Our first order of business is to set Monday, July 9, 2012 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next Planning Board Meeting. Southold Town Planning Board Page Two June 4, 2012 PUBLIC HEARINGS 6:00 p.m. - Cornell, Clifford - This site plan is for a proposed 42' x 60' metal building for agricultural/farm storage to include tractors, plows, loaders and hops on an 8.5-acre parcel in the R-80 Zoning District. The property is located at 2325 Hortons Lane, + .25 miles south of CR 48, Southold. The property is located at 40 & 120 Cottage Place on the s/e corner of Cottage Place & NYS Rte. 25, Southold. SCTM#1000-62-3-11 & 12 Donald Wilcenski: At this time, I would like to ask anyone from the audience if they would like to address the Planning Board on the Mullen Realty public hearing. Richard Lark, Esq., Main Road, Cutcho.que, NY for the applicant: I think the application pretty much speaks for itself. I think we have applied with the requirements of the amended site plan. So, if there are any questions from the Board, I would be glad to answer. Other than that, it would just be belaboring it I think, because this application is pretty complete. Does anybody from the audience have any questions or want to address the Planning Board on the public hearing for Mullen Realty? Emerson Hasbrouck: My wife and I own the property adjacent to the subject site at 160 Cottage Place. rye got several issues that rd like to raise. First, I am a little confused by the process. I thought that commercial properties first had to come before this Board to get site plan approval before they initiated any work. But it seems here that the applicant went ahead to do what they wanted to do and are now coming to amend their site plan and they are asking you to approve what they went ahead and did without prior approval. So I don't know--it just seems a little backward to me. My understanding is that the Town requires a 25' buffer between B Zone and residential properties. My property is residential. There is a survey that I didn't see in the packet in Town Hall the other day. Can I present that to the Board? Don Wilcenski: Sure. For the record, I believe your parcel was split-zoned, is it not? Richard Lark: Yes it is. Emerson Hasbrouck: You can see by that survey that there's a very, very narrow strip that might be 10' or so wide that is zoned Business, but at least 95% of the property is zoned Residential; the use is residential and it has been residential. That house was originally built in--well, it predates zoning--back in the late 1800's. So, that property has always been residential use. Again, you can see by that survey that at least 95% of the property is zoned residential, and that's what the use is. Don Wilcenski: OK. Just for the record, though, it is a split-zone. Emerson Hasbrouck: I don't know what you technically mean by a "split-zone", but I have a narrow strip that's Zone B. Don Wilcenski: You have part of the property in the Business Zone. Emerson Hasbrouck: Correct. A very narrow strip, yes. That's dght. Don Wilcenski: So it's considered split-zone. Emerson Hasbrouck: OK. Don Wilcenski: Just to be clear for the record. Southold Town Plannin.q Board Pa.qe Four June 4, 2012 Emerson Hasbrouck: OK. But again, it's been--it's residential use. So I am requesting that a 25' buffer be required there. In the spirit of the zoning requirements for a buffer to protect my residential property from noise, visual intrusion, headlights and so forth. Again, it is residential use, so I am requesting that the Board consider and require a 25' buffer there. The proposed buffer on the site plan is inadequate in terms of width. What's been done there is nice, but it's not wide enough. In fact the site plan doesn't even say what the width of the buffer is. The site plan that I saw that was mailed to me shows a 10' distance from the fence or from the property line to the parking stalls. But the width of the vegetative buffer is only 7-1/2', so there's 2-1/2' in that 10' distance that they have indicated that is the stone paving. And the cars currently are parking right up to that vegetated area. I guess they are going to continue to park right up to that vegetated area. So you essentially have a 7-1/2' buffer zone there. This needs to be standard 25' to protect my privacy on that property. In a letter from the applicant's attorney back in May 2011, they state that this is a temporary use for this property. I am just wondering if the Board will consider what the future or the permanent use to be? Because that may also affect what the buffer should be there. Again, they said that this parking lot is temporary. What are the future/permanent plans for this parcel? There is no lighting shown on the site plan. So I assume that there will be no lighting on this parcel. There is no signage shown on the site plan, so I am also assuming there will be no signage on this parcel as well. Relative to dreinage: I know that was one of the inadequacies that was mentioned by the Planning Department on the application. But there is somewhat a runoff that comes off that pareel from the stone pavement area but more so from the asphalt apron that leads into the parking lot. There is also additional runoff that comes from the adjacent parking lot. Most of that runs actually south on Cottage Place. Some of it runs north, but most of it runs south on Cottage Place. It comes right down the curb and right into my driveway and floods my driveway out. I've been in touch with the Town Highway Department over the years. Relative to this they have come and they've put a berm at the end of my driveway. With this new parking lot, I am getting flooding again. You can check with the Highway Dept.; I have had to call them again to build that berm up. I don't know how high they can berm it up without the bottoms of cars starting to scrape. The area around Mullen Motors is highly congested during business hours. I appreciate the fact that they are trying to get their cars off the street and into a parking lot. I think that's going to help the situation. But I would also request that vehicles that are there for repair not park in front of the houses on Cottage Place. Even though that lot is currently being used for parking, on a daily basis cars are still parked in front of my house as well as Poiywoda's house. Service people come out--they look at the cars on Southold Town Planning Board Page Five June 4, 2012 the street. So again, I would request that no cars for service be parked--I would even request "No Parking" signs-on the street during business hours during the week. The parking lot can have a negative effect on my property value. When I bought that house 25 years ago, and up until last year, I was next to another residential property. There was a house there. Now I am next to a parking lot. So I am asking the Board to consider that 25' buffer to maintain my privacy on that parcel. Lastly, I noticed in some of the paperwork for the application it indicated that the prominent land use within a quarter mile of that property is Business (B). That's true if you go down 25A, but if you're going a quarter mile down Cottage Place, the primary zoning there is Residential, not Business. Thank you. Don Wilcenski: Thank you. Seven parking stalls are proposed in the HB Zoning District. The property is located at 13200 Route 25, +225' w/o Wickham Avenue, Mattituck. Thank you. 6:06 p.m. - Mill Creek Inn & Marina - This site plan is for the proposed improvement and renovation to an existing 50-slip marina & 8,989 sq. ft. restaurant with new marina/dock master building, parking areas and site drainage on a 3.27-acre parcel in the M-II Zoning District. The property is located at 64300 NYS Route 25, Greenport. Nancy Steelman, Samuels & Steelman Architects: I am here for any questions that you might have. It's a fairly complex project; there are a lot of things we are doing with the marina and the restaurant. So, if you have any questions, I'm here to answer them. Paul Romanelli, Cutcho.que: Having a business in Southold, I travel quite a bit between Southold and Greenport and have looked at the eyesore of that property for many years. I just want to relate that I know the new partners of the existing property; I can't say enough that I don't think you'd find finer stewards for that piece of land that will improve it for all of Southold Town. I think it's a very good project and I think going forward that you've got very responsible people involved in the project and will make it look beautiful for the Town. Donald Wilcenski: Thank you.
