There were present: Messrs: Henry Moisa, Vice-Chairman; Henry Raynor; and Frank Coyle. AbSent: Messrs: John WiCkham, Chairman; Alfred Grebe (due to unfavorable weather conditions) Also present: Howard Terry, Building Inspector Mr. Stephen Tsontakis presented the Planning Board with revised maps for tbs proposed minor subdivision ~f lot n0.'s 5 & 6 of Capt. Kidd Estates, Mattituck, New York. Lot no. 5 is owned by Stephen C. & Aglaia Tsontakis; lot no. 6 is owned by George & Dimetra Nackos. The maps showe~ a division of the property into 4 lots: 5A, 5B, 6A, & 6B, each lot contains Southold Town Pla~ing Board -2- D~_~mber 20, 1971 approximately one-half acre.. A 20ft. right-of-way is located between lots 5A & 6A, running the entire length of these lots to lots 5B & 6B. The Planning Board referred back to the m~nutes of July 19, 1971, the first presentation of this minor subdivision. Discussion was held on the 10ft. strip of land on the west side of lot no. 5. Mr. Tsontakis said that the deed states that the property starts on the west side of this 10ft. strip. The Board requested that this 10ft. strip of land show on this map. Mr. Tsontakis, who is a P. E., cut this 10ft. right-of-way in on the map. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planninq Board table decision on the above proposed minor subdivision for further deliberation of the Board. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Vice-Chairman Henry Moisa called the hearing to order at 7:40 P.M. by reading the legal notice of hearing for the plat of property under question for approval: NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the Town Law, a public hearing will be held by the Southold Town Planning Board at the Town Office, Main Road, Southold, New York, an said Town on the 20th day of December, 1971, at 7:30 o'clock in the evening of said day, on the question of approval of the following plat: 1. Containing 19.72 acres. The Vice-Chairman read all correspondence contained in this file. VICE-CHAIRMAN: I will now open this hearing to anyone who wishes to speak in opposition to this subdivision? (There was no response.) VICE-C~AIRF~AN: Hearing none, I will now open this hearing to anyone wishing to speak in favor of this subdivision? DONIMIC AURICHIO, ATTORNEY: As the attorney for the owners, I have submitted the map in compliance with the requirements requested, I did pick up this map from the Health Dept., signed by the proper authority. However, I did not have time to get to the Suffolk County Department of Environmental Control. I will take it to the Dept. of Environmental Control first thing tomorrow morning. I would like to request a copy of any other requirements that are required by this Board. Provision will be made on the map for a turn-around. This ~oad (Petty's Drive), although not to be dedicated at this time, is subject to a right-of-way of the property to the west. The Board informed Mr. Aurichio that the reserved area on the N/W corner of lot no. 11 must be marked accordingly. The Board also informed Mr. Aurichio that the correspondence in the file was not complete. The following letters, signatures, etc. must be obtained before final approval can be granted: 1. Updated letter of approval from the Supt. of Highways on the following listed items: (a) Approval of road lay-out as per the re-grading and re- filling of the excavated area and approval of the profiles for the Southold Town Pla~ng Board -4- Dec~er 20, 1971 complete road system. (b) Approval of the turn-around located at the N/W corner of lot no. 11. (c) Approval of the reserved strip located at the easterly end of Pe~ty's Drive on lot r~o. 6. 2. Formal review by the Suffolk County Planning Commission and letter of approval. 3. Approval and signature of the map by the Suffolk County Department of Environmental Control. 4. Recommendation or approval of the Town A~torney in reference to the bonding of the westerly 256.96 feet of Petty's Drive, which is to be left as "Reserved for Possible Future Dedication to the Town of Southold for Highway Purposes. 5. N/W corner of lot no. 11 must be marked as "Reserved for Possible Future Dedication to the Town of Southold for Highway Purposes." VICE-CHAIRMAN MOISA: Is there anyone else present wishing to speak in regard to this subdivision? (There was no response.) VICE-CHAIRMAN MOISA: This hearing will be recesse~ until such time as the file is complete in respect to required approval from all departments concerned. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board recess this public hearing on the subdivision "Petty's Bight", until such time as all necessary approvals and signatures have been secured. