Y. 11971 PLANNING BOARD M£MB£R$ John ~a/ickhlalrn, ICh~i ~man Henry' 'Moi8~ Alfred ,Grebe ~-rank ,(~oy~e MINUTES SOUTHOLD TOWN PLANNING BOARD November 22, 1971 A regular meeting of the Southold Town Planning Board was held at 7:30 P.M., Monday, November 22, 1971, at the Town Office, Main Street, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank Coyle; Alfred Grebe. Also present: Howard Terry, Building Inspector; Lawrence Tuthill, Town Engineer. Mr. Koehler presented the Planning Board with a preliminary map for the proposed subdivision of his property located at north side of Main ~State) Road, Orient, N.Y. (formerly Wm. Vogel) This property is east of Orient-By-The-Sea, Section I. Total area of the parcel is 35.553 acres. Preliminary map showed a division of the property into 30 lots, all containing 40,000+ s~Y-ft, of area. Southold Town Planning Board -2- November 22, 1971 The map showed a connecting road into Orient-By-The-Sea, Section I. Mr. Keoh~er said that they would like to d~signate lot ~ 1 for park and playground area, lot ~ 1 fronts on L.I. Sound. The status of the connecting road shown between Orient-By-The-Sea and this property was discussed. It is not an existing road. Mr. Jack Sherwood of Otto Van Tuyl & Son informed the Board that this is not a road and the property doesn't belong to Orient-By-The-Sea, it is owned by Lieblein. Mr. Koehler said that he would try to acquire a portion of this proper~y from M_r. Lieblein to make a connecting road to Orient-By-The-Sea, Section I. Mr. Koehler stated that if everything else besides the connecting road is satisfactory, he would like to have preliminary approval. On motion by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed subdivision of F. W. Koehler & Sons, Inc., property located at north side of Main (State) Road, Orient, New York, subject to the following conditions: (1) Approval of the road lay-out by the Supt. of Highways. (2) An understanding with the developer that he will try to acquire a portion of the property to the west (Lieblein) to cut through a connecting road to Orient-By-The-Sea, Section I. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coy~e, Grebe. David Gillispie presented the Planning Board with a preliminary plan for the proposed minor subdivision of property of Peter Sle~eski, located at north side of Main (State) Road, Orient, New York. The map showed 5 lots (2 of them fronting on L.I. Sound) on a parcel of land of 6 acres. The parcel of land immediately to the south of th~s, containing 2.65 acres, is also owned by Peter Sledjeski. This parcel contains his residence. The map showed right-of-way on west side of property, beginning on the Main Road, running northerly to property of C. Rose, then easterly, then northerly to the lots on the Sound. The Board didn't approve of the sharp turn in this right-of-way. The Chairman stated that the Planning Board doesn't approve of anything with the owners having an interest in the adjoining property. Mr. Gillispie stated that the property to the east is now owned by Nicholas Pappas. The Chairman informed him Southold Town Planning Board -3- November 22, 1971 that the parcel to the south (2.65A), containing his residence, must be contained in this minor subdivision, and with the present lot lay-out this would make too many lots for a minor subdivision. The lots would have to be made larger. This map would have to be sent to the County because this property is less than 500 ft. from the state highway, and the County doesn't look favorably upon such a division. The Board asked Mr. Gillispie to advise Mr. Sledjeski to appear before the Plann~ g Board in reference to this property. Sal Celauro a/c Atlantic Homes of Suffolk, Inc. presented the Planning Board with a preliminary map for the proposed minor subdivision of property located at E/S Grand Avenue, Mattituck, N.Y. The map showed a division of the property into three lots. Each lot with 100 ft. frontage on Grand Avenue and 497 ft. deep. Each lot would be over one acre. Map also showed roadway ad- jacent to southerly boundary line. The Board informed Mr. Celauro that the ratio of the lots is out of proportion. The ~epth should not be more than 3 times the frontage. The depth of these lots is almost 5 times the frontage. The Board suggest- ed that he have 2 lots on ~rand Avenue and one back lot with a right-of-way. On motion by Mr. Wickham, seconded by Mr. Grebe, it was RESOLVED that the above proposed minor subdivision map be tabled until the next meeting of the Planning Board for further study. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Coyle, Grebe. Abstained:- Mr. Henry Raynor Gottlieb Nickles and Marjorie Burns presented the Planning Board with a preliminary sketch for the proposed minor subdivision of their property located at south side of County Road 27, Southold, New York. The map showed a division of ~he property into five (5) lots: 3 lots fronting on S/S CR 27 and ! interior lots~wlth right- of-way along westerly boundary line. The Chairman stated that he wou~d like to see a mlnor subdivision of this property with all of Southold Town Planning Board -4- November 22, 1971 the lots fronting on the road and the back of the property left in open area. The Chairman said that he has recently been discussing this type of land use with the Town Board. The back of this property could be leased to the adjoining property owner, Steve Doroski, for nursery purposes. A lengthly discussion was held in reference to land use and the possibilities for dividing this property into a minor subdivision. The Board advised Mr. Nickles to talk to Steve Doros~i about the possibility of leasing the back of this property. No action was taken. The Board advised Mr. Nickles and Mrs. Burns to appear at the next meeting of the Planning Board. Jack Sherwood of Otto Van Tuyl & Son presented the Planning Board with their recommendation and maps for storm water require- ments for the subdivision "Petty's Bight" located at Orient, N.Y. The Board discussed these recommendations and maps with Jack Sherwood and Mr. Aurichio. The Town Board recommendation for leaving the west end of Petty's Drive was read and discussed by the Board. Mr. Sherwood said that their primary concern is the drainage. Their recommendation is based on 2" rainfall in 24 hours and 50% run-off. Mr. Aurichio requested that this subdivision be set up for a final hearing. