SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in
this application and determines that this review falls under the Type Il category of the State's List of
Actions, without further requirements under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of
Planning issued its reply dated April 17, 2012 stating that this application is considered a matter for local
determination as there appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under
the Minor Actions exempt list and is not subject to review under Chapter 268.
BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section280-
13B, subsection 14 of the Zoning Code, to expand an existing Bed and Breakfast within their single-family
dwelling, accessory and incidental to their residential occupancy under the Building Department's
Certificate of Occupancy -32546 dated 8/22/07. The four additional bedrooms, creating the maximum
allowed of five bedrooms, for lodging and serving of breakfast to the B & B casual, transient roomers was
created through alterations to the applicants' existing one family dwelling by conversion of an attached
garage attic to living space with balcony under Certificate of Occupancy No.33732 dated 5/22/09 for the
original one bedroom granted on September 22, 2009 ZBA File #6194. The additional four bedrooms exist
in the dwelling and will be converted for the Bed and Breakfast use.
ADDITIONAL INFORMATION: During the hearing a neighbor presented their objection to the approval
of this application. Additionally another neighbor was in support of the application. A letter of support was
received from the president of the North Fork B&B Association.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on June 7, 2012 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property and surrounding neighborhood, and other evidence, and upon review of the code requirements

set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the
Board finds that the applicant complies with the requirements for the reasons noted below:
1. Anthony and Lisa Sannino, the applicant(s) herein, are the owners of the property, a flag lot with
50.00 feet of frontage on Alvahs Lane. It is improved with a single family dwelling with attached
three car garage and a vineyard on 5.2 acres as shown on the survey prepared by Peconic Surveyors,
PC, dated January 24, 2006, revised February 9, 2006. The owners/applicants will continue to
occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed
and operated.
2. The applicants plans comply with the on-site parking requirements and provide for seven (7) parking
spaces, two for the principal single-family use and one (1) for each of the Accessory Bed and
Breakfast bedroom(s)
3. The applicants comply with the requirements of a dwelling unit as defined in Section 280-4 of the
Zoning Code
4. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is
located, adjacent use districts, and nearby and adjacent residential uses.
5. The Special Exception is accessory to the principal use and will not prevent the orderly and
reasonable use of adjacent properties.
6. This accessory will not prevent the orderly and reasonable uses proposed or existing in adjacent use
districts.
7. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the
order of the town will not be adversely affected.
8. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted
herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code
before an Accessory use may be occupied.
9. No adverse conditions were found after considering items listed under Section 280-142 and 280-143
of the Zoning Code.
10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the
Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an
Accessory Bed and Breakfast use.
RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member
Dinizio, seconded by Member Weisman, Chairperson, and duly carried to
GRANT~ the Special Exception permit for an Accessory Bed and Breakfast, to be used only in conjunction
with the applicants-owners residence, as applied for and shown on the floor plans dated received by Board
of Appeals on April 9, 2012 and prepared by Robert J. Gruber, Architect and the survey prepared by Peconic
Surveyors, PC, dated January 24, 2006, revised February 9, 2006.
SUBJECT TO THE FOLLOWING CONDITIONS:
The Owners shall occupy this single-family dwelling as their principal residence.
(A) An annual harvesting of grapes is permitted, and
(B) There shall be no commercial or retail uses on the subject property related to the manufacture of
wine, including but not limited to wine tasting, educational programs, wine production, or sales,
without application to and approval by the ZBA of an area variance for acreage related to a
proposed winery (a permitted use) on the applicants' non-conforming 5.2081 acre parcel where the
code requires a minimum of 10 acres for a winery with a retail component, and a Special Exception
for a Winery with a site plan review approval by the Southold Town Planning Board (as per Code),

