Y. 11.971 PLANNING BOARD MEMBERS John Wickham, Chairman Henry Molsa Alfred Grebe Henry Rayno~' Frank Ceyle M I N U T E S SOUTHOLD TOWN PLANNING BOARD December 28, 1970 A regular meeting of the SQuthold Town Planning Board was' held at 7:30 P.M., Monday, December 28t 1970, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickham~ Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; ~rank Coyle. Absent: Mr. Alfred Grebe(due to unfavorable weather conditiQns. ) Also present: Howard Terry, Building Inspector The Chairman read letter received from Otto Uhl, Jr. in support of the Master Plan and urging its immediate adoption, copy of "Franklin Letter" also received. Leteer and pamphlet placed ~n file. Southold Town Plan~g Board -2- December 28, 1970 Notice of extension of bond coverage for "Corey Creek Estates" was received from the International Fidelity Insurance Company. Subject bond is extended until June 22, 1971. The Planning Board was presented with three (3) copies of revised map for minor subdivision of George R. Clary, property located at N/S Sterling Road, W/S Horton Road, and S/S Lilac Lane, Cutchogue, New York. The revised map showed adjoining property owners as required by the Board at their last meeting. Formal application and fee have been received. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of George R. ctary, property located at N/S Sterling Road, W/S Horton R~ad, and S/S Lilac Lane, Cutchbgue, New York. The Chairman signed the maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board was presented with a copy of the revised Highway Specifications of Riverhead Town for their inspection. Under these specifications everything has to be blacktopped now, no more oil, sand, and stone, all blacktop. The Board was notified that the time extension on the subdivision "Shorecrest" will expire on January 8, 1971. They had a 90 day time extension, during which time they were to post a bond, the time extension will be up on January 8, 197~, and they have not yet posted a bond. The Planning Board was presented with "Informational Bulletin No. 8" of the Suffolk County-Dept. of Planning. This bulletin contains the Rules and Regulations for the Referral of Certain , Southold Town Plan~j.~g Board -3- 'December 28, 1970 Municipal Zoning Actions, Variances, Special Permits and Subdivision Plats to the Suffolk County Planning Commission Pursuant to Article XIII, Suffolk County Charter and shall be effective January 1971. John Miesner and Jerry Horton presented the Planning Board with revised maps sh~ing drainage plans for the proposed sub- division "Peconic Homes, Inc. at Mattituck", located at south side of Main Road, Mattituck, New York. The revised map showed 2 leaching pools with catch basins at the south end of the turn around as suggested by the Board at the last meeting. The Board informed them that the overflow could either go down the drain on the b&acktop or in the opposite direction down the drainage easement by means of 18" galvanized pipe. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board authorize the transmittal of the proposed map of "Peconic Homes, Inc. at Mattituck" to the Suffolk County Planning Commission for their study and report. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Board discussed the proposed change of zone .application of Anna Hansen, relative to change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District on PARCEL I, and from "A" Residential and Agricultural District tO "B" Business District on PARCEL II, property located at north side of Mill Road, Mattituck, New York. In the last conversation with the applicant's attorney, Richard Lark, he requested that recommendation be postponed temporarily. Howard Terry infozmed the Board that the Town Board is planning to set up a hearing date, for this proposed change of zone at their next meeting on January 5th. The Chairman telephoned Mr. Lark and advised him of the Town Board's plans to set a date for hearing. Mr. Lark stated that he had no objections to going ahead with the matter. The Planning Board received from the Town Board the original petition of Anna C. Hansen, Mattituck, New York, relative to change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District on PARCEL I, and from "A" Residential and Agricultural District to "B" Business District on PARCEL II, on certain real property, together with the instructions to prepare an official report defining the conditions contained therein. Southold Town Plan~_j~g Board -4- December 28, 1970 This property is situated at Mattituck, in the Town of Southold, County of Suffolk, and State of New York, and more particularly bounded and described as follows: PARCEL I - BEGINNING at a monument on the North Side of Mill Road at the Southeast corner of the premises herein described, ad- joining land of Krupski on the East; running thence along the Northerly side of Mill Road two (2) courses and distances as follows: (1) South 68° 14' 50" West, 304.46 feet; (2) South 83° 31' 10" West, 53.25 feet to a point; running thence North 12° 05' 10" West along other Land of Anna C. Hansen (Parcel II herein) 1193.94 feet to land of Krupski; thence North 77° 41' D0" East along land of Krupski 350. 00 feet to a monument; running thence along said land of Krupski, two (2) courses and distances as follows: (1) South 12° 05' 10" East 908.45 feet; (2) South 12° 50' 10" East 241.00 feet to a mon- ument on the northerly line of Mill Road, the point or place of beginning. PARCEL II - BEGINNING at the monument on the Northerly side of Mill Road ma~rking the southwesterly corner of Parcel I, running thence along the northerly side of Mill Road four (4) courses and distances as follows: (1) South 83° 31' 10" West 92.91 feet; (2) North 57° 48' 50" West 252.76 feet; (3) North 49° 25' 30" West 127 .37 feet; (4) _North 77° 34' 50" West 229.04 feet; running thence along other land of Anna C. Hansen two (2) courses and distances as follows: (1) North ~o 4' 50" West 400.00 feet (2) South 80° 55' 10" West 260.00 feet more or less to Mattituck Creek; thence northerly along said Creek about 500.00 feet; thence northwesterly along said Creek about 260.00 feet to Sebastian's Gutter; thence Southerly along said Gutter about 200 feet; thence along the center' line of a Gutter that seperates property of Hansen and O'Keefe as it winds and turns in a Easterly and North- westerly direction to ~la~d of Krupski approximately 300 feet; thence along land of Krupski two (2) courses and distances as follows: (1) North 80° 52' 40" East 88 feet thence; (2) North 770 41' 20" East 60.57 feet; thence south 12° 05' 10" East along other ~ of Hansen 1193.94 feet to the point or place of Beginning. A lengthly discussion was?held on this proposed change of zone. