the ma~ter and his intention of~ possible use of the property.
The rep~' erom Judge %~enzel ~s reed stating that the 70 ft.
setback re~e~nt as s~g~ested by t~e ~Plarming Board seems
rather smzab~e ~n v~ew of the gore of tha. land already deeded
to the Count~ a few years ago~en the road was straightened~
and ~ereas the property is on a hillock sloping up from the
road~ any building wo~ld ~robably be erected on the crest of
the rise and such a setback would destroy the motels and cottages
recently erected east of him~ Judge Wenzel stated that his present
ffeeling is that the property would be an ideallocation ~or a
restaurant~ s,~mer hotel~ or both. ne advised n~ would be at the

Mr. Grebe asked JUdge Wenzel how much land his parcel c. on-

At the present time Judge Wenzel has no plans to do anything with
the property. He sta~ed hm~ ~a~a ob~ec~mon .to.a~7.0

The Board explained that before a building could be erected
or driveway cut thro~ght to the road after it is taken over by the
County or ~tate: it would have to have Co~auty or State approval.
M~ Tasker stated that concerning the 70 ft~ setback~ there
is no rule or law that authorizes the Pl~uning Board or To~n Board
to require anyone to setback their bui!d~g more than the Ordinance
requires~
Mr~ Young~ Acting ~nairmau~ explained they did not intend
to make that a restriction~ but merely were using their best
judgment and ~sdom of ~mat would come up in the future~

Me~oers oF the Pianuing Board have inspected the property
and Judge Wenzel has met ~_th us at oz~ regular meeting and we
feel that it ~ logics.~ that this be zoned ~B~ Business and ~3a
view of the fact the property to the East is~Busin~ss amd the
prooerty lying i~mediat$1y to ~he West is zoned Residential~ but
in ~¢tUality is non-conforming ~ - '

rentals. This would in affect create a natural intermediary zone
between the residential property lying further to the wes~'ard.
In addition~ we have cautioned Judge Wenzel oF the fact
that the Middle Road (County Route 27A) will possibly be widen-
ed for an appreciable amo~aut and that it would be the recommen-
dation or'the Pls~muing Bos~d that any buildings be setback at
least 70 feet from the existing highway ldne.

At a regular meeting~ the Plarming Board w~l~ review the
report~ aonsider ail phases of the proposed subdivision and

the deve~oper~ as Well as the~T~wn Clerk~ wil~ be notifmed of
the approva~ ~ disaporoval o~ bhe tentative layout as sub~
mitt~d.
If approved~ the developer e~u then instruct his engineer

or surveyor to proceed with the staking of lines, t~/ming all
necessary profiles and establishing street grades as required
by these rules and reg~ations~ computing the map~ preparLug
the finished mao~ size a_ud other details as outlined in the
Rules ~ad Reg~2~6ions for the Subdivision and Platting of Land
as adopted by- the Planning BOard, T~ae developer will also sub-
mit the three (3) cloth prints to the New York State Department
of Health for its approval.
When all of the above has been complied with~ and at least
~ifteen (l~) days before a regular monthly meeting of
ning Board the developer or his agent will file with the Pla~ming
B&ard the finished cloth prints approved by the New York State
Department of Health~ together with all ether necessary details
required by the Plamuiag Board,
'WUaen the Pl~ni~ug Bos~d' receives this information~ the To~n
5~mperintendent of Highways will report to the PlannLug Board
after a field inspection of the proposed subdivision and-the
Pla_~naing Board will compile a final report~ ~nich will include
among other things a detailed list of all improvements and con-

a public hearing mshall then be held by the Plao_u~_ug Board Bursuant
