A regular meeting of the Southold Town Plannir~ Board was
held Monday, J%me 8, 1999~ 7:30 P.M.~ at the Town Clerk,s Office,
Main Road~ Southold~ New York.
There were present: Messrs. Jobm Wickham~ Chairman, Henry
Al_red ~_eb~, and Archibald

Also present: Mr. Howard M. Terry, Building Inspector~
and Mr. Otto Van Tuyi~ Consulting Engineer~

}~. Villa staved that the requirements of the Suffolk
County Health Department for lot sizes in a subdivision is 1/2
acr~ or 21~780 sq. ft.~ umiess there is public water and sewer.
They wo~d consider 1/2 the width of the ~oad abutting the prop-
erty and the balance would be made up within the bou=uds of the
lot. The F.H.A. and the V.A. require 20~000 sq. ft. lot size.
With reference to putting in a sewage System~ Mr. ~lia
stated the County requires two lots adjoining each other must

be done at the same time in order that there may be created a
buffer district.
Mr. Villa described bog as anything -~,here ground water
exists before good suitable material is found.
The Board mmsemssed with ~. Villa the partic-~ar problems
in $outhold Town~ and. the Hilton Epp ~ud Ralph Reed property were
discussed in particular. ~@. Grebe brought up for discussion
problems that exist on Fishers Island.
M~. Vm~ia ~ef~ several bulletins with the Pl~maing Board
for their information and stated additional copies may be
obtained upon request. It wa~ decided a letter should be
forwarded to the Co~ty Health Department for additional copies.

These aforementioned bulletins should be used in conjunction
with the minutes of this date. The bulletins elaborabe fully upon
2~o Villa's discussion with the Planning B~ard.
After Mr. Villa had left the-meeting~ on motion of ~@. Grebe,
seconded by M~. Moisa ~ad carried~ it was
R~I~0LI~D that a letter be forwarded to the Suffolk County
Health Department~ H. N~ Davids~ P.~., Director of Enviromental
Sanitation , ~ex~essing the sincer~ appreciation of-the plar~ing
Board for m~,±ng it possible for Mr. Robert Villa tc be present
at this meeting to discuss the oarticular problems involved in
water supply, sewage disposal, ~tc. on filled land. Mm'. Villa
rendered very helPf~o~ ~d constructive assistance which will aid
the Pl~aing Board in de~ling with many of its problems at hand.

Young that a letter be forwarded to t~e Southold To~m Board of
Appeals c~ ling their attention to the requirements of the
Suffolk County Department of Health as outlined in the b~letins
provided by M~. Villa and copies of which were forwarded to the
Board o f Appeals for their files, In the future the Plamaing
~oard is going to be much more careful in their recommendations

for approval of undersized lots for the reasons noted in the
bulletins°
The Planning Board held considerable discussion on the matter
of the proposed subdivision to be knock'as Hilton Heights a% Bay-
view, Southold. On motion of ~.~. Moisa, seconded by ~. Grebe and
carried, it was

The minutes of the May 26~ !9~9 meeting~ on motion of P~.
Grebe~ seconded by M~. Young and carried, were approved as read.
A letter from Robert Tasker, Towh AttorneM~ rendering an
opinion on the matter of approval of access, $ection 2~ Orient-
By- ~ne-Sea~ waz read. Mr~ Tasker indicated that according to
the Recommended R~les and Regulations for the subdivision of
!an~ of the Town of Southold~ the Pluming Board is not authorizad
to disapprove an application for the subdivision of land upon the
grounds that it does not contain provisions for access to water.
After considerable discussion relative to the aforementioned
letter of Mr. Tasker~ it was ~0L\~ED by Mr. Grebe~ secondedby
~o Young and carried that a letter should be forwarded to ~
Tasker requesting his presence at the next meeting of the Southold
Tow~ Planning Board~ to be held Tuesday~ Jun~ 23, 1999~ to discuss
the Ru~es ahd Regulations ~uder ~ich the Planning Board is operat-
ing~ and any other matters he may~feel should be taken up with the
Pl~iD~ Board relative to its operation.
The Pia~_uing Board received notification from the Southold
Town Board indicating that the application of Edward Nidds for
the establishment of an Open Development Area was gr~uted under
date of May 27~ 19~95 T~_e application o£ John and Alexandra
Drosses for a change of zone from "A" Residential~and Agricultural
to "B" Business District~ heari~ held May 26~ 19Y9~ was granted
effective ~s of Jmue 18~ 19~95 the application of Genevieve
Naugles for a change of zone from "A~ Residential and Agricultural
to "B~ Business District~ hearing held M~y 26~ 19~9~ was granted
effective as of June 18, 19~9~
After considerable discussion relative to subdivisions and
highway specifications with relation to the requirements of the
High~y Department~ on motion of M~. Grebe~ seconded by~. Young
and carried~ it was
RESOLVED that a letter be forwarded to the 8outhoid To~
Board advising of receipt of the letter from Mr. Tasker~ Town
Attorney~ and requesting the Town Board's consideration and the
~ossiblity of specifically authorizing the P±a~mmng Board to
enforce the highway specifications as a condition of approval

in the best interests of the Tov~ of Sou~aold. Further~ t~
Pl~uing Board feels the Recommended Rules and Regulations for
the S~.bdivision of Land should be amended to require larger lot
size~ in subdivisions where there is no public water or sewer
facilities~ in view of the new requirements of 1/2 acre per lot
of the Suffolk County Depzrtment of Health, and the requirement
of 20~000 sq. ft. per lot by the F.H.A. and V.A.
~ Chairman requested M~. Howard Terry~ Building Inspector~
to be present at the Town Board's meeting on June 16th~ ~en this
letter is read Lu order that he may discuss the m~tter with the
Town Board. ~