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Sal Celauro, President of Atlantic Homes of Suffolk, Inc., presented the Planning B'oard with revised maps for their proposed minor subdivision located .at the east side of Grand Avenue, Mattituck, N.Y. The map showed.a division of the property into 3 lots. The 2 lots fronting on Grand Avenue have 133.05' and 135' road frontage and contain 40,326sq. ft. and 42,231sq. ft. of area. A right-of-wa~,=~9.57' in width, runs between these two lots to the interior lot which contains 60,129sq. ft. of area. On motion by Mr. Raynor, seconded by Mr. Coyle, it was Southold Town Pla~ng Board -5- December 20, 1971 RESOLVED that the Southold Town Planning Board table decision on the above proposed minor subdivision for further deliberation of the Board. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Rudolph Bruer, Attorney presented the Planning Board with revised maps for the proposed subdivision of Clarence Fleet, located at E/S Fleet's Neck Road and W/S Stillwater Avenue, Cutchogue, N.Y. The name of this subdivision has been changed from" North Pequash Estates at Cutchogue "to "Bi~ Green Acres at Cutchogue" The map showed ten (10) lots, containing the following a~eas:- lot no. 1-39,864sq. ft.; lot no. 2-40,000sq. ft.; lot no. 3-40,000sq. ft.; lot no. 4-40,000sq. ft.; lot no. 5-39,649sq. ft.; ~ot no. 6-34,786sq. ft.; lot no. 7-39,956 sq. ft.~ lot no. 8-39,932sq. ft.; lot no. 9-40,092sq. ft.; lot no. 10-40,118sq. ft.~ A 50ft. proposed road (Dartmouth Place) was shown between lots 2&9 and l&10. This map must be referred to the Supt. of Highways for his approval of the road lay-out. All adjoining and surrounding property owners were not shown on this map. The Board advised Mr. Bruer that all adjoining and surrounding property owners must be shown on the map. Mr. Bruer corrected~the formal application in regard to the change in ~ame of this subdivision. Mr. Bruer requested that preliminary approval be granted to this subdivision. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed subdivision map of Clarence Fleet, to be known as "BIG ~REEN ACRES AT CUTCHOGUE", located at E/S Fleet's Neck Road and W/S Stillwater Avenue, Cutchogue, N.Y., subject to the approval of the road lay-out by the Supt. of Highways. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Gottlieb Nickles and Marjory Burns presented the Planning Board with revised preliminary plan for the~proposed minor subdivision of their property located at S/S Old Middle Road (off CR 27), Southold, N.Y. The map showed 4 lots fronting on the S/S Old Middle Road, ranging in frontage from 123' to 125', and containing the following areas:- lot no.1-68,000 sq. ft.; lot no. 2-65,625sq. ft.; lot no. 3-61,500sq. ft.; lot no. 4 55,286sq. ft.; The Board was of the opinion that these lots were too large. A lengthly discussion was held on this matter. It was suggested that a covenant be filed with the deed stating that the lots in this mi~Dr subdivision cannot be further subdivided. This plan as presented is more Southold Town Pla~ing Board -6- Dece~r 20, 1971 feasible than the previous plan - which showed 3 lots on the road and one interior lot with right-of-way. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board send a letter to the Town Attorney requesting his advide on the legality of requiring that a covenant be filed with the deed stating that the lots in t~is minor subdivision cannot be further subdivided. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. William Smith presented the Planning Board with revised preliminary maps for the proposed subdivision of W. H. D. Realty Corporation, to be known as "NORTHWOOD ESTATES AT SOUTHOLD", located at S/S Soundview Avenue, Southold, N.Y. The maps showed eleven (11) lots fronting on the S~S Sound- view Avenue. All lots contained 40,000sq. ft. of area with the exception of lots 10 & 11 which contained 35,000sq. ft. of area. The Health Dept. has given their verbal approval of the size of lots 10 & 11. Mr. Smith said that Van Tuyl will have the linens ready for the signature of the Suffolk County Depar~ent of Environmental Control and the Health Department. Mr. Smith said that Van Tuyl advised him to bring in the preliminary map and try to get a date set for the public hearing. The Board advised him that preliminary approval must be granted before a date can be set for the public hearing. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed subdivision of W. H. D. Realty Corporation, to be known as "NORTHWOOD ESTATES AT SOUTHOLD", located at S/S Soundview Avenue, Southold, N.Y. Vote of the Board: Ayes:- Messes: Moisa, Raynor, Coyle. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board set the next regular meeting of the Southold Town Planning Board, to be held at 7:30 P.M., Monday, January 17, 1972, at the Town Office, M&in Street, Southold, New York, as the time and place of hearing upon approval of the following plat: 1. Plat of property owned by W. H. D. Southold Town Pl~nning Board -8- ~Cember 20, 1971 The Planning Board was presented with a preliminary plan for the proposed~minor subdivision of Evelyn Audion, property located at W/S Marratooka Road, Mattituck, New York. The preliminary plan showed four (4) lots fronting on Marratooka Road, all having 125ft. of road frontage and containing over 40,000 sq. ft. of a~ea. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed minor subdivision of Evelyn Audion, property located at W/S Marratooka Road, Mattituck, New York. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board transmit the proposed mi~ subdivision of Evelyn Audion, located at W/S Marratooka Road, Mattituck, New York, to the Suffolk County Health Dept. for their inspection and approval prior to the final approval of the Planning Board. Letter to be sent to Mrs. Audion advising her of the procedure and requesting the necessary number of maps and completion of Health Dept. forms. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Michael Zukas appeared before the Planning Board in reference to the proposed minor subdivision of his property locates at north side of Main Bayview Road, Southold, New York. This map was granted tenative approval, on March 10, 1969, but the final maps were never presented. The~maps contained in the file, dated March 10, 1969, showed a division of the property into five (5) lots:- lot no. 1 - fronting on Main Bayview Road and lots 2, 3, 4, & 5 - interior lots. All lots contained 20,000+ sq. ft. of area. A 30ft. right-of-way was shown on the easterly side of the property, running tO lots 4 & 5, then continuing in a 15 ft. right-of-way to West Creek with a 100ft. ~urn-around. The Planning Board advised Mr. Zukas that the map will have to be revised according to the new regulations, all lots must have 40,000 sq. ft. of area. Southold Town Pl~ing Board -9- December 20, 1971 Richard Cron, Attorney presented the Planning Board with a preliminary map for the proposed subdivision of Clausen Construction Company, Inc., property located at E/S Leslie Road, Peconic, N.Y. The map showed a division of the property into ten (10) lots, all containing over 40,000 sq. ft. of area and having 135ft. of road frontage with the exception of lot no. 10 which has only 111.20 ft. of road frontage. Mr. Raynor suggested that Mr. Cron contact the easterly adjoining property owner, Mr. Pontino, and request him to sell them a wedge of his property to enlarge the road frontage on lot no. 10 to 135 ft. Mr. Cron stated that he will make an effort to obtain a wedge of the easterly adjoining property. Mr. Cron requested that preliminary approval be granted to this subdivision. As all of the lots in this proposed subdivision front on Leslis Road, no road construction will be necessary On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed subdivision of Clausen Construction Company, Inc., property located at S/S Leslie Road, Peconic, N.Y., subject to the following condition: The owners' attorney, Richard Cron, to make an effort to obtain a wedge of the easterly adjoining property owned by Pontino, to increase the frontage on lot ~ 10. The Planning Board will require a copy of letter of request to purchase additional property, to be sent to Mr. Pontino by Richard Cron, Attorney a/c Clausen Construction Co., Incc, and copy of answer received from Mr. Pontino, if any. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Richard Cron, Attorney presented the Planning Board with a preliminary map for the proposed minor subdivision of O.A. Ringwald, property located off N/S Main (State) Ro~d, Orient, N.Y. (presently owned by Tabor, Mr. Ringwald is the contract vendee, subject to the approval of this minor subdivision) The preliminary map showed a division of the property, into five (5) lots: lot no. 1 100~00~q. ft.; lot no. 2 - 105,000 sq. ft.; lot no. 3 - 103,000sq. ft.; lot no. 4 - 100,000sq. ft.; lot no. 5 - 92,000sq. ft. The map showed 16 1/2 ft. right-of- way from the Main Road to this property and 16 1/2 right-of-way continming on this property ~rom lot no. 1 to lot no. 5. The Board informed Mr. Cron that the right-of-way on this property must be increased to at least 25ft. in width. Mr. Cron requested preliminary approval of this minor subdivision map. On motion by Mr. Coyle, seconded by Mr. Raynor, it was Southold Town P~ning Board -10- De~--~mber 20, 1971 RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed minor subdivision of O. A. Ringwald, property located off north side of Main Road, Orient, N.Y. (under contract to purchase from Tabor), subject to the following condition: Right-of-way on this property must be increased to at least 25ft. in width. