Y, 119'71 PLANNING BOARD MEMBERS John Wiokham, Chairman Henry Molsa Alfred Grebe Henry Raynor Frank Coyle MINUTES SOUTHOLD TOWN PLANNING BOARD March 28, 1973 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Tuesday, March 28, 1973, at the Town Office, Main Road, Southold, New York. There were present: Messrs. John Wickham, Chairman; Henry M6isa, Vice Chairman; Henry Raynor, Frank Coyle; Alfred G~ebe. Also present: Howard Terry, Building Inspector; Mrs. Bachrach, League of Women Voters; Mr. Goodale and Mrs. Lytle, North Fork Taxpayers Association; Mrs. LorraiRe Terry. Mr. Alden Young, P.E., reported to the Board on Laurelwood Estates. He presented four (4) prints showing Plan and Profile of Roads in "~aurelwood Estates". Mr. Young said the roads do got vary greatly in regard to the original profiles, but the main drainage comes from the lots surrounding the circ~ intersection. The Board asked Mr. Young how man~ Southold Town Planning Board - 2 - March 28, 1973 catch basins would be needed to take care of the water. Mr. Young said he thought four more catch basins with three rings and a dome, and have the existing ones cleaned out would do it. THE CHAIRMAN: The hearing for the subdivision entitled Land's End at Orient Point was recessed some time ago because the file was not complete. It is now complete. I will reconvene the hearing. It does non require a legal notice. The file is now complete. The subdivision has met the requirements of the Zoning Ordinance and the rules and regulations for the subdivision of land. I will limit any statements to a simple statement that anyone is for it or against it. Does anyone wish to speak in opposition to the subdivision Land's End? (There was no response.) Does anyone wish to speak in favor of the subdivision Land's End? (There was no response.) I will declare the hearing closed with a note that the file is complete. Lefferts P. Edson, Esq. and Messrs. Haberman and Donouan came before the Board and pre~nted preliminary plans and application for Pebble Beach R~alty subdivision ~t E~St Mari~n for approval. Mr. Haberman said they know the submission for preliminary approval must be made two weeks prior to a meeting. The plans are in accordance with the Subdivision ~egula~i~ns and Zoning Ordinance. Mr. Haberman said they have met with the Soil Conservation Department and have not elected to proceed in the direction they suggested since it is not official. The Chairman said the'Board is concerned with %he distance back from the ~op of the bluff, and the f~D~tage of. the lots on the two loops. T~.~ should be a re'striction on all shore front lots that no under- cover or trees can be removed and everything must drain back away from the bluff. The Planning Commission was talking about 70 feet setback from the top of the bluff. This is what the Planning Board had in mind When the proposal was first brought up. A restriction wo~ld go on the filed map that no structure would be buil~ in front of the Setback line. Southold Town Planning Board - 3 - March 28, 1973 Mr. Haberman said the s~bdivision is 260 lots and 163 acres, based on half acre zoning with sewer and water. The property was purchased by Pebble Beach Realty last November. The Board informed them the maps would be sent to the Suffolk County Planning Commission, but the Planning Board had not yet granted Preliminary ApproVal. The Board also asked what percentage of the total area was for park and playground and Mr. Haberman said approximately 2 1/2%. The Board informed them the requirements may well change before this gets to a final hearing. The Town Attorney has said that a subdivision must be incconformity w~th the rules and ~regUlations at the time of the final hearing, and the Town Attorney has also approved for public hearing the proposed amendments to the rules and regulations for the subdivision of land, including a 5% requirement for park and playground. Mr. Haberman asked what the Board felt about ~he concept for highways as designed by the Soil and Water Conservation Department. The Board informed Mr. Haberman that they were kept posted on the tentative design and is interested in it, bu~ did not think it would be adopted as a standard for street design. It would have to be at the express request of the developer because there has to be deed restrictions and covenants so that the easement is maintained. It is also estimated that this method ~s more expensive that the present method with curbs and gutters. Rudolph Bruer, Esq., presented a revised map for a proposed minor subdivision for Addrew Hahn at Peconic, showing only three lots. The last lot,#3 will be Mr. Hahn's residence. The Board told Mr. Bruer there is still the problem of length to width ratio. The Board wall hold the map for further discussion. Southold Town Planning Board - 4 - March 28, 1973 Mr. Jack Levin appeared before the Board and presented the site plans for addition to Sound Shore Motel. Mr. Levin said the foundation for the new building will be poured concrete. The Board inquired about the setback