AM, Chairman ALFRED GREBE FRANK COYLE HENRY RAYNOR Southold, Y. 11971 May 2~, 1976 MINUTES TELEPHONE 765-1313 A regular meeting of the Southold Town Planning Board was held at the Town Clerk's Office, Main Road, Southold, New York, on May 2~, 1976. Present were: John Wickham, Chairman Henry Raynor, Vice-Chairman Frank S. Coyle Frederick Gordon Bob Rinklin, The Long Island Traveler-Watchman ~re Campbell, The Suffolk Times Mr. Wickham opened the meeting for the public hearing on the preliminary map of the subdivision known as "Blue Horizons" located at Peconic. Mr. Peter Fauser aud Mr. Nelson Axien appeared. Mr. Arthur DeRosa and another one of the principles appeared after the hearing was closed. Mr. Raynor read the Notice of Hearing and the proof of publication was presented from the Suffolk Times. It was noted for the record that the next to last course read 34' on the map and 30' in the description. There is no letter in the file from the Superintendent of Highways. Mr. Wickham: This subdivision has been before the Planning Board for several years and it has previously had the approval of the Superintendent of Highways in a general way. Is ~ere anyone who wishes to speak in opposition to this subdivision? Hearing none, I will ask for those that wish to speak in favor of it. Mr. Fauser: We have tried to meet all the criteria and believe we have served all those criteria and request preliminary approval. Mr. Wickham: I would like to comment that Mr. Barnett of the Suffolk County Soil and Water Conservation District has spent a great deal of time on this and has gone over it in minute detail and we have comments from him in the file. Does anyone else wish to speak in favor of it? ~Planning Board -2- ~ 24, 1976 Mr. Axien: It is perfectly alright. Mr. Wickham: Does it meet with your approval? Mr. Axien: Yes. Mr. Wickham: If there is nothing else, we will declare the hearing closed. At this stage, we would like to see it move as quickly as possible. It is a beautiful piece of land, but it has problems. I declare the hearing closed. On motion made by Mr. Coyle, seconded by Mr. Grebe, it was RESOLVED to approve the site plan of proposed office situate at Southold, New York, presented by Winds Way Building Corporation of Southold, subject to buffer on each side of the building, said planting to be shown on map. The Chairman is authorized to sign the site plan as approved when map has been received containing same. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe, Gordon. The Chairman signed the maps of the minor subdivision of John and Linda Vardy. Mr. Wickham reported that he had made the two-year review of the 7 - ll Colgate property in Cutchogue. It is satisfactory with the exception of dead Christmas trees on each side which they should be directed to remove. For the record, there has been no further correspondence from Mrs. Hale, her attorney nor the Town Attorney. Motion was made by Mr. Coyle, seconded by Mr. Grebe and carried to approve the minutes of the meeting of May 3, 1976. The matter of Crown Land Lane was discussed. Filed covenants and restrictions have been received from Mr. Edson designating a five foot easement on the lots for swale road construction. This has been approved by the Town Attorney, according to a letter in the file. Three copies of the map showing the dotted line for the five-foot easement are to be requested from Mr. Edson. ~Planning Board -3- May ~4, 1976 The public hearing was opened at 8:00 p.m. in the matter of "Long Pond Estates" preliminary map of revised section 1. Mr. Wickham: subdivision? in favor? Does anyone wish to be heard in opposition to this Hearing none, is there anyone who wishes to speak Mr. Cron: The Board is well aware of the fact that we have had numerous meetings. I think we have met all the requirements of the Board and the map, as it now exists, is a better layout. I would like to ask the Board to grant us an immediate approval because of the prior approval and the only change is in the sections. I would ask the Board to give consideration not to delay the thing in light of the prior approval which hasn't changed. Mr. Wickham: Does anyone else wish to be heard in favor of it? Hearing none, I will declare the hearing closed. Richard Foster minor subdivision. The Planning Board discussed this minor subdivision and suggested that rather than ask the County for another curb cut that the present one be used with the road to go along the easterly side of Lot #2 and down 150 feet into Lot #1 with no access on the County Road Mr. Raynor made a motion, seconded by Mr. Grebe and carried that a meeting be set up between the Town Board and the Planning Board in regard to changing the zoning from cumulative to non- cumulative. Shorecrest. Mr. Wickham reported that he, Mr. Coyle, Judge Surer, Superintendent of Highways Dean and Town Attorney Robert Tasker met at the Office of the Highway Superintendent on May 10, 1976 regarding the roads and drainage in this subdivision. Mr. Tasker wanted more information from the file and will get back to the Planning Board. Rod 'n' Reel. Michael Weinstein, Esq. appeared before the Board representing this subdivision. It is now being presented as a minor subdivision of four lots. Covenants will be required on each lot as to no further subdivision. A copy of sample covenants will be sent to Mr. Weinstein. The sewage is not realistic on the maps presented because of the low elevations. The well should be taken off the map. Upon receipt of a letter withdrawing the major subdivision application, action will be taken to approve the sketch map. iPlanning Board -4- May 4, 1976 Piccione. Camp Immaculata property. Mr. Howard Young, Mr. Edward Schroeder, attorney, appeared. Lots 3 & 4 lack the 150 foot frontage. Covenants and restrictions as to no further sub- division will be required to be filed with theCouuty Clerk. It was noted that nothing further has been received from George Stankevich, Esq. nor Mr. Rath regarding the engineering report on the footbridge and the report from DEC. On motion made by Mr. Coyle, seconded by Mr. Grebe, it was RESOLVED to grant approval of the preliminary map of the subdivision known as "Blue Horizons"located at Peconic, New York, said map dated April 27, 1976, subject to receipt of a letter of approval from the Town Highway Superintendent. