SOUTHOLD' TOWN PLANNING BOARD
May 9, 1973
A special meeting of the Southold Town Planning
Board was held at 7:30 p.m., Wednesday, May 9, 1973,
at the Town Office, Main Road, Southold, New York.
There were present: John Wickham, Chairman;
Henry Moisa, Vice Chairman; He~y Raynor; Frank
Coy!e; Absent: Alfred Grebe.
Also present: Howard Terry,~ Building Inspector.
Mr. and Mrs. Louis Ramunni appeared before the
Board in regard to their proposed minor subdivision
off Horton Lane, Southold. Map of Van Tuyl dated
April 20, 1973, shows four lots proposed on approximately
six acres. Mr. and Mrs. Ramunni are building a house
on property now. The lot the house is on is two acres
and the Board informed Mr. and Mrs. Ramunni a legal
instrument will be required that this lot will not be
further subdivided. Mr. and Mrs. Ramunni said they own
no adjacent property. The Board told them to have the
lots numbered, the total acreage put on the map and
have the water tested by the Health Department. Since
the water was tested for the house being built, approval
no. S~1291, this will not be required again. The
Board also .said the entire 50 foot width of the road does
not have to be paved.

Lefferts P. Edson, Esq., appeared before the Board
in regard to Pebble Beach Realty Subdivision at East
Marion. He said Mr. Donovan is bringing a map to the
nex~ meeting of the Planning Board showing the bluff line.
The Board said this map must be stamped by a l~censed
surveyor. The bluff line is the point of reference used
by the County and there should be points on the map.
Mr. Edson also asked the Board about his subdivision
at Cutchogue, Crown Land Lane. The water has been tested
and copies of the laboratory reports wer~ submitted to
the Board al®~g with the subdivision application, and
one copy of the road profile and subdivision map. The
Board told Mr. Edson he must get approval from the
Suffolk County Health Department and the Superintendent
of Highways. The map must be sent to the County Planning
Commission for their recommendations. These things must
be done before the Preliminary Hearing is set up.
The following coorespondence was received:
Letter from Robert J. Guarriello, in regard to
terrain problem in lot 916, Willow Terrace, Southotd.
The Board has looked at the property and the problem
will be refereed to Mr. H.W. Davids, P.E~, Suffolk
County Department of Health. A letter will also be sent
to Mr. Guarriello informing him of the Board's action.
The Board received notification from the Suffolk
County Clerk of f~iling of Certificate of Abandonment for
Blue Horizons, Section I. A copy of the Certificate of
Abandonment was received from Holzer & Nappi, Esqs.
Letter from Ellen DeMaria in regard to proposed east-
west road at Orient. The Board w~ll send a letter to
Mrs. DeMaria informing her this road is to be put in the
most logical position and the line on map is only indicative
of general area.

The Board received a copy of a letter to Supervisor
Martocchia from Mrs. Shirley Bachrach in regard to
existing solid waste facilities of Southold Town and the
sewage treatment plant in Greenport.
Received a letter from Fidelity and Deposit Company
in regard to release of bond for Cleaves Point. A copy
of this letter will be sent to the T~wn Board.
The Board ~uthorized pa~5~ent of voucher from Alden
Young, P.E., for work done on Mattituck Shopping Center
and Laurelwood Estates Subdivision.
Received letter from Army Corps of Engineers on
effects of Hurrican~ Doria, 1971 in Town of Southold.
Letter will be sent saying there was minimal damage
in the Town.
Received a memorandum from H.M. Randall Assoc.,
Architects in Port Jefferson in regard to size of
parking spaces in shopping centers.
Received a bill for dues from the New York Planning
Pederation for 197~, 1972, and 1973. The Secretary will
check to see if the dues had been paid.
Received notification from the Suffolk County Clerk
that map of Land's End Subdivision was filed on May 3, 1973.

Received a copy of a letter to Mattituck Shopping
Center, Inc., from the New York State Department of
Transportation in regard to trees planted in area between
curb and sidewalk. The Board will authorize removal
of trees in accordance with this request.
The Board received a letter from Mr. and Mrs. Edward
Miller of Laurel. They complained of damage to their
property and flooding on Bray Avenue from adjacent farm
land. The Board will send a letter informing the~ the
Town is considering putting in additional drainage
facilities, but the Board has no authority in the matter.
Larboratory reports for water tests in Frank H.
Case Est. Subdivision were received. The Board reviewed
the subdivision map, sketch 3, and will inform Mr. Case
of the following corrections to be made:
The road must be extended to the southerly
property line of lot $17, and a 100 foot
turnaround at the end.
Either lot $10 or $21 must be marked reserved
for possible future drainage area. This
reservation is to be for a two year period.
3. Map must showncorrect name of subdivision and
names of adjacent property owners.
4. The right of way for the Babcock property must
be shown.
5. The roads must be named and nine copies of
road profiles submitted.
6. Nine additonal copies of subdiVision map to be
submitted.