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board set the next meeting of the Southold Town Planning Board, 7:30 P.M., Monday, December 20, 1971, at the Town Office, Main Road, Southold, N.Y. as the time and place of hearing upon approval of the following plat: 1. Plat of property owned by George & Irving Newman, entitled "Petty's Bight", consisting of a parcel of land of 19.72 acres, situated at Orient, in the Town of Southold, Suffolk County, New York, and bounded and described as follows: Beginning at a point on the northeasterly line of the Old Road 146.78 feet northwesterly along sai~ northeasterly line from the Main Road, said point of beginning being the westerly corner of land Of Przepiora; from said point of beginning running along said northeasterly line of the Old Road, N. 40° 24' 30" W. - 250.0 feet; thence along land of Sledjeski, four courses: Bouthold Town Planning Board -5- November 22, 1971 (1) N. 49~ 35' 30" E. - 185.38 feet; thence (2) N. 7® 49' 20" W. - 925.25 feet; thence (3) N. 45~ 20' 00" W. - 238.77 feet; thence (4) N. 24c 40' 00" E. - 410.0 feet to ordinary high water mark of Long Island Sound; thence along said high water mark as measured by the following tie lines: (1) S. 38 54' 30" E. - 419.78 feet; thence (2) S. 48° 41' 50" ~. - 419.~9 feet; thence along land of Binzley, three courses: (1) S. 7° 49' 20" E. - 954.63 feet; thence (2) S. 0° 23' 50" E. - 250.14 feet; thence (3) S. 6° 10' 00" W. - 192.35 feet to the northerly line of the Main Road; thence along said northerly line, N. 76' 06' 30" W. 55.50 feet; thence along land of O'Kula, three courses: (1) N. 6 10' 00" E. - 181.74 feet; thence (2) N. 0° 23' 50" W. 125.95 feet; thence (3) S. 90° 36' 10" W. - 238.87 feet; thence along said land of Przepiora, two courses: (1) N. 14° 14' 00" W. 42) S. 55 35' 00" W. 78.53 feet; thence 303.69 feet to the point of beginning. Containing 19.72 acres/ This motion is made subject to the following conditions: 1. Approval of the turn-around by the Supt. of Highways. 2. Easing the corner between Bight Road and Petty's Drive on Lot ~ 7. 3. Westerly 2~.~ of Petty's Drive to be marked as "Reserved For Possible~Future Dedication to the Town of Southold For Town Highway Purposes" 4. Resolution of the amount of performance bond to be set for completion of roads and other improvements in this subdivision, upon receipt of recommended estimate by Lawrence TUthill. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Southold Town Planning Board -6- November 22, 1971 Mr. Carl A. Schmitt and Mr. Best & Mr. Syverson (Mr. Schmitt's son-in-laws); and Mr. Eugene Dane~ri, all of Camp Mineola Road, Mattituck, New York, appeared before the Planning Board in reference to their properties. They complained about the property owners in this area dividing their properties. The Board informed them that a minor subdivision was granted to Lena F. Howell by the Planning Board. However, some of these lot owners in this area were g~anted permission to divide their properties by the Board of Appeals. The Planning Board advised them that they would not go al©ng with any further minor subdivisions in this area, due to the lot sizes and the new requirements of the amendments to the Zoning Ordinance. The Planning Board advised them to go to the Board of Appeals and either complain about the granting of these variances or apply for variances on their properties. George Stankevich, Attorney appeared before the Planning Board in reference to the property of Ilie Wacs and Werner Rosenberg, located at east side of Lighthouse Road, Southold, N.Y. (formerly the Tillinghast Estate) Mr. Stankevich advised the Board that he has been retained by the owners for the sale of several of these lots. Mr. Stankevich has contacted the Health Dept. on this matter. Robert Villa informed him that the Health Dept. has no objection to issuing the requested waivers, however, he would like a letter in his file from the Planning Board or Building Inspector to the effect that this is a "pre-existing subdivision" to which the present Southold Town Subdivision Regulations will not be applied. Mr. Stankevich requested that the Planning Board send a letter to the Health Dept. to the foregoing effect. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southotd Town Planning Board hereby sustain the action of the Board of Appeals in granting approval of access in Appeal No. 995 - dated November 2~ 1966 - on property of Ilie Wacs & Werner Rosenberg, located at east side of Lighthouse Road, Southold, New York. This resolution is made subject to a written waiver from the Suffolk County Department of Health. