Jonathan Wiggins: What is the assessed value? Gerard Schultheis: 61,500 dollars. Jonathan Wiggins: 61 thousand? Linda Sanford: Yes. Darline Duffy: Brand new construction Linda Sanford: Yes. Cara Wells: Owens, did Owens build that? Linda Sanford: No, Bertani. Daniel McConlogue: Does anyone have the indicated market value from that assessment? Darline Duffy: I do. At the .97 it's 6.34 million, at the 1.06 is 5.8 million. Cara Wells: Darline, is this correct at 2.2 acres? Darline Duffy: 2.15 yes. Cara Wells: 2.15 Darline Duffy: Yes. Jonathan Wiggins: Okay, and you have 250 feet on the beach? Linda Sanford: Yes. Daniel McConlogue: Do you have a copy of the appraisal? Linda Sanford: No, the appraisal that was done was for the insurance, you know my Chub insurance, and that was looking at the cost to replace and so I thought the assessments were based on market value. I don't have it with me but I did have it appraised about a year ago for the insurance purposes. Gerald Schultheis: And at that point in time it was appraised at 6.8 million? Linda Sanford: Yeah a year ago, yup. And you know its contents and everything else in the home as well. Cara Wells: So that included the contents? Linda Sanford: Yes. Cara Wells: Chub usually breaks out the house and the land or does the contents? Linda Sanford: Yes, it usually does. I don't have that breakdown. Gerard Schultheis: What proof are you offering in as to the value of the house? Linda Sanford: I really want to thank you very much first of all for your time here. I just wanted to have a conversation with you quite honestly. I was surprised by you know the tax increase. I didn't expect it to be nothing honestly, and Darline and Bob have both b6en very helpful to help me understand it, but I really just wanted to have a conversation and understand a little bit on you know how the assessments are done. I thought they were based on more market value and the market has declined. I just'got a recent figure that I had seen that it was down about 4.8% in the last year for 2008. Daniel McConlogue: Is that Southold? Linda Sanford: That was, yes, Southold. Daniel McConlogue: Do you have that? Linda Sanford: I got that from John Nickles who I spoke to who said that was the recent data he had. Daniel McConlogue: And what was that? Linda Sanford: 4.8% Cara Wells: I believe that is in the newspaper. Linda Sanford: Yes I think it was, you're right. Daniel McConlogue: And that's minus right? Linda Sanford: Yes, that's fight, that's right. Cara Wells: Yes but this is based upon July 1, 08 not 09, not the last 9 months. Linda Sanford: That's true, but there is coming up again I think the next time would be coming up another tax bill. Daniel McConlogue: The concern is this tax year.., the valuation date is July 1, 2008 Jonathan Wiggins: '08 is the date that is for the current tax roll. Linda Sanford: Yeah, and you know I have looked at other places like for example I know East Winds in Nassau Point has been on the market for awhile from 7.9 million they've dropped it 6.9 and they finally took it off the market because they were unable to sell it. I've looked at other homes and got some of the data in terms of the taxes that they are paying and mine is clearly the most expensive for comparable acreage and waterfront property. I don't know the home itself but I know my home is recently built. Cara Wells: When was it done? Linda Sanford: October 2nd, but you know I love it out here, I grew up out here, and I'm coming home when I retire and my intentions are to move out here, and I don't have any intention of selling the house at all. I want to pass it down generation after generation and just to make sure my kids are able to pay for the taxes and stay here and not have to move themselves. I just wanted to kind of give you my perspective and my observations and ask that you just consider. Gerard Schultheis: We really need to see some proof whether it is comparable sales or an appraisal. Linda Sanford: Well the only, you know...nothing has sold in that price range recently, I mean the one that I have which would be the most comparable in terms of acreage, waterfront, and even the size of the house is... Jonathan Wiggins: I know. Gerard Schultheis: Was it sold? Linda Sanford: No. They can't sell it because the price they were asking has...there was no market for it. Daniel McConlogue: Just for your argument, is they're comparable homes to yours that is assessed lower than yours. Daniel McConlogue: (inaudible) Linda Sanford: Yes. Now again when the assessment was done, I don't know the home per se, I'm looking at acreage, I'm looking at waterfront and you know... Daniel McConlogue: Can you give us a sheet or something, do you have anything on that? Linda Sanford: I wrote down, and this all, I can give you a copy of this. But I went... Phyllis Atkinson: Can you bring it up here? Daniel McConlogue: Give it to the chairman. Linda Sanford: I went through and just looked at the acreage and waterfront property, and again the homes I don't know about the homes really and then the tax parcels. Daniel McConlogue: So you think these are comparable to yours? Linda Sanford: (inaudible) Daniel McConlogue: Generally speaking. Linda Sanford: Yes. Gerard Schultheis: So what we have here is just the name of the owners, the acreage, the waterfront, feet on the water and the taxes. Linda Sanford: Yes. Jonathan Wiggins: You don't have anything as far as tax, size of house? Linda Sanford: Right. Exactly. Daniel McConlogue: Section, block, and lot I guess we could get it or you could get it. Linda Sanford: I have it all. I tried to do a cheat sheet. I have it all. Daniel McConlogue: You want to photocopy that and submit that what you have? Linda Sanford: Oh sure. Jonathan Wiggins: I would like to ask the assessor something...Darline? Robert Scott: Wait, wait, one second please. Let's have one conversation here. Jonathan Wiggins: The assessed value of the land has been 7,900 dollars since 1977, thirty years later it's still 7,900 dollars as the land value, it is probably the same. Why did it go up to 11,800 from '07 to '087 Did you reevaluate all of the waterfront properties along that area? Darline Duffy: Uh, yeah that's tree. Jonathan Wiggins: Every one of them went up? Darline Duffy: Several of them went up. I couldn't promise you that every one of them went up. But I'll look that up for you. Jonathan Wiggins: Ok, it just seems a little arbitrary; I'm just trying to figure out why. Darline Duffy: For one thing...can I ask Mrs. Sanford a question? Jonathan