A regular meeting of the Southold Town Planning Board
was held at the Town Clerk's Office, Main Road, Southold, New
York, on May 3, 1976.
Present were:
John Wickham, Chairman
Henry Raynor, Vice-Chairman

Mr. Wickham opened the meeting for a public hearing. Mr.
Raynor read the Notice of Hearing.
NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the
Town Law, Public Hearing will be held by the Southold Town Planning
Board at the Town Clerk's Office, Main Road, Southold, New York,
in said town on the 3rd day of May, 1976, on the question of the
following:
7:30 p.m. Approval of map of minor subdivision of property
owned by Michael Fronimakis and others, situated at Southold, in
the Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at the corner formed by the intersection of the
northwesterly side of North Road with the southwesterly side of
Lighthouse Road; running thence along the southwesterly side of
Lighthouse Road, S. 41° 18' 20" E. 203.68 feet to a point and the
southeasterly side of land now or formerly of Agnes McGunnigle;
thence along last mentioned land the following two courses and
distances: (1) N. ~8° 54' 10" E. 442.85 feet to a point, (2) N.
41° 47' 40" W. 327.43 feet to a point on the northwesterly side
of North Road; thence along the northwesterly side of North Road,
S. 33° ll' 00" W. 456.67 feet to the southwesterly side of Light-
house Road at the point or place of beginning.
Any person desiring to be heard on the above matter should
appear at the time and place above specified.

Mr. Raynor presented proof of publication in the Long Island
Traveler-Watchman. It was noted that the Board of Appeals had
granted a variance on February 5, 1976 to set off lot number two
which is of insufficient area.
Mr. Wickham: We do not need anything from the Superintendent of
Highways. Everything seems to be in order. Is there anyone who
wishes to be heard in opposition to this subdivision? Hearing
none, does anyone wish to be heard in favor of it? Hearing none,
I will declare the hearing closed.
Mr. Raynor wished to make the following correction in the minutes
of the April 5, 1976 meeting. When Dan Latham asked why roads
had to be created in subdivisions, Mr. Raynor referred him to the
section that required roads for intersections at no more than
1200 feet. At that point, Mr. Latham said that some properties
did not run 1200 feet and Mr. Raynor again referred him back to
the same section. Mr. Raynor made a motion, seconded by Mr.
Gordon and carried to approve the minutes as amended.
Sound Shore Motel - 2 year review.
Mr. Coyle reported that he, Alfred Grebe and Frederick
Gordon had inspected the property. They feel it is perfectly
alright the way it is finished. The chips are where they should
be. Some of the little trees have been either blighted by the
cold weather or storm coming over the bank.
Mr. Coyle made a motion, seconded by Mr. Gordon and carried
that the two-year review of the planting and marble chips at the
Sound Shore Motel is satisfactory.
Greton Estates.
Mr. Raynor reported that he, Mr. Wickham, Lawrence Tuthill
and Supt. of Highways Dean had inspected this property as to
roads and drainage. The consensus of those present was the road
elevations and bed are of the correct composition and height but
there is a question of drainage recharge because there are still
quantities of clay and silt. The principles have been instructed
that they have to be redug to virgin sand.
Inlet East Estates.
Mr. Raynor also made a report on this subdivision. He, Mr.

Wickham, Mr. Dean and Mr. Tuthill also visited this site. There
is a drainage problem to Harborview Lane which the Superintendent
of Highways is going to take care of. He is considering a stop
order on the work being done.
Macari.
Mr. Raynor, Mr. Wickham, Mr. Dean and Mr. Tuthill visited
this site on Sound Avenue in Mattituck. There seems to be still
some concern as to the intersection of the proposed subdivision
with Sound Avenue. The line of sight is very limited. They are
going to meet once more on it to get more information.
On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to give final approval to the final map of the
subdivision known as "Syloret Estates" and authorize the chairman
to sign the map.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe,
Gordon.
Dan T. Smith - Southold Development Corporation.
It was suggested that Mr. Smith get in touch with the DEC
and Health Department.and see what they think about it as it now
appears that public water is not going down there.
Bayley minor. Mr. Bayley and Rudolph Bruer, Esq. appeared.
Mr. Bruer reported that the Building Inspector had indicated
that the road would not be necessary until such time as Lot #3
goes for a building permit and then only enough road would be
necessary for fire access. It should be indicated on the map
that the roads be reserved for possible dedication to the Town of
Southold. Covenants and restrictions should be filed as to no
further subdivision.
On motion made by Mr. Grebe, seconded by Mr. Raynor, it was
RESOLVED to give sketch plan approval to the map of the
minor subdivision of Bayley subject to it being indicated on the
map that the roads are reserved for possible future dedication to
the Town of Southold.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe,
Gordon.

Winds Way site plan. Robert Wendell appeared.
Mr. Wendell reported that he had been granted a variance
by the Board of Appeals for 12-1/2 foot side yards on April 29,
1976. He also indicated he had a variance for less than a 150
foot front. He said it was in separate ownership and a separate
parcel. He will need site plan approval for parking and exterior
lighting. He will need a drainage facility for the black-topped
area. He is to talk to the Building Inspector about the drainage.
He needs some sort of planting schedule. Mr. Wickham told Mr.
Wendell that he is only allowed 25% lot coverage and this will be
checked with the Building Inspector. Mr. Wickham said that the
town attorney says a parking lot is lot coverage. On the shrubs,
the Planning Board will want something low up front and something
to buffer the side areas of the parking lot. The Building
Inspector will be checked with as to the sixteen foot access.