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Southold Town Planning Board -7- November 22, 1971 George Ahlers inquired about the possibility of cluster development in a future contemplated subdivision of 70 acres with 2800 ft. of existing town highways. Mr. Ahlers said that he would like to have 70 lots fronting on the road and have cluster development on the back of the lots. The Chairman said that he would like to see this type of developn~snt and advised Mr. Ahlers that it would also have to be worked out with the Health Dept. George Ahlers appeared before the Planning Board in reference to his proposed subdivision "Calves Neck" located at E/S West Hill Road, Southotd, N.Y. Mr. Ahlers requested that the final maps of this subdivision be signed by the Chairman. He Stated that the drainage is working well, it was put in above specifications. Henry Raynor read recommendations from the Supt.of Highways in letter of June 21, 1971 and November 22, 1971. The Board requested a copy of Chas. Abrahams report alss. The Chairman instructed that Lawrence Tuthill be notified to send in his recommendations on the drainage. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board authorize Chairman John Wickham to sign the final maps of the subdivision "Calves Neck" located at E/S West Hill Road, Southold, N.Y., owned and developed by George Ahlers & Another. This motion is made subject to the following con~it~ions: (1) Catch basins to be cleaned out. (2) Receipt of letter of recommendation from Lawrence Tuthill stating that the drainage is adequate for the amount of road that he has constructed. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Southold Town Planning Board -8- November 22, 1971 Further discussion was held on the proposed subdivision "Petty's Bight" located at N/S Main (State) Road, Orient, N.Y. On motion by Mr. Wickham, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board authorize Lawrence Tuthill, Town Engineer, to do an estimate for a per- formance bond for the proposed subdivision "Petty's Bight", located at Orient, N.Y., subject to the following conditions: (1) Receipt of recommendations from Chas. Abrahams. (2) Receipt of revised maps from Van Tuyl. Vote of the Board:- Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Discussion was held on Minor Subdivision ~ 60 Serafino Santini, located at N/E corner of Westphalia Road & Howard Avenue, Mattituck, N.Y. Henry Raynor submitted a letter from Joseph Saland, Real Estate Broker stating that he has a listing of 4-½acre lots on Westphalia Road and one-½acre lot on Howard Avenue on property of Serafino Santini (MS $ 60). On motion by Mr. Wickham, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board send the following letter to Mr. & Mrs. Ellenberger agents acting for Serafino SBntini with copy to Mr. Santini: Mr. & Mrs. E. J. Ellenberger 6 Hill Court Malba (Queens), New York Dear Mr. & Mrs. Ellenberger: We have on file in our office a letter from a real estate broker indicating that all of the lots in the minor subdivision of Serafin~ Santini are on the marke~ for sale. You will recall that you told us that they were for your heirs, and this is so shown ~n the Planning Board minutes of August 16, 1971. It would appear to us that you obtained the approval of this minor subdivision under false pretenses and we are immediately cancelling approval of this minor subdivision Southold Town Planning Board -9- November 22, 1971 and removing it from among our filed minor subdivisions and notifying the Building Inspector that since this minor sub- division was acquired under false pretenses, no building permits shall be issued on any of these lots. The Planning Board inspected copy of letter sent to Supervisor Martocchia by Howard Terry advising him that the BuildTng Depart- ment has received an application to build dwelling on the S/S of New Suffolk Avenue, Cutchogue, N.Y. on land of Herbert Henry. This property is the meadow land which was partially filled prior to the Wetlands Ordinance. The proposed dwelling will be within the area partially filled. Mr. ~erry stated that he has held up the permit pending stamped and signed approval for well & cesspools from the County Health Dept. Word has been received from Supervisor Mart- occhia that he has spoken with Herb Davids of the Health Dept. who agrees to stay in full touch with the Planning Board on this matter. Chairman John Wickham was presented with copies of the agreement between the Planning Board and Leeward Acres, Inc. in regard to the performance bond for the construction of roads and other improvements in the proposed subdivision' "Leeward Acres at Bayview". This document was executed on the 19th day of March 1971, but was not signed by the Chairman. The Chairman requested authorization to sign the agreement. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board authorize Chairman John Wickham to sign the agreement between "Leeward Acres, Inc." and the Planning Board in regard to the performance bond for the subdivision "Leeward Acres at Bayview", subject to the approval of the Town AttDrney. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe.' Southold Town Planning Board -10- November 22, 1971 The Planning Board reviewed the extension of the performance bond on the subdivision "Willow Point". This performance bond was extended by the Planning Board on June 16, 1971 for a period of 90 days. The bond is now in default. The Planning Board instructed that notice be sent to the developer that the bond is now in default. Chairman John Wickham requested authority to send letter to the Soil & Water Conservation District to establish standards for drainage. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board authorize Chairman John Wickham to send a letter to the Soil & Water Conservation District to establish standards for drainage. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the minutes of the Southold Town Planning Board dated October 27, 1971 be approved as submitted. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. On motion by Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the next regular meeting of the Southold Town Planning Board be held at 7:30 P.M., Monday, December 20, 1971, at the Town Office, Main Street, Southold, New York.