Wiggins: Sure. Darline Duffy: Did you redo the bulkhead? Linda Sanford: No I did not. That was already done by... Darline Duff'y: Because it is a double bulkhead. You know, nobody has been down there probably since 30 years. I have a picture of it, and it is a very substantial bulkhead and... Jonathan Wiggins: It's a thirty-year-old bulkhead. Darline Duffy: I have to check. Linda Sanford: I didn't replace it so I'm not sure when it was replaced. Cara Wells: Didn't the Millers replace that? Linda Sanford: It was not Miller, Rosenberg was there before. The owners were Rosenberg that I got it from. Darline Duffy: Hang on I'll show you the bulkhead. It's very substantial. My feeling was that this house...I don't have the bulkhead picture, but it's in the computer. Jonathan Wiggins: Right right, but if somebody redoes the bulkhead we feel it adds value to the land, wouldn't you reassess them at that point? But, they would need a building permit to get bulk heading. Robert Scott: Absolutely, we don't receive every bulk-heading permit. The Trustees don't give us their permits. The only people who give us their permits are the Building Department. Usually when we see a notice of change in the main structure of the building then we have to take a look at any of the other improvements that we've done in the past without notification to the Assessors Office. This is one of the things we take a look at this particular point. Jonathan Wiggins: So what you are say/ng is that the bulkhead was built and then they... Robert Scott: There was no notification and then we went to take a look at it we had to make an adjustment to that particular improvement that we didn't have previously on the card. Jonathan Wiggins: Did you... I mean 11 of '04 you've got demolition of dwelling and reconstruction, 6 of 6 you've got construction of a garage, it seems like you should have been aware of this situation long before '08. Robert Scott: First of all this was a long process for her to do what she doing and one thing that the Assessors do is that we don't try to kill anybody at any one particular stretch. When we finish the assessment we have to look at every aspect on it and that particular time she changed the assessment for everything at that particular point so she wasn't tpfing to penalize Linda beforehand but at the end she had to put everything into it. Jonathan Wiggins: Yes Cara Wells: It was a major... Robert Scott: It was a major project. Cara Wells: Major, major and it took a long... Robert Scott: Beautiful job but a major project. Cara Wells: Four years? Linda Sanford: Four years, it took a long time. (inaudible) Cara Wells: I'm sorry it took so long. I knew it was multi year, a multi-year project. Linda Sanford: Yes it took a long time. Phyllis Atkinson: Do you have...have you contacted any of the marine contractors to get how much per foot it would cost to build the bulkhead? Cara Wells: Costello probably has it. Robert Scott: You can find that information out but I think you will find that at several hundred dollars per front foot. That's the same with every... Phyllis Atkinson: It was 300 a foot that was last year, so double is probably more than that. Robert Scott: With the cost of wood and everything else I can't tell you anymore because I don't keep up with that. Cara Wells: I know with that vinyl clad bulkhead on the Anderson property is quarter of a million dollars. That's why 2 years to get the DEC permit so I do know that. Jonathan Wiggins: Want to get some other property data property cards to see the (inaudible) of some similar properties? Darline Duffy: I have a parcel here on Jackson Street in New Suffolk that sold in November of '07, it's an acre, it's 150 feet on the bay and they paid 2.75 million for it. Historically, our waterfronts have been under assessed and at eleven eight...what number am I using? We are looking at a million one for this two-acre parcel. Robert Scott: With two hundred fifty feet of bulkhead and waterfront so the value attributed to the land alone is very reasonable to be honest with you. Jonathan Wiggins: Yeah, we are...I am just curious as to the spike in the land value and I imagine that you gave us the two properties next door that are probably reflect similar assessments. So maybe you can pull out 15.2 and 15.3. Phyllis Atkinson: The house in New Suffolk that you just cited... Robert Scott: That's just a lot. Phyllis Atkinson: That's just vacant land? They demolished... Robert Scott: It's a vacant lot and then the lot next to it was sold for 3 ½ million in the previous year and that they tore the building down. Phyllis Atkinson: Okay Robert Scott: And that had 108 feet of waterfront and it was on a half acre so basically they paid 3 ½ million dollars for one improved lot which they tore down for a lot to reconstruct and then they bought the lot next door for 2.75 million dollars and it's just a vacant lot. Jonathan Wiggins: It's just vacant land? She paid 1.65 for her lot. Linda Sanford: Right right. Robert Scott: The basic thing here is that the amount that we got there is less than even what the appraised insurance value indicates so...and I'm not sure, when they do an appraised insurance value do they count the land? Jonathan Wiggins: I don't know; I'm not an insurance appraiser so... Phyllis Atkinson: Land doesn't burn. Cara Wells: No because the land...fight. Jonathan Wiggins: The land doesn't burn. Robert Scott: But what I'm saying is that they've got 6.8, what they've got in improvements in the inside are... Linda Sanford: There are valuable things inside. Robert Scott: So I think one of them compensates for the other as far as the land is concerned so that... Jonathan Wiggins: May I ask you a question? Linda Sanford: Please Jonathan Wiggins: What do you think the house and property is worth? Linda Sanford: You know...I'm assuming it goes by market value. That's what I...that's what it costs to replace. That is what I'm trying to explain to you. Jonathan Wiggins: Yeah what do you think it is worth? Linda Sanford: You know, it's probably worth, I don't know...a million less than the 6.8, you know7 Jonathan Wiggins: So you think it's worth 5.8? Linda Sanford: I mean ifI took 5 % offof...I have to do my math, 5% offo£my 6.8...you have the calculator. Robert Scott: She is saying 6.46 million. Linda San£ord: That's what we have testified to come down, the market is down. Robert Scott: We are saying that even at the lowest residential assessment ratio that the state has at .0097; we are saying 6.3. Linda Sanford: