SOUTHOLD TOWN PLA/qNING BOARD
February 8, 1973
A regular meeting-.of the Southold Town Planning
Board was held at 7:30 p.m., Thursday, February 8,
1973, at the Town Office, Main Road, Southold,
New York.
There were present: Messrs. John Wickham,
Chairman; Henry Moisa, Vice Chairman; Henry Raynor;
Frank Coyle. Absent: Alfred Grebe.
Also present: Howard Terry, Building Inspector,
Robert A. Villa, P.E., Suffolk County Department of
Health.
The Planning Board discussed the subdivision
known as "Deep Hole Creeks-Estates". On motion of
Mr. Raynor, seconded by Mr. Moisa, it was

RESOLVED that because the roads in Deep Hole
Creek Estates subdivision are not passable access,
the Planning Board requests that the Building
Inspector withhold all buildingspermits in said
subdivision until such time as the Planning Board
receives a determinatiQn

Vote of the Board: Ayes: Messrs. Raynor, Moisa,
Coyle, Wickham.
The Board held len~hty discussions on the
proposed amendments to the Southold Town Zoning
Ordinance and Subdivision Regulations. Some changes
were made in the proposed amendments and they will
be presented to the Town Board on February 13, 1973.
The following resolutions were passed:
On motion of Mr. Coyle, seconded by Mr. Moisa,
it was
RESOLVED, that based on Comprehensive Public Water
Supply. Study, Vol. II,, SuffQlk COUnty, New York, CPWS-24
by H01~zmacher, McLendon & Murrell, Consulting Engineers,
page 295, states, in part, that 1.2 acres is required
to dil~te nitrates in Suffolk County and also the fact
that until this time package sewer plants have failed
to control the nitrates as well as individual cesspools,
the Southold Town Planning Board recommends to the
Southold Town Board eliminating the "B" category of
the "A" Resident District under the Bulk and Parking
Schedule of the Southold Town Zoning Ordinance and
require all lots to be 40,000 square feet. It ss
also recommended that a new zoning district be created
for parcels of from two to five acre~, to be at the
request of the developer.
Vote of the Board: Ayes: Messrs. Coyte, Moisa,
Wickham, Raynor.
RESOLVED that the Southold Town Planning Board
requests the Southold. Town Board to move immediately
to amend the Southold Town Zoning Ordinance to provide
for cluster zoning as per. recommendation of Proposed
Zoning Regulations, Town of Southold by Raymond & .May
Associates, Section 5.6, page 49. In implementing
this, the Planning Board requests that (1) the Planning

Board be specifically given the right to vary (reduce)
lot widths at the building line by no more than 50%
and side yard clearances by no more than 50%. Setbacks
are to remain the same; (2) under no curcumstances will
multiple resid~R~es be permitted in the "A" Residence
District; (3) an instrument be recorded with the
Suffolk County Clerk guaranteeing the open area will
remain open and in private, taxpaying ownership; and
(4) there must be a Property ~wners Association, as
stated in Raymond & May report.
Vote of the Board: Ayes: Messrs. Coyle, Moisa,
Wickham, Raynor.
On motion of Mr. Wickham, seconded by Mr. Raynor,
it was
RESOLVED that the maximum number of single-family
lots that may be approved in a major subdivision shall
be computed by subtracting from the total gross area a
fixed percentage of 20% of said area and dividing the
remaining 80% of the area by the following minimum
requirements: 40,000 square feet in an "A" District.
Vote of the Board: Ayes: Messrs. Wickham, Raynor,
Moisa, Coy~e.
On motion of Mr. Raynor, seconded by Mr. Coyle,
it was
RESOLVED that the Southold Town Planning Board
will present the lists of proposed amendment~ to the
So~thold Town Zoning Ordinance and Subdivision
Regulations to the Southold Town Board.
Vote of the Board: Ayes: Messrs. Raynor, Coyle,
Wickham, Moisa.
Mr. Villa said the Suffolk County Health Department
is looking at the east end in the area of critical
water supply with the thought of changing their standards
with the availability of water. Their well standards
normally require 40 feet of water. In some areas you
can't get 40 feet. The standards would be changed
so, for example, if you can only get 30 feet of water
you need a 60,000 square foot lot. Mr. Wickham said
the Planning Board would be all in favor of that

