SOUTHOLD TOWN PLANNING BOARD
March 6, 1973
A regular meeting of the Southold Town Planning
Board was held at 7:30 p.m., Tuesday, March 6, 1973,
at the Town Office, Main Road, Southold, New York.
There were present: Messrs. John Wickham, Chairman;
Henry Moisa, Vice Chairman; Henry Raynor; Frank Coy!e;
Alfred Grebe.
Also present: Howard Terry, Building Inspector;
Mrs. Bachrach, League of Women Voters.
Mr. Michael Weinstein appeared before the Board
~rence to proposed minor' subdivision off Platt
Road Mr. Bob Gillispie, III, also oame before
the Board with a proposed iayout~of the Subdivision
showing four lots with a 50 f~o~t ~a~~ in the middle of
the property. The Board approved of this layout and
will require a legal instrument that the prg~perty
will not be resubdivided and also that the 50 foot

road be extended to the property line. The lots must
be numbered and show the square footage of each. A
test hole will be required by the Healt~ Department.
The property is under contract and the purchasers
own no adjacent property. The Board gave tentative
approval to the map, with the right of way extending
to the property line.
Oick Cron, Esq., appeared before the Board in
regard to property owned by Cron and Wilsberg, Orient
Point. He presented a proposal showing 135 condominium
units to be. constructed on approximately 17 acres, five
units to a building, and 30 acres of open space. Mr. Cron
said they plan to develop part of the open space with
a. par 30 golf course. The Board advis~e~d Mr. Cron the
distance between t~e buildings must be twice the height.
Mr. C~on said the ~ke%Ch was not drawn to scale~ but
just to show the general concept as to use. The Board
also ~nformed Mr. Cron that the map must show all
property owned, including the property the hotel is on
and the property where the condominiums are proposed
would require a change of zone. The hotel property
c~ld be pUt in a SeCtion II, but i~ must be included
on the map. The Board asked ~.~ Mr. Cron if the adjacent
property of Latham was under contract. Mr. Cron said
no, but they have first refusal on it. The Board stated
that they were more in favor of this concept than the
previous proposal. Mr. C~on said that this proposal
had been worked out by the SuffOlk County Planning
Commission. They propose to have two bedroom units.
Mr. Cron said it would be an adult community and seasonal.
It would be fully restricted to adults only. This
restriction would be for as tong as the condominiums
exist. The Board told Mr. Cron he would have to apply
to the Town Board for a change of zone first and it would
then be submitted to the Planning Board for their
recommendations. This change is not on the Master Plan
and that would have to be conSidered.
Rudolph Bruer, Esq., appeared before the Board with
a proposed subdivision for Lorraine~Hochman, et al, on
property off Ridge Lane, Cutchogue. The~property is
21.831 acres and 19 lots are proposed. The Board
informed Mr. B~uer that the Town Board is considering
increasing the frontage to 150 feet. Also there will

have to be a connection for the proposed east-west
highway. Mr. B~uer said this would be done and
asked what will be required for park and playg~Qund.
The Board advised Mr. Bruer that park and playground
must be provided for and they are considering bonding
for this improvement and the installation of some type
of recreational equipment. The location would depend
on the topography of the land. It is possible that
the park and playground could be combined with the
drainage area. The Board suggested that before any
further work is done that the water be tested.
Lot $19 will have to have access off Bridge Lane.
Mr. Bruer said the owners have ~o adjacent property
and left copy of map for the Board.
Mr. Kroehler and Mr. Chapman appeared be~6re the
Board in regard to final approval for Land's End
Subdivision at Orient. The Board told them the
affidavit of disclosure and final maps, with changes
requested, had been received and the file is complete.
The hearing is scheduled to reconvene on March 21st,
but this date will be changed and they will ~etnotified
when the date is seu. All the conditions have been
met and they will not be required to appear when the
hearing is reconvened.

Board told Mr. Weglicki the release or renewal of his
bond would depend on the engineer's report. Also if
the engineer recommends changing the circle at the
intersection, the lot lines would have ko be changed.
Mr. Weglicki said approximately 16 lots have been sold.

The Chairman told Mr. Weglicki if a ridge was put up
on property when a house was under construction, it
would help prevent water from running into road.
Mr. Weglicki said the reason the road oonStruction was
held up was because they had to wait for LILCO to put
in the underground service. The Chairman told Mr. Weglicki
that a fire truck could not get through if there was a
fire in one of the houses. The Board told Mr. Weglicki
they will get in touch with him after the engineers report
is received.
Lefferts P. Edson, Esq., appeared before the Board
and alsked what were the specifications for clustering.
Mr. ~ickham informed him hhePlanning Board has the
authority to approve cluster zoning now, but has asked
the T~wn Board to be more specific. A hearing will be
held on this within the next two to four weeks, but
the Board knows what the conditions are to be. The
Board is asking to be allowed to reduce frontage, rear
yard and several requirements by up to 50%. The total
number of units will be figured from the total area
after taking 20% for roads and improvements and then
dividing the remainder by 40,000 squa£e feet. There
must be a home owners association to take care of the
open space.
Mr. Edson presented a map of property owned by
Crown Land Land, Inc., at Cutchogue, N.Y., consis~in~
of 22.~78 acres, which shows proposed clustering.
20 lots are proposed with a frontage of approximately
105 feet. A suggestion was made that part of the open
space be near the Main Road to provide buffering and
have the lots in the middle of the property. Mr. Edson
said he thought it would be more advantageous to have
all t~e open space in one piece. The Board told Mr. Edson
he ~o~ld have %o reserve a strip of land for the
propolsed road parallel to the Main Road. The Board also
said the Health Department may want a test we~l on
t~ie nozth end of the property. The Chairman told Mr. Edson
that this map must go to the County Planning Commission
and Health Department and when it comes to clustering,
the arrangement of wells and cesspools can b~ a problem
on~,half acre lots. The Planning Board will' recommend
this clustering to the ~ounty but their rules are not
based on it. The Health Department has said that if
the Planning Board recommends it they would be inclined
to look favorably on it. They did not say they will
give approval.