My 6.3 would include the property inside so you would have to... Robert Scott: I know but we would ha'be to... Jonathan Wiggins: That's for your insurance; we're not going to value your tea set. Linda Sanford: I know but I would take that off the 6.8. Robert Scott: You know at this particular point we don't want to argue. Linda Sanford: I know we don't want to; we are friends. Robert Scott: We have to...we are assessors, that's what we do and one of the most valid ways of approaching the value of a property is the cost and since it was just completed...what was the cost? And the cost is different from the appraised value. Jonathan Wiggins: Sure Linda Sanford: Yes. But I guess ifI couldn't sell it for that much, which I have no intention of selling it. Jonathan Wiggins: We're just looking for inequities here and there. Robert Scott: To be honest with you the assessors and Linda both want to have an assessment that's fine, if she does nothing else to the property we're not coming back. Jonathan Wiggins: It's a lovely house, it's a good spot, and you're happy with it, that's what's most important. Linda Sanford: I agree; I love it. Jonathan Wiggins: Wetre going to look at everything we can. Do you feel the property...where did you get the 6.8 or that's the insurance? Linda Sanford: That was a Chub appraisal and I will give you a copy of that. Jonathan Wiggins: No I have no doubt. All I really wanted was the figures that we see here before us. Phyllis Atkinson: Does that include the bulkhead on the Chub appraisal? Jonathan Wiggins: No I don't think so. Linda Sanford: I have a copy. I don't think it does. I should double check; if it could bum maybe they did include it right? It could bum down I guess. Jonathan Wiggins: Or wash out. Linda Sanford: I should double check. Phyllis Atkinson: It's in the water, I mean how much can you...? Linda Sanford: I'don't know whether they included it or not; I'll have to check Phyllis Atkinson: Okay Linda Sanford: You know it is...and Chub does tend to appraise, I mean, I've also negotiated with them my insurance bill because that was also very high. Phyllis Atkinson: Oh Linda Sanford: And again he was out here, this was a year ago, he also had a hard time because there was no comparables to take a look at. Jonathan Wiggins: Yeah yeah. Phyllis Atkinson: Did you have to supply him with the cost of construction? And that's how he appraised? Linda Sanford: No, no he measured, looked at the materials I used; I have installed a slate roof so we put a factor on to that. Phyllis Atkinson: Okay so he didn't really go to your specs and... Linda Sanford: Not the (inaudible) Jonathan Wiggins: Did you use real slate? Linda Sanford: Yes Jonathan Wiggins: That's nice Linda Sanford: It has to last forever for my family and grandchildren and the great grandkids. Phyllis Atkinson: Did you want a copy? Darline Duffy: Could I just take a look? Jonathan Wiggins: (whispering to Gerard Schultheis) We have one here, this is 2.6 that's this one and then you have here... Phyllis Atkinson: Mrs. Sanford are any of these properties located along the bay?. Linda Sanford: Yes Phyllis Atkinson: They are. Linda Sanford: Yes yes. Jonathan Wiggins whispers to Gerard Schultheis about property cards they are looking at (inaudible) Robert Scott: Jonathan that one fight there you've got is one that hasn't been, it was done over and we haven't taken a look at it yet, the valuation. Jonathan Wiggins: I see the land has been the same since '76 and was reevaluated in 1990 and the building was demolished in 1980 but still the land has not gone up at all. What happened to 15.2 I'm curious with that one because it is the same square, same water frontage. Darline Duffy: I don't know. Fifteen point two, because the numbers don't nm consecutively it gets crazy. Cara Wells: Mrs. Sanford is the 4.8 average for 2008... Linda Sanford: Yes Cara Wells: You know the major impact of that was after the evaluation date. It is really the third and fourth quarter. Linda Sanford: Foarth qumter, right right. Cara Wells: And again you have to remember this is July 1 '08 date Linda Sanford: Right, I don't know how frequently you assess. It's not every year so I'm kind of paying at the peak and the market is down and no one is predicting that it will go back up to where it was so that was my biggest concern because I happened to get it at the peak. Daniel McConlogue: They do assess every year. Cara Wells: But not with physical inspections. Linda Sanford: Right Daniel McConlogue: They don't reassess. Linda Sanford: Right right. Robert Scott: If you would like for the ones that have the original cards up there I'll make copies for you. Cara Wells: Could you also make a copy of Mrs. Sanford's list? Darliel McConlogue: That's the ones with different assessed values? Robert Scott: Yup, it's the ones with different taxes. There is a difference between assessed value, this isn't equal assessed value; it's taxes, so this could be after exemptions so I want to emphasize that. Linda Sanford: Yes, that's true too and I for my own simple way to look at it... Robert Scott: I'm not trying to...I'm just trying to be accurate is what I'm trying to say. Jonathan Wiggins: Does this jetty indicate the edge of your property? Linda Sanford: Uh actually...actually no (inaudible) Jonathan Wiggins: Ok so that's all of your property. Linda Sanford: I did put a lot into it because it was my dream home. I worked so hard all these years and I thought well this I could leave to my family so... Phyllis Atkinson: It looks gorgeous from the photos; it's absolutely gorgeous. Linda Sanford: I grew up. on a farm out here, a potato farm believe it or not. Darline Duffy: She went to the Laurel school, the little red school. Phyllis Atkinson: Oh Linda Sanford: My mom did, I went to Cutchogue actually, Sacred Heart, then I went to Mercy High School in Riverhead. Jonathan Wiggins: Pretty much, I'm just a little curious about the price of land values here Darline. I see 15.2 has the land assessed at eighteen one in '64 and then in '65 it went down to sixteen and then in '70 it was sixteen four and in '73 it was eleven seven and then '76 it was eight thousand two hundred. Darlinc Duffy: You know what, I was in high school then I don't know what... Jonathan Wiggins: Me too, I'm just seeing the price the value of the assessed value for the land... Cara Wells: The property was divided Jonathan. Phyllis Atkinson: The property was divided. Cara Wells: It was divided. It was originally 19 acres. Jonathan Wiggins: This one