The Planning Board reviewed the map of this subdivision of
property. Mr. Kouros will have to decide what to do with the
three and a half acres that he has reserved out of the subdivision.
He will have to go to the Board of Appeals with A, B, C and D. He
will have to dispose of the property that was to be a roadway and
is marked "Kouros" on the map.
Flood Plain.
Mr. Wickham stated that the Planning Board has spend a good
deal of time on flood plain. We have the actual elevations and
we would be glad to have them come down about the map which we
received. It is very inaccurate and completely inadequate in view
of the fact that we have specific flood plain elevations. A
letter is to be written explaining these views.
Mr. Raynor made~a motion, seconded by Mr. Coyle and carried
to send a copy of the proposal to amend that section of the
ordinance to get cumulative zoning out of Business and Commercial
zoned areas, to the Town Attorney and the Town Board so that
neither B, B-1 nor C can be used for multiple use automatically.
Andersen minor.
The Planning Board would like to see a more recent survey
which includes elevations and how high up the salt meadow is.
It would also be suggested that the Andersens have the Health
Department check the water quality.

Plauuing Board
Long Pond Estates. Harold Wilsberg and Richard Cron, Esq. appeared.
Mr. Cron will send a letter to the Planning Board indicating that
he is changing the sections.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED that a public hearing be held on the preliminary
map of "Long Pond Estates, Section I," as amended.
Vote of the Board: Ayes: Wickham,Raynor, Coyle, Grebe,
Gordon.
Greenbriar Acres. Mr. Cron appeared.
The Planning Board concurred that they were not concerned
with the recommendations of the County as all these items had been
discussed many times.
Hillcrest Estates. Harold Wilsberg and Mr. Cron appeared.
Mr. Wilsberg asked if they would be required to have a right
of way to the water or can they eliminate it? The Chairman
answered that the Board would probably require that the park and
playground be on the water. It will be necessary to have a 100
by 100 foot turnaround. Mr. Wilsberg presented six copies of the
sketch map.
Hale & Hughes minor subdivisions. Phyllis Hale and Irving L.
Price, Jr., Esq. appeared.
Mr. Wickham said that the Town Attorney had told him that the
Planning Board is responsible for highways for subdivisions with
the authority delegated by state law. Covenants and restrictions
will be required for no further subdivision, for any lot over
40,000 square feet. The secretary will send Mr. Price a copy
of sample covenants. No roads can be over 1200 feet long without
a cross road. Mr. Raynor suggested that the Planning Board meet
with the Town Attorney and Mr. Price. Mr. Raynor cited 106-32G
of the Code of the Town of Southold on block size. Mr. Price will
contact Mr. Tasker as to an appointment.
Hutter site plan. Mr. and Mrs. Hurter appeared.
The Hurters plan to eventually open a restaurant with 64 or
65 seats. The parking will have to be figured out with the
Building Inspector. A building permit will have to be obtained

for any addition to the building. At the time of the addition
profiles will have to be presented for all sides of the house and
parking. Find out from the Building Inspector what they will need
for drainage. There will have to be some type of lighting around
the parking area. They would like to open a shop on the porch
with no structural changes right now and will probably come in for
the parking for that.
Rath Lodge. Mr. Roger Rath and George Stankevich, Esq. ~peared.
Mr. Stankevich presented paper copies of the final map. He
requested a public hearing. Mr. Stankevich will provide a written
engineering report on the footbridge. Mr. Rath would like a copy
of the letter of approval of the preliminary map.
On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to grant approval of the minor subdivision of
property owned by Michael Fronimakis and others located at
Southold, New York.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe
and Gordon.
Rath Lodge.
It was the decision of the Planning Board not to schedule
a public hearing on this property until receipt of DEC report
and letter from the engineer on the footbridge.
On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to recommend disapproval of the application of
Walter R. Silleck for change of zone of property located at
East Cutchogue from Residential to B-1 Business zone. The
location of additional business property at this site would not
be in conformity with the development plan of the Town of
Southold.
Vote of the Board: Ayes: Raynor, Coyle, Grebe, Gordon
Abstained: Wickham
On motion made by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED to give sketch plan approval of subdivision known
as "Quail Run Estates" amended November 18, 1975.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe, Gordon.

Laurelwood Estates #2.
The Planning Board discussed the recommendations of the
Suffolk County Department of Planning and decided it would be
alright for the developer to prepare his final maps.

On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to give sketch plan approval to the map of "Blue
Horizons" at Peconic said map amended April 27, 1976.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe and
Gordon.
Luglio.
The subdivision of land of Luglio and others located at
Cutchogue was discussed by the Planning Board. If he can supply
access to Harbor Lane, he won't need the access on the Main Road.
Section 2 will be contingent on the change of zone proposed on
Section 3.
It was also discussed with Mr. Lawrence Tuthill about the
egress on Stillwater Avenue which Mr. Tuthill feels should be
moved south a distance. Mr. Tuthill will meet with Mr. Dean
and give a definite recommendation by the next meeting.
The next meeting of the Planning Board will be held on
May 24, 1976.
Motion was made by Mr. Coyle, seconded by Mr. Grebe and
carried that the meeting be adjourned. Meeting was adjourned at
10:35 p.m.