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board-hereby confirms their original recommenda~tion wi%h the following a~ditional rec- ommendations on the above described proposed change of zone: It is recommended that this proposed project meet all of the requirements of the proposed new amendments to the Zoning Ordinance, including the density requirements. It is also recommended that the meadow island be left in a natural state and we are including in this recommendation a sketch Southold Town Plan~g Board -5- December 28, 1970 which appears reasonable to the Planning Board showing finger piers on the east side of the island and a minimum 50 ft. roadway and 100 ft. turn-aroundl We strongly recommend the proposed location of the gas dock be changed to either the north or south extremity of the meadow island. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board was presented with copy of letter which William Wickham, Esq. a/c Richard Babcock and Fred Rimler, sent to Supervisor Martocchia in regard to the drainage on the lower end of Babcock's property, adjoining the proposed ~West Hill Road" in the proposed subdivision "Calves Neck", owned by George Ahlers. This is a matter which must be resolved between the two property owners. The Chairman dictated a letter to be sent to George Ahlers~ advising him to resolve the matter with Mr. Babcock and his attorney, copies to be sent to all concerned. The Planning Board was presented with final maps for the proposed minor subdivision of John H., & Margaret H. Guest, Fishers Island, New York. Formal application and fee have been received., On motion by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision map of John H.& Margaret H. Guest, Fishers Island, New York. The Chairman signed the maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Cpyle. The Planning Board received from the Town Board the original petition of Gus Schad, 5 Arista Drive, Dix Hills, New 'York, relative to change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District on PARCEL A, and from "A" Residential and Agricultural District to "B-2" Business District on PARCEL B on on certain real property, together with the instructions to prepare ~ ~ Southold Town Planl,~g Board -6- December 28, 1970 an official report defining the conditions contained therein. Containing an area of 12.436 acres. A lengthly discussion was had on this proposed change of zone. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board favorably recommend to the Southold Town Board the change from "A" Residential ' ~ - Southold Town Plann~l.g Board -7- December 28, 1970 and Agricultural District to "M" Multiple Residence on PARCEL A, and from "A" Residential and Agricultural District to "B-2'~ Business District on PARCEL B on the above described proposed change of zone. It is the opinion of the Planning Board that this is a very comprehensive plan, well worked out. There has been a need for additional apartment dwellings in this area of the Town for quite some time, this project will fulfill the urgent need. The light business area will be needed to round out this development and for the surrounding residential area. Various forms of recreation such as golf, boating, and fishing will be cont- ained in the development for the residents use. The Planning Board and the developer have been working on this plan for some 8 months and it is our feeling that with the low density requirements of the proposed new amendments to the Zoning Ordinance, which the developer will have to meet, this development will be outstandingly beneficial to the Town of Southold. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor, Coyle. In reference to the text of the application and the scenic easement contract pertaining to the above proposed change of zone, the Planning Board made the following.suggestions: Petition, page 2~ $ 3., 1st paragraph - balanced mix, The Board suggests that a different phrase or word could be substituted to define the ratio of the one and two bedroom units more clearly. Grant of Scenic Easement, Exhibit ~, page 2, $ 2(a) - Area of land necessary for operation of sewerage plant should be stated, i.e. area of land necessary for operation of sewerage plant not to exceed X number of acres, or it could be described on a percentage basis. Grant of Scenic Easement, Exhibit 3, page 3, $ 5. - It should be clearly stated that this condition shall cover only such part od the property that the condemnation or eminent domain proceedings cover. A list of the above suggestions to be sent to Richard Lark, Attorney representing Gus Schad. "Leeward Acres" was briefly discussed, the Chairman stated that ~ ~' ~ Southold Town Plan~.~J~g Board -8-~ December 28, 1970 ~Leeward Acres" was briefly discussed, the Chairman stated that Mr. Tasker feels that subdivisions which have preliminary approval, and have gone to the Health Dept. and have been referred to the Review Board of Appeals, and have received a favorable determination, should be granted an extension by the Planning Board. The Planning Board discussed the proceedings which they will follow to compile a list of approved subdivisions to be placed in the amendments to the new zoning ordinance. The County is only interested in those subdivisions which have 20 or more unsold lots. The Planning Board must set their policy for review. There will be 3 classifications of subdivisions which have to be reviewed: 1. The list in the back of the present Zoning Ordinance must be checked out. The subdivisions which are all sold out must be dropped from this list. 2. The subdivisions from 1957 to Jan. 1, 1970. 3'. The subdivisions from Jan. 1, 1970 to the present. It was suggested that members of the Planning Board take turns reviewing all of these subdivisions. After all subdivisions are reviewed and the number of unsold lots in each are determined, firm rules for reviewing them will be set up. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the next regular meeting of the Southotd Town Planning Board be held at 7:30 P.M., Wednesday, January 6, 1970, at the Town Office, Main Road, Southold, New York~ Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle.
