Minutes & Discussion Notes from Meeting held

Commencement:

Adoption of Meeting Minutes:

Land Preservation Applications and Inquiries:
The members entered into EXECUTIVE SESSION.
· UPDATE/DISCUSSION RE: FARMLAND PDR AND OPEN SPACE APPLICATIONS

,John Sepenoski, Lillian Ball: Update re: Town Board executive discussion
John Sepenoski and Lillian Ball gave report on Town Board executive session discussion that took
place on July 3, 2012 concerning active projects, application statuses, and financial funding available.
SCTM #1000-45.-6-1,2, 8 (Jurzenia)
Review status and appraisals ordered by The Nature Conservancy [executive session]
John Sepenoski presented appraisal information received from The Nature Conservancy that was
prepared on the three Jurzenia lots being offered for sale to the Town. He explained the advantages
and disadvantages to proposed Town purchases located within the Pipes Cove area.
MOTION made by Lillian Ball, seconded by Anne Murray, to direct Melissa Spiro, Land Preservation
Coordinator, to negotiate a purchase offer for fee title at a value supported by an appraisal on the
Jurzenia properties after obtaining approval from the Town Board to proceed with a purchase option
on properties identified as SCTM #1000-45.-6-1, 2 & 8.

END OF EXECUTIVE SESSION
Applications & Inquiries for Uses or Structures on Preserved Property:
· SCTM #1000-120.-5-1 (Macari PDR)
Request for wind turbine placement on PDR land
John Sepenoski presented Melissa's staff report regarding the Macari's request for a wind turbine
placement on PDR land. Sam McCullough suggested that the committee set a policy for dealing with
ag structure placement on PDR lands when old easement language is involved to allow for changing
times and future requests that the committee will need to deal with.
MOTION made by Sam McCullough, seconded by Allan Connell, to approve landowner Joseph T.
Macari's request for a utility use from a proposed wind turbine to be erected on PDR land (SCTM
#1000-120-5-1) as indicated in LPC request form dated June 25, 2012 with attached proposed
location map.
The Committee has determined that the utility use requested within the development rights easement
has no impact on the agricultural use of the development rights property and is consistent with the
original intent of the easement and is subordinate to the agricultural use of the property.
This approval is given subject to the following conditions:
o Wires are to be buried to a depth of four (4) foot deep. The Committee requires that five (5)
days prior notice be given to its members as to the date of planned trenching in order for LPC
to perform an inspection of the trenching at the easement site. Notification can be done with a
telephone call to the Land Preservation Department at (631) 765-5711;
o During trenching, top soil is to be separated from sand and gravel and, during backfilling,
agricultural soils are to be returned to original condition; and
o Land Preservation Committee will require a recorded disclosure/survey of the buried utility
line location.
Formal LPC approval letter will contain the following paragraphs:
Should you utilize the wind turbine in a manner that differs in any way from that proposed to the Land
Preservation Committee, or to site the utility use at a location that differs from that proposed to the
Committee, you will be required to obtain additional approval from the Committee.
The Committee has opted not to rescind approval previously granted to the landowner on December
29, 2011, revised January 12, 2012, placement of underground wiring crossing PDR lands utilizing
lots SCTM #1000-120.-5-1 and SCTM #1000-121.-1-1.6 for a wind turbine as the members will
continue to support the original placement area for the proposed wind turbine as a favored site
location.

General Land Preservation Items:
· COMPREHENSIVE PLAN: LAND PRESERVATION CHAPTER
Heather Lanza, Planning Director- 7:00 p.m. appointment
Planning Director Heather Lanza provided LPC members with a Draft (July 20, 2012) to the Land
Preservation Chapter of the Southold 2020 - The New Comprehensive Plan for the Town of Southold
that was compiled from old plans dating back to 1962.
Heather reviewed the Draft, opening the floor for discussion, and seeking comments from the
committee members. Several suggestions were made to enhance the Land Preservation Chapter.
Further comments can be directed to Heather Lanza via e-mail (heather. lanza@town.southold.ny, us)
until July 23, 2012. Heather will meet again with the Committee at its next meeting to be held on
Tuesday, July 24th, to finalize the chapter. The final draft of the New Comprehensive Plan is hoped to
be ready for public review by the end of August 2012.
Next Regular Meeting:
· The next regular meeting will be held on Tuesday, July 24, 2012 at 7:00 p.m. in the Annex
Executive Board Room.
