A meeting of the Southold Town Conservation Advisory Council was held Wed., June 13, 2012 at Down's Farm Preserve. Present were: Absent were: Peter Young, Chairman Jack McGreevy, Member Audrey Horton, Member Doug Hardy, Member William McDermott, Member John Stein, Member Lauren Standish, Secretary John Bredemeyer, Trustee CALL TO ORDER The meeting was called to order at 4:30 PM by Chairman Peter Young REPORTS Member Doug Hardy expressed his dissatisfaction with the CAC's decision to Support the Kruter application at the meeting held on May 9th. Member Jack McGreevy attend the Trustee meeting held on May 16th and was disappointed that the Board didn't address the CAC memo sent to them on May 8, 2012 regarding the contamination problem in Mattituck Creek. In his opinion, the Board should have handled the application of the Mattituck Fishing Station in a more aggressive manner, which relates to the contamination, Member Audrey Horton felt the Board has always been very receptive in the past. GUEST SPEAKER Aaron Virgin, Vice-President of the Group for the East End attended the meeting. The topic was the Mattituck Inlet and Creek Natural Resource Management Plan. The area of focus is to create a plan that will detail the natural and cultural resources of the area's significant coastal habitats with an objective to balance the current and proposed recreational development of the stewardship site with the conservation of significant ecological features, all in the context of public use. (See attached project summary.) APPROVAL OF MINUTES Moved by John Stein, seconded by Jack McGreevy, to Approve the Minutes of May 9, 2012. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by William McDermott, seconded by John Stein, it was RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of PEBBLE BEACH FARMS LOT OWNERS ASSOC. to replace the deteriorated wood tie retaining wall approx. 115' long with a boulder wall and replace existing wood tie steps from the top of bluff with stone steps. Located: 5065 The Long Way, East Marion. SCTM#21-5-10 Inspected by: William McDermott, John Stein, Peter Young The CAC Supports the application with the Condition there is adequate treatment of the interception of the read run-off. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was RESOLVED to SUPPORT the Wetland Permit application of KENDALL TODD to remove the existing concrete walkway landward of bulkhead; remove existing wooden ramp and 5'X 18' floating dock; remove 76' of existing bulkhead; construct 76' of new bulkhead and new 6' east return in-place, raising top elevation of new bulkhead 2'; install new 30"X 16' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock secured by two 8" dia. anchor pilings; dredge an area 30'X 25' below dock to -4' below mean Iow water, removing approx. 40 cy. of soil; dredged spoil to be placed as backfill for voids landward of bulkhead; supplement dredged spoil with clean trucked- in sand (approx. 35 cy.) as needed; and provide a non-turf buffer of 6" well compacted gravel on filter cloth landward of bulkhead. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the Wetland Permit application of BREWER STERLING HARBOR to replace various floating dockage; replace two (2) sections of existing timber sheathed bulkheading along the northwestern section of the marina with vinyl/fiberglass sheathed bulkheading; and demolish the extant metal boat storage building and attached plastic building along with the extant frame building and attached trailer and replace them with a new one-story 9,000 sr. metal boat storage building and attached two-story 2,500 sr. office building/storage building. NORDEN to construct an armor stone wall around an existing dwelling consisting of (2) rows of 1-3 ton stone and the installation of ten (10) concrete piers below the dwelling in place of failing Locust posts. Located: 56055 Rt. 48, Southold. SCTM#-44-1-20 Inspected by: William McDermott, John Stein, Peter Young The CAC does Not Support the applications because the proposed activities are not in the long term interest of the community and abutting property owners and requires an engineered plan. SCTM#81-3-1.4 Inspected by: John Stein, Peter Young The CAC does Not Support the application because of the serious erosion problem to the east and should be addressed and coordinated with the other property owners along the shoreline rather than a piecemeal approach, and with an engineered plan for the entire reach of properties. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Audrey Horton, it was RESOVLED to SUPPORT the Wetland Permit application of MICHAEL HIRSCHHORN & JIMENA MARTINEZ to construct a 525.25 sf. second-story addition atop the existing single-family dwelling; reconstruct railing to the attached rear deck; remove 2,260 sr. concrete padding surrounding the dwelling and replace with native plantings; and install a 320 sf. wood walkway from the parking area along the southwestern side of the dwelling to the existing wood walk around the perimeter of the rear attached deck. SCTM#118-4-5 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application with the following Conditions: · The installation of a 15' non-turf buffer; · Installation of hay bales and silt fencing prior to demolition and maintained throughout construction; · Save the mature oaks, and · Contain all run-off. The CAC questions the legality of the beach house that contains a shower and toilet. Also, there has been recent pruning of the vegetation and watering of the slope. Vote of Council: Ayes: All Motion Carried Moved by Audrey Horton, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of WILLIAM MURPHY & KIMBERLY REECE to remove and replace (within footprint and approx. 