Bnard and ()ffice Policies, Practices, and Activities:
MS4/Chapter 236
SMO Jamie Richter and Town Engineer Michael Collins met with the ZBA to
provide MS4 training for all Board Members. The Board decided to implement two
practices. First, all members will carry with them during site inspections a Notice of
Potential illicit Discharge Form and fill it out as needed. Second, the ZBA office will
henceforth forward all Special Exception Permit applications (which do not require
review- by the Building Department) to SM() Richter for comments regarding
compliance with Chapter 236 and the SWPP requirements prior to a public hearing.
ZBA Procedural Guidelines
On June 21,2012 a document titled ZBA Procedural Guidelines was approved by
unanimous vote of the Board. The introduction reads as follows:
The lbllowing Procedural Guidelines are voluntarily adopted by the Southold
Town Zoning Board of Appeals, as permitted by Town Code §280-148. They are
intended to further clarify the responsibilities and operating procedures of Board
Members, the Board Chair, and the ZBA Board Assistant. The purpose is to set an
expected level of personal and professional behavior to ensure that all ZBA
members exercise the highest degree of honesty, dedication, confidentiality and
professionalism. These Procedural Guidelines apply to all members.
Implementation of these procedures is the responsibility of each individual
member as overseen by the Chair of the Board. Failure by any Board member to
adhere to these procedures may result in cause for removal by the Town Board,
after a public hearing as required by New York State Town Law §267.
Topics covered in the document include writing draft findings (Board members and
staffresponsibilities, content, and time frame); procedural matters for individual
applications (Board member actions and authority/responsibilities of Board
Assistant); and procedures for placing an item on a meeting agenda. The ZBA has he

authority to modify or amend portions of this document by resolution approved by the
majority of the members. The Guidelines will be reviewed annually at the first ZBA
meeting in January where possible, but no later than February of each year.