here did increase a little bit that's an indication... Robert Scott: Jon, can I make a statement about one parcel, 15.3 Jonathan Wiggins: 16.37 Robert Scott: Fifteen point three, the assessor that did that change is sitting fight here and that was the first year I was in office, the first four months I was in office and that's the last time I was able to go to the property and I didn't know at that particular point that when we looked at one you had to review all the others, I've learned that since so if there is any error on that particular lot don't blame anyone but me. Darline wasn't even in office yet at that particular point. I reside at 1400 West Creek Avenue, Cutchogue and I am the surviving spouse of my wife Mary whose trust is the owner of the house. She died a few months ago this December and I'm making up my mind whether I'm going to continue to live in the house as I have the fight to do but I'm here because I'm confused of what I view as conflicting information. I'm going to simply present the two pieces of information to you that confuse me and let you fellows decide as your job what should happen in this case. The conflicting pieces of information is that a professional appraiser that I had to call in because I required an appraisal to be done because of the state tax return I have to file, and they demand an appraisal, so I got an appraisal. Also, I wanted to know what the house is worth on the market essentially because ifI elect not to live there it becomes the property of those people specified in the trust, which are my children, and they will inherit and turn around and sell it and so I guess that's their decision but I think that they will likely be thrown a loop and what will they sell it for? That's the issue. What will they sell it for now versus what will they sell for ifI would like to live there in a few months so that's all that is going through my mind. On the other hand, what is the house worth on the market? The professional appraiser says it is worth 800,000 dollars. He is a professional in the business and he's in real estate and I guess he knows what he is talking about so I accept his number. On the other hand, I come in and I talk to Bob and I talked with Kevin and they say that the full market value of the house 876,000 dollars. The presumption that I have is that is what the house would be able to sell for and on the other hand the appraiser says, as he took it over, he wouldn't get more than 800,000 for it if he sells it now. IfI give it to him in 6 months he might not even offer me 800, he tells me he can sell it for 800,000 dollars. I don't know what the house is worth and also I don't know the proper tax is on the house and so I decided to let you fellows thirst out yourself. I gave you all the facts there that I have that I know about and my confusion regarded those facts and so that's why I presented this document to you and allow you to comment on this. Jonathan Wiggins: Okay looks like a fairly new house. Wallace McGahan: Yeah, the house was built in 1990 and finished in '91. Jonathan Wiggins: And your appraisal says 805,000? Wallhce McGahan: The appraisal is what the appraiser ended up with in his statement of appraised value of 800,000 dollars. He went through the process that they use whatever it is looking at comparables and different things and I supposebeing a realtor he also looked at where he thinks the market is. I don't know what he looked at but he came up with a number and wrote it right in and said this is what I think it's worth so I accept what he said. Jonathan Wiggins: Okay Gerard Schltheis: Just for the record I am recluding myselfi Jonathan Wiggins: Okay do you know this gentleman? Gerard Schltheis: That's my father-in-law. Jonathan Wiggins: Okay, let me start by saying I'm sorry for your loss. It is difficult. Wallace McGahan: Thank you. Well we fought a good fight for 15 years and kept her alive but Alzheimer's finally won. We spent a lot of money on medical expense and that's why I need to look ahead because ifI have to pay 10,000 a year in taxes then I'm going to be leaving here in two years because it's all going to be gone and I won't owe any money anymore. I'll get a pension maybe. Jonathan Wiggins: Now according to the state equalization rate we have your house coming up at 948,000. Wallace McGahan: 948? Jonathan Wiggins: That's the state ratio. Wallace McGahan: That's not the number you told me. Kevin Webster: The level of assessment that we are actually using is 1.06 Jonathan Wiggins: They are using their own figures. Daniel McConlogue: They take the assessed value and they divide it by the ratio and the assessor is using one and the state has another and the question is which one do we use. The one that Jonathan uses throws out the value of 948,000. Is that correct Jonathan? Jonathan Wiggins: Yes Daniel McConlogue: Thank you. Wallace McGahan: I or my children will have to say what can they sell the house for and presume that's the value and if that's the value then the tax should be based on the value not on some formula so I don't what the formula means. There is a discrepancy and it bothers me and that's why I am here. Jonathan Wiggins: You spoke to Kevin? Daniel McConlogue: Want to see what Kevin has to say? Jonathan Wiggins: Yes, let's see what Mr. McCallister, I know a Kevin McCallister, I keep messing that name up, Mr. Webster. Let's see what he has to say. Kevin Webster: I have reviewed the appraisal with Mr. McGahan and the value that we have on there now is the 876. My observations are that if you look at the appraisal and the adjusted value that...Erica Stype did this, Andy's daughter, who I know very well and I know Andy as well. The values that she came up with on the bottom the adjusted sale price before she did the adjustments are 975,600, 935,500, and 805,500 so my initial observation for Mr. McGahan is that sale number one comes in at 100,000 dollars higher than what the state has the house at. Sale number two comes in at 60,000 dollars higher than what the state has it at and sale number three does come in lower, but two of the three sales that they chose come in higher than the assessment and the equalized value that's on there from this assessment that was assessed in 1995. That's one thing I wanted to mention. The second thing is that the sale prices are great sale dates; the sales have really good sale dates for our evaluation of July 1st of 2008. The first one is October 2008, the second one is October of 2008 given within three months, and the