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe and Gordon. It was also noted that there may be problems with transporting material from one lot to another and the developer should be apprised that he should follow the town ordinance. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED that in view of the fact a portion of this property has already received approval and this is a redesigned Section 1 that approval be given the preliminary map of "Long Pond Estates, Section I", said map dated April 12, 1976, subject to receiving a letter of approval from the Superintendent of Highways. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe and Gordon. Bayley minor. Rudolph Bruer, Esq. presented six copies of map of this minor subdivision, $40 application fee and copy of proposed covenants and restrictions. This matter will have to go to DEC because of its proximity to Great Pond. A curb cut permit will also have to be secured from the Suffolk County Department of Public Works in Yaphank. Kouros, New Suffolk. Rudolph Bruer, Esq. appeared. The Planning Board will not move on this minor subdivision until a determination by the Board of Appeals as to the undersized lots. ~Pls~ning Board -5- May ~, 1976 Finkle change of zone application. Rudolph Bruer, Esq. appeared. This is the former Joseph Andrade property in Orient which was purchased in 1971. There was discussion regarding the merit money-wise of changing the zoning classification. The Board would like to go down and look at the property. Mr. Raynor requested a copy of the application. Dan T. Smith appeared regarding the two~ lots he owns on North Bayview Road. Mr. Smith said Calvin Smith of the Health Department had told him that the two wells off the property with easements to these two lots would be alright if the water tested alright. Mr. Wickham wanted to discuss with Mr. Tasker if five lots would be legal at this time. KOA. Mr. Richard Wilton appeared. by the foot path would have to be that this was their intention. He was advised that the lots tent lots and Mr. Wilton agreed On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to approve the planting schedule as presented on May 24, 1976 by KOA. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe and Gordon. On motion made by Mr. Coyle, seconded by Mr. Grebe, it was RESOLVED to approve the site plan of Kampgrounds of America as presented on May 24, 1976 subject to certification by the Building Inspector as to whether or not the plan meets the require- ments of all Zoning Ordinance provisions as required in Article XIII Section 100-133 D. THe aforesaid site plan approval is also subject to the following conditions: 1. That public water supply and sanitary sewage disposal to the premises which are the subject of this resolution be supplied by the Incorporated Village of Greenport at the sole cost and expense of the petitioners which said water supply and sewage disposal systems shall comply with all of the requirements of all agencies having jurisdiction thereof, aud that said water supply and sewage disposal systems be installed and in operation prior to the occupancy of the premises for any purposes whatsoever. 2. That in the event that any portion of the premises located within 100 feet of the land o~ned by the Village of Greenport is utilized for campgrounds or trailer sites, a six-foot chain link or equivalent type fence shall be erected and maintained along the boundary line of said land of the Village of Greenport. ~Pla~ning Board -6- May ~ r, 1976 3. That the portion of the premises adjacent to County Route 27 to a distance of 100 feet therefrom shall at all times be maintained as a landscaped buffer zone and that no buildings or structures of any type whatsoever shall be erected or maintained thereon. That the type and location of landscaping within said buffer zone be approved by the Planning Board of the Town of Southold; that in the event that County Route 27 shall be widened, altered or relocated that said buffer zone shall be extended so that said buffer zone shall at all times extend 100 feet from the said highway. 4. That to minimize traffic hazards that may occur by reason of trailer vehicles entering and leaving said premises, suitable turn-off or deceleration lanes or such other highway facilities as the agency having jurisdiction of County Route 27 shall prescribe shall be provided. 5. That in order to provide suitable access to the premises over Queen Street, a 33 foot wide town highway, the same will be required to be widened to 50 feet. Prior to occupancy of the rezoned premises by the owners thereof for trailer park purposes, the owners shall, at their own expense, improve and pave a 17 foot strip along the westerly boundary of Queen Street in accordance with the then Town highway requirements and when so improved and paved, dedicate the same to the Town of Southold. 6. That the portion of the premises extending from a point 100 feet south of County Route 27 to a point 600 feet south of County Route 27 be restricted to open recreational uses with no structures constructed thereon. This resolution is subject to approval of wording by the Town Attorney. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Grebe and Gordon.