3. A Certificate of Occupancy or similar document will be necessary for issuance by the Building
Inspector certifying that the premises conforms to Chapter 280 (Zoning) Code before Occupancy as
an Accessory Bed and Breakfast use.
4. Each of the five required parking spaces for the B&B use shall be clearly identified with signage

indicating; 1) means of egress, 2) location of means for transmitting fire alarms, if any; and 3)
evacuation procedures to be followed in the event of a fire or smoke condition or upon
activation of a fire or smoke-detecting or other alarm device.
4.No sleeping rooms for B&B use shall be located above the second story.
5. The dwelling shall have at least two (2) exits and there shall be a window to code to provide
emergency egress in every sleeping room for B&B use. Means of egress shall include at least
one of the following alternatives: 1) A portable escape ladder that attached securely to the sill,
shall be provided for second story rooms for B&B use, constructed with rigid rungs designed
to stand off from the building wall, it shall be capable of sustaining a minimum load of 1,000
pounds, and shall extend to and provide unobstructed egress to open space at grade, 2) an
exterior stair per code, 3) or limited area sprinkler system per code.
6.There shall be no exterior signage identifying the use as a Bed and Breakfast in residential

premises for which a Bed and Breakfast is authorized or exists.
8. This conversion shall be subject to a building permit, inspection by the Building Inspector and
Renewal of Certificate of Compliance annually.

requirements of Chapter 280 of the Town Code of the Town of Southold.
10. This conversion for the Bed and Breakfast shall comply with all other rules and regulations of

~RA DEIERMJNATION: The Zoning Board of Appeals has viseed the property under consideration
in this application and determines that this review falls under the Type II category o! the State's List of
Actions, without further steps under SEQRA.
BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section
100-31B, subsection 14 of the Zoning Code, to legalize an as built Bed and Breakfast within their
existing single-family dwelling, accessory and incidental to their residential occupancy under the
Building Department's Certificate of Occupancy Z.32546 dated 08/22/07. The existing one bedroom
for lodging and sewing of breakfast to the B & B casual, transient roomers was created through
addltloes and alterations to the applicants' existing one family dwelling by conversion of an attached
garage attic Io living space with balcony under Certificate of Occupancy No. Z.33732 dated 05/22./09.
FINDINGS OF FACT
The Zoning Boardrof Appeals held a public hearing on this application on August 27, 2009 at wfllch
time written and o~1 evidence were presented. Based upon all testimony, documentation, personal
inspection of the ~roperty, and other evidence, and upon review of the code requirements sst forth
pursuant to Article," III, Sect on 280-13B(14) to establish an Accessory Bed and Breakfast, the Board
finds that the appl[bant complies with the requirements for the reasons noted below.'
1. Anthony and Lisac 8annino, the applicants herein, are the owners of the property, s flag ot vath an

Bed and Breakfsst~ The applicants comply with the requirements of a dwelling unit as defined in
Section 280.12 of the Zoning Cede.
The Accessory Bed and Breakfast, ss applied for, is reasonable In relation to the District in which
it is located, adjacent use districts, and nearby and adjacent residential uses.
The Special Exception is accessory to the principal dwelling use and will not prevent the orderly
and reasonable use of adjacent properties.
5. This accessory use will not prevent orderly and reasonable uses proposed or existing in adjacent
use districts.

the order of the Town will be sdvereely effected.

