Dear Mr. Herrmann:
The Board of Trustees reviewed the survey prepared by Nathan Taft Convin III dated March 7,
2011 and determined the proposed demolition of an existing single-family dwelling and
swimming pool and construction of a new dwelling and swimming pool to be out of the Wetland
jurisdiction under Chapter 275 of the Toum Wetland Code and Chapter 111 of the Town Code.
Please be advised that the proposed location of the pool fence will require a further
review by this office.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional beunda~' or seaward of the coastal erosion hazard
ama as indicated above, or within 100' landward from the top of the bluff and/or wetlands
jurisdictional boundary, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 ofthe Town Code. Itis your msponsibilityto
ensure that all necessary best management practices are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Ama, which may result from your project.

Based on the information you have submitted the Deparb~)ent of Environmental Conservation (DEC)
has determined that the property landward of the ~top of bluff" line, as shown on the'survey prepared
by Nathan Taft Corwin III dated 12/16/10, last revised 3/7/11, is beyond Tidal Wetlands Act [Article
25) jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations
(6NYCRR Part 661 ) no permit is required.
Be advised, no construction,* sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is
your responsibility to ensure that all precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction which may
result from your project. Such precautions may include maintaining adequate work area between the
tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or
erecting a temporary fear hale bay berm.

KAM consultants was retained by Soundviow Isles LLC, the owner of 505 Soundview
Avenue, Mattituck, NY 11952 to condm~ a pre demol/lion asbestos survey in accordance
with Industrial Code Rule 56-Part 56 of Title 12 As~he~. And to perform an inspection
for possible Icad based painted surfaces in accordance with guidelines as set forth by
United States Department of Housing and Urban Developmcmt's lead paint threshold
HUD states that paint containing cqusl or grater than 0.5% by weight of lead is to be
considered Lead Bas~xi Paint (LBP)'TIUD'. Laboralory nnnlyses of the various building
materials collected ns~ analyzed at the time determined that NO ASB1L~I'O8 AND NO
LEAD PAINT was detected.
On June 12, 2011 a limited asbestos/lead investigation and bulk sampling was performed
by George Kouvaras ofKAM Consultanl~ at the 505 Sound view Avenue, Mattituck, NY
11952. George Kouvaras holds certifications from The New York State Department of
Labor as an Asbestos Inspector (NYS-DOL No. 90-13668) and from United States
Environmental Protection Agency as a Risk Assessor (Certification No. NY-R-262-3)
A total of 68 asbestc~s bulk samples of suspect building materials and 4 suspect paint chip
samples were collected.
The bulk samples of suspecl building materials and suspect paint chip samples were
delivered to KAM Consultants on Jun~ 14, 2011, which is an accredited laboratory to
perform asbestos and lead analysis NYSDOH LAB ID # 11273, AIHA LAB ID # 100269
& NVLAP LAB ID# 102047.
Laboratory analysis confirms that NO ASBESTOS >1% was de~ected in any of the
susp~t building marsala that wer~ collated and analyzed at thc time.
Laboratory analysis of the paint chip samples determined that the wall palm and ceiling
paint collected and analyzed at the time dM no~ eomlain lead..
Bulks sample analyses and chain of custody is included.
In conclusion it is determined that the de~nolilion of 505 Soundview Avenue, Mattituek,
NY can be performed unde~ General Construction Standards.
Recommendations and results presented in this letter apply to site conditions and features
as they existed at the time of KAM Consultants site viaits, and those reasonably
foreseeable. They cannot necessarily apply to conditions and features of which KAM
Consultants is unaware and has not had tho opportunity to ovuluato