1' higher) existing one- story portion and two-story dwelling in place); install a drainage system of roof drywells, leaders and gutters; construct a 14'X 24' screened porch in place of and within footprint of existing deck and a 15' X 26' on-grade masonry terrace in place of existing 10'X 22' brick terrace; construct various on-grade stone/masonry walkways in place of and/or in addition to existing walkways; replace existing timber steps to dock path and construct new timber steps; construct new stoop in place of existing stoop; remove existing driveway and install new pervious gravel driveway; construct 18'X 38' swimming pool, 7'X 7' spa and 480 sf. on-grade masonry pool patio; install pool fencing, pool equipment, pool drywell, and plantings to screen pool; maintain approx. 9,448 sr. area of natural vegetation adjacent to wetlands as non-disturbance buffer; and establish approx. 3,440 sr. area adjacent to non-disturbance buffer as variable width non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of HELEN & ROBERT KEITH to construct approx. 95 If. of Iow-sill bulkhead between existing Iow-sill bulkheads on subject parcel .' 6 and adjoining parcel to west; and place approx. 20 cy. sand fill (to be trucked in from an upland source) between proposed bulkhead and existing inter-tidal marsh to be planted with Spartina alterniflora (12" on center) to create approx. 190 sf. of additional inter-tidal marsh. It is recommended the Board of Trustees investigate the impact this action will have on Willis Creek. WHITE to reconstruct the existing 4'X 56' fixed wood dock; construct a 4'X 6' landward extension; new 4' X 96' fixed dock extension using Thru-Flow decking; and a 3'X 14' hinged ramp attached to a 6'X 20' floating dock. Located: 4324 Westphalia Rd., Mattituck. SCTM#113-9-10.2 Inspected by: Audrey Hodon, Jack McGreevy, Doug Hardy The CAC Supports the application with the Condition the abandoned floating dock is removed and the walkway is constructed using grated materials. Vote of Council: Ayes: All Motion Carried SIMEON & ELLEN WOOTEN to construct a covered walkway (wood or stone) and provide a handicap access to the new front door. Located: Old Mallory Rd., Fishers Island. SCTM#7-6-11 The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND & COASTAL EROSION PERMITS Moved by Peter Young, seconded by Doug Hardy, it was RESOLVED to SUPPORT the application of SUSAN FARRELL & EDWARD D. FUSCO to Amend Wetland Permit #289 to include the as-built +/- 50 sr. kayak shed along landward side of bulkhead; remove two (2) fallen trees and backfill uprooted area against landward side of bulkhead with clean sand +/- 1 cf.; remove +/- four (4) hollowed out trees; and remove brush, poison ivy and dead branches along east side of property. The next meeting of the Conservation Advisory Council has been set for Wed., July 11, 2012 at 4:30 PM at Down's Farm Preserve. Standish, Secretary Conservation Advisory Council RECEIVED ~;~ o JUL 1 2 2012 UP GiOR THaT [-ND Project Title: Mattituck inlet and Creek Natural Resource Management Plan Primary Goal: To develop a natural resource management plan to assist in the protection of sensitive wetland and coastal habitats. The project will assess current site uses and management, as well as prioritize habitat restoration initiatives. Project Summary: Mattituck Inlet and Creek is recognized as a Significant Coastal Fish and Wildlife Habitat (1987) and in the Long Island Sound Stewardship Initiative (2006) as an inaugural stewardship site for its significant recreational and ecological values. The proposed management plan will help provide a vision for the future condition and public uses within this site. In April 2012, the New York State Department of Environmental Conservation (NYSDEC) closed shellfish harvesting on about 92 acres in Mattituck Creek and Mattituck Inlet because of a marine biotoxin, likely the result of excess nitrogen in the ecosystem due to inadequate septic system management, stormwater runoff from neighboring farmland, or potentially from other sources. While one aspect of the plan will build off the Town of Southold's Mattituck Creek Watershed Analysis and focus on how stormwater impacts this area, the primary focus of the project will detail the natural and cultural resources of the Mattituck Inlet and Creek, which feature state tidal wetlands, locally managed parklands, and a public waterways access. Additional proposed partners include: Audubon New York, Mattituck Park District, NYSDEC, Suffolk County, Town of Southold, and U.S. Army Corps of Engineers. Areas of Focus: This plan will detail the natural and cultural resources of the area and propose several management activities to maintain, enhance, and restore the area's significant coastal habitats. The objective of this plan is to balance the current and proposed recreational development of the stewardship site with the conservation of significant ecological features, all in the context of public use. The five areas of management focus will include, but are not limited to: · Wildlife habitat of protected species, e.g. piping plover, least tern, osprey · A coordinated dredging schedule and routine maintenance · A plan for invasive and non-native species removal, and replacement with native vegetation · Park management coordination with partners and neighboring landowners · Current and potential educational and recreational activities