~ehe holiday season on the Noith Fork of Long Island, NewYork is celebrated with jo;6 warmth and tradition.
The streets, shops and public monuments are festively adomed with lights and unique ornaments. Families rush
about the bustling Christmas tree farms choosing their perfect tree. Going from one quaint village and hamlet to
the next, visitors sample the delights of the shops, restaurants, galleries, antique stores and wineries.
As part of this tradition, The North Fork Bed & Breakfast (NFBBA) has announced its Annual Holiday House
Tour and Progressive Food & lArme Tasting. The event is on Saturda)5 December 4th from 1 p.m. to 5 p.m.
This year, at the much anticipated annual holiday festivity, the tour is featuring five of the association's
members, each of whom will welcome visitors to their seasonally decorated B&B homes. Tickets are limited
and cost $75 per person. Each B&B on the tour will be hosting a prominent loc~ ~i~o~ and ro~taurant,
and guests will be treated to a progressive food & wine tasting with the tour of these five B&Bs. Seasonal
revelers can book their tickets online at www. nfoba.org.
The December 4th festivity is part of the NFBBA's commitment to growing business on the North Fork and
at the same time light up holiday spirits and welcome both neighbors and tourists to enjoy just some of the
delight the East End has to offer during the winter season. It is also the season for sharing and the NFBBA
will donate a percentage of the ticket sales to two local charities.
The B&Bs on the tour will have pulled out ali the stops in decorating their homes .in holiday splendor and
warmth. Each of the B&Bs on the tour will offer refreshments and music to their visitors. Visitors will travel
from one sumptuously decorated B&B to the next and be treated to a fine pairing of wines and foods from
the finest North Fork restaurants, aMano Restaurant, Jamesport Manor Inn, Legends, Noah's, and Love
Lane Kitchen and tayto award winning wines from Old FieldVineyard. Ospre_~s Dominion, Peconic Bay
Vineyard, Bedell Cellarst and BellaVitaVineyard - while entertained by seasonal music.
For twenty years, the NFBBA has been partnering and supporting local
businesses and services involved in the hospitality sector while ensuring a high
standard of accommodation and helping to increase the number of tourists/
visitors to the North Fork. The association has launched numerous promotions
with local businesses and charitable groups. During 2010, several special events
are planned including the April Spring Extravaganza, and NFBBA's Annual
Holiday House Tour, Saturday, December 4th.

Town of Southold ZBA,
I would like to give my firm approval for the expansion of the Sannino Vineyard B and B. Lisa
and Anthony have been active members of the NFBBA since the inception of their B and B, and
have been endlessly contributing to the success of our association. They are avid promoters of
our industry and of our region. Together they helped to develop the first North Fork Agri-tourism
Tour which enabled many of the various local farmers reach out in a very informative way to our
guests. Anthony volunteered to serve as one of our board members on his very first association
meeting. The approval of Sannino Vineyard B& B could at the very least be an asset to our
industry, region, and community.

Attention Members of the Town of Southold Zoning Board, BOARD OF APPEALS
This is a response to the hearing on June 7, 2012 regarding concerns related to the expansion of
our currently approved Bed and Breakfast.
1) We believe we can meet all of the requirements to be in compliance with the criteria set
forth in the town code section 250-13B(14)
2) We have shown and provided a drawing with dimensions for adequate parking, 2 for
owner spaces and 5 for our guests. We have found no legal limitations regarding
parking locations on our property, should we need a different area.
3) The use of our driveway should not be viewed as excessive with the approval of
additional rooms to our current B&B. The rooms could only be occupied by family
members OR guests but never at the same time. This would dictate the use of our
driveway.
4) The timing and use of the additional B&B rooms should be left to us as B&B owners as it
is for all other B&B owners. Most other B&B owners have family, and use their
judgment when it comes to the use of their rooms.
5) Copy of our covenant and restrictions are attached we believe the proposed additional
B&B rooms in our (as built home) is not in violation of any said covenants.
6) We have found that there are no legal restrictions with regard to farming any portion of
our agricultural property.
7) We have spoken with all of our surrounding neighbors none of which have any objection
to the expansion of our B&B. Anthony has helped with construction projects for most of
our neighbors and has also helped clear snow for them including the Slezak and
Summerstad driveway entrance.
8) In response to the Slezak packet:
The group activities that they claim going on at our private residence are all
pertaining to family and friends gatherings.
January ist 10+ cars from 2-5pm ...was an annual family New Years Day party
January 29th 10+ cars 1:30-3:30pm... Was another family and friends gathering for the home
owners (Anthony's Birthday) which was on 1/26
February 4th 15+ cars 1lam till dark...unfortunately Anthony's father was ill this month and
later passed away. Our home became the place for family to gather when visiting Anthony's
Dad at Eastern Suffolk hospital etc.
March 18th cars in and out all day long till 4:15pm...Anthony was working all day and Lisa
was driving the four kids to friends houses, church, supermarket, running errands, kids play
dates etc.
Sunday April 8th cars coming and going all day...It was Easter Sunday so we went to church,
had family over to celebrate and an Easter egg hunt outside with cousins too!
Saturday May 12 15 cars limo and mini buses 12-4pm... Our daughter Ava Grace had her
First Holy Communion and we had a big family and friends gathering to celebrate this. We
had a caterer, a magician and many happy children running around It was a beautiful day.
My guests at the B&B booked a wine tour (one limo)
Friday May 18t" 8 cars noonish... Lisa hosted a luncheon for her local mommy friends to
enjoy on our porch
The Bed and Breakfast Tour in 2010 was a fundraiser for the NFBBA and a few local charities
This is something that we have not participated in since
c. The advertisement on the last page of the neighbors packet is from the north fork
promotion council it is a local magazine that comes out each year for visitors to use as a
directory It explains our one room suite and we don't allow children unless they are over 16
years old with a parent which in the almost 3 years of business we have never had.
d. The advertisement's photo also shows very clearly our address with the title Bed and
Breakfast.
e. To be clear we were never cited by the DEC.
f. We have put gravel down our driveway left trees grow wildly down our drive to be
neighborly
g. Anthony does not run his construction company from the house he has materials sent to his
jobs.
h. We are preserving land by farming it.
i. Mr. Keil was kind enough to spend time at this hearing and explain about his backing vehicle
beeping trucks and dusty driveway at what he considers an intensely used agricultural