of the building from the high water mark; the plan showed the setback was approximately 90 feet from high water. The Board also inquired as to what he plans to do with the existing fresh wauer pond. Mr. Levin said he plans to do some landscaping around it. Mr. Levin also said the porch on the north side of the building would extend 8 feet out from the building, but not extend over the Dluff. The Board asked Mr. Levin if he could get flood plain insurance and he ~aid he could but it was expensive. Th.e ' Board~told ~r. Olsen that the County P~lanning Commission wantis ~o aiccess off the Main Road. Mrs. Olsen said the only a~cess will be off Ninth Strest. They are working one.an agreement now with-the v~llage. All facilities will be electric, with the poles underground. Mr. OlSen said their attorney, Mr. Lechtrecker had p~ocedUres. The access on Ninth' StrSet will existing curb cu~s. ~he Board asked about structures for surface runoff. Mr. Olsen said the are based on a two inch rainfall. The Chairman informed Mr. 8&§eh the present requirements are more than for a two inch rainfall and asked if their proposed structures would hold two inches from the whole area. Mr. Olsen said they would.hold 100%. Mr. Olsen said a test hol~ had been made, but they do not have the results yet. The Board inquired about facilities for handicapped. Mr. Olsen said there will be two apartments provided near the laundry room building. That building, and all the buildings will be wood framed, but there won't be any gasoline stored. The Board said some access should be made for the surplus parking area near the railroad tracks for the rest of the area. The Board agreed to permit a breezeway between the buildings in this area for access to the parking area. It will be a roofed over breezeway. The plans will be sent to the County Planning Commission for final review. Mr. Frank Knispel presented the site plan for the proposed parking area for Anchor Inn at Mattituck. The Board told Mr, Knispel the Sand and Gravel Ordinance is an ordinance of the Town Board and the Planning Board has no jurisdiction over it. The Board will hold decision on this until later in the evening. Mr. Kni~pel also presented the plan for the storage bulitdings for Nauqles Dock. The B6a~ asked Mr. Knispel what he plans to ~ise 'for the retainihg walls an~ he said creosote.ti~s. Mrs. Knispel indicated on the map the highest point water, has ~eached to ih~s~kn°wtedgie. The Board asked Mr. Kni:spel if he could leave the terrace natural by putting in sheet steel instead of grading~ it. Mr, ~Knisp~i said ~he cost would be very high, although he would liks to keep it in a natural' state. The Board suggested sending the map to the Soil and Water Conservation District for their comments on retaining the slope. Mr.~ .Knispel said he would take a copy of the map to them the next day and the Chairman said he.would call and let them know he was coming. The Board discussed the proposed minor subdivision for Hatier off Platt Road, Orient. The Board will require a legal instrument that the property will not be resubdivided. A decision on approval will be made later in the evening. Southold Town Plannmng Board - 6 - March 28, 1973 A revised preliminary subdivision plan for Lorraine Hochman was presented showing access for lot $17 off Bridge Lane only and three acres of park and playground. The topographical map is not complete yet. The Board said there may be a highway connection problem. Also the restriction for access for lot $17 must be stated on the map. The Health Department is requiring three locations for test holes. The Board dis~sed the proposed subdivision map for Poscilliclo at~re~np~o~ The following changes and requirements must be made: (1) The intersection of Kerwin Boulevard and Bayshore Road should be at right angles and have stop signs. (2) Move road connecting Sage Estate property further down by lots $10 and 11. (3) Eliminate northeast connection to Bayshore Road, keeping only connection by Kalbacker property. (4) AllLlots must have 150 feet frontage. (5) 5% of total area must be provided for park and playground. (6) Have Health Department locate test ho~es and submit report. Mr. Grovene~eld appeared before the Board with a map sion off Orchard Street, Orient, con of ~t2~471 acres with tl lots. The Board told Mr. Grove~evetd all lots must have 150 feet frontage and 5% of the area must be provided for park and playground. The park and playground ha~ to be in a hO~elowners association and is deeded to each lot. Also some type of facil~iies must be installed. The Board suggested that he have test hole dug and submit results. Southold Town Planning Board - 7 - March 28, 1973 On motion of Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the proposed list of Suggestions for Prospective Developers to be included in the Subdivision Regulations booklet be adopted by the Planning Board. Vote of the Board: Ayes: Messrs. Moisa, Raynor, Coyle, Wickham, Grebe. On motion of Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the proposed