third one is right on the evaluation date July 18th of 2008 so you can't get better sales for an evaluation date of July of 2008. Jonathan Wiggins: (inaudible) 805,000? Kevin Webster: That one sold July 18th of 2008 so when you look at the... Daniel McConlogue: I'm sorry, what? Kevin Webster: July 18th of 2008. Daniel McConlogue: What was the price? Kevin Webster: It sold for 750,000 dollars on July 18th. That one was right on the evaluation date. But, if we accept that as a good sale for evaluation date of July 1st 2008, which I think everybody would say that's pretty close, he took off, if you look at the appraisal on the first line the date of sale, he took off 75,000 dollars under that line so there's no reason why you would take off 75,000 dollars when you're trying to adjust that sale with an evaluation of July 1St 2008, and number two as well, he took off 46,500 and number one he took off 54,400, strictly for time, nothing to do with age, square footage, basement, acreage, just when you talk about the time. So, if you look at number one and you add back the time adjustment it comes out to a million thirty thousand, number two comes out to 982,000, and number three comes out to 880,500, so all three of them then are above what the equalized value we have for this house as of July 1st 2008. That's why I feel that the assessment that has been on there for 14 years is still a fair tree number because all three of them come out above what the equalized value is because you would not be making time adjustments to July 1st when those sales are within three months of the evaluation date and one is within 18 days. The reason I think he did that is even though he says he's doing this or she's doing this as October, I'm sorry December th 18 of 2008 is the date of the appraisal, so obviously the real estate market changed from July 1 of 2008 to December 18 2008 so Erica is appraising this house as of December th st 18 not July 1 so you would strike those time adjustments. They would not apply on those negative time adjustments so the adjusted values again would be 1,030,000, 982, and 880 strictly on time, nothing to do with the amenities, strictly on time. That is my comment on the appraisal. Wallace McGahan: Okay my comment on the whole thing is that I hear is the assessor criticizing the appraiser of how he arises at the numbers. Now maybe we ought to have the appraiser here to criticize how the assessor arises at the number. On the tax sheet it says that the fair market value for the house is derived by using assessment numbers. They (inaudible)me 76,000 dollm's. Somebody who is in the business of selling houfies says that the fair market value, based upon his experience and knowledge and training, is 800,000 so that is why I am confused that the assessor whose business is assessing is criticizing the appraiser whose business is appraising and that's why I don't understand what is going on. Jonathan Wiggins: I think that's our job here is to kind of...we go through all of this and approve what the facts are. Wallace McGahan: Oh ok, that's what I thought. Daniel McConlogue: With all do respect, the assessors are appraisers too and they're qualified. Jonathan Wiggins: Yeah, we are going to look at it and I can see your point and I... Wallace McGahan: Give me a letter from an assessor that says that this appraisal is wrong and let them sign it like the appraiser did, you know in the appraisal he signed his name and his reputation and his license is on the line, and now we have somebody who has nothing on the line criticizing his appraisal. That's why I am confused. We have two factions here, each with their own expertise saying that each other's wrong, well no the other expert is not here. But I let them... Kevin Webster: May I...I am not criticizing Erica's work here. I'm just pointing at that the appraisal was done for a specific evaluation date of 5 months after our evaluation date that we have to use for the state; so what was done for the December 18th 2008 evaluation date and when the State says look it as of July 1st 2008. Daniel McConlogne: And after that she took time adjustment? Kevin Webster: Right she took off fifty four thousand, forty-six, and seventy five thousand for the time adjustment because... Jonathan Wiggins: So what your saying is her figures would be more accurate than the State's because it is more up to date. Kevin Webster: If you add back the time adjustments...you have to add back the time adjustments and it would show then that the, her, indicated values ora million thirty-five, and nine eighty-two and eight eighty are the State's value is less than that. The State's value is 876 so all three sales are higher. Daniel McConlogue: Your saying that State's value is 876? That's your value using the lower assessment. Kevin Webster: Correct. Daniel McConlogue: The RAR is nine forty-eight. Kevin Webster: Yes the RAR is nine forty-eight and two of the three sales are higher than that as well, a million thirty and nine eighty-two. Daniel McConlogne: Because of the weight of time? Kevin Webster: Right because you would not be making time adjustments on that. Daniel McConlogue: Seems like that's the issue. Jonathan Wiggins: Well the houses aren't exactly the same I think we would have to look at the appraisal and kind of go over it. Daniel McConlogue: Oh yeah Jonathan Wiggins: But it is an interesting case and we'll be happy to review it and we'll... Wallace McGahan: Just educate me a little bit hem...on my tax form there's a number called 100% of full value what does that actually mean? I mean I interpret it to be what the house is worth and could be sold for but maybe that's the incorrect interpretation. Kevin Webster: It is the value your home is being...I'm sorry. Wallace McGahan: And as of what date is that? Kevin Webster: Yeah it is the value that your home is being taxed as if it's worth and that's the value that you can come in and contest, that full market value. If you're contesting that... Wallace McGahan: Yeah, I am contesting that because another professional says ifI told him look you gave me an appraisal on what you sell the house take your job and bring me home 800,000 dollars because oh well you the fact you should bringing me home 876,000, he says no I gave you 800,000 as a number and I can't even give that now because things are going to hell since I did that and so we would be lucky to get 750, if we can get that. That's the kind of thing I am expecting will happen when we're trying to sell the house so 876 is