A regular meeting of the Southold Town Planning Board was
held on February 23, 1976 at 7:30 p.m. Present were:
John Wickham, Chairman
Henry Raynor, Vice-Chairman
Alfred Grebe
Frank Coyle
Frederick Gordon
Vardy minor subdivision public hearing. Present was Rudolph
Bruer, Esq.
Mr. Wickham opened the public hearing at 7:30 p.m. Mr. Raynor
read the Notice of Hearing. Affidavits of publication were
received from the Long Island Traveler-Watchman and the Suffolk
Times.
NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the
Town Law, Public Hearing will be held by the Southold Town Planning
Board at the Town Clerk's Office, Main Road, Southold, New York,
in said town on the 23 rd day of February, 1976, on the question
of the following:
7:30 p.m. Approval of the map of the minor subdivision of
property of which John and Linda Vardy are the contract vendees,
consisting of a parcel of land situate, lying and being at Southold
in the Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a point on the northwesterly side of Soundview
Avenue which point of beginning is 120.66 feet northerly along
the northwesterly side of Soundview Avenue from the intersection
of the northwesterly side of said Soundview Avenue with the
northerly side of Dogwood Lane; which point of beginning is also
the northeasterly corner of lands now or formerly of Bowles and
the southerly point of the property about to be described herein;
running thence from said point of beginning N. 42° 03' 10" W.
along said northeasterly side of lands of Bowes 353.93 feet to

land now or formerly of Gilbride; running thence along land of
Gilbride and lands of Siebert, Green, Turtle and Briamonte N. 32°
55' 20" E. 430.28 feet to the southerly side of lands now or
formerly of Carhegie; running thence along said lands of Carhegie
the following two courses and distances: (1) S. 63° 04' 30" E.
144.28 feet; (2) S. 59° 29' 20" E. 144.07 feet to the north-
westerly side of Soundview Avenue; running thence along the north-
westerly side of Soundview Avenue S. 27° 12' 10" W. 545.87 feet
to the place or point of beginning.
Any person desiring to be heard on the above matters should
appear at the time and place above specified.

Mr. Wickham read the following excerpts from the Declaration
made by John Vardy and Linda Vardy, his wife.
"DECLARANT DOES hereby warrant, covenant and represent that
on approval of the aforesaid land as a minor subdivision by the
Planning Board of the Town of Southold, no further application
will be made to that Board or to any other Board in the Town of
Southold to further subdivide any of the lots set forth in said
minor subdivision.
"DECLARANT does hereby further warrant, covenant and represent
that the aforesaid described lands within the minor subdivision
cannot be subdivided into more than three lots and that each such
lot shall comprise an area of not less than 40,000 square feet.
"DECLARANT does hereby further warrant, covenant and
represent that the aforesaid described lands as shown on a
certain subdivision map dated November 28, 1975 made by Roderick
VanTuyl, P. C., which map indicates that there is certain land
in said minor subdivision known as bog and meadow. It is agreed
that said area known as bog and meadow on said map shall not be
filled.
"DECLARANT does hereby further warrant, covenant and
represent that the aforegoing restrictions and agreement shall
bind the undersigned, his heirs, successors and assigns and any
and all persons who shall succeed to the ownership of any of the
lots shown on aforesaid described premises in said minor sub -
division by transfer or otherwise."
Mr. Wickham: This agreement is signed and attested to. This
is north of Soundview Avenue between Kenney's Road and Horton's
Lane, north of Southold Village. It is customary to go through
the file. There is a resolution for the public hearing, a
resolution on January 8th to approve the sketch map of the sub-
division. This does not have to go to the Suffolk County Planning
Commission because it is more than five hundred feet from the

Sound. There is a receipt for the filing fee. The papers seem
to be in order. It is customary at this time to call for anyone
that wishes to speak in opposition to this subdivision. Hearing
none, I will call for anyone that wishes to speak in favor of
this subdivision.
Rudolph Bruer, Esq.: I think since October and the number of
times it has been on here, I can't add anything more than at the
prior hearings and meetings we have had. I respectfully request
that you approve the minor subdivision.
Mr. Wickham: Does anyone wish to speak further in favor of this
subdivision? Hearing none, I will declare the hearing closed at
this time and a determination will be made at a later date and if
there are any conditions, you will be notified.
KOA site plan. Mr. Wilton appeared.
Mr. Wilton presented a new map that he believes meets the criteria.~
There are 152 sites. He was requested to send in five more copies
of the map and a planting schedule. He is to have his landscape
architect fill in the blanks and put in what seems reasonable to
him. When asked if the perimeter highways would be one-way, Mr.
Wilton answered in the affirmative. The width of the highways
will have to be checked with the attorney.
Beaujolais Acres. Mr. and Mrs. Charles DeVoe and George Stankevich,
Esq. appeared.
Mr. Wickham opened this public hearing at 8:00 p.m. Mr. Raynor
read the Notice of Nearing. Affidavits of publication were
received from the Long Island Traveler-Watchman and the St~ffolk
Times.

