/S Middle Road (CR 27), Peconic, New York. Decision was tabled at the last meeting of the Planning Board held on October 5, 1971 for conference with the Town Attorney. Since that date, the Planning Board has discussed the "Covenant and Restriction" wiih~the Town Attorney. On motion by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Elaine Axien, property located at private right-of-way off N/S Middle Road, (CR 27), Peconic, N.Y., subject to the following conditions: 1. Restriction to read as follows: "That the premises or any part thereof shall not be further subdivided." Covenant and Restriction to be in the proper form for recording in the office of the Suffolk County Clerk, and fee for recording to be collected by the Planning Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Southotd Town Planning Board -8- October 27, 1971 Discussion was held on the proposed minor subdivision of David Gill~spie, property located at north Side of Main (State) Road, East Marion, New York. Decision was tabled at the last Planning Board meeting held on October 5, 1971 for conference With the Town Attorney. Since that date; the Planning Board has discussed the "Covenant and Restriction on the sub-lots" with the Town Attorney. On motion by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that the Southo!d Town Planning Board grant final approval to the minor subdivision of David Gillispie, located at north side of Main Road, East Marion, New York, subject to the following conditions: "Covenant and Restriction to be in the proper form for recording in the office of the Suffolk County Clerk, and fee for recording to be collected by the Planning Board." Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Telephone request received from Richard Lark, Attorney for information in reference to highway requirements for Sunset Knolls, Section 2. On motion by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board hereby submit the following information to the Southold Town Board: "Sunset Knolls, Section 2" was submitted prior to the adoption of the procedure of the reservation of 25 ft. strips on each side of connecting roads, therefore this requirement does not pertain to this particular subdivision. This resolution is made s~bject to the approval of the Supt. of Highways and Construction Inspector Charles Abrahams. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board discussed ~gain the proposed minor subdivision of Valentine Ruch, property located at south side of Middle Road (CR 27), Southold, New York. The lot which was labeled as "to keep" supposedly has been deeded out to his married daughter. Southold Town Planning Board -9- October 27, 1971 On motion by Mr. Moisa,.seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board transmit the proposed minor subdivision of Valentine Ruch, located at south side of Middle Road (CR 27), Southold, New York, to the Suffolk County Health Dept. for their inspection and approval prior to the approval of the Planning Board. Letter to be sent to Mr. Ruch advising him of the new procedure and requesting the maps with all required information. Voke of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. t The Planning Board discussed again the proposed minor subdivision of Steve Mitacchione, property located at south side of Eugene's Road, Cutchogue, N.Y. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board transmit the proposed minor subdivision of Steve Mitacchione, located at south side of Eugene's Road, Cutchogue, N.Y. to the Suffolk County Health Dept. for their inspection and approval prior to the approval of the Planning Board. Letter to be sent to Mr. Mitacchione advising him of the new procedure and requesting the maps with all required information. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Written request was received from Miss Mabelle Dempewolf for permission to record the name of her private road as "Bayberry Path." Subject private road located off Bittersweet Lane on minor subdivision map of Mabelle Dempewolf, Minor Subdivision ~ 19, located at Cutchogue, N.Y~ On motion by Mr. Coyle, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board grant approval to Mabelle Dempewolf to record the name of her private road as "Bayberry Path", private road located on Minor Subdivision Map of Mabelle Dempewolf-Minor Subdivision $19, Cutchogue, N.Y., as approved by the Planning Board on December 8, 1971. On motion by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the minutes of the Southold Town Planning Board dated October 5, 1971, be approved as submitted.