not what the house is worth today then even though it says so right? Kevin Webster: Well that's the difference between... Wallace McGahan: Your meaning a willing buyer and a seller would agree on Kevin Webster: As of a specific date that's what your being taxed is if that home is worth. Wallace McGahan: And what is that date? Kevin Webster: July 1st of 2008 Wallace McGahan: I see. Kevin Webster: It's not real time; it's not today; it's not tomorrow... Daniel McConlogue: It's the evaluation date by law. Wallace McGahan: I see. What you are saying is that today the house is .not worth 876 on the market. Kevin Webster: I'm not saying that. I'm not a sales agent; I'm not listing your house; I'm not going to sell it. All I am saying is that you're being taxed as if your home is worth 876 as of July 1st of 2008. What you could list it for now you might talk to some qualified people who handle that and they migh[ be able to help you out with that. I don't tell people what I can sell their homes for. Wallace McGahan: All right. Daniel McConlogue: By law they have to value it as July 1 of that year; the assessor has to value the property; that's their job. Jonathan Wiggins: What date is the appraisal? Daniel McConlogue: December 18th Wallace McGahan: The date of the appraisal is February '09 1 think. No he has December 18th. Kevin Webster: The date of the appraisal is December 18th of 2008. Jonathan Wiggins: Okay so even that's out of date but those have changed a bit since then so... Wallace McGahan: So they're saying is the house was worth 800,000 as of... Kevin Webster: December 18th of 2008 was the appraisal Wallace McGahan: That's the date of death, yeah. That's proper for the tax purposes but I guess it's in terms of being able to sell it, not necessarily the property, maybe the market... Kevin Webster: And my opinion on this is that that's a low value of your home as of that date because if you look at... Wallace McGahan: Yeah but I don't think you are qualified to do that nor are you legally in a position that the appraiser is to do it; that's why I am confused. You're telling me it isn't worth that, the official appraiser who signs the document says it's worth this so what am I suppose to believe? Kevin Webster: Well I am giving you my opinion and my opinion is based on the fact that if you look at what Erica came up with her adjusted values, which I said to you before, one of them is at 975, one's at 935, and one's at 805 so she picked, which is against really is against policy, she picked the value below the adjusted sale prices of all three comparables. Wallace McGahan: This is what I mean by sitting here and criticizing an appraiser who makes an official number; that's what you are doing and that's why I am confused because you are not in the appraising business and I am standing here listening to you make an official defense of the document you've given me because you haven't given me any and but yet you're saying that the document that I was given by somebody whose reputation and name and license is on the line gave me different numbers but he arrived at it incorrectly so he shouldn't given me that number. Who am I going to believe? Cara Wells: But Mr. McGahan everybody in the Assessors Office are qualified appraisers. They are credentials. They have the same credentials that Erica has. Wallace McGahan: Yup I hope so, yup. Daniel McConlogue: He's given testimony in his opinion and he was previously SWOrn... Wallace McGahan: I understand who pays the person who made the appraisal from a different party. Cara Wells: Sir, even if you used... Wallace McGahan: and their underlying objective is different. They want to sell a house; Kevin wants to support the revenues of the town and they're different underlying objectives. Cara Wells: Okay Sir ifI could just make a couple of comments. There is a very nice house on Bay Avenue in East Marion that was on sale for 629 and then five something and it closed earlier this week for 450,000. Now .if you used the statistics that we heard floating around today, which was published in the Suffolk Times, the values were down 4.8% so that reduces yours from 876 to 833,952, which supports Mr. Webster's argument that he thinks the appraisal at 800 or 805, or whatever it is, is too low. Now yes it is down, the market will tell you what the fair price is but the market right now is pretty much non-existent. Wallace McGahan: Yeah Cara Wells: If you were to go out today and try to find comps, three water view homes that have sold and now the financial institutions are only taking comps in the last three months. It would be hard for us to find anything comparable to your property because there are no sales. Wallace McGahan: How can you get a comparable with no sale? Yeah Cara Wells: So if you use the statistics from Suffolk research about the fall in property values your house would now be worth 834,000 dollars. Your appraisal says it's only worth 800 and then she told you she wasn't sure if she could sell it at that price. Unfortunately it is the middle range where you are, where the value of these homes are the ones that are the least likely to be moving in today's market. The top of the market is moving and the bottom of the market is moving. Wallace McGahan: Yup. Daniel McConlogue: Where is this house on Bay Avenue? What's the... Wallace McGahan: My house is on West Creek Avenue. Cara Wells: His house is on West Creek Avenue in Cutchogue. Daniel McConlogue: Oh all right. Wallace McGahan: It's about halfway down West Creek Avenue between the (inaudible) go past the road and West Harbor Marina at the end West Road Jonathan Wiggins: Mr. Webster what's the square footage of the subject house? Wallace McGahan: Seventeen hundred and ten or something like that. Kevin Webster: We have seventeen eighty the same as the appraisal. They have 1780 and we have 1780. Wallace McGahan: All right. Daniel McConlogue: Mr. Webster are you going to submit any sales to support... Daniel McConlogue: You're just goingto... Jonathan Wiggins: He has three sales on the...oh no no. Kevin Webster: No I am not. No I am comfortable with the sales on the'appraisal the only issue I have is...well even without taking away the time adjustments two of the three are above and if you take away the time adjustment which I think is 100% warranted it comes out to the value I stated. Daniel McConlogue: That's the issue. Kevin Webster: I can prepare a grid using these sales and it will come out to the same exact value like I said a million thirty-five, nine