Received notification of a public hearing from
Holzmacher, McLendon & Murrell in regard to the
Greenport Waste Water Treatment Plant to be held
May 29th.
Received a letter from Bernard Fliegel, Esq.,
in regard to property of Mulverhill on Laurel Lake,
and inquiring as to subdividing it into four parcels.
Mr. Howard Terry wrote to Mr. Fliegel and suggested
he submit proposal to the Planning Board.
Received letter from Alexander Sarri~, owner of
Rhodos Pavilion, East Marion. Mr. Sarris inquired
about enlarging his parking area and possibl~ future
expansion of facilities. The Board will send Mr. Sarris
a letter advising him Rhodos Pavilion is a non-conforming
use and expansion of the parking area would require
approval from the Board of Appeals. As regards future
expansion, this would require a change of zone.
The Board received a copy of a letter to LILCO
from Lefferts P. Edson, Esq., in regard to Highwood
Subdivision.
The Board received the new rules and ~egulations
for referrals to the Suffol~ County Planning Commission.
The Board received a book,et on Automobile Availability
from the Tri-State Regional Planning Commission.

Minutes of the meetings of the Southold Town Board
and Southold Town Trustees will be multi-copie~ and sent
to Plan~i~Board members.
On motion of Mr. Raynor, seconded by Mr. Coyle,
it was
RESOLVED that the minutes of the Planning Board
meetings of March 15, 1973 and April 16, 1973, be
approved.
Vote of the Board: Ayes: Messrs. Raynor, Coyle,
Moisa, Wickham.
The Southold Town Planning Board received from
the Southold Town Board the original petition of
Edgar and Arlene Marvin, 1260 Jackson Street, NeW Suffolk,
relative to a change of zone from "A" Residential and
Agricultural District to "B" Light Business District
on certain real property situated at Southold, New York,
together with the instructions to prepare an official
report defining the conditions contained therein.
ALL that certain plot, piece or parcel of land,
with the buildings and improvements thereon erected,
situate lying and being in the Hamlet and Town of Southold,
County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a point on the easterly side of Railroad
A~enue, also known as Young's Avenue, said point being
63.0 fset southerly from the point of curve at the
intersection of Railroad Avenue with Middte Road; running
thence along land now or formerly of Jgseph F. Carroll
N. 80° 30' 30" E. 211.0 feet to an ~ron pipe and land of
Satko~ki; thence along said land of Satkowski S. 8° 10'
00" E. 201.0 feet ko an iron pipe and land of Tuthilt;
thence along said land of Tuthill S. 80° 30' 30" W. 211.~
feet to a monument set on the easterly line of Railroad
Avenue; thence along the easterly line of Railroad Avenue,
N. 8° 10' 00" W. 201.0 feet to the point of BEGINNING.
The Planning Board discussed this proposed change of zone.

On motion of Mr. Moisa, seconded by Mr. Raynor,
it was
RESOLVED that the Southold Town Planning Board
recommend to the Southold Town Board denial of the
change of zone from "A" Residential and Agricultural
District to "B" Light Business District on certain
property situated at Southold, New York, owned by
Edgar and Arlene Marvin.
It is the opinion of the Planning Board that
this proposed change of zone be denied because (1)
with the additional 30 feet out side the "A" zone
allowed under the Zoning Ordinance, most of the lot
is included in the "B" zone; and (2) additional depth
of the "B" zone would open up problems with adjoining
property owners.
Vote of the Board: Ayes: Messrs. Moisa, Raynor,
Coyle, Wickham.
The Planning Board reviewed the site plan for
Sound Shore Motel addition. Itl.was reported that
some Board members had been at the site ah~ the fill
that was placed in the pond.had been removed. The
plan had not yet been given final approval.
On motion of Mr. Coyle, seconded by Mr. Moisa,
it was
RESOLVED that the Southold Town Planning Board
approve the site plan for addition to Sound Shore
Motel, North Road, Greenport, New York, and the Chairman
is authorized to sign the plan.
Vote of the Board: Ayes: Messrs. Coyle, Moisa,
Raynor, Wickham.
The Board discussed the roads and drainage in
Laurelwood Estates Subdivision. A letter will be sent
to Mr. Martin W~glicki, deve~pper and owner, advising
him he has 30 days to correct the drainage and pavement
problems, or the Board will proceed with foreclosure
of the bond.