Mr. Michael Weinstein came before the Board
with a map of a proposed minor subdivision off
Platt Road, Orient. There are 9.1456 acres and he
proposes four lots. All lots iare shown fronting
on Platt Road with approximateily 145' ~idth and
670' depth. Mr. Raynor told ~r. Wein~tein that
the Planning Board uses a ratio of no more than
three to one for depth of lots. Mr. Moisa told
him that he may be asked to sign a legal instrument
stating that the property will not be'resubdivided.
Mr. Weinstein said he would be. willing to put
covenants and restrictions on the property.
Mr. Wickham told him the Planning Board will require,
in addition to that, an instrument that will be
in recordable form stating the restrictions are
in the deed. Mr. Raynor asked about the topography
of the property and Mr. Weinstein said it was
flat and open. Mr. Molisa also told him. bhat in
the past th~ Planning Board has not loOked too
favorably on anything with such depth as this.
Mr. Raynor asked why.his engineer recommended this
l~t layout. Mr. Weinstein said if it was simply
a right of way, rectangular lots would be no
problem. They were trying to avoid the road expense.
Mr~ Wickham advised Mr. Weinstein that the Town
BOard has told the Planning Board they hh~e been
giving too many minor subdivisions and this is
probably an evasion Of the major subdivision rules
and regulations. Mr.. Weinstein asked if the Board
w~uld suggest the four lots with a right of way
coming down the middle. Mr. Wickham said the Board
will hold the matter,up and look at it some time
before the next meeting. The Board will probably
require some c~oss roads. Mr. Raynor told Mr. Weinstein
that in order for the Planning Board to make some type
of judgment they have to figure out where to put roads.
He.asked if the name on the map was the owner of
record and Mr. Weinstein said Milton Mehlman has the
Property under contract. Mr. Wickham told Mr. Weinstein
the Board will check with its engineer and advise him
after the next meeting.
Mr. Richard Principi et al, of C.P.F. Land Corp.,
appeared before the Board in regard to Blue Horizons
subdivision at Peconic. Mr. Wickham read the following
letter to C.P.F. Land Corporation dated March 22, 1972:

Please be advised that the following
resolution was passed by the Southold Town
Planning Board at their regular meeting on
March 21, 1972:
"IT WAS RESOLVED that the Southold Town
Planning Board grant tentative approval to
the revised preliminary map of the proposed
subdivision "Blue Horizons" as shown on map
by Otto Van Tuyl, date Eebruary 28, 1972,
property located at N/S Middle Road (CR 27),
Peconic, New York, owned and developed by
C.P.F. Land Corporation."
Your next step is to have test holes
and test wells done on the property and then
submit the map to the Health Department for
their approval.
If you wish to make an application for
a waivering of any of the requirements, this
application must be forwarded to the Southold
Town Board.

Mr. Wiekham asked if theyi had a copy oif the

were doing away with them. Mr~ Raynor informed
them they must submit a statement of disc!10,sure of
all the principals involved in C.P.F. Land Corp.
Mr. Wickham said he was.not sure about the cross
road layout. There are 56 acres and 49~lots. The
Board will send {he map to the County Planning
Commission for their comments before they go any
further. They may want to change the intersection.