eighty-two, and eight eighty would be the same...probably about the same value. I have no problems with what she did with the adjustments on the amenities the only issue was the time adjustment because we are dealing with a different evaluation date. Wallace McGahan: Well I begin to see where my confusion is now because it appears that the Town taxes...they have some kind of formula that has nothing to do with necessarily with what the house could sell for on the market place, it's a formula, and that arises at a number which on the tax bill is called 100% of full value and that the appraiser then comes up with his own methods which may or may not be liked by the assessor, but none the less he has his methods, and he comes up with a number which he fully expects I may mm around and say okay sell it for this number for me then. Maybe these are numbers despite what they would sell for and the appraiser would probably...the appraiser would have an opinion of what it would sell for really I guess. Do you? Kevin Webster: The appraiser, well your appraisal or appraiser has an opinion on... Wallace McGahan: (inaudible) Kevin Webster: Oh what it would sell for? Oh we can't... Wallace McGahan: I misunderstood that the number that you call a 100% of full value is probably what it is worth of the marketplace. Kevin Webster: As of that specific date. Daniel McConlogue: That's what the assessor's position is. Wallace McGahan: That's back in '08. Kevin Webster: July of '08 Wallace McGahan: July of '08 yes. Daniel McConlogue: That's his position. Wallace McGahan: Well it's certainly worth less than that as of today. I think everybody is suffering from the market. Kevin Webster: Yes. Cara Wells: That's what I said on the statistics from Suffolk research. The drop here is 4.8%, if you take that from 876 you get 833,952 which I rounded to 834 so even that is higher than the appraisal of 800,000. Crystal balls are not in their toolboxes; they don't read the market the buyers read the market and make the market. Daniel McConlogue: Your taxes are based; the assessment is based on the market value as of July 1. The assessors are saying that the market value is 876,000 on July 1 of '08 and they come up with that by making comparisons of other sales, comparable sales, the appraisal that you submitted is used...that's how you determine what the market value is, they compare other sales to your house and come up with a number and the assessor is using your sale because they are valid sales, but they are not adjusted pi-operly for time and that's (inaudible) intention of market value but it's both the same thing. They are looking at, they are comparing the sale and the only question is the adjustment for time, as I understand it. Kevin Webster: Yes Wallace McGahan: Well as I see it, what we are doing I know what I am going paying in 2009 because it's on the tax bill and that determines a value supposedly of the house back in '08. Now I was considering what will I pay next year in 20107 Daniel McConlogue: We will worry about that then. Wallace McGahan: The whole fuss I am making right now is for what I am going to pay in 2010, isn't that correct? Kevin Webster: Yes Wallace McGahan: Okay so in 2010 you're telling me that I should pay taxes on substantially higher values than actually exists because it's the value of what we are talking about in 2008, so this year I'm paying taxes on higher values than it is today. Next year I'll pay higher taxes on what even exists today and probably if the market continues to do what it's doing higher than what it is than so you're at least coming up with a year's taxes based upon a much lower evaluation at the time you are taxing me so that doesn't strike me as a taxpayer; it's wonderful for the town actually but I'm arguing for what I would pay next year and I think next year the market's going to be like it is this year let's face that's the problem, it it's all over the country. Nobody thinks it is going to happen here until it does everyone thinks their region is safe but I read the papers everyday and I read the national figures and markets everywhere are going down. Daniel McConlogue: We understand what you're saying but Kevin correct me ifI am wrong those dates determine the 2008 valuation and you're paying that in 2010 but those dates are all set by law. Kevin Webster: Correct, your 2010 tax bill is determined by your market value as of July 2008. You are 100% correct. Daniel McConlogue: By law Kevin Webster: I'm not a legislature; I did not make that law. You are 100% correct in that's the law and that's the law I have to follow. Wallace McGahan: It didn't make me any happier that the legislature decided that's what's going to happen. The money is coming out of my pocket and that amount of money what determines who I got to leave this town in a few years so that's what I am fighting for. Kevin Webster: I would say this...it determines everybody's, all 18,000 plus parcels, in the town's taxes in 2010 are determined by July '08. It's not... Wallace McGahan: I'm not being discriminated against I know that. Kevin Webster: No you're not. It's not just you; it's everybody. Wallace McGahan: We're all being screwed equally. Daniel McConlogue: Anything else Jonathan? Jonathan Wiggins: No I think this is interesting and we'll look into it further. I appreciate that your appraiser has offered an additional 30 pages of documentation. Wallace McGahan: And I have that here if you need to see that. I will give you the full document. There's 30 some more odd pages here if you need it. Daniel McConlogue: He doesn't contest; the only thing he contests is...he accepts the sale as an indication of market value. He just contests the one adjustment and all the sales at the time. Jonathan Wiggins: We will take it all. we are satisfied with this. I am a little curious though of how she came up with a figure when these others are coming out at 975 and 935 and that's the question. Where did she get 800? That's my question; that's why I think we should see the other appraisal. Wallace McGahan: I have nothing more to add. Daniel McConlogue: You can give the appraiser the form and see if she has an answer for the assessor for that adjustment of time. Kevin Webster: If I may, I know why she did it because she was appraising it as of December 18th not July 1st. As of December 18th that's why she came up with the negative 54,000 and so forth. Jonathan Wiggins: That's her job isn't it? Kevin Webster: What's that? Jonathan Wiggins: That's her job to give the