Mr. Frank Knispel appeared before the Board
with ~ revised site plan for proposed storage
build~ings at Naugles Dock. This revised plan shows
all the buildings within the Business zone district,
plus the 30 foot allowance into the "A" district.
Mr. Knispel gave the Board pictures of the buildings
to be put up. Mrs. Backrach a~ked the Board if this
would involve the Army Corps of Engineers and the
Chairman said it would not because this was upland.
Mr. Terry said he would still have to put up a
retaining walt. Mr~ Knispel said he would put up a
fence also. The Board told Mr. Knispel he will have
to submit a plan showing elevations for site plan
approval. Also the Board will want to know what
plantings will be used, where the retaining wall will
be, what the buildings will look like and the Board
may submit the plans to the Soil and Water Conservation
Depar~tment for their comments.
Mr. Knispel also submitted a plan of Anchor Inn
Restaurant and asked about removing part of the bank
to enlarge the parking. The Board told Mr. Knispel
to submit a plan showing contours and elevations.
Charles Cuddy, Esq., came before the Board and
inquired about multiple dwellings on t~o pisces of
property owned by Wer~er L. Adel, Jr., at Mattituck,
consisting of 38 acres and 16 acres. The Board informed
Mr. Cuddy that the zone would have to be changed and
the prospects of this are very remote because this
the Town Board, but the PlanRing Board cannot be expected
to approve it. Mr~ Cuddy asked about cluster development.
The chair~an told him the Planning Board h~s the authority
to cluSter but has not done it. They want more guidance
from ~he Town Board and there is a problem, with the
County Health Department. Under the guidelines clustering
would allow you to put houses on half acre lots and
make some arrangement to maintain other half of the property
in open space and tie it up to a home owners association.
Mr. Cuddy thanked the Board for their recommendations.

Mr. James Bitses a~peared before the Board with
a map of property off G~hd Avenue, Mattituck,
consisting of 11.9 acres. Mr. Bitses said he does
not want to develop the !w~ol~ parcel at once and
would like approval for three lots. The plan shows
a 60 foot road and Mr. ~ihses asked about.having a
10 foot island down the middle of the road. The
Board told Mr. Bitses they would not accept a minor
s~bdivision where there is more than five lots and
where there is other property in the same ownership,
so this would be a major subdivision. If he files
for a subdivision and preliminary approval is given
the Planning Board will i~struct the Building Inspector
to give you a building permit on only one lot. The
Planning Board cannot give a building permit on one
· ~t in a subdivision before the plans reach the stage
of final approval. Also you would have to get special
permission from the Superintendent of Highways for
the island in the middle of the road. Sometimes
divided highways cause maintenance problems. Mr. Bitses
asked about curbs and the Chairman told him at the
present time the specs call for cubbs and gutters.
There is a proposed idea for no curbs b~t it is.more
costly than putting in curbs and gutters.
On motion of Mr. Raynor, seconded by Mr. Wickham,
it was
RESOLVED t~at a Special Meeting of the Planning
Board wi~t be held March 15, 1973, at 7:30 p.m., at
the Town Office, Main Road, Southold, N.Y.
Vote of the Board: Ayes: Messrs. Raynor, Wickham,
Coyle, Grebe, Moisa.
On motion of Mr. Coyle, seconded by Mr. Moisa,
it was
RESOLVED that the Planning Board meeting'scbeduled
for March 21, 1973, be changed to March 281, 1973, and
the hearing for Land's-End Subdivision will reconvene
on March 28, 1973, at 7:30 p.m., at the Town Office,
Main Road, Southold, N.Y.

Vote of the Board: Ayes: Messrs. Coyle, Moisa,
Wickham, Raynor, Grebe.
The Board received a copy of a letter sent to
Supervisor Martocchia and the members of the Town
Board from the League of Women Voters, dated March 6,
1973, in regard to their.comments on the proposed
amendments to the Zoning Ordinance.
The Board received a copy of a letter from the
Supervisor to Mr. Edward J. Bage, that he is being
retained as consulting engineer for the Town and will
perform duties formerly performed by Charles Abrahams.
The meeting was adjourned at 11:00 p.m.