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Richard Cron, Attorney a/c Leeward Acres at Bayview, Inc. appeared before the Planning Board to request a reduction in the performance bond of the subdivision "LEEWARD ACRES AT BAYVIEW". The amount of the performance bond is $59,504.39 The Board advised Mr. Cron that the following letters must be secured before the Planning Board can make a recommendation to the Town Board for a reduction in this performance bond: (1) A report on the amount of work to be completed and recommendation from Supt. of Highways. (2) Recommendation from Lawrence Tuthill and revised bond estimate for the amount of work to be completed. The' foregoing letters to be secured and matter to be taken up at the next meeting. Ralph Tuthill presented the Planning Board with final maps for the proposed minor subdivision of his property located at N/S wickham Avenue (offdiVisi0ni6~i. theW/S of ~'~t-of-wa¥ .) Mattituck, N.Y. The map showed a property into five (5) lots with 30ft. right-of-way. !This minor subdivision was submitted prior to the enactment of the amendments to the Zoning Ordinance. The lots contain the following ar~as:- lOt no. 1 - 38,000sq~ ft.; lot no. 2 - 38,080sq. ft.; lot no. 3 40,500sq. ft.; lotno. 4 38,000 sq. ft.; lot no. 5 - 35,000sq. ft. Mr. TUthil~ requested that final approval be granted to this minor subdivision map. F~rmal ~pp!ication a~d fee are yet to be received, and this m~nor subdivision must be referred to the Health Dept. On motion by Mr. Moisa, seconded b~ Mr. Coyle, it was RESOLVED that the Southold Town Planninq Board grant final approval to the proposed minor subdivision of Ralph ~Rthill, property located at N/S Wickham Avenue (off W/S of right%of-way), Mattituck, New York, subject to receipt of the following: (1) Two (2) copies of formal application. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board transmit the proposed minor subdivision of Ralph Tuthill, property located at N/S Wickham Avenue (off W/S of right-of-way), Mattituck, New York, to the Suffolk County Health Dept. for their inspection and approval. Letter to be sen~ to Mr. Tuthill advising him of the procedure and requesting the necessary number of maps and completion of Health Dept. forms. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. The Planning Board discussed again the proposed minor subdivision of Stephen C. & Aglaia Tsontakis and George & Dimetra Nackos, lot no.'s 5 & 6 of Capt. Kidd Estates, Mattituck, New York. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Stephen C. & Aglaia Tsontakis and George & Dimetra Nackos, lot no.'s 5 & 6 of Capt. Kidd Estates, Mattituck, N.Y. The Vice-Chairman signed the final maps of this minor subdivision. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. The Planning Board discussed again the proposed minor subdivision of Atlantic Homes of Suffolk, Inc., property located at E/S Grand Avenue, Mattituck, N.Y. On motion by Mr. Moisa, seconded by Mr. Raynor, it was Southold Town P~ning Board -12- k~ember 20, 1971 RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Atlantic Homes of Suffolk, Inc., property located at E/S Grand Avenue, Mattituck, N.Y., subject to favorable determination of the Health Dept. on the Planning Board referral of this minor subdivision. This motion shall include authorization for the Chairman to sign the final maps upon receipt of favorable determination of the Health Dept. Vote of the Board; Ayes:- Messrs: Moisa, Raynor, Coyle. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board transmit the proposed minor subdivision of Atlantic Homes of Suffolk, Inc., property located at E/S Grand Avenue, Mattituck, N.Y., to the Suffolk County Health Dept. for their inspection and approval. Vote of the Board: Ayes;- Messrs: Moisa, Raynor, Coyle. The Planning Board was presented with favorable letter of recommendation from Lawrence Tuthill in regard to "CALVES NECK", Subdivision located at S/S West Hill Road, Southold, N.Y. Subject letter stated that "the drainag~ is s~fficient for this subdivisi~nnas normally computed. It is to be noted that when the acreage to the north is subdivided, it is recommended that due to change in characteristics of-drainage in lands subdivided that additional drainage be constructed by the subdivider." The catch basins have been cleaned out. Resolution was passed by the Southold Town Planning Board on November 22, 1971, authorizing the Chairman to sign the final maps of this subdivision, subject to the catch basins being cleaned out and letter of rsCommendation on the drainage from Lawrence Tuthill, Town Engineer. As both of these conditions have been met, the maps were signed by Vice-Chairman Moisa. The Planning Board discussed the proposed minor subdivision of Tendler & others, property located at E/S Ninth Street & S/S Brown Street, Greenport, New York. Final approval was granted to this proposed minor subdivision at the Planning Board meeting Southold Town P~nning Board -13- -~ecember 20, 1971 of August 16, 1971, subject to the following condition: "Presentation of notice of acceptance or approval, from the County Clerk,s Office, of the abandonment of lot numbers 1, 11, 13, 15, 17, 19, 21, 23~ 25, 27, 29 & 31 on the map of Greenport Driving Park, County Map No. 369." To date, this requirement has not been fulfilled. The Planning Board instructed that a letter be sent to the owners of this property stating that we have instructed the Building Inspector to withhold any further building permits on this minor subdivision until such time as we receive the notice of acceptance or approval from the County Clerk's Office on the abandonment of the lots in the above mentioned subdivision. Letter was received from Robert L. Tooker, on date of December 16, 1971, notifying the Planning Board of the with- drawal of their application for the proposed subdivision on their property located at E/S Wells Road, Peconic, N.Y. The Planning Board instructed that this letter of withdrawal be placed in the subdivision file, and file be transferred to Planning Board dead-file. Letter received from Bache Bleeker, President of Bleeker Construction'Co., Inc., on date of December 9, 1971, in re- ference to the subdivision "WILLOW POINT", located at N/S Main Road & E/S Bay Home Road, Southold, N.Y. Mr. Bleeker stated that all of the required work has been completed in this subdivision with the exception of: (1) Replacing missing monuments on both sides of streets; and (2) Completing repair of two excavations across Willow Point Road done by lot owners. He stated that he has given orders for the above work to be completed and will keep after the contractors until they are cleared up which should be within two weeks. Mr. Bleeker stated that as soon as the remaining work is completed he will make formal application for release of the performance bond. The Planning Board instructed that a list of expired subdivision bonds be compiled for study at the next Planning Board meeting. Southold Town ~anning Board -14- ~/cember 20, 1971 Howard Terry, Building Inspector informed the Planning Board that Lawrence Tuthill has recommended that the Planning Board compile a set of sub-standards in regard to lot sizes, road conditions, drainage, etc. in all old subdivisions. The Southold Town Planning Board received from the Southold Town Board, on date of November 29, 1971, the proposed amendments to the Building Zone Ordinance and Building Zone Maps of the Town of Southold, together with the instructions to submit their recommendations with respect to these proposed amendments. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board table recommendation on the above proposed amendments to the Building Zone Ordinance and Building Zone Maps of the Town of Southold, until the next meeting for full attendance of the Board. Vote of the Board: Ayes:- Messrs: Moisa, Raynor, Coyle. Correspondence received from Mc-Crosky-Reuter advising the Planninq Board that they are available to make a population and housing profile for Southold Town. The Planning Board stated that they would not be interested in such a profile. Letter received from the ~t~ University of New York requesting a copy o~ our Town Urban Development ~lan. The Planning Board instructed that reply be sent stating that it is unavailable at this time. Howard Terry advised the Planning Board that the New York Association of Towns meeting will be held on February 6, 7, 8, & 9th. Official notice and schedule should be received in the near future. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the next regular meeting of the Southold Town Planning Board be held at 7:30 P.M., Monday, January 17; 1972, at the Town Office, Main Street, Southold, New York.
