Y. 11971 PLANNING BOARD MEMBERS John Wickham, Chairman Henry M o.lsa Alfred Grebe Henry Raynor Frank Coyle M I N U T E S SOUTHOLD TOWN PLANNING BOARD August 16, 1973 A regular meeting of the Southold Town Planning Board was held at 1:50 P.M., Thursday, August 16, 1973, at the Fishers Island School, Whistler Avenue, Fishers Island, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice Chairman; Henry Raynor;~_ ' ~_~-,; Alfred Grebe. Also present: Mr. Lawrence Tuthill, P.E.; Mr. Howard Terry and Mr. George Fisher, Building Inspectors. Prior to the meeting the Planning Board personally inspected the proposed site of supermarket to be built by ~r. H~n~y Z~bo~onski on Fishers Island, On the west side of~Central Avenue, north of Fishers Island Utilities Generat±hg Plant.. This property was walked over and markers of the proposed building and markers of the existing power cable were examined, and the proper~y on West Harbor w~ich is Southold Town Planning Board -2- August 16, 1973 owned by Zabohonski, and which is proposed to be used for additional parking, was inspected. Also, the property of Zabohonski on the north side of Fox Avenue, known as North Hill, where much grading and filling has been going on for the past year, was inspected. The Board found that in the process of grading the property, on the north side, several swales and low areas used for natural drainage were filled in resulting in raising the grade of the property so that the water runs into Pox Avenue, and stands on the public highway. This is deemed to be a violation of the Excavation Ordinance and the State Law relative to channeling the run-off water. Also, Mr. Zabohonski's property on the west side of a public right of way sometimes referred to as Crescent Avenue Extension, running from Crescent Avenue on the northeast to Fox Avenue on the south: It was found that he had graded and had done some filling of wetlands. Some time ago a letter was written to Mr. Zabohonski to cease and desist the filling of any wetlands. This afternoon the Board found that more rocks and rubble have been dumped on the edge of this filled wetland, which is considered a violation of the Wetlands Ordinance. During the grading and excavation of Mr. Zabokonski's p~operty, this private rOad or right of way - Crescsnt Avenue Extension -.has been torn up and the surface now is unsatisfactory for vehicular traffic and is nearly impassable. After inspection of these properties, the Board returned to the Fishers Island School to conduct their regular meeting. The Chairman opened the meeting by reviewing ~he plan of Henry Zabohonski to build a new supermarket on the west side of Central Avenue, which is the site the Board visited p~evious to the meeting. For Site Plan Approval, the Planning Board will require the following items: Ail the conditions imposed by the Board of Appeals in the Special Exception, and confirmed by the Suffolk County Planning Commission in their action. 2. The Planning Board recommends that. Mr. Zabohonski attempt to purchase additional property on the north Southold Town Planning Board -3- August 16, 1973 e (cont'd) and west of the present site which has access to Madetine Avenue (Boyd Estate). for additional square footage, access and parking. The narrow lot will have to be cleared and regraded to retain all rainfall and run-off water so none will run into the highway. A drainage system is to be designed for a minimum of 6" rainfall in a 24 hour period with a 100% retention of all water on the premises. The building must be redesigned to meet all required setbacks, planting area, and parking requirements. The frontage on Central Avenue is to be curbed with curb cut entrance to be in the southeast partlof the frontage. Curbing to be as described in Southold Town Highway specifications. A minimum width 4 foot standard sidewalk as per Southold Town specifications shall be installed on the westerly side of Central Avenue along the entire frontage. This can be on the property line if desired. A planting width of a minimum of 10 feet wide shall be installed along the easterly property line from the curb cut entrance northerly to property of Gordon Ahman; and additional plantings along the north, west, and south property lines sufficient to make up 25% of lot area, must be provided. This planting area shall be in shrubbery, mixed varieties and grass (no wood chips); and there shall be perpetual maintenance of this area. The. Planning Board does not recommend parking, for thiS store, on theieas~erly side of Central Avenue; and may recommend a reduction in the size of the building to meet the above requirements. A motion was made by Mr. Grebe, seconded by Mr, Raynor, that the above recommendations be approved. All voted Aye. Southold Town Planning Board -4- August 16, 1973 A letter from the Suffolk County Planning Commission dated August 13, 1973 was received reviewing requirements for the Pebble Beach subdivision~ This was read and the Chairman reviewed the meeting held with Charles Lind lash week in the Southold office. -Comments of the Health Department on clustering were discussed, including a sewage system for the entire eastern part of Suffolk. There was no action taken on this letter at this time, and it is to be put in the Pebble Beach file for the next Planning Board meeting when the Pebble Beach subdivision is again reviewed. A letter was received from the Town Clerk relative to subdivision Cleaves Point, Section III, being~included in approved list in the back of the Zoning Ordinance. The Planning Board records show the roads to be okay ahd~ recommendation for the release of Bond has been sent in to the Town Board. Also, recommendation that this subdivision shall be included in the approved list. A motion was made by Mr. Raynor, seconded by Mr. Moisa, that the Planning Board recommend to the Town Board approval of Section III, Cleaves Point, on the approved list. Vote of the Board: Ayes:- Messrs: Wickham, Raynor, Grebe, Moisa, ~. Fairway Farm Subdivision: Letter was read from Mr. Babcock re. proposed ponds and drainage as lsuggested by Mr. Barnett of the Soil and Water Conservation Service. The Chairman read letter received from Mr. Barnett regarding Lot No. 10 and other possible drainage areas being reserved; also regrading edge of such drainage ponds so that chain-link basins, or similar basins, would not be required. This letter is to be filed in the Fairway Farm file. There w~as a discussion of the new map on drainage plan with pond, s'and S~ates. The lot ntlmbers on ~his new map must be checked ~a~ns% the old map as it appears that some o!f the lots had been renumbered; and it was agreed to submit this new map to the Highway Committee with the alternative ways to take care of the drainage. Southold Town Planning Board -5- August. 16, 1973 It was agreed that the Agenda for the meeting to be held on August 28, 1973, be set up so that the last discussion will not be started later than 10:30 P.M., the meeting to be adjourned at 11:00 P.M. The next meeting date after August 28, 1973, will be September 4, 1973. Anything which can not be completed by 11:00 P.M. on August 28th should be rescheduled for September 4th. There was a further discussion on the grading and filling of Zabohonski's property where it resulted in blocking natural waterways and drainage and created a serious traffic hazard on Fox Avenue during heavy rains. This must be corrected immediately and a letter should be sent to the Town Board outlining this problem. There was a short discussion on Majors Pond Subdivision being owned by Nelson Douglas and the work being done by Bob Douglas. Bob has been to see John Wickham about this fill, defining the area which has to be filled. There were several matters in connection that wore discussed, and the Planning Board is to make a definite decision and show on the map tho areas to be fillod, making sure that none of the regular ponds will be eliminated. The Secretary is to write to the County Planning Commission requesting several copies of Bulletin $8 which outlines the procedure to be followed in submitting material to the County Planning Commission both for preliminary review and for fina~t approval. It was roported to the Board that application on Witsberg for a change of zone and development been disapproved by the CoUnty Plannihg complete information. The ~sion requested a development plan be submitted to contact Southold Town Planning Board -6- August 16, 1973 Richard Cron, Attorney, requesting same for submission to the County Planning Commission.