There is a Master Plan for an east-west highway
somewhere near this property. Preliminary approval
is just to say you hawe something filed with the
Planning Board. Sooner or later we will require
5% to be park and playground. Sometimes we allow
drainage area to be part of it. Mr. Moisa said
the Town Highway Committee will look at it also.
Mr. Terry said the conRection to the County road
has been approved and installed. Mr~ Wickham
told them they have to get approvals from the
Suffolk Co~y Departments of He<h and Environmental
Control. W~n we settle on the cross roads then
we will have our engineer figure out what the cost
of the improvements are going to be and you will
have to put up a bond. If-it meets the approval of
the Planning Board we can then set a time for a
hearing. You don't have to have the bond at the
time of the hearing, but after the hearing you have
to have the bond in the hands of the Town Board and
they have to notify us before it can be sent up for
filing. We will need more copies of the map.
Joseph and Edwina Hatier appeared before the
Board in reference to property off Platt Road, Orient,
consisting of 8.17 acres. They want to sell off
one parcel of approximately two acres and build their
house on the other parcel. Mr. Wickham told them
the Planning Board will not allow the~ to keep selling
off lots. They must have a layout of the property
and give a statement that the property will never be
re-subdivided. Mr. Raynor said it will have to be a
perpetual deed restriction. Mr~ Wickham suggested
they divided the property up into three or four lots
and if they had to dispose of the property they could.
Mr. Hatier said they would discuss it and come back
at the next meeting 6f the Board.
Rudolph Bruer, Esq., came before the Board in
reference to minor subdivision for K&mon Retzos at
East Marion. He presented a copy of the deed for
the property. Mr. Raynor asked if he discussed with
his client the 30 foot right of way. Mr. Bruer said
he did not feel it would be a serious detriment to
the property as it was. Mr. Wickham said he thought

he should add another 6 feet to the right of way.
Mr. Bruer said he has to get the water tested.
Mr. Villa said if they can get the dat~ they can
use the existing well.
Mr. Bruer also asked for the Board's opinion
on the proposed minor subdivision for Hahn at Peconic.
Mr~ Wickham said he did not approve of it. If he
brought in a subdivision showing two lots then he
would be in line with what some people are doing.
We may say that this piece of property does not lend
itself to subdivision. Our regulation says no more
than three times the width. If you divide it in half
you have roughiy four to five times the width.
Mr. Wickham said he should tell his client the property
does not have 135 feet on the first lot.
Bob ~rupski appeared before the Board mepresenting
Pontinos ~and presented a sketch of a proposed subdivision
at Peconi~. 19 lots were shown on the sketch. There
is an exilsting house on lo% ~10. Mr. Rayno~ asked if
Mr. Pontino owned any adjacent property. Mr:~ Krupski
said no~ but they own the homestead and approximately
12 acr~s~ Mr. Wickham told Mr. Krupski thati'the
Planning Board is recommending to the Town B~ard and
they will take action on Tuesday that we take 80% of
the total acreage and say we will allow that many lots.
The rest is for park and playground, highways, etc.
Also there is a recommendation for raisin~ ~e percentage
to sand~and gravel mnd we are looking at this in another
subdivision and think we Will ~robably recommend this
to the Town Board. It may not be any cheaper than
curbs and gutters. You have to put in a substantial
area for drainage. Mr. Coyle told him they have to
preserve the water on the property. Mr. Raynor also
said that any subdivision can be made to drain within
200 feet on the highway. Mr. Krupski said they put

in the two roads in order~to keep the lots smaller,
as large lots are not easily marketable. The lots
should market at $9,000 a lot. Mr. Wickham said
the Planning Board will want a statement that no
lot in the subdivision is less than 40,000 square
feet. Mr. Krupski said he would do that.
Mr. Jack Levint Sound Shore Resort Motel,
appeared before the board with plans for an addition
on the east side of existing pool and asked for
suggestions on site plan approval. Mr. Levin said
he owned property on both side of Feeney's house.
There would be about 15 feet between the pool and
the ~ddit~on. There will be 8 units in the addition.
Mr. ~ickham asked~if the parcel was purchased
separately and the date purchased. ~Mr. Levin said
it was purchased separately about 7 to 8 years ago.
Mr. Wickham said the Zoning Ordinance says you can't
have more than so many units per acre and we have
to e~tablish the size of the parcel. Mr. Villa
saidlit will have to be resubmitted to the Health
Department for approval. Mr. Wi~kham said the Planning
Board will require a complete site plan including
circulation of traffic. We think there is a little
bit of a traffic hazard on the present property.
Mr. Levin said he would qet the Health Department
approval and complete site plans.
!JOseph Snellenberg appeared before the Board
with ~a:pr~p~sed minor subdivision for ~ohn B. Pearson
amendling the Zoning Ord'ihance to provid~e for a
newdliStrict, to be at the request of the'~bdivider
for l~w density lots. Mr~ Sn~lenberq said the
road comes in from South Harbor Road ~o the S~ellenberg
property. There is another roads which runs down
through the woods. Mr. Wickham said the Planning Board
will wan~ to look at the property.

