THIS INDENTURE, made the 17th day of December nineteen hundred and ninety-eight

ALL that certain plot, pita or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffok and State of New York, more particularly described as follows
BEGINNING at a stake set in the northwest corner of the premises herein described, adjoining land now or
formerly of Apolonia Stankewicz on the West, said point of beginning being the following six(6)courses and
distances from the point marking the southerly line of Main Road (NYS Route 25)and said easterly line of land
now or formerly of Apolonia Stankewicz:
1) South 13 degrees 02 minutes 25 seconds East,319.92 feet;
2) South 12 degrees 12 minutes 28 seconds East, 276.00 feet;
3) South 15 degrees 47 minutes 28 seconds East, 185.50 feet;
4) South 14 degrees 10 minutes 28 seconds East, 574.00 feet;
5) South 15 degrees 25 minutes 28 seconds East,495.80 feet; and
6) South 09 degrees 40 minutes 28 seconds East, 169.47 feet; from said point of beginning;
RUNNING THENCE North 78 degrees 07 minutes 20 seconds East along other land now or formerly of
Mohring Enterprises,Inc.,483.57 feet to a stake and land now or formerly of Florence M. Terry;
THENCE South 1 ddegrees 52 minutes 40 seconds East along said land now or formerly of Florence M. Terry,
403.99 feet to a monument and land now or formerly of Moltring Enterprises, Inc.;
THENCE South 63 degrees 55 minutes 53 seconds West along said last mentioned land, 522.74 feet to a stake
and land now or formerly of Apolonia Stankewicz;
THENCE Northerly along said land now or formerly of Apolonia Stankewicz the following three(3)courses and
distances:
1) North 09 degrees 25 minutes 28 seconds West, 333.02 feet;
2) North 09 degrees 10 minutes 28 seconds West, 148.00 feet; and
3) North 09 degrees 40 minutes 28 seconds West, 51.63 feet to the stake at the point or place of BEGINNING.

TOGETHER with and subject to a right of way 50 feet in width running from Main Road(NYS Route 25)to Richmond Creek,
which right of way is more particularly described in LIBER 9857 CP 224, for ingress and egress to Main Road(NYS Route 25)
and Richmond Creek and for installation of underground utilities, said right of way to be in common with others.The right of
way to Richmond Creek shall be for the exclusive use of Lots 1,2, 3 and 4 on the Minor Subdivision Plan prepared for
Mohring Enterprises II dated March 21, 1984, by Young&Young, Riverhead,New York(hereinafter the "Minor Subdivision
Plan."),their guests and invitees,as set forth in LIBER 9857 CP 224. The right of way to Richmond Creek shall include the
right to construct a dock in common with others who use said right of way.Mohring Enterprises, Inc., reserved the right to
reduce the 50 right of way as it runs from the northerly boundary of Lot#3 to Richmond Creek to a 25 foot right of way as
described in LIBER 9857 CP 224,subject to the approval of the Southold Town Planning Board.
JOHN MEYER and GAIL MEYER,the party of the second part,shall pay one third(1/3)of the cost of the repair and
maintenance of the 16 foot roadway from Main Road to the northerly boundary of Lot 41. In the event Lot#4 is subdivided
into a major subdivision and a road meeting Town of Southold specifc2tions for a major subdivision road is constructed over
the aforesaid right of way of Lot#4,which road replaces the 16 right of way in part,then the cost of maintenance shall be
shared only as to the remaining portion of the 16 foot roadway. Mohring Enterprises, Inc. has reserved the right to dedicate a
road within the 50 right of way along Lot#4 to the Town of Southold.
The premises herein conveyed being and intended to be Lot#2 on said Minor Subdivision Plan, which premises were conveyed
to JOHN M. SCOPAZ and LINDA N. SCOPAZ,the party of the first part by a deed dated 8/9/85 and recorded on 8/22/85 in
Liber 9857 CP 224.