amendments to the Subdivision Regulations, as corrected, be approved. Vote of the Board: Ayes: Messrs. Wickham, Coyle, Grebe, Moisa, Raynor. On motion of Mr. Grebe, seconded by Mr. Raynor, it was RESOLVED that the Planning Board will hold .a public hearing on the proposed amendments to the Subdivision Regulations of the Town of Southold on April 16, 1973, at 7:30 p.m., at the Town Office, Main Road, Southold. Vote of the Board: Ayes: Messrs. Grebe, Raynor, Coyle, Moisa, Wickham. On motion of Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the next regular meeting of the Planning Board will be April 16, 1973, at 7:30 p.m., at the Town Office, Main Road, Southold. Southold Town Planning Board March 28, 1973 The Board instructed the Secretary to send for a booklet, Control of Land Subdivision, from the State Office of Planning Services, 488 Broadway, Albany, New York, 12207. On motion of Mr. Raynor, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board grant final approval to the s~bdivision Land's End at Orient, New York, and the Chairman is authorized to sign ~he maps. Vote of the Board: Ayes: Messrs. Raynor, Grebe, Coyle, Wickham, Moisa. On motion of Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Planning Board will submit the maps for Pebble Beach Realty to the Suffolk County Planning Commission for their comments. Vote of the Board: Ayes: Messrs. Raynor, Moisa, Wickham, Coyle, Grebe. On motion of Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Planning Board grant approval of the site plan for parking area for Anchor Inn, subject to any action by the Town BOard under the Sand and Gravel Ordinance. Vote of the Board: Ayes: Messrs. Raynor, Moisa, Wickham, Coyle, Grebe. Southold Town Planning Board - 9 - March 28, 1973 On motion of Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Planning Board ad~se Mr. Jack Levin to hold up building on addition to Sound Shore Motel until the County Highway Department gives approval of access and all fill that has been placed in pond is cleaned out. Vote of the Board: Ayes: Messrs. Raynor, Coyle, Wickham, Moisa, Grebe. On motion of Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Planning Board send plans for Driftwood Cove (Greenport Homes) to the Suffolk County Planning Commission for their comments. Vote of the Board: Ayes: Messrs. Coyle, Raynor, Moisa, Grebe, Wickham. On motion of Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the minor subdivision for Joseph and Edwina Hatier, Platt Road, Orient, be approved, subject to submission of a legal instrument in recordable form that lots will not be resubdivided. Vote of the Board: Ayes: Messrs. Wickham, Coyle Moisa, Grebe. Abstention: Mr. Raynor. A copy of the report of the Town Engineer, EdWard J. Bage, P.E., on the roads in Harbor Lights Subdivision Sections l, 2, and 3 was read by the Secretary. For the most part the subdivision has not complied with the provisions of the applicable highway specification. Southold Town Planning Board - 10 - March 28, 1973 A copy of the report of Town Engineer, Edward J. Bage, P.E., on the roads in Petty's Bight Subdivision was read by the Secretary. A copy of this report will be senn to the attorney representing the developer. The Board received an inquiry from the Bonding Company for Willow Point Subdivision. Received from Justice Martin Suter a copy of a letter sent to Mr. Harold Reese from the Town Board Highway Committee in regard to Harbor Lights Subdivision, requesting him to make an appointment with the Town Superintendent of Highways and Town Engineer in order that the roads meet the specifications. On motion of Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the request of Peter D. Pizza~elli to. move the easterly line of Lot ~2 of his Minor Subdivision at East Marion twenty feet west on Main Road and fifteen feet west on Orient Bay be denied. Vote of the Board: Ayes: Messrs. Moisa, Coyle, Raynor, Wickham, Grebe. Southold Town Planning Board - 11 - March 28, 1973 The Board discussed the proposed minor subdivision of Pearson property at Southold. Mr. Snellenberg had asked about some changes in the road and selling a piece to an adjoining property owner. The Board will want to see the proposals dr~mrn up before any decision is made. The Planning Board discussed the proposed subdivision of Case property at C~tchogue. There was a proposal to have a turnaround at lot ~17. Mr. Raynor said the County Planning Commission felt lot ~17 should not be a lot, but be left for drainage. On motion of Mr. Grebe, seconded by Mr. Coyle, it was RESOLVED that the map of proposed subdivision of Case property at Cutchogue, be changed to extend road to southerly line of lot 917 and provide a 100 foot turnaround and all lots must have 150 feet frontage, including lots $4 and ~11. Vote of the Board: Ayes: Messrs. Grebe, Coyle, Wickham, Moisa. Naye: Mr. Raynor. On motion of Mr. Coyle, seconded by Mr. Moisa, it was RESOLVED that the minutes of the Planning Board meeting of March 6, 1973, be approved. Vote of the Board: Ayes: Messrs.