situate, lying and being at Orient in the Town of Southold, County
of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a monument on the southwesterly side of Orchard
Street distant 617.73 feet northwesterly, when measured along the
southwesterly side of Orchard Street, from the corner formed by
the intersection of the southwesterly side of Orchard Street with
the northerly side of King Street, said point of beginning also

being where the division line between the premises herein described
and land now or formerly of J. Witzenburg intersects the south-
westerly side of Orchard Street; running thence S. 70° 13' 50" W.
along said last mentioned division line 692.77 feet to a monument
and land now or formerly of Vilna Estates, Inc.; thence along said
last mentioned land the following two courses and distances: (1)
N. 29° 55' 10" W. 546.97 feet to a monument (2) N. 64° 09' 10" W.
241.47 feet to a monument and land now or formerly of T. Rohloff;
thence N. 22° 56' 30" E. along said last mentioned land 431.16
feet to a monument and the southwesterly side of Orchard Street;
thence along the southwesterly side of Orchard Street the following
two courses and distances~ (1) S. 65° 40' 40" E. 570.31 feet to a
point; (2) S. 41° 51' 10" E. 680.91 feet to the monument at the
point or place of beginning.
Any person desiring to be heard on the above matters should
appear at the time and place above specified.

Mr. Wickham: The file is complete. The final map is signed by
the County Board of Health and the Department of Environmental
Control. Everything appears to be in order. It does not involve
construction of highways so there is no bond required. It doesn't
require the approval of the Superintendent of Highways or the
Highway Committee. At this time, I will ask for anyone that
wishes to speak in opposition to this subdivision. Hearing none,
I will ask for anyone that may wish to speak in favor of this
subdivision entitled "Beaujolais Acres" at Orient.
George Stankevich, Esq.: I represent Mr. Charles DeVoe who now
resides on one of the lots in the proposed subdivision. The
salient feature is it contains 12.5 acres but the owner is only
asking for eight lots which is a benefit to the owner and the
community. The community benefits by less density. The owner
gets more privacy. The family intends to live there. The further
benefit to the landowner is the land in excess will be covenanted
to be used only for agricultural purposes in perpetuity. The
owner hopes to obtain a tax abatement to the Town Board. We have
the approval of health and environmental. We would ask for your
approval of this subdivision.
Mr. Wickham: Being a farmer myself and the Town of Southold has
looked favorably upon maintaining its agriculture. I personally
feel we have some of the best agricultural land in the world with
slight experience in other areas myself. The Planning Board is
very pleased with this subdivision and since the file is complete,
I cannot see why it couldn't be processed very quickly. We will
close the hearing at this time.

Rath Lodge. George Stankevich, Esq. and Mr. Rath appeared.
Mr. Stankevich presented a letter from the Superintendent of
Highways indicating that he is in approval of the roads as long
as there is emergency access. Recharge of water would be
facilitated by the use of swales rather than curbs. Mr.
Stankevich requested that the Planning Board review the matter,
and requested a work meeting on March 1st. He officially
requested an additional two weeks for the Planning Board to take
action.
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to grant the extension of time for action for the
Rath Lodge in compliance with the wish of the attorney for the
developer.
Vote of the Board: All ayes.
Mr. Raynor suggested that Mr. Stankevich review Section 106-32(F)
for road construction requirement.
Glen Heidtmann site plan. Mr. Heidtmann appeared.
Mr. Heidtmann will have to go before the Board of Appeals as the
sideyard and frontyard do not meet the requirements of the Zoning
Ordinance of the Town. He will have to come before the Planning
Board with height and side profiles of the proposed building.
Luglio.
Mr. Raynor reported that he was informed that the attorney
representing Dalchet Corporation has indicated to the Planning
Board that they will deed over the necessary property for a
through street connection to Harbor Lane, Cutchogue. Mr. Luglio
will be given an appointment for the March 15th meeting. The
Counsellor will send a letter to the Planning Board this week.
Schriever.
The secretary was directed to send a letter to the Board of
Appeals indicating that the Plarauing Board is in agreement for
the granting of the variance for the two undersized lots outside
the perimeter of Mr. Schriever's development.

A delegation of residents and property owners from the Orient
area were present at the entire meeting. At this point many of
them voiced their objection to a projected east-west connection
to the north of the State road in Orient. The people present
indicated that they would have a meeting of their own to discuss
the matter and get back to the Planning Board.
Motion was made by Mr. Coyle, seconded by Mr. Raynor and
carried that the meeting be adjourned. Motion was carried.
Meeting was adjourned at 10:O0 p.m.