current market value to reflect what is going on at that current time. Kevin Webster: Right she did not do an appraisal as of July 1st Daniel McConlogue: Is it possible that her adjustments for time are offand you are saying maybe we should not take off as much because we find her adjustments for time aren't correct. Kevin Webster: My position is that you should strike the time adjustments off all together that's is why I added them back. Daniel McConlogue: Yeah but maybe the number we strike isn't that high.., well I don't know. If ou have a J th Kevin Webster: y uly 18 of 2008 closed sale date my position is I don't think you should make any time adjustment that's eighteen days from the evaluation date and even October 6th and October 9th those are well within the parameter, those are right on the evaluation date. Daniel McConlogue: And December 18th isn't? Kevin Webster: No it's not but even with those tim~ adjustments two of the three sales are well above 876 but it's 976 one is 935 and the raw sale prices are a million eighty eight and 930,000. Albert Safer: The second thing is the property market values have come down between 15 and 20% in the last year or so and that's a known fact in the industry and certainly I can bring original documentations to support that from the local broker. Certainly I do have it checked to clearly look at my neighbor who has a similar house as mine and that' his property is smaller than mine by 30 feet I believe; I don't make a mistake. Robert Scott: About 23 feet. Albert Safer: Okay so a very similar house and it has a bigger lot than mine. Jonathan Wiggins: Is it on the water also? Albert Safer: It is on the water next to...like mine. I don't what his values or what his values are but I certainly believe they are lower than mine. Jonathan Wiggins: We don't know for sure, we have to check it. Albert Safer: No no it's like mine, the assessment is like mine. Robert Scott: Twenty-five percent for the completion of the main house. Phyllis Atkinson: Your assessment is what you consider 25% of the... Robert Scott: No there's 25% of that could be added later on when the house is completed. When we made the inspection of the house it wasn't quite complete so we took 25% offthe total assessment of the main house there's more than one structure here. Jonathan Wiggins: Right. Robert Scott: There's a cottage; there's a garage building and there's the main house. The main house wasn't finished when we were there so we took 25% offthe completion. That's why we put the partial and we are going to look at it again next year. Phyllis Atkinson: Oh so once we get the true, what you anticipate assessing it; I would add 25%. Robert Scott: You would add about another 9,000 dollars approximately. Jonathan Wiggins: You would add 25% to the cost of the improvements. Phyllis Atkinson: Okay Jonathan Wiggins:. So that would take that up to 35... Robert Scott: It's on the property card. Cara Wells: It's right them. Daniel McConlogue: Do you have some proof that ...some comparable sales or what are you going use to proof... Albert Safer: I will certainly provide that if I'm given an extension. I will provide additional information. I know I didn't pay this amount. This comes out to like 2.8 or something, the value of the house. Robert Scott: It's forty one three is the... Albert Safer: No no the improvements. Robert Scott: We can't segment that. The assessment is 41,300 dollars we're going to take 3.9 million dollars. I think you can see they purchased the property for... Phyllis Atkinson: Four million four eighty Robert Scott: I don't have the cards anymore; I don't know where they are. Cara Wells: Here here Phyllis Atkinson: Over four million Robert Scott: Four million eighty thousand and then he put substantial improvements. He demoed the main building and then completely did it over again. Albert Safer: The four million that we paid for that address consisted of two separate lots of half an acre each with beach rights. Jonathan Wiggins: So you combined two lots? Albert Safer: We didn't combine them. They are two separate. Somehow or another when they did the deed they put a very low value on the lot and the rest of the value on the main house. The property consisted of three lots. There's two sets of lots which is visible with beach rights. Phyllis Atkinson: One of the lots is waterfront and the other... Albert Safer: The other beach rights only, yes. Phyllis Atkinson: And obviously your house is on the waterfront. Albert Safer: Right exactly. Phyllis Atkinson: Okay, this the only card? Robert Scott: No there's another card. I'm sorry Phyllis we were rushing to get as much information to you as we could. We don't have a complete card here for you. We were told we had to get in quickly. Phyllis Atkinson: Okay Jonathan Wiggins: Just to clarify this we're looking at the tax map number of 98-5-2, which is 1.8 acres Albert Safer: Right Jonathan Wiggins: The 1.8-acre parcel in fact that he paid for a million dollars for. Robert Scott: He paid four point, he put four million eighty thousand dollars~on that particular parcel. He put 10,000 and 10,000 on 98-5-3 and 98-5-4 so if you want to say he spent 4.1 million dollars on all three parcels I'm not going to dispute that. Jonathan Wiggins: Okay so he owns two lots... Robert Scott: which I could see here for he first time Jonathan Wiggins: I'm sorry I understand and so those three lots were for a million dollars. Robert Scott: The same lots, 4.1 million Jonathan Wiggins: 4.1 million okay Robert Scott: And then.if you can see there's a demo, there's a permit to demo the existing structure in the complete renovation. He rebuilt the entire structure all over again and that's what you see here on cards two and three. Cara Wells: Do you know what your building cost? Albert Safer: I don't...I don't have them with me but I (inaudible) Cara Wells: That would be helpful information to evaluate your clients. Jonathan Wiggins: The more information you could provide the better, like the building costs are very important and anything else you have on the other properties. Daniel McConlogue: Do you a formal appraisal that you are going to submit? Albert Safer: 'I wasn't planning to but ifI have to I will I mean is it problem to get an appraisal at this point I don't know. Robert Scott: He doesn't...you don't have an appraisal. Albert Safer: I don't have an appraisal. Robert Scott: He doesn't have an appraisal so if you're asking him to get one at this point I don't think it's fair to be honest with you.