Mr. Villa suggested increasing the frontage
on 40,000 square foot .lots. He also said the
Health Department may put in their own drainage
requirements where all water must be contained
on the property. He discussed the suggestions of
the Soil and Water Conservation District for
drainage with the Board.
Mr. Wickham said the Board would like~bs Villa~s
office to check on the drainage for Mattituck
Shopping Center.
Mr. Villa also gave the Board a copy of a
letter he sent to Mr. DeMaria in reply to his letter
of January 31, 1973.
On motion of Mr. Coyle, seconded by Mr. Raynor
it was
RESOLVED that the Planning Board authorize
Lawrence Tuthill to prepare bond estimates for the
following: Inlet East Subdivision, Donald Dennis;
Majors Pond Subdivision, Douglas Lahham;and for
the ~ollowing, after necessarylmaps have been
submitted: Penny & Luce; Oregon Hills, Tommassini;
Blue Horizons, C.P.F. Land Corp. (after submission
to County Planning Commission~.
Vote of the Board: Ayes: Messrs. Coyle, Raynor,
Moisa, Wickham.
The Board discussed Orient By The Sea S~ubdivision
and the Secretary read a letter from Mr. Mahony dated
February 2, 1973, with revised Section III enclosed.
This revised Section III shows Uhl Lane with a cul
de sac and had an additional three lots. Mr. Wickham
instructed the Secretary to contact the Superintendent
of Highways for his approval.
On motion of Mr. Coyle, seconded by Mr. Moisa,
it was
RESOLVED that upon receipt of a letter of approval
from the Supt. of-Highways of Hhl Lane as shown with
a cul de sac, the Chairman and Building Inspector

are authorized to present the map of Orient-By-The-Sea
Section III to the Town Board.
Vote of the Board: Ayes: Messrs. Coyle, Moisa,
Raynor, Wickham.
Mr. Frank Knispel appeared before the Board in
~regard to a change of zone on property of Anna Hansen
for a marina. Mr. Raynor told him he should get an
erchitects rendering of what he plans to do.
Mr. Wickham said generally the Planning Board feels
~it will be an asset to the community and the development
Hf waterfz6nt is very important. Mr. Wickham also
said his problem is the change of zone. Mr. Radnor
said he discussed his proposal With some of the
adjacent property owners. They wanted to know about
the proposed change of the road and what was proposed
for plantings. Mr. Knispel said when Mr. Bishop did
the road layout he took out the sharp turns and he
will have to put the road in further in order to put
in plantings. He said he wants to put up old houses
for a Mattituck Seaport. Mr. Coyle asked if he had
any plans for year-round homes. Mr. Knispel said he
did nou. He said he was not interested in doing this
for the smaller boats. He wants it for large boats,
but on the east side of the Harbor there would be ties
and storage for smaller boats. Mr~ Wickham said the
Planning Board recommends that hhe property be preserved
in a natural state.
On motion of Mr. Raynor, seconded by Mr. Coyle,
it was
RESOLVED that the following letter be sent to
the Southold Town ~onservation Advisory Council:
"The Southold Town Planning Board respectfully
suggests that the Conservation Advisoky Council
~va!~'ate ~he wetlands of the
Southold Town Planning Board
Pebruary 8, 1973
evaluate the wetlands of the Town of Southold
as catalogued in the "Marine Wetlands of
Nassau & Suffolk Counties-,-New York, 1972",
in view of the fact that the New York State
Department of Environmental Conservation is
moving to acquire some of the wetlands in the
Town and it would seem advisable that those
most in need of being preserved should be
included.

RESOLVED that the minu~s of the Planning Board
meetings of December 6, 1972, January 11, 1973 and
January 13, 1973, be approved.

The Secretary reported that all necessary letters
have been received as required by the Planning Board
for release of the bond for Laurel Country Ests.
On motion of Mr. Raynor, seconded by Mr. Moisa,
it was
RESOLVED that the Southold Town Planming Board
recommend to the Southold Town Board r~lease of the
bond for Laurel Country Estates Subdivision.
Vote of the Board: Ayes: Messrs. Raynor, Moisa,