The Town Board of the Town of Southold finds that farming is an essential
activity' within the Town of Southold. Farmers provide fresh food, clean air,
economic diversity, and aesthetic open spaces to all the citizens of our town. In
addition, land in agricultural uses requires less tax dollars for services than does
land with residential er commercial developmenL According)y/farmers shall
have the Right to Farm in Southold without undue interference from adjacent
landowners or users. For the purpose of reducing future conflicts between
people residing on tracts adjacent to farmlands and farmers, it is necessary t6
establish and give notice of the nature of the farming activities to future.

Agricultural activities .conducted on farmland, undertaken in 'compliance with
applicable federal, state, county and town laws, rules and regulations are
presumed to be good agricultural practices and presumed not to adversely affect
the public health safety and welfare. We find that whatever nuisance may be
' caused to others by such uses and activities, so conducted, is more than offset
Dy the benefits from farming to the community. Therefore, all such activities shall
be Protected Farm Practices within the Town of Southotd.
Farmers shall have the right to undertake protected farm practices in the active
pursuit of agricultural operations, including, but not limited to: clearing, grading,
plowing, aerial and ground 'spraying, the use of lega. l agricultural chemicals
(including herbicides, pesticides, and fertilizers), raising horses, 'poultry, small
livestock and cattle, processing and marketing produce, installing water and soil
conservation facilities, utilizing farm crop protection devices, designing and
constructing and using farm structures, including barns, stables, paddocks,
fences, greenhouses, and pump houses, using water, pumping, spraying,
pruning and harvesting, disposing of organic wastes on the farm, extensive use
of farm laborers, training and others in the use and care of farm equii2ment,
animals, traveling local roads in properly marked vehicles and provi~ling local
farm produce markets near farming areas.
These activities can and do generate dust, smoke, noise, vibration and odor.
These activities may occur on ho days, Sundays, and weekends, at night and 'in
the day. Such activities are presumed to be reasonable, Such activities do not
constitute a nuisance unless the activity has a substantial adverse effect on the
public health, safety and welfare.

you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arrangements were made in either a written statement, or during the
hearing, providing the returned letter to us as soon as possible;
AND not later than May 28th: Please either mail or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted, along with the
